1 का.आ. 236( अ ).-केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा उक की उपधारा ( 1 ) के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का. आ. 993 (अ ) तारीख 2 सितम्बर, 2004 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है ) , जो भारत के राजपत्र, असाधारण, भाग- II , खंड-3 , उपखंड ( ii ) , तारीख 2 सितम्बर, 2004 को प्रकाशित की गई थी, द्वारा आन्ध्र प्रदेश राज्य के प्रकाशम जिले के राष्ट्रीय राजमार्ग सं. 5 के 237/000 कि.मी. से 274/000 कि.मी. (चेन्नई- विजयवाड़ा सैक्शन ) तक के भूखंड पर सिंगारायकोंडा गांव बाईपास सड़क बिछाने के लोक प्रयोजन के लिए उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी;

और उक्त अधिसूचना का सार " ईनाडू" तारीख 11 अक्तूबर, 2004 और " दि न्यूइंडियन एक्सप्रेस " तारीख 12 अक्तूबर, 2004 में प्रकाशित किया गया था;

और आक्षेप प्राप्त कर लिए गए हैं और सक्षम प्राधिकारी द्वारा उन पर विचार कर लिया गया है तथा तारीख 20 नवम्बर , 2004 के अपने आदेश द्वारा उनका निपटान कर दिया गया है ;

और, सक्षम अधिकारी ने उक्त अधिनियम की धारा उष की उपधारा ( 1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;

अतः अब केन्द्रीय सरकार, उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा उघ की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध उक्त अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जानी है;

और अब, केन्द्रीय सरकार उक्त अधिनियम की धारा उघ की उपधारा ( 2 ) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर इससे उपाबद्ध उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त आत्यन्तिक रूप से केन्द्रीय सरकार में निहित होगी।

NOTIFICATION

New Delhi , the 16th February, 2005.

S.O. 236 (E) . Whereas , by the notification of the Government of India in the erstwhile Ministry of Road Transport and Highways , number S.O. 993 (E ) , dated the 2nd September, 2004 (hereinafter referred to as the said notification) issued under sub - section (1 ) of Section 3 A of the National Highways Act , 1956 (48 of 1956) (hereinafter referred to as the saidAct) and published in Part - II , Section -3 , sub -section ( ii ) of the Gazette of India, Extraordinary, dated the 2nd September, 2004 , the Central Government declared its intention to acquire the land specified in the Schedule appended to the said notification for the public purpose of laying bypass road to Singarayakonda Village of Highways No. 5 of the stretch from Km . 237/000 to Km. 274/000 ( Chennai - Vijayawada Section ) in Prakasam District, in the State of Andhra Pradesh;

And whereas the substance of the said notification has been published in " Eenadu " dated the 11th October , 2004 and" The New Indian Express " dated the 12th October , 2004;

And whereas objections have been received and the same have been considered and disposed by the competent authority in his order dated the 20th November, 2004;

And whereas, in pursuance of sub - section ( 1) of Section 3D of the said Act, the competent authority has submitted its report to the Central Government ;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub - section (1 ) of Section 3D of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto is to be acquired for the aforesaid purpose;

And further, in pursuance of sub - section ( 2) of Section 3 D of the said Act , the Central Government hereby declares that on the publication of this notification in the Official Gazette, the land specified in the said Schedule annexed hereto, shall vest absolutely in the Central Government free from all encumbrances .
