का.आ. 203( अ )- केन्द्रीय सरकार, नाशक कीट एवं नाशक जीव अधिनियम, 1914 ( 1914 का 2 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पादप करंतीन ( भारत में आयात का विनियमन ) आदेश , 2003 , का संशोधन करने के लिए निम्नलिखित आदेश करती है , अर्थात्: -
1. ( 1 ) इस आदेश का संक्षिप्त नाम पादप करंतीन ( भारत में आयात का विनियमन ) ( संशोधन ) आदेश , 2005 है ।
( 2 ) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा। 2. पादप करंतीन ( भारत में आयात का विनियमन ) आदेश, 2003, के खण्ड 5 में निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा, अर्थात्:-
' परन्तु भारत- नेपाल व्यापार संधि के उपबंधों के अनुसार नेपाल से पादपों और रोपण सामग्री के आयात के संबंध में अनुसूची १ केस्तंभ (4 ) में" क-निरीक्षण फीस " शीर्ष के अधीन विहित दरों के पचास प्रतिशत पर निरीक्षण की फीस प्रभारित की जाएगी ' ।

New Delhi , the 14th February , 2005
S.C. 203 (E). In exercise ofthe powers confere by Sub -section ( 1) of Section 3 of the Destructive Insects and Pests Act, 1914 (2 of 1914) , the Central Government hereby makes the following Order further to amend the PlantQuarantine (Regulation of Import into India) Order, 2003, namely:-
1. (1) This Order may be called the Plant Quarantine (Regulation of Import into India) (Amendment) Order, 2005.
(2) It shall come into force from the date of its publication in the Official Gazette .
2. In clause 5 of the Plant Quarantine (Regulation of Import into India ) Order, 2003 , the following proviso shall be inserted , namely :-
'Provided that the fees for inspection shall be charged at fifty per cent of the rates prescribed under the heading " A - Inspection Fees " , in column (4) of Schedule IX, in respect of imports of plants and planting materials from Nepal as per the provisions ofthe Indo -Nepal Trade Treaty' .

Note:- The Plant Quarantine (Regulation of Import into India) Order, 2003 was published in the Gazette of India vide S.O. 1322 ( E) , dated 18th November , 2003 , subsequently amended vide S.O. 167 (E) , dated 6th February, 2004, S.O. 427 (E) , dated 29th March, 2004 and S.O. 644(E) dated 31st May, 2004 ..
