फा. सं. 16-6/2005-एफ.ए. भारतीय दूरसंचार विनियामक प्राधिकरण अधिनियम, 1997 की धारा 11 की उपधारा ( 1 ) के खण्ड (ख) के पैरा ( i ) के साथ पठित धारा 36 तथा भारतीय दूरसंचार विनियामक प्राधिकरण, सेवा प्रदाता ( खाता बहियों तथा अन्य दस्तावेजों का अनुरक्षण ) नियम, 2002 और उसके अन्तर्गत जारी आदेश/ अधिसूचना द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय दूरसंचार विनियामक प्राधिकरण एतद्द्वारा निम्नलिखित विनियम बनाता है :-
संक्षिप्तनाम, विस्तार और प्रारंभ:-
1. ( 1 ) इस विनियम का नाम" लेखांकन पृथक्करण पर रिपोर्टिंग पद्धति ( तीसरा संशोधन ) विनियम, 2005 ( 2005 का 6 ) " होगा। (2) यह विनियम सरकारी राजपत्र में इसके प्रकाशन की तारीख से लागू होगा ।
विनियम 7 को हटाना
2. लेखांकन पृथक्करण पर रिपोर्टिंग पद्धति विनियम, 2004 का विनियम 7 तथा उससे संबंधित प्रविष्टियां , जो गोपनीयता से संबंधित हैं, को एतद्वारा हटाया जाता है ।

गएहैं । 3. इस विनियम के अनुबंध में एक व्याख्यात्मक ज्ञापन दिया गया है, जिसमें इस विनियम को जारी करने की पृष्ठभूमि तथा कारण स्पष्ट किए

व्याख्यात्मक ज्ञापन
भारतीय दूरसंचार विनियामक प्राधिकरण ने इसे प्रदान की गई सूचना की गोपनीयता के बारे में एक व्यापक विनियम बनाया है इसलिए लेखांकन पृथक्करण पर रिपोर्टिंग पद्धति विनियम, 2004 में इसी प्रकार के प्रावधानों को रखने की कोई आवश्यकता नहीं है और इसलिए संगत प्रावधान हटादिए गए हैं ।

No. 16-6/2005-FA. In exercise of the powers conferred by Section 36 read with para (i) of clause (b ) of sub- section( 1 ) of Section 11 of the Telecom Regulatory Authority of India Act, 1997 and the Telecom Regulatory Authority of India, Service Providers ( Maintenance of Books ofAccounts and Other Documents) Rules , 2002, and the order/notification issued thereunder, the Telecom Regulatory Authority hereby makes the following regulation, namely :-
1. Short title, extent and commencement : ---
(i)ThisRegulation may be called " The Reporting System on Accounting Separation (Third Amendment ) Regulation, 2005" ( 6 of2005 ).
(ii) It shall come into force on the date of its publication in the Official Gazette.
Deletion of Regulation 7
2. Regulation 7 and the entries relating thereto of the Reporting System on Accounting Separation Regulation, 2004, dealing with confidentiality, are hereby deleted.
ExplanatoryMemorandum
3.This Regulation contains at Annexure an Explanatory Memorandum that explains the background and reasons for issuance this regulation.

ExplanatoryMemorandum
Telecom Regulatory Authority of India has made a comprehensive Regulation on confidentiality of information provided to it, as such there is no necessity of having similar provisions in the Reporting System on Accounting Separation Regulation, 2004, and therefore the relevant provision has been deleted.
