सा.का.नि. 154( अ ) संविधान के अनुच्छेद 309 के परंतुक में दी गई शक्तियो का प्रयोग करते हुए राष्ट्रपति भारतीय विदेश सेवा, शाखा 'ख' (भर्ती, कैडर, वरिष्ठता तथा पदोन्नति) नियम, 1964 में आगे संशोधन करने के लिए निम्नलिखित नियम बनातें हैं, यथा:-
1. (1) इन नियमों को भारतीय विदेश सेवा, शाखा' ख', (भर्ती, कैडर, वरिष्ठता तथा पदोन्नति)
(संशोधन) नियम, 2005 कहा जाएगा ।
(2) ये नियम सरकारी राजपत्र में प्रकाशित होने की तिथि से प्रभावी होंगे ।
2. भारतीय विदेश सेवा, शाखा 'ख ' ( भर्ती, कैडर, वरिष्ठता तथा पदोन्नति) नियम , 1964 में नियम 12 के उप- नियम (7) में ' योग्यता ' शब्द के स्थान पर 'चयन ' शब्द प्रतिस्थापित किया जाएगा ।

G.S.R. 154 (E)-In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules further to amend the Indian Foreign Service , Branch ' B ' , (Recruitment, Cadre, Seniority and Promotion) Rules , 1964 , namely: - [ भाग II- खण्ड 3 (i ) ]

1. (1) These rules may be called the Indian Foreign Service, Branch ' B ' , (Recruitment, Cadre, Seniority and Promotion) (Amendment ) Rules , 2005.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Indian Foreign Service , Branch ' B ' (Recruitment, Cadre, Seniority and Promotion) Rules, 1964 , in sub- rule (7) of rule 12, for the word " merit", the word " selection" shall be substituted.

सा.का.नि. 155( अ ) भारतीय विदेश सेवा, शाखा ' ख ' ( भर्ती, काडर, वरिष्ठता और पदोन्नति नियमावलि 1964 के नियम 12 के अनुपालन में, विदेश मंत्रालय , भारत सरकार भारतीय विदेश सेवा, शाखा ' ख ' (ग्रेड की पदोन्नति ) विनियम 1975 को और संशोधित करने के लिए निम्नलिखित विनियम बनाती है, यथा 1. (1 ) ये विनियम भारतीय विदेश सेवा शाखा 'ख' (ग्रेड में पदोन्नति) विनियम , 2005 कहे जाएंगे । (2) यह सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रभावी होंगे ।
2. भारतीय विदेश सेवा में शाखा ' ख ' (ग्रेड-1 की पदोन्नति) विनियम 1975, में विनियम 4,
(1 ) खंड (ख) के लिए निम्नलिखित को प्रतिस्थापित किया जाएगा, अर्थात
* निम्नलिखित ग्रेड के अधिकारियों के चयन के आधार पर चयन सूची में अधिकारी होंगे , अर्थात्
(i) सामान्य संवर्ग के एकीकृत ग्रेड ।। और !!!
(ii ) आशुलिपिक उप- संवर्ग के चयन ग्रेड
(iii) साइफर उप- संवर्ग के ग्रेड- ।
(2) खंड (च) के लिए , निम्नलिखित प्रतिस्थापित किया जाएगा यथा
' वरिष्ठ समिति चयन के लिए शामिल अधिकारियों को उनकी चरित्र पंजी/गोपनीय रिपोर्टों के आधार पर अच्छा के तलचिन्ह के अनुसार सामान्य संवर्ग के ग्रेड । की नियुक्ति हेतु उपयुक्त ' अथवा अनुपंयुक्त के रूप में अधिकारियों को वर्गीकृत करेगी ।
टिप्पणी : अनुसूचित जाति और अनुसूचित जन जाति के अधिकारियों के मामलों पर विचार करते हुए वरिष्ठ समिति कार्मिक एवं प्रशिक्षण विभाग द्वारा समय- समय पर जारी किए गए अनुदेशों का पालन करेगी । '
3. खंड (छ) के लिए निम्नलिखित प्रतिस्थापित होगा, अर्थात- चयन सूची में शामिल किए जाने वाले अधिकारियों के नाम पहले
(i) साइफर उप- संवर्ग के ग्रेड। के अधिकारियों के लिए और
(ii ) सामान्य संवर्ग के एकीकृत ग्रेड ॥ और ।।। और आशुलिपिक उप- संवर्ग के सेलेक्शन ग्रेड के अधिकारियों को अच्छा' के तल चिन्ह के अनुसार उपयुक्त के रुप में वर्गीकृत किए अनुसार भिन्न सूचियों में व्यवस्थित किए जाएगे । चयनित अधिकारियों के नाम तव आयोग के परामर्श के अनुसार यह निश्चय करके कि कोई दमन न हो, एक मिश्रित सूची में दो वर्गों में रखे जाएंगे '

5 टिप्पणी:- प्रमुख विनियम दिनांक 1 मार्च, 1975 की अधिसूचना सं ० क्यू(जी ए) 792/2/72 के अनुसार भारत के राजपत्र में प्रकाशित किए गए थे और अभी तक संशोधित नहीं किए गए हैं ।
NOTIFICATION
NewDelhi , the 3rd March, 2005
G.S.R. 155(E). In pursuance of Rule 12 of the Indian Foreign Service, Branch 'B' , (Recruitment, Cadre, Seniority and Promotion) Rules , 1964, the Government of India in the Ministry of External Affairs hereby makes the following regulations further to amend the Indian Foreign Service , Branch ' B ' (Promotion to Grade I) Regulations , 1975, namely: -
1. (1) These regulations may be called the Indian Foreign Service , Branch 'B' (Promotion to Grade- I) Regulations , 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Inthe Indian Foreign Service , Branch ' B ' (Promotion to Grade I ) Regulations , 1975 , in regulation 4,
(1) for clause (b) , following shall be substituted, namely: -
"The Select List shall consist of officers on the basis of selection from amongst the officers of the following Grades , namely: -
(i) Integrated Grades II and III of General Cadre
(ii) Selection Grade of the Stenographers Sub-Cadre
(iii) Grade I ofthe Cypher Sub -Cadre "
(2) for clause ( f) , following shall be substituted, namely: -
"The Senior Committee shall classify officers included in the field of selection as ' fit ' or ' unfit' for appointment to Grade I of the General Cadre with reference to the benchmark of ' Good ' on the basis of their Character Rolls /Confidential Reports
Note: While considering the cases of officers belonging to the Scheduled Castes and Scheduled Tribes , the Senior Committee shall be guided by such instructions as may be issued from time to time by the Department of Personnel and Training."
(3) for clause (g) , following shall be substituted, namely: -
"The names of the officers selected for inclusion in the Select List shall first be arranged in separate lists for ( i) for officers of Grade I of the Cypher Sub -Cadre and ( ii ) officers of the Integrated Grades II and III [PART II-SEC. 3(i))

of the General Cadre and the Selection Grade of the Stenographers ' Sub-Cadre on the basis of their being classified as ' fit ' with reference to the benchmark of ' Good ' . The names of selected officers in the two categories shall then be placed in a combined list, in accordance with the advice of the Commission, ensuring that there is no supersession. "
