फा. सं. 6-6/2005 बी एंड सी एस.- भारतीय दूरसंचार विनियामक प्राधिकरण अधिनियम, 1997 की धारा 11 की उपधारा 1 ( बी) के खण्ड ( iv ) , ( vii ) तथा ( viii ) के साथ पठित धारा 36 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय दूरसंचार विनियामक प्राधिकरण एतद्द्वारा निम्नलिखित विनियम बनाता है :
1. संक्षिप्त नाम, विस्तार तथा प्रारंभ
( i ) इस विनियम का नाम अन्तरसंयोजन करार रजिस्टर ( प्रसारण तथा केबल सेवाएं ) ( पहला संशोधन ) विनियम , 2005 ( 2005 का 4 ) होगा ।
( ii ) यह विनियम सरकारी राजपत्र में इसके प्रकाशन की तिथि से लागू होगा ।
2. रजिस्टर के गोपनीय भाग के संबंध में अन्तः संयोजन करार रजिस्टर ( प्रसारण तथा केबल सेवाएं ) विनियम , 2004 के विनियम 4 से संबंधित प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि को प्रतिस्थापित किया जाएगा :
" जहां अन्तरसंयोजन करार करने वाली कोई पार्टी, प्राधिकरण से करार को पूर्णतः अथवा उसके किसी भाग को गोपनीय रखने का अनुरोध करती है, वहां प्राधिकरण , भारतीय दूरसंचार विनियामक प्राधिकरण ( सूचना की प्राप्ति ) विनियम, 2005 के संगत प्रावधानों के अनुसार निर्णय लेगा। " 3. व्याख्यात्मक ज्ञापन
एक व्याख्यात्मक ज्ञापन, जिसमें इस विनियम की पृष्ठभूमि दी गई है, अनुबंध के रूप में संलग्न है ।

व्याख्यात्मक ज्ञापन
भारतीय दूरसंचार विनियामक प्रधिकरण ने इसे प्रदान की गई सूचना की गोपनीयता के बारे में एक व्यापक विनियम बनाया है इसलिए दूरसंचार ( प्रसारण तथा केबल सेवाएं ) अन्तरसंयोजन विनियम, 2004 ( 2004 का 13 ) में इसी प्रकार के प्रावधानों को रखने की कोई आवश्यकता नहींहै और इसलिए संगत प्रावधान संशोधित कर दिए गए हैं ।

No. 6-6/2005-B& CS. In exercise of powers conferred by Section 36 read with clauses ( iv) , (vii ) and ( viii) of Sub- section 1(b) of Section 11 of theTelecom Regulatory Authority of India Act , 1997, the Telecom Regulatory Authority of India hereby makes the following regulation, namely :
1. Short title , extent and commencement
(i ) This regulation shall be called The Register of Interconnect Agreement (Boardcasting and Cable Services) (First Amendment) Regulation, 2005 (4 of2005).
(ii) It shall come into force from the date of its publication in the Official Gazette .
2. The following entries shall substitute the entries relating to regulation 4 of The Register of Interconnect Agreement (Broadcasting and Cable Services ) Regulation, 2004 dealing with confidential portion of the register-- "Where any party to an Interconnect Agreement requests the Authority to keep the whole or any part of the agreement as confidential , the Authority shall take a decision thereon in accordance with the relevant provisions of The Telecom Regulatory Authority of India (Access to Information) Regulation, 2005" .

n explanatory memorandum dealing with the background of this regulation is annexed.

ExplanatoryMemorandum
Telecom Regulatory Authority of India has made a comprehensive Regulation on confidentiality of information provided to it, as such there is no necessity of having similar provisions in the Telecommunication (Broadcasting and Cable Services) Interconnection Regulation , 2004 ( 13 of 2004) and therefore the relevant provision have been amended.
