सं.टीएएमपी/103/2001-सीपीटी. महापत्तन न्यास अधिनियम, 1963( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण कोलकाता पत्तन न्यास के हल्दिया स्थित भूमि और भवनों के वर्तमान दर-अनुसूची की वैधता को इसके साथ संलग्न आदेशों के अनुसार विस्तार प्रदान करता है ।

यह प्रकरण कोलकाता पत्तन न्यास के हल्दिया स्थित भूमि और भवनों की प्रचलित दर अनुसूची की वैधता को 31 दिसम्बर, 2004 से आगे विस्तार प्रदान करने से संबंधित है ।
2. इस प्राधिकरण ने , हल्दिया में भूमि और भवनों के लिए प्रचलित किराया अनुसूची की वैधता 31 दिसम्बर, 2004 या संशोधित किराया अनुसूची की अधिसूचना के क्रियान्वयन की तिथि तक , इनमें से जो भी पहले हो, विस्तार प्रदान करते हुए, 22 जून, 2004 को एक आदेश पारित किया था ।
3. केओपीटी ने दिनांक 24 दिसम्बर, 2004 के अपने पत्र द्वारा इस प्राधिकरण से , केओपीटी की हल्दिया स्थित भूमि और भवनों के वर्तमान किराया अनुसूची की वैधता 30 जून, 2005 तक बढ़ाने का अनुरोध किया है:-
(i ) टीएएमपी ने दिनांक 30 सितम्बर, 2004 के अपने आदेश द्वारा केओपीटी को सलाह दी थी कि वह केओपीटी के हल्दिया स्थित भवनों और भूमि के लिए किराया अनुसूची के प्रस्ताव को संशोधित करे और अपना संशोधित प्रस्ताव, केन्द्र सरकार द्वारा केओपीटी के लिए नई भूमि नीति मार्गदशियों घोषित करने की तिथि से 60 दिन के भीतर प्रस्तुत करें ।
(ii ) केंन्द्र सरकार द्वारा केओपीटी के लिए नई भूमि नीति मार्गदर्शी जारी करना अभी बाकी है ।
(iii ) हल्दिया स्थित केओपीटी की भूमि और भवनों के लिए वर्तमान किराया अनुसूची 1 जनवरी 2005 को समाप्त हो जाएगी और वर्तमान किराया अनुसूची की वैधता 1 जनवरी, 2005 से आगे बढ़ाना आवश्यक हो गया है ।

[PART III-SEC.4] ( iv ) उपरोक्त को ध्यान में रखते हुए, हल्दिया स्थित केओपीटी की भूमि और भवनों की प्रचलित किराया अनुसूची की वैधता 30 जून, 2005 तक की अवधि के लिए बढ़ा दी जाए ।
4. दरमान और शर्तों की विवरणी तैयार करने के प्रयोजन से इस प्राधिकरण द्वारा पत्तन परिसम्पत्तियों के पट्टेदारी के मामले में केन्द्रीय सरकार द्वारा जारी किए गए मार्गदर्शियों का अनुसरण किया गया है । केओपीटी की सम्पदा के लिए वर्तमान भूमि नीति भारत सरकार की समीक्षा के अधीन है । केओपीटी ने कहा है कि केओपीटी के लिए नई भूमि नीति मार्गदर्शियों भारत सरकार द्वारा अभी घोषित की जानी है । 5. दिनांक 30 सितम्बर, 2004 के अपने आदेश द्वारा इस प्राधिकरण ने केओपीटी को, भारत सरकार द्वारा नई भूमि नीति घोषित करने के बाद, वर्तमान दरों की समीक्षा के लिए अपना प्रस्ताव प्रस्तुत करें । केओपीटी को अपना प्रस्ताव प्रस्तुत करने के लिए सरकार द्वारा नई भूमि नीति घोषित करने की तिथि से 60 दिन का समय दिया गया है ।
6. जैसाकि हल्दिया में केओपीटी की भूमि और भवनों की प्रचलित किराया अनुसूची की वैधता 1 जनवरी , 2005 को पहले ही समाप्त हो चुकी है , ऊपर वर्णित परिसम्पत्तियों को ध्यान में रखते हुए, हल्दिया में केओपीटी की भूमि और भवनों की वर्तमान किराया अनुसूची की वैधता को 31 दिसम्बर, 2004 से आगे विस्तार प्रदान करना आवश्यक हो गया है । भारत सरकार द्वारा केओपीटी के लिए नई भूमि नीति की घोषणा करने के बाद, केओपीटी को संदर्भित वर्तमान किराया अनुसूची की समीक्षा पर अपना प्रस्ताव तैयार करना है और इस प्राधिकरण के समक्ष संशोधित प्रस्ताव प्रस्तुत करना है जिसके लिए केओपीटी को , सरकार द्वारा नई भूमि नीति की घोषणा करने की तिथि से 60 दिन का समय पहले ही दिया जा चुका है । केओपीटी द्वारा प्रस्तुत किए जाने वाले प्रस्ताव पर संबंधित स्टेक होल्डरों के परामर्श से निर्णय लिया जाना है , जिसमें समय लग सकता है । इसलिए हल्दिया में केओपीटी की भूमि और भवनों की किराया अनुसूची की वैधता के विस्तार के लिए, केओपीटी के प्रस्ताव के अनुसार 30 जून, 2005 की बजाय 31 दिसम्बर, 2005 तक एक बाहरी सीमा निर्धारित करना समुचित होगा ।
7. परिणामस्वरूप और ऊपर दिए गए कारणों से और समग्र विचार - विमर्श के आधार पर यह प्राधिकरण, हल्दिया में केओपीटी की हल्दियामें भूमि और भवनों की प्रचलित किराया अनुसूची की वैधता 30 जून, 2005 तक या संशोधित किराया अनुसूची की अधिसूचना के क्रियान्वयन की तिथि, इनमें से जो भी पहले हो , को विस्तार प्रदान करता है ।

No. TAMP/ 103 /2001 - CPT.-In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports extends the validity of the existing Schedule ofRates for land and buildings ofthe Kolkata Port Trust at Haldia as in the Order appended hereto .

This case relates to extension of the validity of the existing Schedule of rent for land and buildings of the Kolkata Port Trust ((KOPT) at Haldia beyond 31 December, 2004.
2. This Authority had passed an Order on 22 June, 2004 extending the validity of the existing rent Schedule for land and buildings at Haldia till 31 December , 2004 or date of effect of notification ofthe revised rent Schedule whichever is earlier.
3. The KOPT vide its letter dated 24 December, 2004 has requested this Authority to extend the validity of the existing Schedule of rent for land and buildings of KOPT at Haldia till 30 June, 2005. The main points made by the KOPT are as follows:-
(1) TAMP vide Order dated 30 September, 2004 advised KOPT to revise the proposal of Schedule of rent for land and buildings of KOPT at Haldia and file its revised proposal within 60 days from the date Central Govt . announces the new land policy guidelines for KOPT.

3 (ii) The Central Govt , is yet to announce new land policy guidelines for KOPT.
(iii) The existing rent schedule for land and buildings of the KOPT at Haldia will expire on 1 January, 2005 and it is necessary to extend the validity of the existing rent Schedule beyond 1 January, 2005 .
( iv) In view of the above, the validity of the existing Schedule of rent for land and buildings of KOPT at Haldia may please be extended for a period upto 30 June 2005.
4. The guidelines issued by the Central Government in the matter of leases of Port assets have been followed by this Authority for the purpose of framing of Scale of Rates and statement of conditions. The existing Land Policy for the estates of KOPT is under review by the Government of India . The KOPT has stated that the New Land Policy guidelines for KOPT is yet to be announced by the Government of India.
5. This Authority vide its Order dated 30 September, 2004 has directed KOPT to file its proposal for review of the existing rates after new Land Policy is announced by the Government of India . The KOPT has also been granted 60 days time from the date the Government announces the new Policy to file such a proposal.
6. Since the validity of the existing Schedule ofrent for land and buildings at Haldia has already expired on 1 January 2005, it is necessary to extend the validity of the existing rent Schedule for land and buildings of KOPT at Haldia beyond 31 December , 2004. After pronouncement of new Land Policy for KOPT by the Government of India the KOPT has to formulate its proposal for review of the existing Rent Schedule in reference and file the revised proposal before this Authority for which the KOPT has already been granted 60 days time from the date of Government announces the new Land Policy. The proposal (to be ) filed by the KOPT has to be decided in consultation with the relevant stakeholders which may take time. It is, therefore, appropriate to set an outer limit for extension ofthe validity of the Rent Schedule of Land andBuildings of KOPT at Haldia till 31 December 2005 instead of30 June, 2005 as proposed by KOPT.
7. In the result, and for the reasons given above , and based on a collective application of mind, this Authority extends the validity ofthe existing rent Schedule for land and buildings of KOPT at Haldia till 31 December, 2005 or date ofeffect of notification of the revised Rent Schedule , whichever is earlier.
