सा.का.नि. 62( अ ).-केन्द्र सरकार , महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 132 की उप - धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विशाखापट्टणम पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दर्शित विशाखापट्टणम पोर्ट कर्मचारी ( वर्गीकरण , नियंत्रण एवं अपील ) संशोधन विनियम , 2005 का अनुमोदन करती है ।
2. ये विनियम इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।
अनुसूची
विशाखापट्टणम पोर्ट ट्रस्ट
महापत्तन न्यास अधिनियम , 1963 की धारा 28 ( 1963 का 38 ) द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए विशाखापट्टणम पोर्ट ट्रस्ट का न्यासी मंडल विशाखापट्टणम पोर्ट कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियम, 1968 में संशोधन करते हुए निम्नलिखित विनियम बनाता है । बशर्ते कि उपर्युक्त अधिनियम की धारा 124 के तहत यथापेक्षित केन्द्र सरकार से अनुमोदन प्राप्त हो :-
( 1 ) लघु शीर्ष और प्रारंभ:
(क) ये विनियम विशाखापट्टणम पोर्ट कर्मचारी ( वर्गीकरण , नियंत्रण एवं अपील ) संशोधित विनियम, 2005 कहे जायेंगे । (ख ) ये विनियम केन्द्र सरकार के शासकीय राजपत्र में प्रकाशित होने की तारीख से लागू होंगे ।
(2 ) विशाखापट्टणम पोर्ट कर्मचारी ( व. नि. अ. ) विनियम , 1968 में विनियम -7 में, उप विनियम-7 के बाद निम्नलिखित उप विनियम शामिल किए जाएंगे ।
उपविनियम-8 :
इस विनियम के अंतर्गत दिया गया निलंबित आदेश या दिया गया समझे जाने पर निलंबन आदेश उपांतरण करने या निरस्त करने वाले सक्षम 443 GI/2005 (1) [PART II-SEC.3 (1) ] THE GAZETTE OF INDIA : EXTRAORDINARY
2 प्राधिकारी द्वारा निलंबन आदेश जारी करने की तिथि से 90 दिन समाप्त होने से पहले, निलंबन जारी रखने या निरस्त करने पर निर्णय करके आदेश जारी करने के लिए गठित समीक्षा समिति की सिफारिशों के आधार पर समीक्षा की जाएगी । निलंबन के लिए विस्तारित अवधि के समाप्त होने से पहले अनुवर्ती समीक्षा की जानी चाहिए । एक समय में निलंबन अवधि 180 दिन से ज्यादा नहीं होनी चाहिए ।
उप विनियम-१:
उप विनियम 6 एवं 7 में कुछ होते हुए भी 90 दिन समाप्त होने से पहले समीक्षा करके निलंबन अवधि विस्तार नहीं करने पर इस विनियम के उप विनियम 1 से 3 के अंतर्गत दिया गया या समझा गया निलंबन आदेश 90 दिन के बाद वैध नहीं होगा ।

NOTIFICATION
New Delhi , the 10th February, 2005
G.S.R. 62 (E) . In exercise of the powers conferred by Sub - section (1 ) of Section 124 , read with Sub-section ( 1 ) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Government hereby approves the Visakhapatnam Port Employees ' ( Classification, Control & Appeal ) Amendment Regulations , 2005 made by the Board of Trustees of Visakhapatnam Port Trust as set out in the Schedule annexed to this Notification .
The said Regulations shall come into force from the date of publication of this Notification in the Official Gazette .

VISAKHAPATNAM PORT TRUST
In exercise ofthe powers conferred under Section 28 of Major Port Trusts Act , 1963 (Act 38 of 1963 ) , the Board of Trustees of Port of Visakhapatnam hereby makes the following regulations amending the Visakhapatnam Port Employees' 3

(Classification, Control and Appeal ) Regulations , 1968 , subject to the approval of the Central Government, as required under Section 124 of the aforesaid Act .
(1) Short title and commencement :
(a) These Regulations may be called the Visakhapatnam Port Employees ' ( Classification, Control and Appeal ) Amendment Regulations , 2005 .
(b) They shall come into force from the date of publication of the same in the Central Government Official Gazette.
(2) In the Visakhapatnam Port Eployees ' ( Classification, Control & Appeal ) Regulations , 1968 , in Regulation-7, after sub -Regulations -7 , the following sub -Regulations shall be inserted.
Sub-Regulation-8 :
"An order of suspension made or deemed to have been made under this Rule shall be reviewed by the authority competent to modify or revoke the suspension, before expiry of ninety days from the date of order of suspension , on the recommendation of the Review Committee constituted for the purpose and pass orders either extending or revoking the suspension . Subsequent reviews shall be made before expiry of the extended period of suspension . Extension of suspension shall not be for a period exceeding one hundred and eighty days at a time " .
Sub-Regulation -9 :
"Notwithstanding anything contained in sub -Regulation - 6 & 7 , an order of suspension made or deemed to have been made under sub -Regulations 1 to 3 of this Regulations shall not be valid after a period of ninety days, unless it is extended after review, for a further period before the expiry of ninety days" .
