का.आ. 170( अ ).- केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा उक की उप धारा (1 ) के अधीन जारी की गई भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग) की अधिसूचना सं. 1129 (अ) तारीख 14 अक्तूबर, 2004 द्वारा पश्चिम बंगाल राज्य में राष्ट्रीय राजमार्ग सं. 2 (666.000 कि.मी. से 672.197 कि.मी. ) पर हुगली नदी पर इसकी पहुँच संरचनाओं सहित प्रस्तावित द्वितीय विवेकानंद पुल का निर्माण, अनुरक्षण, प्रबंधन और प्रचालन करने के लोक प्रयोजन के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि जिसका संक्षिप्त वर्णन संलग्न अनुसूची में दिया गया है, ऐसी भूमि का अर्जन करने के अपने आशय की घोषणा की थी;
और, उक्त अधिसूचना का सार "दि एशियन एज " तारीख 29 अक्तूबर, 2004 और " गणशक्ति" तारीख 29अक्तूबर, 2004 में प्रकाशित किया गया था ;
थे ; और, सक्षम प्राधिकारी द्वारा इस भूमि में हितबद्ध किसी भी व्यक्ति से कोई आक्षेप प्राप्त नहीं किए गए और, सक्षम पाधिकारी ने उक्त अधिनियम की धारा उघ की उपधारा (1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है :

[PART II-SEC. 3( ii)] अतः अब केन्द्रीय सरकार, उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा उघ की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना है ;
और अब, केन्द्रीय सरकार उक्त अधिनियम की धारा उघ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर इसके साथ संलग्न अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त आत्यन्तिक रूप से केन्द्रीय सरकार में निहित होगी ।

NOTIFICATION
New Delhi , the 2nd February, 2005
S.O. 170 (E) . Whereas , by the notification of the Government of India, in the Ministry of Shipping, Road Transport and Highways (Department of Road Transport & Highways ) , number S.O. 1129(E) dated the 14th Oct , 2004 issued, under sub - section ( 1 ) of section 3A of the National Highways Act, 1956 (48 of 1956) , (hereinafter referred to the said Act) , the Central Government declared its intention to acquire the land specified in the Schedule appended to that notification for the public purpose: of building, maintenance , management, operation of proposed Second Vivekananda Bridge on National Highway No. 2 ( Km . 666.000 to Km. 672.197) across River Hooghly alongwith its approach structures in the State of West Bengal;

And whereas the substance of the notification was published in ' The Asian Age dated 29 October , 2004 and in the Ganashakti dated 29th October , 2004;
And whereas no objections were received by the competent authority from any person interested inthe land;
And whereas , in pursuance of sub -section ( 1 ) of section 3D of the said Act , the competent authority has submitted its report to the Central Government ;
Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub -section ( 1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto are to be acquired for the aforesaid purpose;
And further, in pursuance of sub - section ( 2) of section 3D of the said Act, the Central Government hereby declares that on the publication of this notification in Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
