सा.का.नि. 165(अ).-केन्द्रीय मोटर यान नियम , 1989 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप , मोटर यात्र अधिनियम , 1988 ( 1988 का 59 ) की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार, भारत के राजपत्र, असाधारण , भाग II, खंड 3 , उप-खंड ( i ), तारीख 25 जनवरी , 2005 में भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना सं. सा.का.नि. 41 ( अ ) , तारीख 25 जनवरी , 2005 द्वारा प्रकाशित किया गया था, जिसमें ऐसे सभी व्यक्तियों से जिनके उससे प्रभावित होने कीसंभावना थी, उस तारीख सेजिसको भारत के उस राजपत्र की प्रतियां, जिसमें यह अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं, तीस दिन की अवधि के भीतर आक्षेप या सुझाव आंमत्रित किए गए थे;
और उक्त राजपत्र की प्रतियां जनता को तारीख 27 जनवरी , 2005 को उपलब्ध करा दी गई थीं;
और उक्त प्रारूप नियम पर कोई आक्षेप या सुझाव प्राप्त नहीं हुए हैं;
अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 110 की उपधारा ( 1 ) के खंड ( छ ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय मोटर यात्र नियम, 1989 में निम्नलिखित और संशोधन करती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान नियम ( संशोधन) नियम , 2005 है ।
(2) ये राजपत्र की प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय मोटर यान नियम , 1989 के नियम 115क के उपनियम ( 5 ) में, टिप्पण 2 के स्थान पर, निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा, अर्थात्:-
:
" 2. उक्त सारणी के स्तम्भ ( 3 ) में उल्लिखित मान 1 अक्तूबर, 2005 से लागू होंगे ।" ।

NOTIFICATION
NewDelhi, the 9th March, 2005
G.S.R. 165 (E).-Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, were published as required by Sub -section ( 1 ) of Section 212 of the Motor Vehicles Act, 1988 (59 of 1988) in the Gazette of India, Extraordinary, Part- II , Section 3 , Sub -section (i ) , dated 25th January, 2005 vide notification ofGovernment of India in the Ministry of Shipping, Road Transport and Highways (Department ofRoad Transport and Highways ) , number G.S.R. 41 (E) , dated the 25th January, 2005, inviting objections or suggestions from all persons likely to be affected thereby within a periodofthirty days from the date on which copies of the Gazette of India, in which the said notification was published, were made available to the public;
And, whereas , the copies of the said Gazette were made available to the public on the 27th January, 2005 ;
Andwhereas no objections or suggestions have been received from the public in respect of the said draft rules ;
Now, therefore, in exercise of the powers conferredby clause (g) of Sub- section ( 1 ) of Section 110 of the said Act , the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989 , namely:-
1.(1) These rules may be called the Central Motor Vehicles (Amendment) Rules, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules , 1989 , in sub -rule (5) of rule 115A, for Note 2, the following Note shall be substituted, namely:-
"2. The norms mentioned in column (3 ) of the said Table shall be applicable with effect from 1st October , 2005." .

Note : The principai rules were notified in the Gazette of india vide G.S.R. 590 ( E ), dated 2nd June, 1989 and last amended vide G.S.R.686 (E), dated 20th October, 2004.
