सा.का.नि. 107( अ ) केन्द्रीय सरकार, वित्त अधिनियम, 1994(1994 का 32 ) की धारा 94 की उप- धारा ( 1 ) और उप- धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सेवा कर नियम, 1994 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम सेवा कर (तीसरा संशोधन) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. सेवा कर नियम, 1994 के नियम 4 में, उप- नियम ( 1 ) के तीसरे परन्तुक में , " 28 फरवरी , 2005 " अंकों और शब्द के स्थान पर " 31 मार्च, 2005" अंक और शब्द रखे जाएंगे ।

वि. शिवसुब्रमणियन, उप सचिव टिप्पणः- मूल नियम अधिसूचना सं० 2/94- सेवा कर, तारीख 28 जून, 1994 द्वारा अधिसूचित किए गए थे और भारत के राजपत्र, असाधारण में, सा.का.नि. 546(अ ), तारीख 28 जून, 1994 द्वारा प्रकाशित किए गए थे और उनमें अंतिम संशोधन अधिसूचना सं० 2/2005- सेवा कर, तारीख 14 फरवरी , 2005 द्वारा किया गया था जो सा.का.नि. 71 ( अ), तारीख 14 फरवरी, 2005 द्वारा प्रकाशित की गई थी ।

New Delhi , the 26th February , 2005
No. 3/2005-Service Tax
G.S.R. 107 (E) . In exercise of the powers conferred by Sub - sections ( 1 ) and ( 2) of Section 94 of the Finance Act, 1994 (32 of 1994) , the Central Government hereby makes the following rules further to amend the Service Tax Rules, 1994, namely:--
1.(1) These rules may be called the Service Tax(Third Amendment)Rules, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 4 of the Service Tax Rules, 1994, in sub -rule (1), in third proviso , for the figures , letters and words " 28th day of February, 2005", the figures, letters and words " 31st day ofMarch, 2005" shall be substituted.

Note: The principal rules were notified vide notification No. 2/94 - Service Tax, dated the 28th June , 1994 and published in the Gazette of India, Extraordinary vide number G.S.R. 546 (E), dated the 28th June 1994 and were last amended vide notification No. 2/2005- Service Tax, dated the 14th February, 2005 and published in the Gazette of India, Extraordinary vide number G.S.R. 71 (E ) , dated the 14th February, 2005.
