का.आ. 259 (अ) .- केन्द्रीय सरकार ने पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन ) अधिनियम , 1962 , (1962 का 50 ) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 की उपधारा (1 ) के अधीन जारी भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का . आ . 2375 तारीख 16/09/2004 द्वारा , उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में गेल (इण्डिया ) लिमिटेड द्वारा आंन्ध्र प्रदेश राज्य में लिंगाला जी.जी.एस. ।। से के .के . जैन एवं मीना जैन इन्टरप्राइजेज पाइपलाइन परियोजना के माध्यम से पेट्रोलियम गैस के परिवहन के लिए पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;
गई थी; और उक्त राजपत्रित अधिसूचना की प्रतियाँ जनता को तारीख 22/11/2004 तक उपलब्ध करा दी और पाइपलाइन बिछाने के संबंध में जनता से प्राप्त आक्षेपों पर सक्षम प्राधिकारी द्वारा विचार कर लिया गया है और उन्हे अननुज्ञात कर दिया गया है;
और सक्षम प्राधिकारी ने , उक्त अधिनियम की धारा 6 की उपधारा (1 ) के अधीन केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है;
और केन्द्रीय सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइनें बिछाने के लिए अपेक्षित हैं , उस में उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है ;

[PART II-SEC . 3 (ii ) ] अतः, अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 6 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइनें बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है ;
और , केन्द्रीय सरकार , उक्त अधिनियम की धारा 6 की उपधारा (4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निर्देश देती है कि पाइपलाइनें बिछाने के लिए भूमि में उपयोग का अधिकार , इस घोषणा के प्रकाशन की तारीख को , केन्द्रीय सरकार में निहित होने की बजाए , पाइपलाइनें बिछाने का प्रस्ताव करने वाली गेल (इण्डिया ) लिमिटेड में निहित होगा और तदुपरि, भूमि में ऐसे उपयोग का अधिकार, इस प्रकार अधिरोपित निबंधनों और शर्तों के अधीन रहते हुए , सभी विल्लंगमों से मुक्त , गेल (इण्डिया) लिमिटेड में निहित होगा ।

NOTIFICATION
New Delhi , the 23rd February, 2005
S.O. 259 ( E) . Whereas by notification of the Government of India in the Ministry ofPetroleum and Natural Gas nurriber S.O. 2375 dated 16-09-04 issued under sub -section (1) of section 3 of the Petroleum and Minerals Pipelines ( Acquisition of Right of Users in Land) Act , 1962 ( 50 of 1962) ( hereinafter referred to as the said Act ) , the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transport of Natural Gas through Lingala GGS -II to M / s K.K. Jain & Meena Jain Enterprises pipeline project in the State of Andhra Pradesh by the GAIL ( India ) Limited ;
And whereas copies of the said Gazette notification were made available to the public on the 22/11/2004;
And whereas the objections received from the public to the laying of the pipeline havebeen considered and disallowed by the Competent Authority;
And whereas the Competent Authority has , under sub- section ( 1 ) of section 6 of the saidAct , submitted its report to the Central Government;
And whereas the Central Government has , after considering the said report , decided to acquire the Right of User in the lands specified in the Schedule;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 6 of the said Act, the Central Govemment hereby declares that the Right of User in the land specified in the Schedule is hereby acquired for laying the pipeline ;
And , further, in exercise of the powers conferred by sub- section (4) of section 6 of the said Act, the Central Government hereby directs that the Right of User in the said land for laying the pipeline shall , instead of vesting in the Central Government , vest, on this date of the publication of this declaration , in the GAIL ( India ) Limited , free from all encumbrances .
