का.आ. 238( अ ). कृषि और प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण अधिनियम, 1985 ( 1986 का 2 ) की धारा 32 की उपधारा ( 2 ) के खंड ( च ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार एतद्वारा कृषि और प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण नियम , 1986 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: -
1. ( 1 ) इन नियमों को कृषि और प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण ( संशोधन) नियम, 2004 कहा जाएगा । (2) वे शासकीय राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. कृषि और प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण नियम, 1986 में नियम 9 में उप- नियम ( 2 ) के स्थान पर निम्नलिखित उप- नियम प्रतिस्थापित किया जाएगा, अर्थात्: -
" ( 2 ) निर्यातक के रूप में रजिस्ट्रीकरण के लिए प्रत्येक आवेदन - पत्र के साथ रजिस्ट्रीकरण प्रमाणपत्र जारी किए जाने के लिए 5,000 रुपये कीफीस भी देनी होगी :
परन्तु यह कि उन निर्यातकों के लिए, जिनका रजिस्ट्रीकृत कार्यालय जम्मू तथा कश्मीर और असम, मेघालय , मणिपुर, नागालैंड, त्रिपुरा, मिजोरम, अरुणाचल प्रदेश और सिक्किम जैसे पूर्वोत्तर राज्यों में है और उन्हीं राज्यों से चला रहे हैं , आवेदन- पत्रों के साथ रजिस्ट्रीकरण प्रमाण पत्र जारी करने के लिए केवल 1,000 रुपए की फीस होगी , यदि ऐसे निर्यातक इस अधिसूचना के प्रकाशन की तारीख के दो वर्षों के भीतर आवेदन करें" ।

NOTIFICATION
New Delhi, the 22nd February, 2005
S.O. 238 ( E) . In exercise of the powers conferred by clause (f) of Sub - section ( 2) of Section 32 ofthe Agricultural and Processed Food Products Export Development Authority Act , 1985 (2 of 1986) , the Central Government hereby makes the following rules further to amend the Agricultural and Processed Food Products Export Development Authority Rules , 1986 , namely:-
1.( 1) These rules may be called the Agricultural and Processed Food Products Export Development Authority (Amendment ) Rules, 2004 .
(2)They shall come into force on the date of their publication in the Official Gazette.
2. In the Agricultural and Processed Food Products Export Development Authority Rules , 1986 , in rule 9 , for sub- rule(2), the following sub - rule shall be substituted, namely:--
" (2) Every application for registration as an exporter shall also be accompanied by a fee of Rs . 5,000 for issue of aregistration certificate:
Provided that for exporters. having their registered office in the States of Jammu & Kashmir and North Eastern States ofAssam , Meghalaya , Manipur, Nagaland, Tripura, Mizoram , Arunachal Pradesh and Sikkim , who are operating from these States, their applications shall be accompanied by a fee of Rs . 1,000 only for issue of the registration certificate , in case such exporters apply within two years from the date of publication of this notification."
