सा.का.नि. 51 ( अ ). औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप, जिसे केन्दीय सरकार औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औषधि तकनीकी सलाहकार बोर्ड से परामर्श के पश्चात् बनाना चाहती है, उक्त धाराओं की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और एतद्वारा सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख सेजिसको उस राजपत्र की प्रतियां, जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को प्राप्त करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
2. आक्षेप या सुझाव, यदि कोई हों, सचिव ( स्वास्थ्य) , स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, निर्माण भवन, नई दिल्ली- 110011 को भेजे या सकते हैं ।
3. ऐसे किसी आक्षेप या सुझाव पर, जो उक्त प्रारूप नियमों की बावत् किसी व्यक्ति से ऊपर यथा विनिर्दिष्ट अवधि की समाप्ति के पूर्व प्राप्त होंगे, केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूपनियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री (.... संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री अधिनियम , 1945 की अनुसूची ण में, भाग 1 स्थान पर निम्नलिखित भाग रखा जाएगा, अर्थात्:
"भाग-1
कृष्ण तरलों और श्वेत तरलों को लागू उपबंध
रोगाणुनाशकों के लिए मानक भारतीय मानक ब्यूरों द्वारा समय - समय पर निर्धारित किए गए भारतीय मानक विनिर्देश ( भा.मा. 1061: 1997 ) के अनुरूप होंगे । "

[PART II -SEC.3 (i) ] टिप्पण:-मूल नियम राजपत्र में अधिसूचना सं. एफ. 28-10 /45 - एच ( 1 ) , तारीख 21-12-1945 द्वारा प्रकाशित किए गए थे और इनमें अंतिम बार सा.का.नि. 808 ( अ ) तारीख 13-12-2004 द्वारा संशोधन किया गया था ।

NOTIFICATION
New Delhi , the 2nd February,2005
G.S.R. 51 (E) . The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945, which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board, in exercise of the powers conferredby Section 12 and Section 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940 ) , is hereby published as required by the said sections for the information of all persons likely to be affected thereby and notice is hereby given that the said draft ruics will be taken into consideration after the expiry of a period of forty -five days from the date on which the copies of the Official Gazette in which this notification is published, are made available to the public;
2. Objections or suggestions , if any, which may be addressed to the Secretary (Health ), Ministry of Health & Family Welfare, Government of India, Nirman Bhawan, New Delhi - 110011.
3. Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period as specified above will be taken into consideration by the Central Government.
DRAFT RULES
1. ( 1 ) These rules may be called the Drugs and Cosmetics ( . Amendment ) Rules , 2005.
(2)They shall come into force on the date of their final publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945 in the Schedule O, for Part I following part shall be substituted, namely
"Part I
Provisions applicable to black fluids and white fluids
The standards for disinfectants shall conform to the Indian Standards specification ( IS 1061 : 1997 ) laid down from time to time by Bureau of Indian Standards . "
