सा.का.नि. 50 (अ ) .-केन्द्रीय सरकार, उपभोक्ता संरक्षण अधिनियम , 1986 ( 1986 का 68 ) की धारा 30 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उपभोक्ता संरक्षण नियम , 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम उपभोक्ता संरक्षण ( संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. उपभोक्ता संरक्षण नियम, 1987 में , नियम 12 के पश्चात् निम्नलिखित नियम अंतः स्थापित किया जाएगा, अर्थात्:-
" 12 क. सदस्यों के चयन की प्रक्रिया.- ( 1 ) उपनियम ( 2 ) में यथाउपबंधित के सिवाय, किसी सदस्य की नियुक्ति की प्रक्रिया रिक्ति उत्पन्न होने से कम से कम तीन मास पूर्व आरम्भ की जाएगी ।
(2) यदि पद किसी सदस्य की सेवानिवृत्ति या मृत्यु या नए पद के सृजन के कारण रिक्त होता है, पद को भरने की प्रक्रिया, यथास्थिति, पद रिक्त होने या सृजित होने के तुरंत पश्चात् आरंभ की जाएगी ।
(3 ) पात्र अभ्यर्थियों से आवेदन आमंत्रित करते हुए किसी रिक्ति के लिए विज्ञापन या रिक्ति परिपत्र या दोनों, जो केन्द्रीय सरकार द्वारा विनिश्चित किए आए, भारत के किसी प्रमुख समाचारपत्र में प्रकाशित किया जा सकेगा ।
( 4 ) आवेदन की प्राप्ति के लिए विनिर्दिष्ट अंतिम तारीख तक प्राप्त आवेदनों की संवीक्षा करने के पश्चात् पात्र अभ्यर्थियों की एक सूची उनके आवेदन पत्रों के साथ धारा 20 की उपधारा ( 1 ) के तीसरे परन्तुक के अधीन गठित चयन समिति के समक्ष रखी जाएगी । ( 5) चयन समिति उसे निर्दिष्ट किए गए पात्र आवेदकों के सभी आवेदनों पर विचार करेगी ।
(6 ) चयन समिति, यदि वह आवश्यक समझे, अभ्यर्थियों की संख्या पर निर्भर रहते हुए गुणागुण के आधार पर उनकी छंटनी कर सकेगी और ऐसे छंटनी किए गए अभ्यर्थियों को सदस्य के पद के लिए उनकी उपयुक्तता पर विचार करने के लिए पुनः व्यक्तिगत साक्षात्कार के लिए बुला सकेगी ।

[PART II-SEC.3 (1) ] (7 ) चयन समिति उप- नियम ( 5 ) में निर्दिष्ट आवेदकों में से उसके द्वारा किए गए अपने मूल्यांकन के आधार पर सदस्य के रूप में नियुक्ति के लिए गुणागुण के क्रम में अभ्यर्थियों के नामों का एक पैनल केन्द्रीय सरकार द्वारा विचार किए जाने के लिए सिफारिश कर सकेगी । ( 8 ) केन्द्रीय सरकार मंत्रिमंडल नियुक्ति समिति का अनुमोदन चाहने से पूर्व चयन समिति द्वारा सिफारिश किए गए पैनल से और सदस्य के रूप में नियुक्ति के लिए ऐसे अभ्यर्थियों की उपयुक्तता का समाधान करने के लिए केन्द्रीय सरकार द्वारा चयन किए गए अभ्यर्थियों कीविश्वसनीयता और पूर्ववृत्त को सत्यापित कर सकेगी या सत्यापित करवा सकेगी ।
( १ ) सदस्य की प्रत्येक नियुक्ति उसकी चिकित्सीय उपयुक्तता के अध्यधीन होगी । "

G.S.R. 50(E ) . In exercise of the powers conferred by Sub - section ( 1 ) of Section 30 of the Consumner Protection Act , 1986 (68 of 1986 ) , the Central Government hereby makes the following rules further to amend the Consumer Protection Rules , 1987 , namely :
1. ( 1) These rules may be called the Consumer Protection ( Amendment) Rules , 2005 .
( 2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Consumer Protection Rules , 1987, after rule 12 , the following rule shall be inserted , namely: ---
" 12A. Procedure for selection of Members.-( 1 ) Save as otherwise provided in sub - rule (2) , the process of appointment of a Member shall be initiated at least three months before the vacancy arises .
(2) if a post falls vacant due to resignation or death of a Member or creation of a new post , the process for filling the post shall be initiated immediately after the post has fallen vacant or is created, as the case may be.
(3 ) An advertisement of a vacancy inviting applications from eligible candidates may be published in icading newspapers in India or by vacancy circulars or both , as may be decided by the Central Government .
(4) After scrutiny of the applications received till the last date specified for receipt of applications , a list of cligible candidates alongwith their applications shall be placed before the Selection Committee constituted under the third proviso to Sub - section ( 1 ) of Section 20.
(5) The Sclection Committce shall consider all the applications of eligible applicants referred to it.
(6 ) The Sclection Committee may, if it considers necessary, depending on the number of candidates, short list them on the basis of merit and call such short listed candidates for personal interview to consider their suitability for the post ofMember . " [ भाग II- खण्ड 3 (i)]

3 (7) The Selection Committee may, on the basis of its assessment made by it , recommend a panel of names of candidates for appointment as Members from amongst the applicants referred to in sub -rule (5) in order ofmerit for the consideration of the Central Government.
(8) The Central Government shall , before seeking approval of the Appointments Committee of the Cabinet, verify or cause to be verified the credentials and antecendents of the candidates selected by the Central Government from the panel recommended by the Selection Committee and satisfy the suitability of such candidates for appointment as Members .
(9) Every appointment of a Member shall be subject to his medical fitness ." .
