सा.का.नि. 44( अ ) .- केंद्रीय सरकार, रेल अधिनियम, 1989 ( 1989 का 24) की धारा 28, धारा 29 और धारा 198 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रेलवे को चालू करने संबंधी (यात्रियों के सार्वजनिक वहन के लिए) नियम, 2000 का और संशोधित करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. (1) इन नियमों का संक्षिप्त नाम रेलवे को चालू करने संबंधी (यात्रियों के सार्वजनिक वहन के लिए) (संशोधन) नियम, 2005 है ।
(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. रेलवे को चालू करने संबंधी (यात्रियों के सार्वजनिक वहन के लिए) नियम, 2000 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 1 में, उपनियम ( 1 ) के पश्चात्, निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्:-
"(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे । "
3 . उक्तनियमों के नियम 2 के खंड (त) में, " लैंडर " शब्द के स्थान पर 'टेंडर' शब्द रखा जाएगा ।
4. अध्याय 2 में, " रेलवे को चालू करने की तैयारी" शीर्ष के नीचे -
(क) हिंदी अनुवाद सही है अतः किसी शुद्धि की आवश्यकता नहीं है ।
(ख) उपनियम 1 के पश्चात् " 2. गैर- सरकारी रेलवे के रेलवे प्रशासन का मुख्य कार्यपालक अधिकारी " अंक और शब्दों से शुरू होने वाले और " इस मामले को निरीक्षण और उस रेलवे की संरक्षा पर रिपोर्ट देने के लिए आयुक्त को भेजेगा " शब्दों के साथ समाप्त होने वाले भाग के स्थान पर , निम्नलिखित रखा जाएगा , अर्थात् -

[PART II- SEC . 3 ( i)} " (2) जहां क्षेत्रीय रेलवे के महाप्रबंधक , या गैर- सरकारी रेलवे के मुख्य कार्यपालक अधिकारी की यह राय है कि रेलवे या उसके भाग को यात्रियों के सार्वजनिक वहन के लिए खोला जाना अपेक्षित है , उस स्थिति में वह इस मामले को निरीक्षण और उस रेलवे की संरक्षा पर रिपोर्ट देने के लिए आयुक्त को भेजेगा । "
5. उक्तनियमों के नियम 4 के, उपनियम ( 1 ) में, "नियम 3 के अधीन निरीक्षण हेतु आयुक्त को संदर्भित करते समय आयुक्त के समक्ष निलिखित सभी दस्तावेज प्रस्तुत करेगा " अंक और शब्दों के स्थान पर निम्नलिखित शब्द, कोष्ठक और अंक द्वारा रखे जाएंगे, अर्थात्: -
"नियम 3 के उपनियम (2 ) के अधीन निरीक्षण हेतु आयुक्त को संदर्भित करते समय , उस तारीख से, जिसको रेलवे द्वारा किसी रेल लाइन या किसी रेल लाइन के खंड को खोले जाने का प्रस्ताव है, पहले एक मास की अवधि के भीतर आयुक्त के समक्ष निम्नलिखित सभी दस्तावेज प्रस्तुत करेगा, "
6. उक्त नियमों के नियम 10 में, -
(क) उपनियम ( 1) में, " साथ रहेंगे " शब्दों के स्थान पर "साथ रह सकते हैं" शब्द रखे जाएंगे । (ख) उपनियम (2) के स्थान पर, निम्नलिखित उपनियम रखे जाएंगे , अर्थात्: -
" (2) यदि किसी अपरिहार्य कारण से महाप्रबंधक का आयुक्त के साथ रहना संभव न हो तो, मुख्य प्रशासनिक अधिकारी या मुख्य इंजीनियर ( समन्वय) निर्माण , अन्य संबंधित अधिकारियों के साथ निरीक्षण की अवधि के दौरान आयुक्त के साथ रहेगा ।
(2क) मंडल रेल प्रबंधक भी, संबंधित शाखा अधिकारियों के साथ निरीक्षण की पूरी अवधि के दौरान आयुक्त के साथ रहेगा । "
7. उक्त नियमों के नियम 19 में, स्पष्टीकरण के स्थान पर, निम्नलिखित स्पष्टीकरण रखा जाएगा, अर्थात्-
"स्प्ष्टीकरण - जब यात्री यातायात के लिए पहले से ही चालू लाइन पर विद्युत कर्षण चालू करने के लिए मंजूरी की आवश्यकता हो तो आयुक्त को उपनियम ( 1 ) की मद (ञ) , (ट) , (ठ) , (ड) और (ढ) , उपनियम (2) की मद (घ) और नियम 5 के उपनियम (4) की मद (क) ( vii ) में विनिर्दिष्ट दस्तावेज अग्रेषित किए जाएंगे । "
8. उक्तनियमों के नियम 24 में, -
(
क) उपनियम (4) में , " जिम्मेदार अधिकारी " शब्दों के स्थान पर "कार्यप्रभारी रेल सेवक" शब्द रखे जाएंगे ;
(ख) उपनियम (5) के स्थान पर, निम्नलिखित उपनियम रखा जाएगा , अर्थात्: -
"(5) जहां कहीं अस्थायी मार्ग परिवर्तन के उपयोग की अवधि 3 दिन से अधिक बढ़ानी हो, तो आयुक्त, यदि वह ऐसा आवश्यक समझें , यथा संभव शीघ्र उसका निरीक्षण करेगा । " [ भाग II- खण्ड 3 (i) ]

3 9. उक्तनियमों के नियम 25 में, उपनियम (5) का लोप किया जाएगा ।
10. उक्तनियमों के नियम 28 के उपनियम (5) में -
(क) खंड (ख) में, "उपर्युक्त नियम ( 1 ) " शब्दों, कोष्ठकों और अंक के स्थान पर , " उपनियम (2)" शब्द, कोष्ठक और अंक रखे जाएंगे ;
(ख) खंड (ग) में, " 100 कि.मी./घंटा" अंकों, अक्षरों और शब्द के स्थान पर " 105 कि.मी./घंटा" अंक, अक्षर और शब्द रखे जाएंगे ।
11. हिंदी में यह ठीक है अतः किसी शुद्धि की आवश्यकता नहीं है ।
12. उक्त नियमों के नियम 32 के उपनियम (2) में, "रीडिंग " शब्द के स्थान पर , " रॉडिंग " शब्द रखा जाएगा ।
13. उक्त नियमों के नियम 33 के उपनियम (5) में "पैरा 7.88.2 " शब्द और अंकों का लोप किया जाएगा ।
14. उक्त नियमों के नियम 36 के उपनियम (9 ) में, विधि ख में हिंदी अनुवाद सही है अतः किसी शुद्धि की आवश्यकता नहीं है ।
15. हिंदी अनुवाद सही है अतः किसी शुद्धि की आवश्यकता नहीं है ।
16. उक्त नियमों के फार्म XV में, क्रमांक 46 के सामने , स्तंभ 2 में , टिप्पणी 2 में, " 100 में 1 से अधिक की ढलान " शब्दों और अंकों के स्थान पर , "स्टेशन की ओर 80 में 1 और 100 में 1 से अधिक की ढलान" शब्द और अंक रखे जाएंगे ।

NOTIFICATION
New Delhi , the 27th January, 2005
G.S.R 44( E) . In exercise of the powers conferred by sections 28, 29 and 198 oftheIndian Railways Act, 1989 (24 of 1989 ) , the Central Government hereby makes the following rules further to amend the Railways ( Opening for Public Carriage of Passengers ) Rules, 2000 , namely: - 4

[PART II SEC . 3 (i ) ] 1. (1) These rules may be called the Railways (Opening for Public Carriage of Passengers ) (Amendment ) Rules , 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2 . In the Railways (Opening for Public Carriage of Passengers ) Rules ,2000, ( herein- after referred to as the said rules ) , in rule 1 , after sub- rule (1 ) , the following sub-rule shall be inserted, namely: -
(2) They shall come into force on the date of their publication in Official Gazette." .
3. In rule 2 of the said rules , in clause (p) , for the word " lenders " , the word " tender" shall be substituted .
4. In Chapter II ,below the heading " Preparation for opening of Railways " , -
(a) for the figure and words " 1. Reference to the Commissioner " , the following shall be substituted , namely :-
" 3. Reference to the Commissioner " ;
(b) for the portion beginning with the figure and words " 2. The Chief Executive of the railway " and ending with the words " refer the matter to the Commissioner for inspection and report on the safety of that railway " , occurring after sub- rule ( 1 ) , the following shall be substituted , namely : -
" (2) Where the General Manager of a Zonal Railway , or the Chief Executive of a non- Government railway is of the opinion that any railway or part therof is required to be opened for public carriage of passengers , he shall refer the matter to the Commissioner for inspection and report on the safety of that railway. ",
5. In rule 4 of the said rules , in sub- rule ( 1 ) , for the words and figure " shall furnish all the relevant documents to the Commissioner while making reference to the Commissioner for inspection under rule 3 , " the following words , brackets and figures shall be substituted , namely: -
" while making a reference to the Commissioner for inspection under sub- rule ( 2) of rule 3 , shall furnish all the relevant documents to the Commissioner within a period of one month before the date on which a railway line or a section of a railway line is proposed for opening by the railway , " .
6. In rule 10 of the said rules , -
(a) in sub- rule ( 1 ) , for the words " shall accompany " , the words may accompany " shall be substituted ;
for sub - rule (2) , the following sub - rules shall be substituted, namely:-

5 Manager to accompany the Commissioner, then the Chief Administrative Officer or the Chief Engineer ( Co- ordination ) Construction , along with other concerned officers shall accompany the Commissioner during the period of inspection .
(2A) The Divisional Railway Manager along with the concerned branch officers shall also accompany the Commissioner during the entire period of inspection . " .

In rule 19 of the said rules , for the Explanation, the following Explanation shall be substituted, namely :-
"Explanation. When sanction is required for the initiation of electric traction on a line already opened for passenger traffic , the documents specified in items (j ) , (k) , ( 1 ) , ( m ) and ( n ) of sub- rule ( 1 ) , item (d ) of sub- rule(2) and item ( a) ( vii ) of sub- rule (4) of rule 5 shall be forwarded to the Commissioner. " .
8. In rule 24 of the said rules, -
(a) in sub- rule ( 4) , for the words " responsible officer, " the words "railway servant in- charge of work" , shall be substituted.;
(b) for sub -rule (5) , the following sub- rule shall be sustituted, namely : - " (5) Where the use of temporary diversion is likely to be extended to more than 3 days , the Commissioner shall , if he considers it necessary, take the earliest possible opportunity of inspecting it. " .
9. In rule 25 of the said rules, sub- rule (5) shall be omitted.
10. In rule 28 of the said rules , in sub- rule (5) , -
(a) in clause ( b) , for the word , brackets and figure " sub - rule (1 ) " , the word, brackets and figure " sub -rule(2) " shall be substituted ;
(b) in clause (c) , for the figures , letters and word, " 100Km/hour" , the figures , letters and word , " 105 Km /hour" shall be substituted.
11. Chapter VII of the said rules , relating to the heading " Requirements and recommendations for signaling and interlocking installations . , " shall be renumbered as CHAPTER VIII there of.
12. In rule 32 of the said rules , in sub- rule (2) , for the word, " reading " , the word " roding" shall be substituted .
13. In rule 33 of the said rules , in sub- rule (5) , the word and figures Paragraph 7.88.2 " shall be omitted.

14. In rule 36 of the said rules , in sub- rule (9 ) , in Method B , for the words , " A train must be admitted " , the words " No train shall be admitted shall be substituted.
15. Chapter VIII of the said rules , relating to the heading " Rules for the design and inspection of equipment for electric traction " shall be renumbered as CHAPTER IX there of .

figures " steeper than 1 in 80 falling towards the station and 1 in 100 " shall be In Form XV of the said rules , against serial number 46 , in column (2) , in Note 2, for the words and figures " steeper than 1 in 100" , the words and substituted .
