सा.का.नि. 52( अ ) - भारत के संविधान के अनुच्छेद 309 के परंतुकबंधों द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इस प्रतिस्थापना से पहले किए गए कार्यों अथवा किए जाने वाले कार्यों को छोड़कर राजकीय कला कालेज, चंडीगढ़ प्रशासन लेक्वरर ( वर्ग ' क ' ) भर्ती नियम, 1997 के प्रतिस्थापन में राष्ट्रपति , एतद्वारा राजकीय कला कालेज , चण्डीगढ़ में लेक्चरर के वर्ग ' क ' पदों की भर्ती की प्रणाली के विनियमन के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. लघु शीर्षक और आरंभ होना ( 1 ) इन नियमों को राजकीय कला कालेज, चण्डीगढ़ प्रशासन लेक्चरर , ( वर्ग ' क ' ) संशोधन भर्ती नियम , 2004 कहा जाए ।
(2) ये नियम सरकारी राजपत्र में प्रकाशित होने की तारीख से प्रवृत्त होंगे ।
2. पदों की संख्या , वर्गीकरण और वेतनमान: इन पदों की संख्या, उनका वर्गीकरण और उनसे संबद्ध वेतनमान उसी प्रकार होंगे , जिस प्रकार इन नियमों के साथ संलग्न अनुसूची के कॉलम ( 2 ) से ( 4 ) में निर्दिष्ट हैं ।
3. भर्ती की प्रणाली, आयु- सीमा और अर्हताएं आदि उक्त पदों के लिए भर्ती प्रणाली, आयु- सीमा, अर्हताएं और तत्संबंधी अन्य मामले वही होंगे, जो पूर्वोक्त अनुसूची के कॉलम ( 5 ) से ( 14 ) में निर्दिष्ट है ।
4. अनर्हताएं: कोई भी ऐसा व्यक्ति, जिसने
(क) किसी ऐसे व्यक्ति से विवाह का अनुबंध किया है अथवा विवाह किया है जिसका पति/ पत्नी जीवित हो, अथवा
(ख) पति/पत्नी के जीवित रहते हुए किसी दूसरे व्यक्ति से विवाह अथवा विवाह का अनुबंध किया है ,
पद पर नियुक्ति का पात्र नहीं होगा:
बशर्ते यदि केन्द्रीय सरकार इस बात से संतुष्ट हो कि उस व्यक्ति और विवाह के दूसरे पक्षकार पर लागू वैयक्तिक कानून के अधीन ऐसा विवाह अनुज्ञेय है और ऐसा करने के कुछ अन्य आधार हैं तो किसी व्यक्ति को इस नियम से छूट दी जा सकती है ।
5. रियायत देने की शक्ति जहां केन्द्रीय सरकार की यह राय हो कि ऐसा करना आवश्यक तथा उचित है , तो वह लिखित में कारणों का उल्लेख करते हुए तथा संघ लोक सेवा आयोग के परामर्श से , आदेश द्वारा व्यक्तियों के किसी वर्ग अथवा श्रेणी को इन नियमों के किसी उपबंध के सम्बंध मेंरियायत दे सकती है ।
6. व्यावृत्ति: केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए जाने वाले आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, पूर्व सैनिकों और अन्य पिछड़े वर्गों के व्यक्तियों को दिये जाने वाले आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर इन नियमों का कोई प्रभाव नहीं पड़ेगा ।

NOTIFICATION
New Delhi , the 25th January , 2005
G.S.R. 52 (E). In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Government College of Art , Chandigarh Administration , Lecturers (Group ' A' ) Recruitment Rules , 1997 , except as respects of things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to Group ' A' posts of Lecturer's in the Government College of Arts , Chandigarh , namely: - 1 . Short title and commencement
(1) These rules may be called the Government College of Art, Chandigarh Administration, Lecturers ( Group ' A' ) Amendment Recruitment Rules , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of posts , classification and scale of pay
The number of posts , its classification and scale of pay attached thereto shall be as specified in columns ( 2) to (4) of the Schedule annexed to the rules .
3.
Method of recruitment , age limit , qualification etc.
The method of recruitment to the said posts , the age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule .
4.
Disqualification- No person
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who , having a spouse living has entered into or contracted marriage with any person , shall be eligible for appointment to the said post:
Provided that the Central Government may if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds för so doing , exempt any person from the rule .
5.
Power to relax
Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasonsto be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.
6.
Saving
Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Caste , Scheduled Tribes , Ex - Servicemen , Other Backward Classes and other special category of persons in accordance with the orders issued by the Central Government from time to time .
