का. आ. 314( अ ).-केन्द्रीय सरकार, विस्फोटक अधिनियम, 1884 ( 1884 का 4 ) की धारा 14 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्वारा मैसर्स रिलायंस इंडस्ट्रीज लि. , धीरूभाई अम्बानी नोलेज सिटी, ब्लाक एच, द्वितीय तल कोपारर्वएयरेन , थाणे , बेलापुर रोड, नवी मुंबई-400709 को मैसर्स एस. आर. सी. टैक्नोलोजी सेन्टर, श्लमबर्गर टैक्नोलोजी कार्पोरेशन 110 श्लमबर्गर ड्राईब , सूगर लैंड, टैक्सास- 77478, संयुक्त राज्य अमेरिका से चेन्नई हवाई अड्डे पर निम्नलिखित विस्फोटक सामग्री के आयात के लिए विस्फोटक नियामावली, 1983 के नियम 31 के उपनियम ( 2 ) जो भारत के राजपत्र असाधारण , भाग II , खण्ड 3 , उप खण्ड (i) में दिनांक 2 मार्च, 1983 के सा.का.नि. सं. 248 ( अ ) के तहत प्रकाशित की गई थी ( जिसे इसके पश्चात् उक्त नियमावली कहा गया है ) के उपबंधों के अनुपालन से छूट देती है, यथाः-

2. उक्त पैराग्रॉफ 1 में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः:-
( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों, का पालन किया जायेगा;
( 2 ) अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली, 1996 की धारा -3 में दिये गये, वर्गीकरण के प्रभाग 1.4 और 4.1 के ही अनुरूप विस्फोटकों का आयात किया जायेगा;
(3) नियम 31 के उपनियम ( 2 ) के अलावा, उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जायेगा;
(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जायेगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;

[PART II-SEC . 3 ( ii) ] (5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जायेगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन केचारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जायेगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहींहो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;
(6 ) घिरे हुये क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी; तथा
(7 ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्तेमें कोई अनुचित विलम्ब नहीं किया जायेगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जायेगा।

NOTIFICATION
NewDelhi , the 14th March, 2005
S.O. 314(E) . In exercise of the powers conferred by Sub -section (2 ) of Section 14 of the Explosives Act , 1884 (4 of 1884) , the Central Government hereby exempts M/s . Reliance Industries Limited , Dhirubhai Ambani Knowledge City, Block H, 2nd Floor, Koparkhairane , Thane Belapur Road, Navi Mumbai -400709 , from the provisions of sub - sule (2 ) of rule 31 ofthe Explosives Rules , 1983 , published in the Gazette of India, Extraordinary, Part II , Section 3 , Sub - section (i ) vide G.S.R. number 248 (E ), dated the 2nd March, 1983 (hereinafter referred to as the said rules ), for import of the following cxplosives from M/s . S.R.C. Technology Center , Schlumberger Technology Corporation, 110 Schlumberger Drive , Sugar Land, Texas 77478 , United States of America at Chennai airport, namely :-

2. The explosives mentioned in paragraph 1 above shall be imported subject to the following conditions , namely:--
(1 ) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;
(2) explosives conforming only to Division 1.4 and 4.1 of the classification given in Section 3 ofthe International AirTransport Association Dangerous Goods Regulations , 1996 shall be imported;
(3) relevant provisions relating to the possession , transport , use and import of explosives , as contained in the said rules , except sub - sule (2) of rule 31 , shall be compliedwith;
(4) adequate number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing.
(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site ;
(6) smoking or use of naked light shall not be permitted within the cordoned area; and
(7) vans carrying the explosives shall proceed to the storage magazines licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any, shall be complied with during the transportation of the explosives .
