सं.टीएएमपी/53 /2004-सीएचपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 49 के द्वारा प्रदत्त शक्तियों का उपयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतत्द्वारा, दरमान में 3 टन की क्षमता वाले पे - लोडर के भाड़ा प्रभारों को शामिल करने हेतु चेन्नई पत्तन न्यास के प्रस्ताव को, संलग्न आदेशानुसार अनुमोदन प्रदान करता है ।

यह प्रकरण दरमान में 3 टन की क्षमता वाले पे -लोडर के भाड़ा प्रभारों को शामिल करने हेतु चेन्नई पत्तन न्यास (सीएचपीटी) से प्राप्त प्रस्ताव से संबंधित है ।
2. सीएचपीटी द्वारा उठाए गए मुख्य बिन्दु निम्नानुसार हैं:
(1 ) 3 टन क्षमता वाले पे लोडर के लिए दरें अप्रैल 2000 के दरगान में उपलब्ध थीं । ये दरें रु. 6354/ - एक पूरी पालीके लिए और रु. 3178/- (न्यूनतम) आधी पाली के लिए थीं ।
(IF) 3 टन क्षमता वाले पे - लोडर की दरें सीएचपीटी द्वारा सामान्य संशोधन ( 2002) के लिए इसके पिछले प्रस्ताव में से अनायास ही हटा दी गई थीं ।
(ⅲ) फ्तन इस पे-लोडर को उपयोगकर्ताओं के लिए उपलब्ध तो करवा रहा है किन्तु वर्तमान दरमान (2002 के संस्करण ) में इस क्षमता के पे -लोडर के लिए कोई दर उपलब्ध नहीं है । दरें केवल 6 टन वाले पे-लोडर के लिए ही हैं ।
(iv) पिछले दरमान (2000) में उपलब्ध, 3 टन क्षमता वाले पे - लोडर से संबंधित निम्नलिखित दर वर्तमान दरमान में " अध्याय - VI , श्रेणी-1 के ( दर) मान 6 के अन्तर्गत धारा 11 - फ्लोटिंग क्राफ्ट, उपस्कर इत्यादि" शीर्ष के अंतर्गत सम्मिलित की जाएँ:
11) 3 टन क्षमता वाले पे लोडर ( पाली आधार पर)
पे- लोडर को प्रति घंटा आधार पर भाड़े पर देने को तक सीमित किया जाएगा ।
प्रत्येक आवेदक द्वारा मांगे गए और आपूरित प्रत्येक यूनिट की प्रति आधा पाली की न्यूनतम दर रु. 3178/- के साथ रु. 6354/- प्रति पाली ।

(v) अनुरोध किया जाता है कि दरों का क्रियान्वयन पिछले प्रभाव 24 अक्तूबर 2002 से अनुमोदित किया जाए ।
3.1. सीएचपीटी द्वारा अब प्रस्तावित 3 टन की क्षमता वाले पे - लोडर के भाड़ा प्रभार मार्च 2000 में अनुमोदित सामान्य संशोधन के आधार पर, मार्च 2001 में अधिसूचित एकीकृत दरयान में उपलब्ध थे । जैसाकि सीएचपीटी ने स्वीकार किया है, इसने दरमान के सामान्य संशोधन हेतु जून 2002 में प्रस्तुत अपने प्रस्ताव में 3 टन क्षमता वाले पे - लोडर के भाड़ा प्रभारों के लिए प्रस्ताव नहीं किया था ! परिणामस्वरूप, अक्तूबर 2002 से प्रभावी (संशोधित) दरमान में 3 टन क्षमता वाले गे-लोडर के लिए भाड़ा प्रभार सम्मिलित नहीं किए गए हैं ।
3.2. पे लोडर को भाड़े पर लेने हेतु यूनिट के संदर्भ से, पे - लोडरों के लिए संदर्भित वर्तमान (तत्कालीन) दरमान " पाली आधार " पर और " प्रति घंटा आधार " पर था । यह पूछे जाने पर कि प्रस्तावित निर्धारण में प्रति घंटा आधार पर प्रभार को क्यों हटाया गया है, सीएचपीटी ने प्रति घंटा आधार पर भी वर्तमान ( तत्कालीन) भाड़ा प्रभारों को अनुमोदित करने का अनुरोध किया है !

4. सीएचगीटी का प्रस्ताव संदर्भित पे लोडर के भाड़ा प्रभारों की पूर्व संशोधित दरों को केवल शामिल करने के लिए है । सीएचपीटी के प्रस्ताव से उपयोगकर्ताओं पर कोई अतिरिक्त बोझ नहीं पड़ने वाला है । इसलिए इसे मामले में सामान्य परामर्शी प्रक्रिया को आवश्यक नहीं पाया गया है ।
5. पत्तन ने प्राधिकरण से प्रस्ताव को पिछले प्रभाव 24 अक्तूबर 2002 से अनुमोदन प्रदान करने का अनुरोध किया है । आनुषंगिक श्रेणियों के लिए वर्तमान दरमान 24 अक्तूबर 2002 से प्रभावी हुआ । जैसाकि 3 टन पे -लोडरों के लिए पूर्व संशोधित दरों की दरयान मेंकेवल पुनर्स्थापित किया गया है. इसलिए संशोधन को सीएचपीटी के अनुरोध के अनुसार पिछले प्रभाव से लागू किया जा सकता है । 6. सीएचपीटी ने प्ररताव किया है कि 6 टन की क्षमता वाले पे -लोडरों के भाड़ा प्रभारों को शासित करने वाली वर्तमान सशर्तताएँ, 3 टन क्षमता वाले पे- लोडरों के भाड़ा- ग्रभारों के मामले में भी लागू किया जाए । इसे अनुमोदित किया जाता है ।
7. परिणामस्वरूप और ऊपर दिए गए कारणों से तथा समग्र विचार-विमर्श के आधार पर यह प्राधिकरण सीएचपीटी के वर्तमान दरमान में श्रेणी-1 , मान-6 में अध्याय - विविध प्रभार में क्रम सं . 11 क के रूप में निम्नलिखित धारा को शामिल करने के लिए पिछले प्रभाव 24 अक्तूबर 2004 से अनुमोदन प्रदान करता है :

No. TAMP/53/2004- CHPT.-In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963) , the Tariff Authority for Major Ports hereby approves the proposal of the Chennai Port Trust for inclusion ofhire charges for the 3 tonne capacity pay loader in its Scale of Rates as in the Order appended hereto .

This case relates to a proposal received from the Chennai Port Trust (CHPT) for inclusion of hire charges for the 3 tonne capacity pay loader in its Scale of Rates .
2. The main points made by the CHPT are as follows:
(i) . The rates for 3 tonne capacity pay loader were available in the Scale of Rates ofApril 2000. The rates were Rs.6354/- for full shift and Rs.3178/ - (minimum) for halfshift.
(ii) . The rates for 3 tonne capacity pay loader were inadvertently deleted by CHPT in its last proposal for general revision (2002).
(iii) . Theport is sparing this pay loader to the users but no rate is available for pay loader of this capacity in the present Scale of Rates (2002 edition ) . Rates are available only for 6 tonne capacity pay loader.
(iv) . The following rates relating to the 3 tonne capacity pay loader available in the previous Scale of Rates ( 2000) maybe included under the head of "Charges for Floating Craft, Appliances etc. clause 11 under Scale 6 of Chapter-VI , Category-l " in the existing Scale of Rates:
( 1 ) The hiring out of pay loader on hourly basis will be limited 11) Pay loader of 3 tonne capacity ( on shiftbasis)
Rs.6354/- per shift with a minimum of Rs.3178/- per half of a shift per unit requisitioned by each applicantand supplied .
(v). Approval is also requested for implementation of the rates retrospectively from 24October 2002 .
3.1. Thecharges for hire of pay loader of 3 tonne capacity, now proposed by the CHPT, were available in the consolidated Scale of Rates notified in March 2001 based on the general revision approved in March 2000. As admitted by the CHPT, it did not propose hire charges for the pay loader of 3 tonne capacity in its proposal submitted in June 2002 for general revision of Scale of Rates . Consequently, the hire charges for the pay loader of 3 tonne capacity has not been included in the (revised ) Scale of Rates came into effect from October 2002 .
3.2. With reference to the unit of charging for hire of pay loaders , the (then ) existing Scale of Rates for the pay loader in reference was on "shift basis " as well as on hourly basis . Onbeing pointed out about the omission of hourly basis of charge in the proposed prescription , the CHPT has requested to approve the ( then ) existing hire charges on hourly basis also.
4. Theproposal of the CHPT is only for inclusion of the pre-revised rates of hire charges of the pay loader in reference. The proposal of the CHPT will not cast any additional burden on the users . The usual consultation process is, therefore , found not necessary in this case.

5. The port has requested this Authority to approve its proposal retrospectively with effectfrom 24 October 2002. The existing Scale of Rates for relevant categories came into effect from 24 October 2002. Since the pre- revised rates of hire for 3 tonne pay loaders are only reinstated in the Scale of Rates , the amendment can be given retrospective effect , as requested by CHPT.
6. The CHPT has proposed that the existing conditionalities governing the hire charges of pay loaders of 6 tonne capacity will apply in case of the hire charges of pay loader of3 tonne capacity . This is approved.
7. In the result , and for the reasons given above , and based on a collective application of mind , this Authority approves the following clause for insertion in Chapter -VI MISCELLANEOUS CHARGES in Scale- 6 , Category - l as Sl . No.11A in the existing Scale of Rates of the CHPT with retrospective effect from 24 October 2002:
