नई दिल्ली, 9 मार्च, 2005
का.आ. 304(अ).-केन्द्रीय सरकार, वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 9 ए द्वारा प्रदत्त शीक्तयों का प्रयोग करते हुए एतद्वारा निदेश देती है कि दिनांक 5 जनवरी , 1988 की अधिसूचना संख्या का.आ. 988 में,
(
क) पैरा ( i ) को पैरा ( 1 ) के उप - पैरा ( i) के रूप में संख्यांकित किया जाए और इसके पश्चात् पैरा ( ii ) को उसके उप-पैरा ( ii ) के रूप में संख्यांकित किया जाए ।
(ख ) पैरा ( 1 ) के पश्चात् निम्नलिखित पैरा अंतः स्थापित किया जाए, नामशः:-
" (2) पैरा ( 1 ) में निहित प्रावधानों के होते हुए भी, बाधा सीमा अपेक्षाओं से संबंधित अंतर्राष्ट्रीय नागर विमानन , 1944 पर कंवेन्शन के अनुबंध 14 ( वोल्यूम '1 ) के अध्याय 4 के पैरा 4.2 में निर्धारित प्रक्रिया के अनुसार नई वस्तुओं या विद्यमान वस्तुओं के विस्तार के संबंध में जैसा भी मामला हो, उपयुक्त प्राधिकारी विचार कर सकता है;
उपयुक्त प्राधिकारी द्वारा पैरा ( 2 ) के अनुसार प्रदत्त कोई भी अनुमोदन, अन्य वस्तुओं पर स्वतः लागू नहींहोगा; और (3 )
(4) पैरा ( 2 ) के उद्देश्य के लिए उपयुक्त प्राधिकारी केन्द्रीय सरकार होगी।

रघु मेनन, संयुक्त सचिव टिप्पण:- मूल अधिसूचना दिनांक 5 जनवरी, 1988 के का.आ. 988 के रूप में प्रकाशित की गई थी और इसमें दिनांक 11 दिसम्बर, 1999 को भारत के राजपत्र के भाग II- खंड 3 ( ii ) में दिनांक 9 नवम्बर, 1999 के का.आ. 3563 द्वारा अंतिम संशोधन किया गया था ।

NOTIFICATION
New Delhi , the 9th March, 2005
S.O. 304(E) . In pursuance of the powers conferred by Section 9A of the Aircraft Act, 1934 (22 of 1934) , the Central Government hereby directs that in the notification number S.O. 988 dated the 5th January, 1988,- (a) paragraph ( i ) shall be numbered as sub -paragraph ( i ) of paragraph ( 1 ) and paragraph (ii) shall be numbered assub-paragraph (ii ) thereof;

[PART II-SEC. 3 ( ii)] (5) after paragraph (1 ) , the following paragraphs shall be inserted , namely :-
"(2) Notwithstanding the provisions contained in paragraph ( 1 ), the appropriate authority may consider matters with regard to new objects or extension of existing objects , as the case may be , in accordance with the procedure laid down in paragraph 4.2 of Chapter 4 of Annex 14 (Volume I) to the Convention onInternational Civil Aviation, 1944 relating to obstacle limitation requirements;
(3) Any approval granted by the appropriate authority pursuant to paragraph (2) shall not provide automatic shielding effect to other objects; and
(4) the appropriate authority for the purpose of paragraph (2) shall be the Central Government . "
