विषय:-चीन जनवादी गणराज्य के मूल के अथवा वहां से निर्यातित कम्पैक्ट फ्लोरेसेंट लैम्प्स ( सी एफ एल ) के आयातों पर लगाए गए पाटनरोधी शुल्क संबंधी न्यू शिपर समीक्षा ( नियम 22 के अंतर्गत ) शुरू करना
सं. 15/27/2004- डी जी ए डी. मै० . ओसराम चाईना लाइटिंग लि. , चीन जनवादी गणराज्य ने यथा संशोधित सीमाशुल्क टैरिफ अधिनियम, 1975 और सीमाशुल्क टैरिफ (पाटित वस्तुओं की पहचान, उन पर पाटनरोधी शुल्क का आकलन एवं वसूली तथा क्षति निर्धारण) नियमावली 1995 के अनुसार निर्दिष्ट प्राधिकारी (जिसे आगे प्राधिकारी कहा गया है) के समक्ष एक आवेदन पत्र दायर किया है जिसमें पाटनरोधी जांच मामले में जहां सरकार ने सीमाशुल्क टैरिफ अधिनियम के अध्याय 69 के अंतर्गत आने वाली वस्तुओं पर दिनांक 10.12.2002 की अधिसूचना सं 0 138/ 2001- सीमाशुल्क के तहत पाटनरोधी शुल्क अधिसूचित किया था, में चीन जनवादी गणराज्य से कम्पैक्ट फ्लोरेसेंट लैम्प्स (सी एफ एल ) (जिन्हें आगे संबद्ध वस्तुएं कहा गया है) के आयातों पर निर्दिष्ट प्राधिकारी द्वारा अनुसंशित पाटनरोधी शुल्क की समीक्षा के लिए अनुरोध किया गया है ।
2. प्राधिकारी ने दिनांक 2 नवंबर, 2001 की अधिसूचना सं0 34/1/ 2001-डी जी ए डी के द्वारा चीन जनवादी गणराज्य से कम्पैक्ट फ्लोरेसेंट लैम्प्स के आयातों से संबंधित प्रारंभिक जांच परिणामों को अधिसूचित किया था और केन्द्र सरकार द्वारा दिनांक 21.12.2001 की अधिसूचना सं 0 128/2001- सीमाशुल्क के द्वारा अनंतिम पाटनरोधी शुल्क लगाया गया था । अंतिम जांच परिणाम दिनांक 14 नवंबर,

[PART I-SEC. 1 ] 2002की अधिसूचना सं0 34/ 1 / 2001 -डी जी ए डी द्वारा जारी किए गए थे और निश्चयात्मक शुल्क दिनांक 10.12.2002 की अधिसूचना सं 0 138/ 2002- सीमाशुल्क के द्वारा लगाया गया था ।

3. वर्तमान जांच कम्पैक्ट फ्लोरेसेंट लैम्प्स के निर्यात के संबंध में मै० ओसराम चाईना लाइटिंग लि० , चीन जनवादी गणराज्य द्वारा यथासंशोधित सीमाशुल्क टैरिफ अधिनियम, 1975 के अनुसार दायर आवेदन पत्र से संबंधित है ।

4. सीमाशुल्क टैरिफ (संशोधन) अधिनियम, 1995 और उसके अंतर्गत बनाए गए नियमों में यह अपेक्षित है कि प्राधिकारी प्रश्नाचीन निर्यातक देश के किसी निर्यातक या उत्पादक जिसने चीन जनवादी गणराज्य से कम्पैक्ट फ्लोरेसेंट लैम्प्स के आयातों से संबंधित पाटनरोधी जांच के पूर्ववर्ती मामले की जांच अवधि के दौरान संबद्ध वस्तुओं का भारत को निर्यात नहीं किया है, के लिए अलग-अलग पाटन मार्जिन निर्धारित करने के प्रयोजनार्थ समीक्षा करें और आवेदक ने यह घोषणा की है कि वह निर्यातक देश के किसी भी निर्यातक और उत्पादक जिन पर पाटनरोधी शुल्क लग रहा है, से संबंधित नहीं है ।
1 5. प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अंतर्गत विनिर्दिष्ट शर्तों से प्रथम दृष्ट्या संतुष्ट होने पर और दिनांक 10.12.2002 की अधिसूवना सं० 138/ 2002 - सीमाशुल्क को ध्यान में रखते हुए प्राधिकारी द्वारा दिनांक 14 नवंबर, 2002 की अधिसूचना सं0 34/1 / 2001 - डी जी ए डी द्वारा की गयी सिफारिशों के अनुसरण में केन्द्र सरकार द्वारा लगाए गए पाटनरोधी शुल्क की समीक्षा करने का निर्णय करते हैं जैसा कि मै० ओसराम चाईना लाइटिंग लि०, चीन जनवादी गणराज्य द्वारा अनुरोध किया गया है। 6. न्यू शिपर समीक्षा शुरू करने का निर्णय करने के पश्चात दिनांक 14 नवंबर, 2002 की अधिसूचना सं0 34/1 /2001-ड़ी जी ए डी के द्वारा अधिसूचित अंतिम जांच परिणामों की चीन जनवादी गणराज्य से कम्पैक्ट फ्लोरेसेंट लैम्प्स के आयात के संबंध में समीक्षा करने की जरूरत है । प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अनुसार मै० ओसराम चाईना लाइटिंग लि०, चीन जनवादी गणराज्य के संबंध में पृथक पाटन मार्जिन का निर्धारण करने के लिए एतद्वारा जांच शुरू करते हैं ।
7. प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अनुसार और दिनांक 10.12.2002 की अधिसूचना सं 0 138 / 2002- सीमाशुल्क को ध्यान में रखते हुए इस समीक्षा के पूरा होने तक मै ० ओसराम चाईना लाइटिंग लि० , चीन जनवादी गणराज्य द्वारा किए गए कम्पैक्ट फ्लोरेसेंट लैम्प्स के सभी निर्यातों से सबंधित अनंतिम मूल्यांकन करने की अनुशंसा करते हैं ।
जांच की अवधिः
8. वर्तमान जांच के प्रयोजनार्थ जांच की अवधि 1 जनवरी, 2005 से 30 जून, 2005 (6 महीने ) तक की है । i

सूचना प्रस्तुत करनाः
9. हितबद्ध पक्षकारों को अलग से सूचित किया जा रहा है ताकि वे निर्धारित विधि और पद्धति से संगत सूचना को प्रस्तुत करें और अपने विचारों से निर्दिष्ट प्राधिकारी, पाटनरोधी एवं संबद्ध शुल्क महानिदेशालय, वाणिज्य विभाग, वाणिज्य एवं उद्योग मंत्रालय, भारत सरकार, उद्योग भवन, नई दिल्ली- 110011 को अवगत करायें । अन्य कोई हितबद्ध पक्षकार भी जांच से संबंधित अपने निवेदन निम्नानुसार निर्धारित समय- सीमा के भीतर निर्धारित विधि और पद्धति में कर सकता है ।
समय-सीमा
10. इस समीक्षा से संबंधित सभी सूचनाएं लिखित रूप में भेजी जाएं जो उपर्युक्त पते पर निर्दिष्ट प्राधिकारी के पास जांच अवधि पूरी होने की तारीख से चालीस दिनों के भीतर पहुँच जानी चाहिए । यदि निर्धारित समय- सीमा के भीतर कोई सूचना प्राप्त नहीं होती है अथवा प्राप्त सूचना अधूरी है तो प्राधिकारी उनके समक्ष उपलब्ध तथ्यों के आधार पर उपर्युक्त नियमों के अनुसार अपने जांच परिणाम दर्ज कर सकते हैं ।
सार्वजनिक फाइल का निरीक्षणः
11. पाटनरोधी नियमावली के नियम 6 (7) के अनुसार कोई भी हितबद्ध पक्षकार उस सार्वजनिक फाइल का निरीक्षण कर सकता है जिसमें अन्य हितबद्ध पक्षकारों द्वारा प्रस्तुत किए गए साक्ष्यों के अगोपनीय अंश रखे गए हैं ।
12. सभी हितबद्ध पक्षकार नियम 7 (2) के अनुसार उपर्युक्त नियमावली के नियम 7 (1 ) के अनुसार उपलब्ध करायी गयी गोपनीय सूचना के लिए गोपनीय सारांश उपलब्ध कराएंगे ।
13. यदि कोई हितबद्ध पार्टी आवश्यक सूचना जुटाने से मना करती है या उचित समय के भीतर उसे अन्यथा उपलब्ध नहीं कराती है या महत्त्वपूर्ण ढंग से जांच में बाधा डालती है तो प्राधिकारी अपने पास उपलब्ध तथ्यों के आधार पर अपने निष्कर्ष दर्ज कर सकते हैं तथा केन्द्रीय सरकार को यथोचित सिफारिशें कर सकते हैं ।

INITIATION NOTIFICATION
New Delhi , the 15th February , 2005
Subject :-Initiation of New Shipper Review (under Rule 22) of Anti - Dumping duty imposed on imports of Compact Fluorescent Lamps ( CFL ) originating in/ or exported from China PR.
No. 15 / 27 / 2004 - DGAD.- M/ s . Osram China Lighting Limited , China PR has filed an application in accordance with the Customs Tariff Act , 1975 as THE GAZETTE OF INDIA: EXTRAORDINARY
[PART I- SEC . 1 ] amended and Customs Tariff (Identification , Assessment and Collection of Anti -Dumping duty on Dumped Articles and for Determination of Injury) Rules , 1995 before the Designated Authority (hereinafter referred to as the Authority) requesting for a review of the Anti - Dumping duty recommended by the Designated Authority on exports of Compact Fluorescent Lamps (CFL) (hereinafter referred to as subject goods) from China PR in the case of Anti-Dumping investigation where Government had notified the Anti- Dumping duty vide Notification No. 138 / 2001- Customs dated 10.12.2002 falling under Chapter 69 of Customs Tariff Act.
2. The Authority had notified the preliminary findings concerning import of Compact Fluorescent Lamps from China PR vide Notification No. 34/1/2001 - DGAD dated 2nd November 2001 and provisional Anti - Dumping duty was imposed by the Central Government vide Notification No. 128/ 2001- Customs dated 21.12.2001 . Final finding were issued vide Notification No. 34/ 1 / 2001 -DGAD dated 14th November , 2002 and definitive duty was imposed vide Notification No. 138 / 2002- Customs dated 10.12.2002 .
EXPORTER INVOLVED :
3. The present investigations relate to an application filed concerning export of Compact Fluorescent Lamps by M / s . Osram China Lighting Limited , China PR in accordance with the Customs Tariff Act, 1975 as amended.
INITIATION OF REVIEW IN RESPECT OF NEW EXPORTER :
4. The Customs Tariff (Amendment) Act, 1995 and the Rules made there under require the Authority to review for the purpose of determining individual margin of dumping for any exporter or producer in the exporting country in question who had not exported the subject goods to India during the period of investigation of the earlier case of Anti - Dumping investigation concerning imports of Compact Fluorescent Lamps from China PR and applicant has given declaration that he is not related to any of the exporters and producers in the exporting country who are subjected to anti - dumping duty.
5. The Authority having been prima facie satisfied with the conditions as prescribed under Rule 22 of Anti - Dumping Rules , decides to review the Anti- Dumping duty imposed by the Central Government in pursuance to the recommendations made by the Authority vide Notification No. 34/1 /2001- DGAD dated 14th November 2002 , and having regard to Notification No. 138 /2002 - Customs dated 10.12.2002, as requestedby M/ s . Osram China Tighting Limited, China PR.

6. Having decided to initiate New Shipper review the final findings notified vide Notification No. 34/ 1 / 2001 - DGAD dated 14th November 2002 needs to be reviewed with regard to import of Compact Fluorescent Lamps from China PR, the Authority hereby initiates investigations to determine separate dumping margin in respect of M/ s . Osram China Lighting Limited, China PR in accordance with Rule 22 of the AD Rules .
7. The Authority recommends provisional assessment on all exports of Compact Fluorescent Lamps made by M/ s . Osram China Lighting Limited, China PR , till this review is completed , in accordance with the Rule 22 of the AD Rules and having regard to Notification No. 138 / 2002- Customs dated 10.12.2002.
PERIOD OF INVESTIGATION :
8. The period of investigation for the purpose of the present review is 1st January 2005 to 30th June 2005 (6 months) .
SUBMISSION OF INFORMATION :
9. The interested parties are being informed separately to enable them to submit relevant information in the form and manner prescribed and to make their views known to the Designated Authority , Directorate General of Anti- Dumping & Allied Duties , Department of Commerce , Ministry of Commerce and Industry, Government of India , Udyog Bhavan , New Delhi - 110011. Any other interested party may also make its submissions relevant to the investigation to the above Authority in the prescribed form and manner within the time limit set out below .
TIME LIMIT :
10. All information relating to this review should be sent in writing so as to reach the Authority at the above address not later than forty days from the date of completion of period of investigation. If no information is received within the prescribed time limit or the information received is incomplete , the Authority may record its findings on the basis of the facts available before the Authority in accordance with the Rules Supra .
INSPECTION OF PUBLIC FILE :
11. In terms of Rule 6 (7) of Anti - Dumping Rules , any interested party may inspect the public file containing non- confidential version of the evidence submitted by other interested parties .

[PART I-SEC . 1 ] 12. All interested parties shall provide a Confidential Summary in terms of Rule 7 (2) , for the Confidential information provided as per Rule 7 (1 ) of the rules Supra .
13. In case where as interested party refuses access to , or otherwise does not provide necessary information within a reasonable period , or significantly impedes the investigation , the Authority may record its findings on the basis of the facts available to it and such recommendations to the Central Government as deemed fit .
