सा.का.नि. 79( अ ).-ओषधि और प्रसाधन सामग्री नियम, 1945 का संशोधन करने के लिए कतिपय नियमों का प्रारूप, ओषधि और प्रसाधन सामग्री अधिनियम, 1940 (1940 का 23) की धारा 33 ढ की अपेक्षानुसार भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय की अधिसूचना सं० सा.का. नि. 652(अ ), तारीख 30 सितम्बर, 2004 के अधीन भारत के राजपत्र, भाग 2, खंड 3 , उपखंड (i) तारीख 30 सितम्बर, 2004 में प्रकाशित किया गया था जिसमें ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, आक्षेप और सुझाव मांगे गए थे और यह सूचना दी गई थी कि उक्त प्रारूप पर, उस तारीख से जिसको भारत के उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थी, 30 दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;
और उक्त राजपत्र अधिसूचना जनता को 30 सितम्बर, 2004 को उपलब्ध करा दी गई थी ; और उक्त प्रारूप नियमों पर जनता से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं ;
अतः अब केन्द्रीय सरकार, उक्त अधिनियम की धारा 33 - ढ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , आयुर्वेद, सिद्ध, यूनानी ओषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात्, ओषधि और प्रसाधन सामग्री नियम, 1945 में निम्नलिखित और संशोधन करती है, अर्थात :-
1. ( i ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( तृतीय संशोधन) नियम, 2005 है ।
(ii) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. ओषधि और प्रसाधन सामग्री नियम , 1945 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 153 में, -
( i) " साठ रुपये फीस" शब्दों के स्थान पर, "एक हजार रुपये फीस" शब्द रखे जाएंगे ।
(ii ) "ऐसी अनुज्ञप्ति के नवीकरण के लिए संदेय फीस साठ रुपये तथा अतिरिक्त फीस तीस रुपये होगी" शब्दों के स्थान पर, "ऐसी अनुज्ञप्ति के नवीकरण के लिए संदेय फीस एक हजार और दो सौ रुपये तथा अतिरिक्त फीस छह सौ रुपये होगी" शब्द रखे जाएंगे ।
( iii ) " पन्द्रह रुपये फीस " शब्दों के स्थान पर, "तीन सौ रुपये फीस " शब्द रखे जाएंगे ।
3. उक्त नियमों के नियम 153 - क में-
(i ) "तीस रुपये फीस " शब्दों के स्थान पर "छह सौ रुपये फीस " शब्द रखे जाएंगे ।
(ii ) स्पष्टीकरण के अधीन " ऐसी अनुज्ञप्ति के नवीकरण के लिए संदेय फीस तीस रुपये तथा अतिरिक्त फीस पन्द्रह रुपये " शब्दों के स्थान पर " ऐसी अनुज्ञप्ति के नवीकरण के लिए संदेय फीस छह सौ रुपये :तथा अतिरक्त फीस तीन सौ रुपये" शब्द रखे जाएंगे ।
(iii) स्पष्टीकरण (ii) के अधीन " पन्द्रह रुपये फीस" शब्दों के स्थान पर " तीन सौ रुपये फीस" शब्द रखे जाएंगे ।
4. उक्त नियमों के नियम 156 में
(i ) "उस वर्ष के, जिसमें वह दी गई है या उसका नवीकरण किया गया है , आगामी वर्ष के 31 दिसंबर तक विधि मान्य होगी" शब्दों और अंकों के स्थान पर " उस तारीख से जिसको यह जारी की है, तीन वर्ष की अवधि के लिए विधि मान्य होगी " शब्द रखे जाएंगे ।
(ii) " अतरिक्त फीस तीस रुपये" शब्दों के स्थान पर, " अतिरिक्त फीस पांच सौ रुपये" शब्द रखे जाएंगे ।
5. उक्त नियमों के नियम 156-क में : -
" उस वर्ष के, जिसमें वह दी गई है या नवीकरण किया गया है , आगामी वर्ष के 31 दिसंबर तक विधि मान्य होगी" शब्दों और अंकों के स्थान पर, " उस तारीख से जिसको यह जारी की है, तीन वर्ष की अवधि के लिए विधि मान्य होगी " शब्द रखे जाएंगे ।

New Delhi , the 14th February, 2005
G.S.R. 79 (E) . Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 were published as required by Section 33N of the Drugs and Cosmetics Act, 1940 (23 of 1940) in the notification of the Government of India in the Ministry of Health and Family Welfare No. GSR 652 (E) , dated the 30th September, 2004 in theGazette of India Extraordinary , Part - II, Section 3 , Sub - section( i) dated the 30th September , 2004 inviting objections and suggestions from all persons likely to be affected thereby and notice was given that the said draft will be taken into consideration after the cxpiry of a period of 30 days from the date vin which copies of the Official Gazette containing the said notification were made available to the public;
And, whereas the said Gazette Notification was made available to the public on the 30th September, 2004;
And, whereas no objections and suggestions have been received from the public on the said draft rules;
Now, therefore, in exercise of the powers conferred by section 33 -N of the said Act, the Central Government , after consultation with the Ayurvedic, Siddha and Unani Drugs Technical Advisory Board , hereby makes the following further amendment in the Drugs and Cosmetics Rules , namely: -
1. 1.( i) These rules may be called the Drugs and Cosmetics (3rd Amendment) Rules , 2005.
(ii) They shall come into force on the date of final publication in the Official Gazette.
2. In the Drugs and Cosmetics Rules 1945 , ( herein after referred to as the said rules) , in Rule 153, -
(1) For the words " a fee of rupees sixty" , the words " a fee of rupees one thousand" shall be substituted.
(ii) (ii) For the words " the fee payable for renewal of such license shall be rupees sixty plus an additional fee of rupees thirty " the words "the fee payable for renewal of such license shall be rupees one thousand and two hundred plus an additional fee of rupees six hundred" shall be substituted.
(iii) For the words " a fee of rupees fifteen" the words " a fee of rupees three hundred" shall be substituted.
3. In Rule 153-A of the said rules: -
(i) For the words " a fee of rupees thirty" , the words " a fee of rupees six hundred" shall be substituted.

(ii) Under explanation for the words "the fee payable for renewal of such license shall be rupees thirty plus an additional fee of rupees fifteen " the words "the fee payable for renewal of such license shall be rupees six hundred plus an additional fee of rupees three hundred" shall be substituted.
(iii) Under explanation (ii) for the words " A fee of rupees seven and paise fifty " the words " A fee of rupees one hundred and fifty " shall be substituted.
4. In Rule 156 of the said rules : -
(i) For the words, figures and letter, " valid upto the 31 December of the year following the year in which it is granted " , the words " valid for a period of three years from the date of its issue " shall be substituted:
(!!) For the words " additional fee of rupees thirty " the words " additional fee of rupees five hundred" shall be substituted.
5. In Rule 156A of the said rules : -
For the words , figure and letter "valid upto the 31 December of the year following the year in which it is granted" the words " valid for a period of three years from the date of its issue " , shall be substituted.
