सा.का.नि. 103( अ ), केन्द्रीय सरकार, बैंकों और वित्तीय संस्थाओं को शोध्य ऋण वसूली अधिनियम , 1993 ( 1993 का 51 ) की धारा 36 की उपधारा ( 2 ) के खण्ड ( ङ) के साथ पठित धारा १ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ऋण वसूली अपील अधिकरण (अपील अधिकरण के पीठासीन अधिकारी नियुक्ति प्रक्रिया ) नियम, 1998 का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम ऋण वसूली अपील अधिकरण ( अपील प्राधिकरण के अध्यक्ष के रूप में नियुक्ति के लिए प्रक्रिया) संशोधन नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. ऋण वसूली अपील अधिकरण (अपील प्राधिकरण के पीठासीन अधिकारी नियुक्ति प्रक्रिया ) नियम, 1998 के नियम 3 में , उप- नियम ( 1 ) में खण्ड (v ) के लिए, निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा, अर्थात्: -
" (v ) सचिव, जिनकी अनुपस्थिति में विशेष सचिव, दोनों की अनुपस्थिति में अपर सचिव , वित्त मंत्रालय, आर्थिक कार्य विभाग , बैंकिंग प्रभाग। "

NOTIFICATION
New Delhi , the 25th February , 2005 G.S.R. 103 (E) .--In exercise of the powers conferred by Section 9 read with clause (e) of Sub -section (2) of section 36 of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993 (51 of 1993) , the Central Government hereby makes the following rules further to amend the Debts Recovery Appellate Tribunals (Procedure forAppointment as Chairperson of the Appellate Tribunal ) Rules, 1998, namely:---
1.(1) These rules may be called the Debts Recovery Appellate Tribunals (Procedure for Appointment as Chairperson of the Appellate Tribunal) (Amendment)Rules, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 3 of the Debts Recovery Appellate Tribunals (Procedure for appointment as Chairperson on theAppellate Tribunal ) Rules 1998 , in Sub -rule (1) , for clause (v) , the following clause shall be substituted, namely:-
"(v) The Secretary , in the absence ofwhom Special Secretary , in the absence of both , the Additional Secretary , Ministry of Finance , Department of Economic Affairs , Banking Division."
