का.आ. 157( अ ) केन्द्रीय सरकार, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय (सड़क खंड़) की अधिसूचना संख्यांक का.आ. 393 (अ) तारीख 12 मई, 1988 के द्वारा तमिलनाडु राज्य में राष्ट्रीय राजमार्ग 45 को खंड़ 27.8 कि.मी. से 122.00 कि.मी. (चिंगलपेट से तिंडीवनम खंड़) को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा गया था;
अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग खंड़ और स्थायी पुल के प्रयोग के लिए शुल्क सार्वजनिक रूप से वित्तपोषित परियोजनाएं) नियमावली, 1997 के नियम 3, नियम 5 और नियम 11 और राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के नियम 3 के उपनियम (2) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह अधिसूचित करती है कि तमिलनाडु राज्य में राष्ट्रीय राजमार्ग सं. 45 के 28.00 कि.मी. से 74.50 कि.मी. और 74.50 कि.मी. से 121.00 कि.मी. के चार लेन के भूखंड़ों के उपयोग के लिए यांत्रिक यानों पर किसी फीस को, केन्द्रीय सरकार की ओर से भारतीय राजमार्ग प्राधिकरण द्वारा विभागीय रूप से प्रत्यक्षतः प्रतिस्पर्द्धात्मक निविदा के आधार पर, संलग्न अनुसूची में विनिर्दिष्ट दर से उदग्रहीत और संग्रहीत की जाएगी । फीस , अधिसूचना के प्रकाशन की तारीख से या उक्त चार लेन के भूखंड को यातायात के लिए खोले जाने की तारीख से, जो भी पश्चातवर्ती हो, से शाश्वत रूप से संग्रहीत की जाएगी । फीस की दरें राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के पुनरीक्षण के अध्ययधीन होगी ।

278 1. जब उसी यांत्रिक यान को किसी दिन में एक से अधिक बार पथकर द्वार को पार करना है तो उपयोक्ता के पास यह विकल्प होगा कि वह पहली बार ही द्वार पार करते समय अनुसूची में दी गई दरों पर बहु यात्रा के लिए फीस का संदाय कर दे या यदि यान को पूर्ण मास में उससे अधिक उक्त खंड का प्रयोग लगातार और बारंबार करना पड़ता है तो यान का स्वामी अनुसूची में यथा विनिर्दिष्ट उसको लागू एकल दरों के तीस गुणा के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकेगा ।
स्पष्टीकरण: - " दिन " के 24 घंटें अभिप्रत हैं । 3

2. निम्नलिखित प्रकार के यानों से अनुसूची में ऊपर विनिर्दिष्ट फीस से छूट प्राप्त होगी अर्थात: -
यान
(i)
(क) जो " अति महत्वपूर्ण व्यक्ति" प्रतीक, वाले या सरकारी रूप में निम्नलिखित के हैं : -
(क) भारत के राष्ट्रपतिः
(ख) भारत के उपराष्ट्रपति;
(ग) राज्य के राज्यपाल या संघ शासित प्रदेश के उपराज्यपाल;
(घ) भारत के शासकीय दौरे पर उच्चपदस्थ वैदेशिक;
(ड) " सी डी " ! " सी सी " नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद के सभापति या राज्य विधान सभा के अध्यक्ष या केंद्रीय या राज्य मंत्री या लोक सभा या राज्य सभा या राज्य विधानमंडल में प्रतिपक्ष के नेता जिनका दर्जा कैबिनेट मंत्री का हो , यदि, वे स्वयं वाहन में हों; या
(छ) संसद सदस्य या अपने- अपने राज्यों में राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद के सदस्य, यदि, वह यथास्थिति, संसद या राज्य की संबंधित विधायिका, जैसा भी लागू हो , द्वारा जारी पहचान पत्र प्रस्तुत करते हैं;
(ख) सक्षम प्राधिकारी द्वारा पुरस्कार के प्रमाणन के संबंध में जारी फोटो परिचय पत्र प्रस्तुत करने पर वीरता पुरस्कार अर्थात परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र विजेता;
(ii) रक्षा यान, पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान, केंद्रीय सरकार और राज्य सरकार के कार्यस्थ यान ।
3. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम, पता, टेलीफोन संख्या , जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए , पथकर चौकी से 500 मी . आगे , पथकर चौकी से 100 मी . आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित किया जाएगा । संप्रर्दशन बोर्ड की ऊचांई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना सहज हो, पर प्रदर्शित करना होगा । THE GAZETTE OF INDIA: EXTRAORDINARY

( i ) अनुसूची की क्रम संख्या 2 के मामले में मिनी बस; और
( ii) अनुसूची की क्रम संख्या 3 के मामले में, वे मल्टी ऐकस्ल वाहन जो कि अनुसूची की क्रम संख्या 4 में शामिल नहीं हैं ।
5. उक्त अनुसूची के अंतर्गत नहीं आने वाले किसी यांत्रिक यान से कोई फीस उदग्रहीत और संग्रहीत नहीं की जाएगी ।
6. फीस दो स्थानों पर संग्रहीत होगी । पहली 28.00 कि.मी. से 74.50 कि.मी. के खंण्ड़ के लिए और दूसरी 74.50 कि.मी. से 121.00 कि.मी. के खंण्ड़ के लिए।

NOTIFICATION
New Delhi , the 2nd February , 2005
S.O. 157 (E)-Whereas , the Central Government , vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 393 (E ) , dated the 12th May , 1998 issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988) , entrusted the section of National Highway No. 45 from Km 27.8 to Km 122.00 (Chingelpet to Tindivanam section) in the State of Tamil Nadu to the National Highways Authority of India;
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956) , read with rules 3 , 5 and 11 of the National Highways ( Fees for the Use of National Highways Section and Permanent Bridge Public Funded Project) Rules , 1997 , and sub - rule (2) of rule 3 of the National Highways ( Rate of Fee) Rules , 1997 , the Central Government hereby notifies that there shall be levied , and collected , by the National Highways Authority of India departmentally , directly on the basis of competitive bidding on behalf of the Central Government , a fee on mechanical vehicles for the use of the four laned stretches from Km 28.00 to Km 74.50 and from Km 74.50 to Km 121.00 of National Highway No. 45 in the State of Tamil Nadu , at the rates specified in the Schedule annexed hereto . The fees shall be collected in perpetuity from the date of the publication of the notification in the Official Gazette or date of opening of the said four laned stretches to traffic , whichever is later . The fee rates are subject to revision as per the National Highways ( Rate of Fee) Rules , 1997.

1. When the vehicle has to cross the toll booth more than once in a day , the user shall have the option to pay the fee for the multiple trips at the rates as given in the Schedule above while crossing the gate in first trip itself, or if the vehicle has to use the said stretch continuously and frequently for the entire month or even beyond that, the vehicle owner can have a monthly pass on the payment of charges equivalent to thirty single rates applicable to it , as specified in the aforesaid Schedule .
Explanation . - " Day " means 24 hours .

[PART I-SEC. 3 (ii)] 2. The following types of vehicles shall be exempted from the fee specified above in the Schedule , namely: -
(i) vehicles , -
(A) having " VIP " symbols ; or officially belonging to
(a) the President of India;
(b) the Vice President of India;
(c) the Governor of a State or Lt. Governor of a Union Territory ;
(d) a Foreign Dignitary on State visit to India;
(e) a Foreign diplomat stationed in India using cars with " CD " / " CC " number plates;
(f) the Chairman of Rajya Sabha or the Speaker of Lok Sabha or the Chairman of a State Legislative Council or Speaker of a State Legislative Assembly or a Minister for the Union or State , or Leaders of Opposition in Lok Sabha or Rajya Sabha or State Legislatures having the status of Cabinet Minister , if he is sitting in the vehicle ; or
( g ) a Member of Parliament or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective State , if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be ;
(B) belonging to winner of Gallantary awards such as Param Vir Chakra , Ashok Chakra , Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award .
(ii) Defence vehicles , Police vehicles , Fire - fighting vehicles , Ambulances , Funeral vans , vehicles of the Department of Posts and Telegraphs and Central Government and State Government vehicles on duty .
3. The rates of fees , the categories of vehicles exempted from payment of fee and the name , address and telephone number of the Company to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also . The height of the display boards and size of letters being such that it is easy for drivers to read the display boards .

4. The type of vehicle shall include: -
(i) in case of S. No. 2 of the Schedule , "Mini Buses " ; and
(ii ) in case of S. No. 3 of the Schedule , "Multi Axle vehicle " not covered by S No. 4 of the said Schedule .
5. No fee shall be levied and collected from a mechanical vehicle , which is not covered by the said Schedule.
6. The fee shall be collected at two places that is one for the stretch from km 28.00 to km 74.50 and another for the stretch from km 74.50 to km 121.00.
