का.आ. 160( अ )- केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनिमय , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 920 ( अ ) , तारीख 28 अगस्त, 2002 और का.आ. 1192( अ ) , तारीख 3. दिसम्बर, 2001 द्वारा क्रमशः राष्ट्रीय राजमार्ग सं. 79अ का 0.000 कि.मी. से 35.000 कि.मी. और राष्ट्रीय राजमार्ग सं. 79 का 14.000 कि.मी. से 182.000 कि.मी. का खंड राजस्थान राज्य में भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था।
अतः, अब , केंद्र सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग खंड और स्थायी पुल के उपयोग लोक वित्तपोषित परियोजनाओं के लिए फीस) नियम , 1997 के नियम 3,5 और 11 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह अधिसूचित करती है कि राष्ट्रीय राजमार्ग संख्या 79अ का 0.000 कि.मी. से 35.000 कि.मी. और राष्ट्रीय राजमार्ग सं . 79 का 15.000 कि.मी. से 81.000 कि.मी. तक के खंड के प्रयोग के लिए उक्त अनुसूची के स्तंभ (3 ) और स्तंभ (4) में विनिर्दिष्ट दरों पर भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय तौर पर अथवा प्रतिस्पर्द्धात्मक बोली के आधार पर निजी ठेकेदार के माध्यम से केंद्रीय सरकार की ओर से संलग्न अनुसूची के स्तंभ (2 ) में विर्निदिष्ट यांत्रिक यानों पर फीस उदग्रहीत और संदत्त की जाएगी । यह फीस इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख अथवा चार लेन के खंड को यातायात के लिए खोले जाने की तारीख से, इनमें जो भी पश्चात्वर्ती हो, नियमित आधार पर संगृहीत की जाएगी । यह फीस राष्ट्रीय राजमार्ग ( फीस की दर) नियम, 1997 के अनुसार पुनरीक्षण के अधीन होंगी ।

नोटः
1. जब उसी यांत्रिक यान को एक दिन में एक से अधिक बार पथकर द्वार को पार करना है तो प्रयोक्ता को यह विकल्प होगा कि वह पहली बार ही द्वार पार करते समय अनुसूची में दी गई दरों पर अनेक बार यात्रा के लिए फीस का संदाय कर दे या यदि यान को संपूर्ण मास में या उससे अधिक लगातार या प्रायः बार बार उक्त खंड का प्रयोग करना पड़ता है तो यान का स्वामी अनुसूची में यथा विनिर्दिष्ट उसको लागू एकल दरों के तीस गुणा के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
2. अर्थात: - निम्नलिखित प्रकार के यानों से पूर्वोक्त अनुसूची में उपर्युक्त विनिर्दिष्ट फीस नहीं ली जाएगी , यान -
(1)
(अ ) जो " अति महत्वपूर्ण व्यक्ति " प्रतीक, वाले अथवा निम्नलिखित से संबंधित सरकारी वाहन हैं: - (क) भारत के राष्ट्रपति;
(ख) भारत के उपराष्ट्रपति;
(ग) राज्य के राज्यपाल अथवा संघ राज्य क्षेत्र के उपराज्यपाल;
(घ) भारत के शासकीय दौरे पर उच्च पदस्थ विदेशी व्यक्तिः
(ड) " सी डी" / " सी सी" नंबर प्लेटों की कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनायिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद के सभापति या राज्य विधान सभा के अध्यक्ष या केंद्रीय अथवा राज्य के मंत्री अथवा भारत का राजपत्र असाधारण

लोक सभा या राज्य सभा या राज्य विधानमंड़लों में प्रतिपक्ष के नेता जिनका दर्जा कैबिनेट मंत्री का हो यदि वे वाहन में हों ; अथवा
(छ) संसद सदस्य अथवा अपने-अपने राज्यों में राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद के सदस्य यदि वह, यथास्थिति, संसद अथवा राज्य के संबंधित विधानमंडल, द्वारा जारी पहचान पत्र प्रस्तुत करते हैं;
(आ) सक्षम प्राधिकारी द्वारा पुरस्व.. र के प्रमाणन के संबंध में जारी परिचय पत्र प्रस्तुत करने पर वीरता पुरस्कार अर्थात परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र विजेता;
(ii) रक्षा यान, पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान, केंद्रीय और राज्य सरकार के कार्यस्थ यान ।
3. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम, पता, टेलीफोन संख्या, जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए, पथकर चौकी से 500 मी . आगे, पथकर चौकी से 100 मी. आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित किया जाएगा । संप्रर्दशन बोर्ड की ऊचांई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना सहज हो और इसे अंग्रेजी, हिंदी और उस खंड की क्षेत्रीय भाषा में स्पष्ट रूप से लिख कर अथवा छपाई करके बोर्डों पर प्रदर्शित करना होगा ।
4. यह फीस राष्ट्रीय राजमार्ग सं. 79 पर अवस्थित एकल टोल प्लाजा. 80.800 कि.मी पर ही संगृहीत की जाएगी ।

NOTIFICATION
New Delhi , the 3rd February, 2005
S.O. 160( E) .- Whereas , vide notifications of the Government of India in the then Ministry of Road Transport and Highways number S.O. 920 (E ) , dated 28th August, 2002 and S.O. 1192 (E) , dated 3rd December, 2001 issued under section 11 of National Highways Authority of India Act , 1988 (68 of 1988 ) , the Central Government entrusted the stretches from Km 0.000 to Km 35.000 of National Highway No. 79A and from Km 14.000 to Km 182.000 of National Highway No. 79, respectively in the State of Rajasthan to the National Highways Authority of India;

[PART II SEC . 3 (ii) ] Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956), read with rules 3 , 5 and 11 of the National Highways (Fees for the use of National Highways Section and Permanent Bridge - Public Funded Projects) Rules , 1997, the Central Government hereby notifies that there shall be levied and collected fees on mechanical vehicles specified in column (2) of the Schedule annexed hereto by the National Highways Authority of India departmentally or through private contractors on the basis of competitive bidding on behalf of the Central Government, for the use of the said stretches from Km 0.000 to Km 35.000 of National Highway No. 79 (A) and from Km 15.000 to Km 81.000 of National Highway No. 79 in the State of Rajasthan, respectively at the rates specified in columns (3 ) and (4) ofthe said Schedule . The fees shall be collected in perpetuity from the date of publication of this notification in the Official Gazette or opening of the said stretch to traffic whichever is later. The fee rates are subject to revision as per the provisions of National Highways (Rate of fee) Rules , 1997 .

Notes :-
1. When the same vehicle has to cross the said stretch of the National Highway more than once in a day, the user shall have the option to pay the fee of multiple trips at the rates as given in the Schedule above while crossing the gate in the first trip itself or if the vehicle has to use the said stretch continuously and frequently for entire month or even beyond that, the vehicle owner can have a monthly pass on payment of charges equal to thirty times single rates applicable to it as specified in the aforesaid Schedule .
2. The following types of vehicles shall be exempted from the fee specified above in the Schedule , namely : -
(i) vehicles-
(A) having " VIP " symbols , or Officially belonging to -
the President of India
(a)
(b) the Vice President of India ;

(c) the Governor of a state or Lt. Governor of a Union Territory ;
(d) a Foreign Dignitarie on State Visit to India :
(e) a Foreign Diplomat stationed in India using cars with " CD "/ "CC" number plates:-
(f) the Chairman of Rajya Sabha or Speaker of Lok Sabha or the Chairman of a State Legislative Council or Speaker of a State Legislative Assembly or a Minister for the Union or State , or Leaders of Opposition in Lok Sabha or Rajya Sabha or State Legislatures , having the status of Cabinet Minister , if he is sitting in the vehicle ; or
(g) a Member of Parliament or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective State , ifhe produces his identity card issued by the Parliament or concerned Legislature of a State, as the case may be;
(B) belonging to winner of Gallantary awards such as Param Vir Chakra, Ashok Chakra, Maha Vir Chakra , Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award;
(ii) Defence vehicles , Police vehicles , Fire- fighting vehicles , Ambulances , Funeral vans , vehicles of the Department of Posts and Telegraphs and Central and State Government vehicles on duty .
3. The rates offees , the categories of vehicles exempted from payment of fee and the name, address and telephone number of the authority to whom complaints , if any, should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also . The height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English , Hindi and regional language of the area in which the section is situated .
4. The fees shall be collected at a single toll plaza located at Km 80.800 on NH 79 .
