का.आ. 293 ( अ ) - केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय ( सड़क स्कन्ध) की अधिसूचना सख्यांक का.आ. 78 (अ) तारीख 4 फरवरी , 1999 द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्यांक 4 को 592.000 कि.मी से 834.000 कि.मी. (कर्नाटक/ महाराष्ट्र सीमा से पुणे) तक का भूखंड़ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था ;
अतः , अब, केंद्रीय सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग खंड और स्थायी पुल लोक- वित्तपोषित परियोजनाएं के उपयोग के लिए) नियम, 1997, के नियम 3,5 और 11 के और राष्ट्रीय राजमार्ग (फीस की दर) नियम , 1997, के नियम 3 के उपनियम (2 ) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह अधिसूचित करती है कि महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्यांक 4 के 725.000 कि.मी. से 772.000 कि.मी. तक के भूखंड के उपयोग के लिए भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय तौर पर, सीधे या प्रतिस्पर्द्धात्मक बोली लगाने के आधार पर, निजी ठेकेदार के माध्यम से केन्द्रीय सरकार की ओर से यांत्रिक यानों पर इससे संलग्न अनुसूची में विर्निदिष्ट दरों पर फीस उद्गृहीत और संगृहीत की जाएगी और इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख अथवा उक्त भूखंड को खोले जाने की तारीख , जो भी बाद में पड़े, से ऐसी फीस को संगृहीत करने के लिए भी भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को प्राधिकृत करती है । यह फीस शाश्वत आधार पर संगृहीत की जाएगी । फीस की दर राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के पुनरीक्षण के अध्यधीन होगी ।

महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं . 4 के 725.000 कि.मी. से 772.000 कि.मी. ( सतारा- खंडाला खंण्ड़) के चार लेन वाले भूखंड के उपयोक्ताओं से वसूल की जाने वाली फीस की दर :

टिप्पण: -
1. जब उसी यांत्रिक यान को एक दिन में एक से अधिक बार राष्ट्रीय राजमार्ग के उक्त भूखंड को पार करना है तो उपयोक्ता के पास यह विकल्प होगा कि वह पहली बार ही द्वार पार करते समय उपर अनुसूची में दी गई दरों पर अनेक बार यात्रा के लिए फीस का संदाय कर दे अथवा उसी यांत्रिक यान को संपूर्ण मास या उससे अधिक के लिए एक से अधिक बार उक्त भूखंड का प्रयोग करना पड़ता है तो यान का स्वामी पूर्वोक्त अनुसूची में यथा विनिर्दिष्ट उसको लागू एकल दरों के तीस गुणा के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
2. अनुसूची में उपर्युक्त विनिर्दिष्ट फीस से निम्नलिखित प्रकार के यानों को छूट प्राप्त होंगी , अर्थात: - ऐसे यान -
(i)
जो " अति महत्वपूर्ण व्यक्ति" प्रतीक, वाले अथवा शासकीय रूप से निम्नलिखित से संबंधित हैं : - (अ)
भारत के राष्ट्रपति,
(क)
भारत के उपराष्ट्रपतिः
(ख)
राज्य के राज्यपाल अथवा संघ राज्य क्षेत्र के उपराज्यपाल;
(ग)
भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(घ)
(ड)
" सी डी" या " सी सी" नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद या राज्य विधान सभा के अध्यक्ष या केंद्रीय अथवा राज्य मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधान- मंडलों के विपक्ष के नेता जिनकी प्रास्थिति कैबिनेट मंत्री की हो , जब वे यान में हों; अथवा 3

(छ) संसद सदस्य अथवा अपने -अपने राज्यों में राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद के सदस्य, यथास्थिति, यदि संसद अथवा राज्य के संबंधित विधान- मंडल , द्वारा जारी किए गए पहचान पत्र प्रस्तुत किए जाने पर ;
(आ) शौर्य पुरस्कारों जैसे परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र के विजेता से संबधित यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कारों के लिए संक्षम प्राधिकारी द्वारा सम्यक रूप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता हो;
(ii) रक्षा यान , पुलिस यान, अग्नि शमन यान, एम्बुलेंस , अन्त्येष्टि यान , डाक और तार विभाग के यान, केंद्रीय सरकार और राज्य सरकार के कार्यस्थ यान ।
3. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम, पता टेलीफोन संख्या, जिसे शिकायत , यदि कोई हो, संबोधित की जानी चाहिए , पथकर चौकी से 500 मो. आगे, पथकर चौकी से 100 मी . आगे और पथकर चौकी पर भी सहजदृश्य रूप से प्रमुख रूप से संप्रदर्शित किया जाएगा । संप्रर्दशन बोर्ड की ऊचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना सहज हो और इसे अंग्रेजी , हिंदी और उस क्षेत्र जिसमें उक्त भूखंड अवस्थित है, की प्रादेशिक भाषा में स्पष्ट रूप से लिख कर अथवा छपाई करके बोर्डों पर से संप्रदर्शित करना होगा । :
4. यह फीस 748.600 कि.मी पर पथकर चौकी पर ही संगृहीत की जाएगी

S.O. 293 (E) .- Whereas , vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 78 ( E) dated 4th February , 1999 issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) , the Central Government entrusted the stretch from km 592.000 to km 834.000 ( Karnataka / Maharashtra Border to Pune) of National Highway No. 4 in the State of Maharashtra to the National Highways Authority of India;
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act , 1956 ( 48 of 1956) , read with rules 3 , 5 and 11 of the National Highways (Fees for the Use of National Highways Section and Permanent Bridge Public Funded Projects) , Rules , 1997 , and sub - rule ( 2) of the rule 3 of the National Highways ( Rate of Fee) Rules , 1997 , the Central Government hereby notifies that there shall be levied and collected by the 4

PART II-SEC. 3(ii) ] National Highways Authority of India departmentally , through private contactor on the basis of competitive biding on behalf of the Central Government , a fee on mechanical vehicles for the use of the stretch from km 725.000 to km 772.000 of the National Highway No. 4 in the State of Maharashatra at the rates specified in the Schedule annexed hereto , and also authorises the National Highways Authority of India to collect such fee from the date of publication of this notification in the Official Gazette or date of opening of the said stretch to traffic whichever is later . The fee shall be collected in perpetuity. The rate of fee are subject to revision as per the National Highways ( Rate of fee ) Rules , 1997 .

Note : -
1 . When the same mechanical vehicle has to cross the said stretch of the National Highway more than once in a day , the user shall have the option to pay the fee for the multiple trips at the rates as given in the Schedule above while crossing the gate in the first trip itself, or if the same mechanical vehicle has to cross the said stretch continuously and frequently for the entire month or even beyond that , the owner of the vehicle may obtain a monthly pass on payment of charges equal to thirty times single rates applicable to it as specified in the aforesaid Schedule .

2 . The following types of vehicles shall be exempted from the fee specified above in the Schedule , namely : -
(i) Vehicles -
(A) having " VIP" symbols , or Officially belonging to -
(a) the President of India
(b) the Vice President of India ;
( c ) Governor of a state or Lt. Governor of a Union Territory ;
(d) a Foreign Dignitary on State visit to India :
(e) a Foreign Diplomat stationed in India using cars with " CD " or " CC " number plates : -
( f) Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislative Assembly or a Minister for the Union or State , or Leaders of Opposition in Lok Sabha or Rajya Sabha or State Legislatures , having the status of Cabinet Minister, if he is sitting in the vehicle ; or
:
(g) a Member of Parliament or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective States , if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be;
(B) belonging to winner of Gallantry awards such as Param Vir Chakra , Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award ;

(ii) Defence vehicles , Police vehicles , Fire-fighting vehicles , Ambulances , Funeral vans , vehicles of the Departments of Posts and Telegraphs and Central Government and State Government vehicles on duty .
3. The rates of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of the authority to whom complaints , if any, should be addressed, shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also . The height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English , Hindi and the regional language of the area in which the said stretch is situated .
4. The fees shall be collected at the toll booth at km 748.600 .
