सं. 20012/ 10 / 2003 - बी.सी.सी. जबकि भारत सरकार ने विद्यमान आरक्षण नीति के अंतर्गत न आने वाली आर्थिक रूप से पिछड़े वर्गों के लिए राज्य के अधीन सिविल पदों और सेवाओं में आरक्षण प्रदान करने के लिए इसे समीचीन समझा था।
2. और जबकि भारत सरकार इस विषय पर राज्य सरकारों/संघ राज्य क्षेत्रों और अन्य आयोगों के विचार प्राप्त करना भी आवश्यक समझती है;
3. और जबकि आर्थिक रूप से पिछड़े वर्गों की पहचान का आधार निर्धारित करने तथा उससे संबंधित आरक्षण के उपाय एवं प्रमात्रा सुझाने के लिए विस्तृत परीक्षण करना अपेक्षित होगा;
4. अतः भारत सरकार ने अब विद्यमान आरक्षण नीति के अंतर्गत न आने वाले आर्थिक रूप से पिछड़े वर्गों के लिए प्रस्तावित आरक्षण पर विचार करने के लिए आर्थिक रूप से पिछड़ा वर्ग आयोग को , उसका 5 जनवरी , 2005 को कार्यकाल समाप्त होने पर, जारी रखने का संकल्प लिया है । इसके विचारार्थ विषय निम्नलिखित हैं:
(क) इस विषय पर राज्य सरकारों/ संघ राज्य क्षेत्रों और अन्य के विचार प्राप्त करना;
(ख) आर्थिक रूप से पिछड़े वर्गों की पहचान के लिए मानदंड सुझाना;
(ग ) धार्मिक और भाषायी अल्पसंख्यकों के लिए राष्ट्रीय आयोग के साथ परामर्श करके कल्याणकारी उपायों तथा शिक्षा और सरकारी नौकरी में आरक्षण की प्रमात्रा की सिफारिश करना; और
(घ ) उनकी सिफारिशों के क्रियान्वयन के लिए यथापेक्षित आवश्यक संवैधानिक, कानूनी और प्रशासनिक क्रिया - विधियों का सुझाव देना । 5. इस आयोग में एक अध्यक्ष, एक सदस्य और एक सदस्य सचिव होंगे । वे विशेष योग्यता एवं सत्यनिष्ठा वाले सामाजिक रूप से प्रख्यात होंगे ।
6. आयोग अपनी स्वयं की कार्य- प्रणाली अपना सकता है तथा जब कभी आवश्यक हो, भारत के किसी भी भाग में निरीक्षण कर सकता है । 7. इस आयोग का मुख्यालय नई दिल्ली में होगा।
8. आयोग , आयोग के अध्यक्ष की नियुक्ति के 6 माह के भीतर अपने विचार-विमर्शों और सिफारिशों की रिपोर्ट प्रस्तुत करेगा ।

RESOLUTION
New Delhi , the 3rd March, 2005
No. 20012/10/2003- BCC.-Whereas the Government of India had considered it expedient to provide reservation in civilposts and services under the State for Economically Backward Classes (EBCs) not covered by the existing reservation policy.
2. And whereas the Government of India also consider it proper to elicit the views of State Governments/UTs and other Commissions on the subject ;
3. And whereas a detailed examination would be required to determine the basis for identification of Economically Backward Classes and suggest the measures and quantum of reservation thereto ;
4. Now, therefore , the Government of India has resolved to continue the Commission for Economically Backward Classes once its term expired on 5th January, 2005 to consider the proposed reservation for EBCs not covered under the existing Reservation Policy with the following terms of references:
(a) to elicit the views of State Governments/UTs and other Commissions on the subject;
(b) to suggest criteria for identification of economically backward classes ;
(c) to recommend the welfare incasures and quantum of reservation in education and Government Employment in consultation with the National Commission for Religious and Linguistic Minorities ;
(d) to suggest the necessary constitutional , legal and administrative modalities as required for the implementation of their recommendations .
5. The Commission shall consist of a Chairperson , one Member and one Member - Secretary. They shall be persons ofability, integrity and standing .
6. The Commission may adopt its own procedure of working and may visit any part of India as and when considered necessary .
7. The Head quarter of the Commission shall be in New Delhi .
8. The Commission will submit the report of its deliberations and recommendations within a period of 6 months ofthe appointment of the Chairperson of the Commission .
