का.आ. 86 ( अ ) -भारत सरकार के पर्यावरण एवं वन मंत्रालय की अधिसूचना संख्या का.आ.114(अ) दिनांक 19 फरवरी , 1991 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है) के द्वारा तटीय क्षेत्र को तटीय विनियमन क्षेत्र के रूप में घोषित किया था और उक्त क्षेत्र में उद्योगों को स्थापित करने और उनके विस्तार, प्रचालन और प्रक्रियाओं पर निर्बधन अधिरोपित किए गए थे;
और अंडमान और निकोबार द्वीप समूह के संघशासित क्षेत्र के अण्डमान निकोबार प्रशासन द्वारा उक्त राज्य क्षेत्र के तटीय विनियमन क्षेत्र में बालू के खनन पर उपर्युक्त अधिसूचना द्वारा लगाए गए निर्बधनों के और द्वीप समूह में वैकल्पिक निर्माण सामग्री उपलब्ध न होने के कारण उक्त क्षेत्र के स्थानीय व्यक्तियों द्वारा सहन की जा रही कठिनाइयों की ओर केन्द्रीय सरकार का ध्यान आकृष्ट किया था।
और, भारत सरकार के पर्यावरण एवं वन मंत्रालय द्वारा इस मुद्दे की जांच की गई है;

[PART II-SEC . 3 (ii) ] और, केन्द्रीय सरकार की यह राय है कि उक्त अधिसूचना में संशोधन किया जाना चाहिए;
और , पर्यावरण (संरक्षण) नियम, 1986 के नियम 5 के उप नियम (4) में यह उपबंध है कि उप नियम (3 ) में किसी बात के होते हुए भी जब कभी केन्द्रीय सरकार को ऐसा प्रतीत होता है कि * ऐसा करना लोकहित में है तो वह उक्त नियमों के नियम 5 के उपनियम (3) के खंड (क) के अधीन सूचना की अपेक्षा से अभिमुक्ति दे सकेगी;
और, केन्द्रीय सरकार की यह राय है कि उक्त अधिसूचना में संशोधन हेतु उक्त नियमों के नियम 5 के उप - नियम (3 ) के खण्ड (क) के अधीन सूचना की अपेक्षा से अभिमुक्ति देना लोकहित में है;
अतः अब केन्द्रीय सरकार पर्यावरण ( संरक्षण) नियम, 1986 के नियम 5 के उपनियम (3 ) और (4) के साथ पठित पर्यावरण ( संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 3 की उपधारा ( 1 ) और उपधारा (2) के खंड (v) द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए, उक्त अधिसूचना में निम्नलिखित और संशोधन करती है, अर्थातः-
उक्त अधिसूचना में, : -
(क) पैरा 2 के उप पैरा ( ix ) " बशर्ते कि" शब्दों से शुरू होने वाले और ' पक्षी घौंसले स्थल और संरक्षित क्षेत्रों " शब्द से अन्त होने वाले भाग को निम्नलिखित उपबंध से प्रतिस्थापित किया जाएगा, अर्थात्: -
"बशर्ते कि अण्डमान एवं निकोबार द्वीप समूह के संघ शासित क्षेत्र में निर्माण कार्यों के लिए मामला दर मामला आधार पर अण्डमान निकोबार द्वीप समूह के उपराज्यपाल द्वारा गठित समिति, जिसमें 1 ) मुख्य सचिव, अण्डमान निकोबार प्रशासन; 2) सचिव, पर्यावरण विभाग 3) सचिव, जल संसाधन विभाग और 4) सचिव, अण्डमान लोक निर्माण विभाग शामिल होंगे, द्वारा बालू खनन की अनुमति दी जा सकती है:
इसके अतिरिक्त 31 दिसम्बर 2005 तक खनन की जानेवाली कुल बालु की मात्रा 28,226 सी एम डी से ज्यादा नहीं होनी चाहिए और यह कि बालु खनन केवल सागर प्रबन्धन संस्थान, चैन्नई द्वारा संवर्धी क्षेत्रों के रूप अभिनिर्धारित किए गए क्षेत्रों में किया जाना चाहिए और यह बालु के पुनर्भरण या जमाव की दर पर आधारित होना चाहिए;
परन्तु यह और कि इस उप पैरा के अधीन बालू के खनन हेतु प्रदान की गई अनुमति खनन परियोजनाओं पर आधारित होनी चाहिए और संवेदी तटीय पारि प्रणाली, जिसमें प्रवालभित्ति या कछुए, मगरमच्छ, पक्षी घौंसलें स्थल और संरक्षित क्षेत्र शामिल हैं को हानि से बचाने के लिए पर्याप्त सुरक्षा उपाय निर्धारित किए जाने चाहिए । 3

इसके अतिरिक्त यह कि अण्डमान निकोबार प्रशासन एक वर्ष अर्थात 01 जनवरी 2005 से 31 दिसम्बर 2005 तक वैकल्पिक निर्माण सामग्री को अभिनिर्धारित करेगा;
इसके अतिरिक्त खनन कार्यों और संघ शासित प्रशासन द्वारा किए गए पर्यावरणीय उपायों की निगरानी के लिए एक निगरानी समिति गठित की जानी चाहिए । निगरानी समिति में संघशासित प्रशासन , पर्यावरण एवं वन मंत्रालय, क्षेत्रीय कार्यालय, भुवनेश्वर और अण्डमान निकोबार के एक गैर सरकारी संगठन के प्रतिनिधि शामिल होंगे । एक तिमाही निगरानी रिपोर्ट पर्यावरण एवं वन मंत्रालय को भेजी जानी चाहिए;
(ख) "तटीय विनियमन क्षेत्र iv अंडमान और निकोबार द्वीप समूहँ शीर्ष के अधीन अनुबंध- । में मद (iv) की उप-मद (ख) में 31 मार्च, 2003 अंकों, और शब्दों के स्थान पर 31 दिसम्बर 2005 अंक, अक्षर और शब्द प्रतिस्थापित किए जाएंगे।

NOTIFICATION
New Delhi , the 25th January, 2005
5.O. 86 (E) . Whereas by notification of the Government of India in the Ministry of Environment and Forests number S.O.114 (E) , dated the 19th February, 1991 ( hereinafter referred to as the said notification) , the Central Government declared Coastal Stretches as Coastal Regulation Zone and restrictions were imposed on the setting up and expansion of industries , operations and processes in the said Zone ;
And whereas the Andaman and Nicobar Administration of the Union Territory of the Andaman and Nicobar Islands has drawn the attention of the Central Government to the difficulties being faced by the local population of the said territory due to lack of alternative construction materials available in the islands and the restrictions imposed by the aforesaid notification on mining of sand in the Coastal Regulation Zone in the said territory;
And whereas the issue has been examined by the Government of India in the Ministry ofEnvironment and Forests ;
And whereas the Central Government is of the opinion that the said notification should be amended ;
And whereas sub - rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that notwithstanding anything contained in sub - rule (3 ) , wherever it appears to the Central Government that it is in public interest to do so, it may dispense with the requirement of notice under clause ( a) of sub - rule (3 ) of rule 5 of the aforesaid rules;
And whereas the Central Government is of the opinion that it is in public interest to dispense with the said requirement of notice under clause (a) of Sub -rule (3 ) of rule 5 of the aforesaid rules for amending the said notification;
Now, therefore , in exercise of the powers conferred by sub -section (1) and clause (v) of sub - section (2 ) of section 3 of the Environment ( Protection) Act, 1986 (29 of 1986) read with sub - rules (3) and (4) of rule 5 of the Environment (Protection) Rules , 1986 , the Central Government hereby makes the following amendments in the said notification , namely: - In the said notification , -
(a) in paragraph 2 , in sub - paragraph ( ix) , for the portion beginning with the words "Provided also that ' and ending with the words " bird nesting sites and protected areas " , the following provisos shall be substituted, namely: - 5

"Provided that in the Union Territory of the Andaman and Nicobar Islands , mining of sand may be permitted for construction purpose on a case to case basis by a committee constituted by the Lieutenant Governor of the Andaman and Nicobar Islands consisting of ( 1 ) the Chief Secretary Andaman & Nicobar Administration; (2) Secretary , Department of Environment ; (3 ) Secretary, Department of Water Resources ; and (4) Secretary, Andaman Public Works Department:
Provided further that the total quantity of sand to be mined shall not exceed 28,226 CMD for the period ending on the 31st December, 2005 and that sand mining shall be undertaken only in those areas identified as accreting areas by Institute for OceanManagement ( IOM ) , Chennai and based on rate of replenishment or deposition ofsand ;.
Provided also that the permission as may be granted unde this sub - paragraph for mining of sand shall be based on mining plans and shall stipulate sufficient safeguards to prevent damage to the sensitive coastal eco - system including corals , turtles , crocodiles , birds nesting sites and protected areas .
Provided further that the Andaman and Nicobar Administration shall identify alternate construction materials within the period of one year i.e. , from 1st January , 2005 to 31st December, 2005 " ; :
Provided further that a monitoring Committee shall be constituted for monitoring the mining activity and the environmental safeguards taken , by the Union Territory Administration . The monitoring Committee shall comprise of representatives from Union Territory Administration, Regional Office of the Ministry of Environment and Forests , Bhubaneshwar and a NGO based at Andaman and Nicobar . The monitoring report shall be sent quarterly to Ministry of Environment and Forests ." ;
(b) in Annexure - I, under the heading " CRZ- IV Andaman and Nicobar Islands" , in item ( iv) , in sub - item (b) , for the figures , letters and words " 31st day of March, 2003 ," the figures, letters and words " 31st day of December, 2005 " shall be substituted .
