सा.का.नि. 172(अ).- केंद्रीय मोटर यान नियम, 1989 में और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप, जिसे केंद्रीय सरकार मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 27, 64, 110 और 128 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है, उक्त अधिनियम की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार ऐसे सभी व्यक्तियों की जिनके उससे प्रभावित होने की संभावना है, जानकारी के लिए प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको भारत के राजपत्र में यथा प्रकाशित अधिसूचना प्रतियां जनता को उपलब्ध करा दी जाती है; तीस दिन की समाप्ति के पश्चात् विचार किया जाएगा ;

ऐसे आक्षेपों या सुझावों पर जो इस प्रकार विनिर्दिष्ट अवधि के भीतर उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त हो सकेंगे , केंद्रीय सरकार द्वारा विचार किया जाएगा;

इन प्रारूप नियमों से संबिधित आक्षेप या सुझाव, संयुक्त सचिव (परिवहन), सड़क परिवहन और राजमार्ग विभाग , परिवहन भवन, संसद मार्ग, नई दिल्ली-110001 को भेजे जा सकेंगे ।

प्रारूप नियम

1. (1 ) इन नियमों का संक्षिप्त नाम केंद्रीय मोटर यान (.... संशोधन) नियम, 2005 है ।

(2) इन नियमों में यथा अन्यथा उपबंधित के सिवाय, ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

[PART II -SEC. 3 ( i ) ] 2. केंद्रीय मोटर यान नियम, 1989 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 2 में, खंड (न) के पश्चात् निम्नलिखित खंड अंतःस्थापित किए जाएंगे , अर्थात्:-

' (प) " बैटरी चालित यान " से ऐसा यान अभिप्रेत है जो सड़क पर प्रयोग के लिए आशयित हो, अनन्य रूप से विद्युत मोटर से शक्ति मिलती हो और जिसे कर्षण ऊर्जा, यान में स्थापित कर्षण बैटरी द्वारा अनन्य रूप से दी जाती है :

परंतु यह कि यदि मोटर तीस मिनट शक्ति 0.25 किलोवाट से कम है, तो बैटरी चालित यान को मोटर यान नहीं समझा जाएगा ।

स्पष्टीकरण मोटर की तीस मिनट शक्ति को ए आई एस: 49 : 2003 में परिभाषित किया जाता है और सत्यापन की पद्धति ए आई एस: 041 : 2003 में विहित है जब तक कि तत्स्थानी बी आई एस विनिर्देश अधिसूचित नहीं किए जाते ;

ז (फ) " पावर टिलर " से एकल धुरी युक्त एक कृषि मशीनरी अभिप्रेत है जो भूमि तैयार करने के लिए प्रयोग की जाती है और यात्रा की दिशा और फील्ड प्रचालन के लिए इसका नियंत्रण इसके पीछे चलने वाले प्रचालक द्वारा किया जाता है । इस उपस्कर में बैठने की व्यवस्था हो सकती है अथवा नहीं भी हो सकती और जब इसे ट्रेलर के साथ जोड़ा जाए तो इसका प्रयोग माल के परिवहन के लिए किया जा सकता है । ट्रेलर के साथ जुड़े होने पर पावर टिलर की अधिकतम गति 22 कि.मी. प्रति घंटा से अधिक नहीं होगी । ट्रेलर के साथ जुड़े होने पर पावर टिलर की अधिकतम वहन क्षमता 1.5 टन से अधिक नहीं होगी । ' । 3.

+ उक्त नियमों के नियम 4 में, -

(क) मद संख्या 1 और उससे संबंधित प्रविष्टि का लोप किया जाएगा ;

(ख) मद संख्या 10 और उससे संबंधित प्रविष्टि के पश्चात् निम्नलिखित मद और प्रविष्टि अंतःस्थापित की जाएगी , अर्थात्: -

" II . मोटर यान अधिनियम 1988 की धारा 28 के खंड (ट) के अधीन राज्य सरकार द्वारा यथा विहित कोई अन्य दस्तावेज "

4. केंद्रीय मोटर यान ( ... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही उक्त नियमों के नियम 24 के उप नियम (4) में " ऐसा आवेदन प्राप्त होने की तारीख से नब्बे दिन की अवधि के भीतर " शब्द अंत में अंतःस्थापित किए जाएंगे । 5. उक्त नियमों के नियम 25 में निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्:-

"परंतु उक्त अनुज्ञप्ति की विधिमान्यता ऐसा मानदंड पूरा करने के अध्यधीन होगी जिसे अनुज्ञप्ति प्राधिकारी अथवा राज्य सरकार द्वारा इस प्रयोजन के लिए वार्षिक आधार पर यथाविहित किसी अन्य प्राधिकारी द्वारा प्रमाणित किया जाना है । " । भारत का राजपत्र असाधारण

6. केंद्रीय मोटर यान (......... संशोधन ) नियम , 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही उक्त नियम के नियम 30 के उप नियम (2 ) में "ऐसी अपील प्राप्त होने की तारीख से पेंतालीस दिन की अवधि के भीतर " शब्द अंत में अंतःस्थापित किए जाएंगे । 7. केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही उक्त नियमों के नियम 35 के उप नियम (1 ) में " प्ररूप 17 में " शब्दों और अंकों के पश्चात् " ऐसा आवेदन प्राप्त होने की तारीख से तीस दिन की अवधि के भीतर " शब्द अंतःस्थापित किए जाएंगे ।

8. केंद्रीय मोटर यान (......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही उक्त नियम के नियम 46 के उप नियम ( 2 ) में "ऐसी अपील प्राप्त होने की तारीख से तीस दिन की अवधि के भीतर " शब्द अंत में अंतःस्थापित किए जाएंगे ।

9. उक्त नियम के नियम 48 में "ऐसा आवेदन प्राप्त होने की तारीख से तीस दिन की अवधि के भीतर" शब्द अंत में अंतःस्थापित किए जाएंगे ।

10. केंद्रीय मोटर यान (... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियम के नियम 50 में, उप नियम ( 1 ) के खंड ( vi ) में द्वितीय परंतुक के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किए जाएंगे, अर्थात्: -

" परंतु यह भी कि पावर टिलर की रजिस्ट्रीकरण प्लेट का आकार 285 x 45 मि.मी. होगा और यह आगे प्रदर्शित की जाएगी । इसके अतिरिक्त पावर टिलर के साथ ट्रेलर जुड़े होने की दशा में रजिस्ट्रीकरण प्लेट का आकार 200 x 100 मि.मी. होगा और यह पीछे प्रदर्शित कीजाएगी,

परंतु यह और कि मोटर साइकिल की दशा में अगली रजिस्ट्रीकरण प्लेट के लिए 285 x 45 मि.मी. का आकार अनुज्ञात किया जाएगा । "

11. उक्त नियमों के नियम 51 की सारणी में क्रम संख्या 7 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित क्रम संख्या और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्: -

[PART II-SEC. 3 (i )] 12. केंद्रीय नोटर यान (... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 62 के उप नियम (1 ) के खंड (ग) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्: -

"( ग) इन नियमों के नियम 82 के अंतर्गत आने वाले यानों के संबंध में फिटनेस प्रमाणपत्र का नवीकरण

13. केंद्रीय मोटर यान ( ... संशोधन ) नियम , 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात्से ही उक्त नियमों के नियम 93 में , -

(क) उप नियम (4) के खंड ( ii ) के स्थान पर निम्नलिखित खंड रखा जाएगा , अर्थात्, "( ii) दो डैक वाले परिवहन यान की दशा में यह 4.75 मीटर से अधिक नहीं होगी और ट्रैक्टर- ट्रेलर माल यान की दशा में यह 4.20 मीटर से अधिक होगी ; " ;

(ख) उप नियम (6 ) में स्पष्टीकरण I के उप पैरा ( ख ) के पश्चात्, निम्नलिखित उप पैरा अतःस्थापित किया जाएगा , अर्थात्: -

"(ग ) तीन धुरी से अधिक धुरी वाले यानों की दशा में अगली धुरी संयोजन के मध्य बिंदु और पिछली धुरी संयोजन के मध्य बिंदु के बीच मापित दूरी । " ।

14. केंद्रीय मोटर यान (... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियम के नियम 93 क के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्: -

66 93 ख , पावर टिलर का समग्र विमाएं (i) राइडिंग अटैचमेंट युक्त पावर टिलर की समग्र लंबाई 3.5 मीटर से अधिक नहीं होगी ।

(ii) केज व्हीलर सहित राइडिंग अटैचमेंट युक्त पावर टिलर की समग्र लंबाई 1.5 मीटर से अधिक नहीं होगी ।

(iii) पावर टिलर की अधिकतम समग्र ऊंचाई 2.0 मीटर से अधिक नहीं होगी ।

( iv) ट्रेलर से जुड़े पावर टिलर की समग्रं लंबाई 6.0 मीटर से अधिक नहीं होगी ।

(v) ट्रेलर से जुड़े पावर टिलर की अधिकतम समग्र चौड़ाई 1.7 मीटर से अधिक नहीं होगी । 5

(vi) ट्रेलर से जुड़े पावर टिलर की अधिकतम समग्र ऊंचाई 2.0 मीटर से अधिक नहीं होगी । " ।

15. उक्त नियमों के नियम 95 में उप नियम ( 1 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्: -

" ( 1 ) कृषि ट्रैक्टर, संनिर्माण उपस्कर यान और पावर टिलर से भिन्न 1 अक्तूबर, 2005 को और उसके पश्चात् विनिर्मित सभी मोटर यानों में प्रयुक्त टायर जिनमें रेडियल टायर भी सम्मिलित हैं, तत्स्थानी बी आई एस विनिर्देश अधिसूचित किए जाने तक लागू ए आई एसः 044 (भाग 1 से 3) : 2004 में विनिर्दिष्ट अपेक्षाओं को पूरा करेंगे :

परंतु यह कि 1 अक्तूबर, 2005 को और उसके पश्चात् विनिर्मित मोटर यानों के लिए टायरों का चयन और फिटमेंट, तत्स्थानी बी आई एस विनिर्देश अधिसूचित किए जाने तक दुपहिया व तिपहिया यानों की दशा में ए आई एसः 050 : 2004 और अन्य मोटर यानों की दशा में ए आई एसः 051 : 2004 के अनुसार होगा ।

परंतु यह और कि केंद्रीय सड़क परिवहन संस्थान , पुणे और समय समय पर केंद्रीय सरकार द्वारा प्राधिकृत कोई अन्य अभिकरण नियम 126 के प्रयोजन के लिए टायरों हेतु ए आई एसः 044 के रात्त्यापन के लिए परीक्षण कर सकती है ।

16. केंद्रीय मोटर यान (....... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 95 क के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्: -

" 95ख . पावर टिलर के लिए टायर का आकार और प्लाई रेटिंग टायर में टायर विनिर्माता द्वारा यथाविनिर्दिष्ट भार वहन क्षमता होनी चाहिए तथापि, पावर टिलर विनिर्माता द्वारा विनिर्दिष्ट अधिकतम भार, टायर विनिर्माता द्वारा अनुज्ञात भार से अधिक नहीं होगा । (2) पावर टिलर विनिर्माता, टायर विनिर्माता द्वारा दिए गए सुझावों के अनुसार अनुशंसित / अधिमानित रिम आकार के टायर का ही चयन करेगा ।.

टिप्पण , उपर्युक्त दो उपनियमों के अनुपालन के लिए निम्नलिखित मानक निर्दिष्ट किए जाएंगे :-

(i) समय समय पर यथासंशोधित आई एसः 13154 1991 कृषि ट्रैक्टर उपकरण और पावर टिलर के लिए टायर ;

[PART II- SEC. 3 (1) ] (ii) यदि समय समय पर यथासंशोधित आई एसः 13154 में विशेष आकार का टायर सूचीबद्ध नहीं है तो ई सीई, जे ए टी एम ए , ई टी आर टी ओ, टी एन आर एम, आई टी टी ए सी आदि जैसे अंतर्राष्ट्रीय मानक के समकक्ष कोई टायर । " । 17 . उक्त नियमों के नियम 96 में ; -

(क) उप नियम (4) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्:-

" (4) 1 अक्तूबर, 2005 को और उसके पश्चात् विनिर्मित प्रत्येक मोटर यान में ब्रेक प्रणाली होगी जिसका कार्यनिष्पादन निम्नलिखित भारतीय मानक के अनुरूप होगा : -

(i) दुपहिया और तिपहिया के लिए समय समय पर यथासंशोधित आई एसः14664-1999;

( ii ) दुपहिया, तिपहिया, ट्रेलर, अर्ध ट्रेलर, संनिर्माण उपस्कर यान, कृषि ट्रेक्टर और पावर टिलर से भिन्न सभी मोटर यानों के लिए समय समय पर यथासंशोधित आई एसः 11852 ( भाग 1 ): 2001 , 11852 (भाग 2): 2001, 11852 (भाग 3): 2001 , 11852 (भाग 4): 2001, 11852 (भाग 5): 2001 , 11852 (भाग 6): 2001 , 11852 (भाग 7): 2001 और 11852 ( भाग 8): 2001 :

परंतु आई एसः 11852: 2001 (भाग 9 के सिवाए ) के पैरा 4.2.1.11 क में विनिर्दिष्ट स्वतः वियर समायोजन की अपेक्षा 1 अप्रैल, 2006 से ही प्रवृत्त होगी :

परंतु यह और कि 1 अक्तूबर, 2006 को और उसके पश्चात् विनिर्मित और एंटी लॉक ब्रेक प्रणाली युक्त यानों के लिए आई एसः 11852 (भाग 9) : 2001 लागू होगा :

परंतु यह और कि ट्रैक्टर ट्रेलरों से भिन्न एन 3 प्रवर्ग के सभी यानों के संबंध में जो 1 अक्तूबर, 2006 से ही खतरनाक माल के परिवहन के लिए रजिस्टर किए जाते हैं, आई एसः 11852-2003 (सिवाय भाग 9) के अनुसार प्राधिकृत परीक्षण अभिकरणों द्वारा यथा प्रमाणित एंटी लॉक ब्रेक प्रणाली लगाई जाएगी । इसके अतिरिक्त, 1 अक्तूबर, 2007 से ही रजिस्ट्रीकृत किसी ट्रैक्टर/ अर्ध ट्रेलर में इसी प्रकार ऐसा तंत्र लगाया जाएगा । " ।

(ख) उपनियम (8 ) के पश्चात् निम्नलिखित उप नियम अंतःस्थापित किया जाएगा, अर्थात्: - " (9 ) निम्नलिखित प्रवर्ग के यानों में एंटी लॉक ब्रेक (ए बी एस ) प्रणाली लगाई जाएगी : - (i) खतरनाक माल और द्रवित पेट्रोलियम गैस की ढुलाई के लिए 1 अक्तूबर, 2006 को और उसके पश्चात् विनिर्मित ट्रैक्टर- ट्रेलर संयोजन से भिन्न एन 3 प्रवर्ग के यान ;

(ii) 1 अक्तूबर, 2006 को और उसके पश्चात् विनिर्मित एन 3 प्रवर्ग के यान जो डबल डेकर कार वाहक हैं ;

(iii) 1 अक्तूबर, 2007 को और उसके पश्चात् विनिर्मित एन 3 प्रवर्ग के यान जिनका प्रयोग ट्रैक्टर- ट्रेलर संयोजन के रूप में किया जाता है ;

(iv) 1 अक्तूबर, 2007 को और उसके पश्चात् विनिर्मित एम 3 प्रवर्ग की बसें जो अखिल भारतीय पर्यटन परमिट पर चलती हैं । " ।

18. केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 96 ग के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्:- " 96 घ . पावर टिलर के लिए ब्रेक प्रणाली की अपेक्षाएं पावर टिलर जब ट्रेलर से जुड़े हों निम्नलिखित अपेक्षाओं को पूरा करेंगे -

(i ) ट्रेलर से जुड़े पावर टिलर के लिए 1.5 टन से अनधिक सकल संयोजन भार के साथ ब्रेक परीक्षण किया जाएगा जैसा कि विनिर्माता द्वारा घोषणा की गई है ;

(ii) 600 एन से अनधिक पैडल प्रयास के साथ 7.5 मीटर की रुकने की अपेक्षा की दूरी को पूरा करने के लिए 15 कि.मी. प्रति घंटे की गति पर ब्रेक परीक्षण किया जाएगा ;

(iii ) पावर टिलर से जुड़े ट्रेलर में पार्किंग ब्रेक लगी होगी जो 12 % ऊपरी ढलान और निचले ढलान पर संयोजन को रोक सके । " ।

19. केंद्रीय मोटर यान (...... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 98 ख के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्: -

" 98 ग. पावर टिलर के लिए स्टियरिंग गियर ट्रेलर के साथ जुड़े पावर टिलर का मोड़ चक्र व्यास और मोड़ निकासी चक्र व्यास जब समय समय पर यथासंशोधित आई एसः 12222 के अनुसार मापा जाए, 10 मीटर से अधिक नहीं होगा । " ।

20. केंद्रीय मोटर यान ( ... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 99 में निम्नलिखित परंतुक अतःस्थापित किया जाएगा, अर्थात्: - 8

[PART II-SEC. 3 (i)] "परंतु यह कि राइडिंग अटैचमेंट युक्त पावर टिलर और ट्रेलर से जुड़ा पावर टिलर विपरीत दिशा में भी अपनी शक्ति से चलने में समर्थ होगा । " ।

21 . उक्त नियमों के नियम 101 में,-

(क) उप नियम (1 ) में 1 अक्तूबर, 2005 से ही " मोटर साइकिलों और 500 घन सेंटीमीटर से अधिक क्षमता के इंजन वाले तिपहिया को छोड़कर " शब्दों और अंकों के स्थान पर " मोटर साइकिल " शब्द रखे जाएंगे ।

(ख) उप नियम (3 ) में 1 अक्तूबर, 2005 से ही " 500 घन सेंटीमीटर से अनधिक क्षमता के इंजन वाले " शब्दों और अंकों का लोप किया जाएगा ।

22. उक्त निगमों के नियम 102 में 1 अक्तूबर, 2005 से ही उप निगम (1 ) और उसके अधीन परंतुक के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्: -

" ( 1 ) सभी मोटर यानों जिनमें संनिर्माण उपस्कर यान भी सम्मिलित हैं, में दाएं मुड़ने अथवा बाएं मुड़ने के लिए संकेत , विद्युत चालित दिशा सूचक लैंप द्वारा दिए जाएंगे । प्रत्येक मोटर यान जिसमें संनिर्माण उपस्कर यान सम्मिलित हैं, इस तरह रखे और अनुरक्षित किए जाएंगे कि वह निम्नलिखित शर्तों को पूरा करें, अर्थात्:-

(i) दिशा सूचक लैंप अंबर रंग की होंगी जो प्रति मिनट 60 से अन्यून और 120 फ्लैश से अनधिक दर पर लाइट फ्लैश द्वारा मुड़ने के आशय की सूचना देने के लिए जलती है ;

(ii) लैंप से निकला प्रकाश जब वह प्रचालन में हो , यान के आगे और पीछे दोनों ओर स्पष्ट रूप से दिखाई देगा ;

( iii ) प्रत्येक दिशा सूचक का न्यूनतम प्रकाशित क्षेत्र 60 वर्ग सेंटीमीटर होगा :

परंतु इस नियम में उल्लिखित कोई भी बात 1 जनवरी , 2003 से पूर्व विनिर्मित 70 घन सेंटीमीटर से अधिक इंजन क्षमता की मोटर साइकिलों और एल 1 प्रवर्ग की मोटर साइकिलों पर लागू नहीं होगी । " ।

23. उक्त नियमों के नियम 103 में 1 अक्तूबर, 2005 से ही उप नियम (2) में " 500 घन सेंटीमीटर से अधिक क्षमता के इंजन वाले तिपहियों " शब्दों और अंकों का लोप किया जाएगा । 9

24. उक्त नियमों के नियम 104 में, -

(क) उप नियम ( 1 ) और उसके अधीन परंतुक के स्थान पर निम्नलिखित उप नियम और परंतुक रखा जाएगा, अर्थात्:-

"( 1 ) तिपहिया और मोटर साइकिलों से भिन्न 1 अक्तूबर, 2005 को और उसके पश्चात् विनर्मित प्रत्येक मोटर यान जिनमें ट्रेलर और अर्द्ध ट्रेलर भी सम्मिलित हैं, में उनके पीछे दो परावर्तक अर्थात् दोनों सिरों पर 1-1 परावर्तक लगाया जाएगा । प्रत्येक मोटर साइकिल में पीछे न्यूनतम 1 लाल रिफ्लैक्स परावर्तक लगाया जाएगा :

परंतु प्रत्येक माल वाहन के आगे और पीछे बॉडी की चौड़ाई में न्यूनतम 20 मि.मी. चौड़ा परावर्तक टेप अथवा परावर्तक पेंट लगाया/पेंट किया जाएगा । " ;

(ख) उप नियम (2) में 1 अक्तूबर, 2005 से ही " 500 घन सेंटीमीटर से अनधिक की क्षमता के इंजन वाले " शब्दों और अंकों का लोप किया जाएगा ;

(ग) उप नियम (3) में 1 अक्तूबर, 2005 से ही " 500 घन सेंटीमीटर से अनधिक इंजन क्षमता पर " शब्द अंक और अक्षर का लोप किया जाएगा ;

(घ) उप नियम (4 ) में 1 अक्तूबर, 2005 से ही " भारतीय मानक ब्यूरो द्वारा विनिर्दिष्ट भारतीय मानक आई एसः 8339- 1993 " शब्दों, अंकों और अक्षरों के स्थान पर तत्स्थानी वी आई एस विनिर्देश अधिसूचित किए जाने तक "ए आई एसः 057-2005 शब्द, अंक और अक्षर रखे जाएंगे ।

25. उक्त नियमों के नियम 104क के पश्चात् निम्नलिखित नियम अंतःस्थापित किए जाएंगे , अर्थात्: -

(क) " 104ख. कृषि ट्रैक्टरों के लिए परावर्तक लगाया जाना ( 1 ) प्रत्येक कृषि ट्रैक्टर में पीछे दोनों ओर 28.5 वर्ग से.मी. से अन्यून परावर्तन क्षेत्र वाले दो गैर - त्रिकोण लाल परावर्तक लगाए जाएंगे ,

(2) इस नियम के उप नियम ( 1 ) में निर्दिष्ट परावर्तक समय समय पर यथासंशोधित भारतीय मानक आई एसः 8339-1993 के अनुरूप रिफ्लैक्स किस्म के होंगे । "

(ख) " 104 ग . पावर टिलर पर परावर्तक लगाया जाना , केंद्रीय मोटर यान (......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही -

(i) प्रत्येक पावर टिलर पर यान के अगले भाग में दोनों ओर 28.5 से.मी. से अन्यून परावर्तन क्षेत्र वाले दो श्वेत रिफ्लैक्स परावर्तक लगाए जाएंगे और जो रात्रि के समय आगे से आने वाले यानों को दिखाई देंगे ;

(ii ) पावर टिलर से जुड़े ट्रेलरों की दशा में भूमि से 1500 मि.मी. से अनधिक ऊंचाई पर दाएं और बाएं सिरे पर 28.5 से.मी. से अन्यून परावर्तन क्षेत्र वाले दो लाल परावर्तक लगाए जाएंगे । " |

26. 1 अक्तूबर, 2005 से ही उदत नियमों के नियम 105 में उप नियम (1 ) के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्: -

" ( 1 ) इसमें इसके पश्चात् यथा उपबंधित के सिवाय , प्रत्येक मोटर यान को जिसे सूर्यास्त के पश्चात् आधा घंटे की अवधि के भीतर और ऐसे किसी समय जब पर्याप्त प्रकाश न हो, सार्वजनिक स्थल पर चलाते समय निम्नलिखित लैंप जलाई जाएगी जिससे वाहन से एक सौ पचपन मी. की दूरी पर सड़क पर किसी व्यक्ति, यान अथवा किसी अन्य वस्तु को स्पष्टतः देखा जा सकेगा,

(क) तिपहिया, अशक्त तिपहिया यानों, मोटर साइकिलों और निर्माण उपस्कर यानों से भिन्न अन्य यानों की दशा में दो अथवा चार हैड लैंप :

(ख ) मोटर साइकिल और अशक्त तिपहिया यानों की दशा में एक अथवा दो हैड लैंप ;

(ग) मोटर साइकिल से संबद्ध कार की दशा में एक लैंप जो आगे श्वेत प्रकाश दर्शाए । " 27. उक्त नियमों के नियम 109 में 1 अक्तूबर, 2005 से ही " 500 घन सेंटीमीटर से अनधिक की क्षमता के इंजन वाले " शब्दों और अंकों का लोप किया जाएगा ।

28. उक्त नियमों के नियम 110 में 1 अक्तूबर, 2005 से ही, -

(क) शीर्षक के स्थान पर निम्नलिखित शीर्षक रखा जाएगा, अर्थात्:- " तिपहिया पर लैंप " ;

(ख) " आटो रिक्शा और 500 घन सेंटीमीटर से अनधिक की क्षमता के इंजन वाले तिपहिए " शब्दों और अंकों के स्थान परं " तिपहिया " शब्द रखे जाएंगे ;

(ग ) परंतुक के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्: - 11

66 परंतु यह और कि एक हैड लैंप का लगाया जाना 1400 मि.मी. से अनधिक समग्र चौड़ाई वाले तिपहिया की दशा में ही लागू होगा और ऐसे मामलों में साइड की लाइटें अम्बर रंग की होंगी ।

29. केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 115 क में, -

(क) शीर्षक के स्थान पर निम्नलिखित शीर्षक रखा जाएगा, अर्थात्: -

" डीजल इंजनों से चलने वाले कृषि ट्रैक्टरों , पावर टिलरों और संनिर्माण उपस्कर यानों से धूम्र और वाष्प का उत्सर्जन " ;

(ख) उप नियम (4 ) में " संनिर्माण उपस्कर यानों" शब्दों के स्थान पर " संनिर्माण उपस्कर यान और पावर टिलर " शब्द रखे जाएंगे ।

(ग) उप नियम (5) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थात्: -

66 " (5) विनिर्माता द्वारा डीजल इंजन से चलने वाले प्रत्येक कृषि ट्रैक्टर और पावर टिलर का विनिर्माण और उत्पादन इस तरह किया जाएगा कि वह दृष्टव्य प्रदूषकों के अतिरिक्त उसके द्वारा उत्सर्जित गैसीय प्रदूषकों के निम्नलिखित मानकों का अनुपालन करे जैसा कि उप नियम (2) में उपबंध है, जब आई एस ओ 8178-4 ' सी 1 ' 8 मॉड चक्र में विहित प्रक्रिया के अनुसार परीक्षण किया जाए, अर्थात्: -

परीक्षण के दौरान उत्सर्जित ग्राम प्रति किलोवाट घंटा में कार्बन मोनोक्साइड (सी ओ ) , हाइड्रोकार्बन (एच सी) और नाइट्रोजन आक्साइड (एन ओ एक्स) का औसत भार टाइप अनुमोदन और उत्पादन परीक्षणों की अनुरूपता के लिए निम्नलिखित सारणी में दी गई सीमाओं से अधिक नहीं होगा, अर्थात्: -

(1 ) सारणी के स्तंभ (2 ) में उल्लिखित मानक कृषि ट्रैक्टरों के लिए 1 जून, 2003 से और पावर टिलरों के लिए 1 अक्तूबर, 2006 से लागू होंगे ।

(2) सारणी के स्तंभ ( 3 ) में उल्लिखित मानक कृषि ट्रैक्टरों के लिए 1 अक्तूबर, 2005 से और पावर टिलरों के लिए 1 अप्रैल , 2008 से लागू होंगे । " ।

30. उक्त नियमों के नियम 115 ख में,

(क) केंद्रीय मोटर यान (......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही भाग क के मद (I ) के खंड (क) में, -

(i) " भारत स्टेज ।। " शब्दों और अंकों के स्थान पर " भारत स्टेज ।।। " शब्द और अंक रखे जाएंगे ;

(ii) " इंडिया-2000 ( इंडिया स्टेज -1) " शब्दों, अंकों और कोष्ठक के स्थान पर " भारत स्टेज ।। " शब्द और अंक रखे जाएंगे ।

(ख) भाग क के मद ( II ) के खंड (क) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्: -

"(क) केंद्रीय मोटर यान (......... संशोधन ) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही सी एन जी किट लगे प्रयोगशील यान , ऐसे यान के संबंधित वर्ष के लिए लागू गैसोलिन वाहन के लिए इन नियमों में विनिर्दिष्ट टाइप अनुमोदन उत्सर्जन मानकों को पूरा करेंगे बशर्ते यह न्यूनतम भारत स्टेज ।। मानकों को पूरा करे । तथापि भारत स्टेज ।।। उत्जर्सन मानकों के साथ विनिर्मित यान भारत स्टेज ।।। उत्सर्जन मानकों को पूरा करेंगेः परंतु मॉडल/ कन्वर्जन किट/ अनुमोदित टाइप इंजन प्रतिस्थापन और इन नियमों के प्रांरभ से पूर्व नियम 115ख के अधीन प्रमाणित (अधिसूचना सं. सा.का.जि.853 (अ ) तारीख 19 नवम्बर, 2001 के अनुसार) यानों के संबंध में ऐसे प्रमाण पत्र, विनिर्दिष्ट विधिमान्यता अवधि के बावजूद इस अधिसूचना की तारीख से बारह महीने पश्चात् विधिमान्य नहीं रहेंगे । ऐसे प्रमाण पत्रों को केंद्रीय मोटर यान ( संशोधन ) नियम, 2005 के निबंधनों के अनुसार परीक्षण अभिकरणों से पुर्नविधिमान्यकरण आवश्यक होगा ।

(ग) केंद्रीय मोटर यान (......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही भाग ख के मद (I ) के खंड ( क) में, - 13

(i) " भारत स्टेज । " शब्दों और अंकों के स्थान पर " भारत स्टेज ।।। " शब्द और अंक रखे जाएंगे ;

(घ) केंद्रीय मोटर यान (......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही भाग च में टिप्पण 7 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -

" 7. प्रयोगशील गैसोलिन यानों में कन्वर्जन किट अथवा परिवर्तित डीजल यानों की दशा में परीक्षण अभिकरणों द्वारा जारी प्रमाण पत्र की विधिमान्यता उस यान जिसमें ऐसे किट का परीक्षण किया गया है के विनिर्माण वर्ष में विनिर्मित ऐसे सभी यानों पर प्रवृत्त होगी और यह भारत स्टेज ।। अथवा भारत स्टेज ।।। मानकों की विधिमान्यता तक रहेगी, जो भी हो ।. परीक्षण अभिकरणों को मॉडल और उनके रूपभेद जिन पर प्रमाण पत्र विधिमान्य होगा, का स्पष्ट उल्लेख करना होगा । " ।

31. उक्त नियमों के नियम 115 ग में, -

(क) उप नियम ( 3 ) में खंड क के स्थान पर निम्नलिखित खंड रख जाएगा, अर्थात: -

" (क) केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही एल पी जी किट लगे प्रयोगशील यान ऐसे यानों के तत्स्थानी निर्माण वर्ष में यथा लागू गैसालिन यानों के लिए इन नियमों में विनिर्दिष्ट टाइप अनुमोदन उत्सर्जन मानकों को पूरा करेंगे जो इस शर्त के अध्यधीन होगा कि यह न्यूनतम भारत स्टेज ॥ उत्सर्जन मानकों को पूरा करेगा :

परंतु मॉडल/कन्वर्जन किट/अनुमोदित टाइप इंजन प्रतिस्थापन और इन नियमों के प्रांरभ से पूर्व नियम 115 ग के अधीन प्रमाणित (अधिसूचना सं. सा.का.नि. 284 (अ ) तारीख 24 अप्रैल, 2001 के अनुसार) यानों के संबंध में ऐसे प्रमाण पत्र, विनिर्दिष्ट विधिमान्यता की अवधि के होते हुए भी इस अधिसूचना की तारीख से 1 वर्ष के लिए विधिमान्य होगी । ऐसे प्रमाण पत्रों को केंद्रीय मोटर यान ( संशोधन) नियम, 2005 के निबंधनों के अनुसार परीक्षण अभिकरणों से पुर्नविधिमान्यकरण आवश्यक होगा । " ।

(ख) उप नियम (5) का लोप किया जाएगा ।

(ग) केंद्रीय मोटर यान (......... संशोधन) नियम , 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उप नियम (6) में, -

(ङ) केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उप नियम ( 10 ) में टिप्पणी 5 के पश्चात् निम्नलिखित टिप्पणी अंतःस्थापित की जाएगी, अर्थात्: -

" (6) प्रयोगशील गैसोलिन यानो में कन्वर्जन किट अथवा संपरिवर्तित डीजल यानों की दशा में परीक्षण अभिकरणों द्वारा जारी प्रमाण पत्र की विधिमान्यता उस यान जिसमें ऐसे किट का परीक्षण किया गया है कि विनिर्माण वर्ष में विनिर्मित ऐसे सभी यानों पर प्रवृत्त होगी और यह भारत स्टेज ॥ अथवा भारत स्टेज ।।। मानकों की विधिमान्यता तक रहेगी, जो भी हो । परीक्षण अभिकरणों को मॉडल और उनके रूपभेद जिन पर प्रमाण पत्र विधिमान्य होगा, का स्पष्ट उल्लेख करना होगा । " ।

32. केंद्रीय मोटर यान (... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही उक्त नियमों के नियम 119 में, -

(क) उप नियम (1 ) में " प्रत्येक मोटर यान जिसमें संनिर्माण उपस्कर यान और कृषि ट्रैक्टर सम्मिलित हैं " शब्दों के स्थान पर " प्रत्येक मोटर यान, कृषि ट्रैक्टर, पावर टिलर और संनिर्माण उपस्कर यान " शब्द रखे जाएंगे ।

(ख) उप नियम ( 1 ) के परंतुक में " हॉर्न लगाने की आवश्यकता " शब्दों के स्थान पर "मोटर यान के लिए हॉर्न लगाने की आवश्यकता " शब्द रखे जाएंगे । 15

भाग - खण्ड 3 (i) ]

33. उक्त नियमों के नियम 120 में, -

(क) उप नियम (2) के अधीन निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्: -

" परंतु अक्तूबर, 2005 से ही जहां पेट्रोल और डीजल यानों के लिए ध्वनि के विभिन्न स्तर विहित हैं, पेट्रोल यानों के लिए विहित सीमाएं बैटरी चालित यानों के लिए लागू होंगे । " ;

(ख) केंद्रीय मोटर यान (......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उप नियम (3 ) के पश्चात् निम्नलिखित उप नियम अंतःस्थापित किया जाएगा, अर्थात्: -

"(4) राइडिंग अटैचमेंट युक्त पावर टिलर अशता ट्रेलर से जुड़े पावर टिलर की दशा में जब ध्वनि स्तर, समय समय पर यथासंशोधित आई एसः 12180-2000 के अनुसार परीक्षण किया जाएगा तो यह साथ खड़े रहने वाले व्यक्ति की स्थिति में 88 डी बी (ए) और प्रचालक के कर्ण स्तर पर 98 डी बी ( ए) से अधिक नहीं होगा । " ।

34. 1 अक्तूबर, 2005 से ही उक्त नियमों के नियम 122 में, -

(क) शीर्षक के स्थान पर निम्नलिखित शीर्षक रखा जाएगा, अर्थात् -

"चेसिस संख्या और इंजन संख्या और बैटरी चालित यानों की दशा में मोटर संख्या और विनिर्माण मास का उत्कीर्णन " ;

(ख) उप नियम ( 1 ) के परंतुक में " इंजन संख्या, चेसिस संख्या और विनिर्माण मास के साथ साथ " शब्दों के स्थान पर " इंजन संख्या/मोटर संख्या, चेसिस संख्या और विनिर्माण मास" शब्द अंतःस्थापित किए जाएंगे ।

35. केंद्रीय मोटर यान (...... संशोधन ) नियम, 2005 के प्रारंभ की तारीख से एक मास पश्चात् से ही उक्त् नियमों के नियम 124 में उप नियम ( 1 क) के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्: -

"परंतु यह कि यान विनिर्माता यह सुनिश्चित करेगा कि विशेष प्रयोजन यानों अर्थात् ट्रैक्टरों और टिपरों को छोड़कर एन 2, एन 3 प्रवर्ग के यानों और उनके ट्रेलरों में अपने यहां गतिशील अवस्था में पश्च सुरक्षा तंत्र और अपनी फैक्टरी अथवा अपने डीलरों के यहां गतिशील अवस्था में पार्श्वीय सुरुक्षा तंत्र लगाएंगे । जिन यानों में ऐसे तंत्र नहीं लगे होंगे , इन नियमों के अधीन उनकी रजिस्ट्री नहीं हो सकेगी । यदि उनके द्वारा किट नहीं लगाई गई है तो वे आवश्यक किटों की आपूर्ति भी सुनिश्चित करेंगे :

[PART II-SEC . 3(1) ] परंतु यह और भी कि चल अवस्था में पश्च सुरक्षा तंत्र पर पिछले पूर्ण भाग में पीली और श्वेत जेब्रा पट्टिया होंगी । जब तक ट्रक बॉडी का संनिर्माण नहीं हो जाता पिछले बंपरों पर एक अस्थाई लाल परावर्तक त्रिकोण की भी व्यवस्था की जाएगी ।" ।

36. केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 124क के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्:-

" 124 ख . पावर टिलर के लिए पुर्जों के सुरक्षा मानक ( 1 ) निम्नलिखित के लिए पावर टिलर पर प्रयुक्त लैंप / बल्व :

(i) हैड लाइट मुख्य और डिप

(ii) पार्किंग लाइट

(iii) दिशा सूचक लैंप

(iv) टेल लैंप

(v) रिवर्सिंग लैंप

(vi) स्टॉप लैंप

पश्च रजिस्ट्रेशन चिटन प्रकाश लैंप

(vii)

तत्स्थानी बी आई एस विनिर्देश अधिसूचित किए जाने तक समग समय पर यथासंशोधित ए आई एसः 034 के अनुसार होंगी ।

(2) प्रकाश और संकेत तंत्र तत्स्थानी बी आई एस विनिर्देश अधिसूचित किए जाने तक समय समय पर यथासंशोधित ए आई एसः 062 के अनुसार होगा ।

(3) पावर टिलर के प्रचालक की सुरक्षा और सुविधा समय समय पर यथासंशोधित आई एसः 12239 (भाग -3) -1996 के अनुसार होगी ।

(4) विनिर्माता द्वारा घोषित संयोजन भार के अधीन ट्रेलर से जुड़े पावर टिलर की ग्रेड क्षमता समय समय पर यथासंशोधित आई एस: 9980-1988 के अनुसार होगी । 37. उक्त नियमों के नियम 125 में उप नियम (5) के पश्चात् निम्नलिखित उप नियम अंतःस्थापित किए जाएंगे अर्थात् : -

"(6) 1 अक्तूबर, 2006 से ही एम 2, एम 3 , एन 1 , एन 2 और एन 3 प्रवर्ग के यानों के लिए सीट, उनकी एंकर व्यवस्था और उनका सिर प्रतिरोध तत्स्थानी बी आई एस विनिर्देश 17

अधिसूचित किए जाने तक समय समय पर यथासंशोधित ए आई एसः 023 के अनुसार होगा ।

38. उक्त नियमों के नियम 125क के पश्चात् निम्नलिखित नियम अंतःस्थापित किए जाएंगे , अर्थात्:-

" 125ख. ऐसे परिवहन यानों के लिए विशेष अपेक्षाएं जो पर्वतीय मार्गों पर चलाए जाते हैं- 1 अक्तूबर, 2005 से ही पर्वतीय प्रदेशों में ऐसे मार्गों अथवा क्षेत्रों में चलने के लिए राज्य सरकार द्वारा राजपत्र में यथा अधिसूचित ऐसे परिवहन यानों में फॉग लैंप, पावर स्टियरिंग, डीफॉगिंग और डीमिस्टिंग प्रणाली लगाई जाएंगी :

परंतु 1 अक्तूबर, 2007 से ही ऐसे राभी क्षेत्रों में अखिल भारतीय पर्यटन परमिट पर चलने वाली एम -2 प्रवर्ग की सभी बसों में एंटी लॉक ब्रेक प्रणाली प्रारंभ की जाएगी ।

125 ग . बॉडी निर्माण और अनुमोदन (1 ) 1 अक्तूबर, 2006 से ही बसों के बॉडी निर्माण

का परीक्षण और अनुमोदन तत्स्थानी बी आई एस विनिर्देश अधिसूचित किए जाने तक उल्लिखित यानों के लिए ए आई एस: 052 के अनुसार होगा ।

(2) स्कूल बसों के बॉडी निर्माण का परीक्षण और अनुमोदन तत्स्थानी बी आई एस विनिर्देश अधिसूचित किए जाने तक उल्लिखित यानों के लिए ए आई एस: 063 के अनुसार होगा ।" ।

39. केंद्रीय मोटर यान ( ......... संशोधन) नियम, 2005 के प्रारंभ की तारीख से एक वर्ष पश्चात् से ही उक्त नियमों के नियम 128 में उप नियम (4) के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात् : -

"(4) आपात निकास पर्यटन यान में उपलब्ध आपात निकास निम्नलिखित अपेक्षाओं को पूरा करेगा -

(i) पर्यटन यान के भीतरी और बाहरी ओर स्पष्ट अक्षरों में ' आपात निकास ' लिखा होगा,

(ii) पर्यटन यान के भीतरी और बाहरी दोनों ओर से खुलने वाला दरवाजा लगाया जाएगा,

(iii) यह इस तरह डिजाइन किया जाएगा कि पर्यटन यान के भीतरी और बाहरी दोनों ओर से खुले,

( iv) उसे बंद करने का तंत्र लगा होगा जिसे आसानी से मुक्त किया जा सके किंतु वह इस तरह बना होगा कि दुर्घटना की दशा में सुरक्षा प्रदान करे,

[PART II-SEC. 3( 1)] (v) यान के बाहर भूमि पर खड़े सामान्य लंबाई के व्यक्ति आसानी से उस तक पहुंच सकें,

(vi) यात्रियों के लिए सुगम्य हो,

(vii ) इस तरह स्थित हो कि यान में स्थित कोई सीट अथवा अन्य वस्तु आपात दरवाजे के मार्ग को बाधित न करे,

(viii) यान के पिछली ओर अथवा दायीं ओर स्थित हो,

(ix) इसके लिए कोई सीढ़ी न हो । "

40. केंद्रीय मोटर यान (...... संशोधन) नियम, 2005 के प्रारंभ की तारीख से दो वर्ष पश्चात् से ही उक्त नियमों के नियम 128 के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्: -

" 128 क . एम 3 प्रवर्ग के यानों के लिए विशेष उपबंध - नियम 128 के उप नियम 4 के उपबंध एम 3 प्रवर्ग के सभी यानों पर लागू होंगे ।" । 41. केंद्रीय मोटर यान ( ... संशोधन) नियम, 2005 के प्रारंभ की तारीख से छह मास पश्चात् से ही उक्त नियमों के नियम 138 के उप नियम (4) में, -

(क) खंड ( ग) के पश्चात् निम्नलिखित परंतुक रखा जाएगा, अर्थात्: -

"(ग) परंतु यह और कि एम 3 और एन 3 प्रवर्ग के यानों में भी यान के आगे और पीछे स्थायी रूप से ए आई एसः 022 के अनुसार पश्च परावर्तक चेतावनी त्रिकोण लगाना अपेक्षित होगा । आगे का स्थान भूमि स्थल से न्यूनतम 1 मीटर ऊपर होना चाहिए । पीछे की दिशा में यह बंपर और गतिशील अवस्था में पश्च सुरक्षा तंत्र के मध्य होना चाहिए । " ;

(ख) खंड (ङ) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्: -

" (च) दुपहिया की खरीद के समय दुपहिया विनिर्माता बी आई एस द्वारा विहित विनिर्देश के अनुरूप सुरक्षा हैड गियर प्रदान करेगा ;

परंतु यह मोटर यान अधिनियम, 1988 की धारा 129 के निबंधनों के अनुसार छूट प्राप्त प्रवर्ग के व्यक्ति को लागू नहीं होगा । " । [ भाग II- खण्ड 3 ( i ) ]

19 42. 1 अक्तूबर, 2005 से ही प्ररुप 20, 21 , 22 , 23, 23 , 24, 25, 27, 28, 29, 31 , 32, 41 , 42, 43,46, 47, 51 और 54 में आने वाले " इंजन संख्या " शब्दों के स्थान पर " इंजन संख्या या बैटरी चालित यानों की दशा में मोटर संख्या " शब्द रखे जाएंगे ।

G.S.R. 172( E) .- The following draft of certain rules further to amend the Central Motor Vehicles Rules , 1989, which the Central Government proposes to make in exercise of the powers conferred by sections 27, 64, 110 and 128 of the Motor Vehicles Act, 1988 (59 of 1988) is hereby published as required by sub- section ( 1 ) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Gazette of India, are made available to the public;

The objections or suggestions which may be received from any person with respect to the said draft rules within the period so specified will be considered by the Central Government .

Theobjections or suggestions to these draft rules may be sent to the Joint Secretary (Transport ) , Department of Road Transport and Highways, Transport Bhawan , Parliament Street, New Delhi- 110001.

DraftRules

1. (1) These rules may be called the Central Motor Vehicles ( ..... Amendment) Rules, 2005.

(2)Save as otherwise provided in these rules, they shall come into force onthe date of their final publication in the Official Gazette .

2. In the Central Motor Vehicles Rules , 1989 ( hereinafter referred as the said rules) , in rule 2, after clause (t) , the following clauses shall be inserted, namely:-

'(u) "Battery Operated Vehicle " means a vehicle intended for road use, powered exclusively by an electric motor whose traction energy is supplied exclusively by traction battery installed in the vehicle:

Provided that if the thirty minute power of the motor is less than 0.25 kW, the battery operated vehicle shall not be deemed to be a motor vehicle.

Explanation . The thirty minute power of the motor is defined in AIS:49 : 2003 and method of verification is prescribed in AIS: 041 : 2003 , till thecorresponding BIS specifications are notified ;

(v) " Power tiller " means an agricultural machinery used for soil preparation having a single axle in which the direction of travel and its control for field operation is performed by the operator walking behind it . This equipment may or may not have a riding attachment and when coupled to a trailer can be used for the transportation of goods . The maximum speed of the power tiller when coupled to a trailer , shall not exceed 22 km/h . The maximum haulage capacity of the Power tiller coupled to a trailer shall not exceed 1.5 tons . ' .

3. In rule 4 of the said rules , -

(a) item number 1 and entry relating thereto shall be omitted;

(b) after item number 10 and entry relating thereto , the following item and entry shall be inserted , namely: -

"11. Any other documents as may be prescribed by the State Government under clause (k) of section 28 of the Motor Vehicles Act, 1988 :" .

4. On and from one month from the date of commencement of the Central Motor Vehicles (...... Amendment) Rules, 2005, in rule 24 of the said rules , in sub - rule (4) , the words "within a period of ninety days from receipt of such application " shall be inserted at the end.

5. In rule 25 of the said rules , the following proviso shall be inserted, namely: -

"Provided that validity of the said licence shall be subject to fulfilling the criteria, which are to be certified by the licensing authority or any other authority as may be prescribed for the purpose by the State Government on an annual basis . " .

6. On and from one month from the date of commencement of the Central Motor Vehicles (-- Amendment ) Rules , 2005, in rule 30 of the said rules, in sub - rule (2) , the words " within a period of forty-five days from receipt of such an appeal " shall be inserted at the end.

21 7. On and from one month from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, in rule 35 of the said rules, in sub - rule ( 1 ) , after the words and figures " in Form 17 " , the words "within thirty days from receipt of such an application " shall be inserted.

8. On and from one month from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, in rule 46 of the said rules, in sub - rule (2) , the words "within the period of thirty days from receipt of such an appeal " shall be inserted at the end .

9. in rule 48 of the said rules , the words " within thirty days from the receipt of such application " shall be inserted at the end .

10. On and from one year from the date of commencement of the Central Motor Vehicles (...... Amendment ) Rules , 2005, in rule 50 of the said rules , in sub - rule ( 1 ) , in clause ( vi ) , after the second proviso, the following provisos shall be inserted , namely: -

"Provided also that the size of registration plate for power tiller shall be 285 x 45 mm and shall be exhibited at the front . Further, in case of trailer coupled to power tiller, the size of registration plate shall be 200 x 100 mm and shall be exhibited on its rear:

Provided also that in case of a motor cycle , the size of 285 x 45 mm for front registration plate shall also be permitted ." .

11. in rule 51 of the said rules, in the table , after serial number 7 and entries thereto , the following serial number and entries thereto shall be inserted, namely:-

12. On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005 , in rule 62 of the said rules, in sub - rule ( 1 ) , for clause (c) , the following clause shall be substituted, namely: -

"(c) renewal of certificate of fitness in respect of vehicles covered under rule 82 of these rules

one year" .

13. On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, in rule 93 of the said rules, -

(a) in sub- rule (4 ) , for clause (ii ) , the following clause shall be substituted, namely:-

"(ii ) in the case of a double decked transport vehicle shall not exceed 4.75 metres and in the case of tractor trailer goods vehicle shall exceed 4.20 metres ; " ;

(b) in sub- rule ( 6 ) , in Explanation I, after sub - paragraph (b ) , the following sub-paragraph shall be inserted , namely: -

"(c) in the case of vehicles having more than three axles , the distance measured between the centre point of the front combination axles and the centre point of the rear combination axles. " .

14. On and from one year from the date of commencement of the Central Motor Vehicles (...... Amendment ) Rules , 2005, after rule 93A of the said rules, the following rule shall be inserted , namely: -

"93B . Overall dimensions for power tillers.- (i ) The overall length of the power tiller with a riding attachment shall not exceed 3.5 metres.

(ii) The overall length of the power tiller with a riding attachment including cage wheelers shall not exceed 1.5 metres .

(iii) The maximum overall height of the power tiller shall not exceed 2.0 metres.

(iv) The overall length of the power tiller when coupled to a trailer shall not exceed 6.0 metres .

(v) The maximum overall width of the power tiller when coupled to a trailer shall not exceed 1.7 metres .

(vi ) The maximum overall of the power tiller height when coupled to a trailer shall not exceed 2.0 metres . " .

15. In rule 95 of the said rules , for sub - rule (1 ) , the following sub- rule shall be substituted, namely: -

"(1) The tyres including radial tyres used on all motor vehicles manufactured on and after 1st October , 2005, other than agricultural tractors , construction equipment vehicles and power tillers shall comply the requirements specified in AIS : 044 ( Parts 1 to 3 ) : 2004 as applicable till the corresponding BIS specifications are notified:

Provided that the selection and fitment of tyres for motor vehicles manufactured on and after 1st October , 2005 shall be in accordance with AIS: 050: 2004 in the case of two and three wheelers and AIS : 051 : 2004 in the case other motor vehicles , till such time the corresponding BIS specifications are notified;

Provided further that Central Institute of Road Transport , Pune and any other agency which may be authorised by the Central Government from time to time can carry out tests for verification against AIS:044 for tyres for the purposes of rule 126." .

16. On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment ) Rules , 2005, after rule 95A, the following rule shall be inserted , namely : -

"95B. Size and ply rating of tyres for power tillers.- ( 1 ) The tyre should have load carrying capacity as specified by the tyre manufacturer , however, the maximum load specified by the power tiller manufacturer shall not be greater than that permitted by the tyre manufacturer .

(2) The power tiller manufacturer shall select the recommended / preferred rim sizes only , as suggested by the tyre manufacturer .

Note.- for compliance to the above two sub - rules, the following standards shall be referred to: -

(i ) IS: 13154-1991 , as amended from time to time Tyrefor agricultural tractor, implement and power tillers;

(ii ) In case a particular size of tyre is not listed in IS : 13154-1991, as amended from time to time, any equivalent International Standard like ECE , JATMA, ETRTO , TNRA , IFTAC, etc. " .

17. In rule 96 of the said rules , -

(a) for sub- rule (4 ) , the following sub - rule shall be substituted, namely: - " (4) Every motor vehicle manufactured on and after 1st October , 2005 shall have a braking system whose performance shall conform to the following Indian Standard , namely: -

(i ) For two wheelers and three wheelers IS : 14664-1999, as amended from time to time;

[PART II-SEC. 3 (i) ] (ii ) All motor vehicles , other than two wheelers , three wheelers , trailers , semi trailers , construction equipment vehicles , agricultural tractors and power tillers, IS : 11852 ( Part 1 ) : 2001 , 11852 ( Part 2) : 2001 , 11852 ( Part 3 ) : 2001 , 11852 ( Part 4) : 2001 , 11852 (Pari 5) : 2001 , 11852 ( Part 6) : 2001 , 11852 ( Part 7) : 2001 and 11852 ( Part 8): 2001, as amended from time to time:

Provided that the requirements of automatic wear adjustment specified in para 4.2.1.11a of IS: 11852: 2001 ( except Part 9) shall come into force on and from 1st April , 2006 .

Provided further that IS: 11852 ( Part 9 ) : 2001 shall be applicable for vehicles manufactured on and after 1st October , 2006 fitted with Anti- lock Braking System (ABS) . " ;

Provided further that Anti - lock braking system as may be certified by authorised testing agencies shall be fitted in accordance with IS: 11852-2003 (except Part 9 ) in respect of all N3 category vehicles other than tractor trailers , which are registered on and from 1st October , 2006 as carrying hazardous goods . Further , any tractor/ semi trailers registered on and from 1st October , 2007 shall be similarly fitted with such a device ." .

(b) after sub - rule (8) , the following sub - rule shall be inserted , namely: - " (9) The following category of vehicles shall be fitted with Anti -lock Braking System (ABS) : -

(i) N3 category of vehicles other than tractor-trailer combination manufactured on and after 1st October , 2006 meant for carrying hazardous goods and liquid petroleum gas;

(ii ) N3 category vehicles manufactured on and after 1st October , 2006, that are double decker car carriers ;

(iii ) N3 category vehicles manufactured on and after 1st October 2007 , that are used as tractor -trailer combinations ;

(iv)M3 category of buses that ply on All India Tourist permit, manufactured on and after 1st October , 2007. " .

25 18. On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, after rule 96C of the said rules , the following rule shall be inserted, namely: -

"96D . Braking requirements for power tillers.- The Power tillers when coupled to a trailer shall meet the following requirements-

(i ) the brake test for the power tiller coupled to a trailer shall be carried out with a gross combination weight not exceeding 1.5 tons as declared by the manufacturer;

(ii ) the brake test shall be conducted at a speed of 15 km / h to meet the stopping distance requirement of 7.5 metres with the pedal efforts not exceeding 600N ;

(iii ) the trailer coupled to the Power tiller shall be fitted with a parking brake capable of holding the combination on an upslope and down slope gradient of 12% . " .

19. On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, after rule 98B of the said rules , the following rule shall be inserted, namely: -

"98C. Steering gear for power tillers . The turning circle diameter and the turning clearance circle diameter of Power tillers coupled to trailers , when measured as per IS: 12222 , as amended from time to time, shall not exceed 10 metres . " .

20. On and from one year from the date of commencement of the Central Motor Vehicles ( ..... Amendment) Rules , 2005 , in rule 99 of the said rules , the following proviso shall be inserted, namely: -

"Provided that Power tillers with a riding attachment and power tillers coupled to trailers shall be capable of moving under its own power in the reverse direction also . " .

21. In rule 101 of the said rules, -

(a) In sub- rule ( 1 ) , on and from 1st October , 2005, for the words , figures and letters " motor cycles and three wheelers of engine capacity not exceeding 500 cc " , the words " and motor cycles " shall be substituted .

(b ) In sub - rule (3 ) , on and from 1st October, 2005, the words, figures and letters "with engine capacity not exceeding 500 cc" shall be omitted .

22. In rule 102 of the said rules , on and from 1st October, 2005 , for sub - rule (1) and proviso thereunder, the following sub - rule shall be substituted , namely: -

" (1) The signal to turn to the right or to the left shall be given by electrically operated direction indicator lamps on all motor vehicles including construction equipment vehicles . Every motor vehicle including construction equipment vehicle shall be fitted and maintained so that the following conditions are met , namely: - (i ) The direction indicator lamps shall be of amber colour which are illuminated to indicate the intention to turn , by a light flashing at the rate of not less then 60 and not more than 120 flashes per minute;

(ii) The light emitted by the lamps when in operation shall be clearly visible from both front and rear of the vehicle;

(iii) The minimum illuminated area of each direction indicator shall be 60 square centimeters:

Provided that nothing contained in this sub - rule shall apply to motor cycles of engine capacity exceeding 70 cc manufactured before 1st January, 2003 and to L1 category of motorcycles . ".

23. In rule 103 of the said rules , on and from 1st October , 2005 , in sub- rule (2) , for the words , figures and letters " three wheelers of engine capacity not exceeding 500 cc " , shall be omitted .

1 24. Inrule 104 of the said rules , -

(a ) for sub - rule ( 1 ) and proviso thereunder, the following sub - rule and proviso shall be substituted , namely: -

"(1) Every motor vehicle manufactured on and after 1st October , 2005, including trailers and semi - trailers , other than three wheelers and motor cycles shall be fitted with two red reflectors , one each on both sides at their rear . Every motor cycle shall be fitted with at least one red reflex reflector at the rear :

Provided that a reflective tap or reflective paint of not less than 20 mm width and running across the width of the body shall be affixed / painted at the front and rear of every goods carriage . ";

( b) in sub- rule (2 ) , on and from 1st October , 2005, the words, figures and letters "of engine capacity not exceeding 500 cc " shall be omitted ;

(c) in sub- rule (3 ) , on and from 1st October , 2005, the words , figures and letters " on engine capacity not exceeding 500 cc " shall be omitted;

(d) in sub - rule (4) , on and from 1st October , 2005 , for the words , figures and letters "the Indian Standards IS:8339-1993 specifiedby the Bureau of Indian Standards " , the words , figures and letters " AIS : 057-2005 till thecorresponding BIS specifications are notified " shall be substituted;

25. After rule 104A of the said rules, the following rules shall be inserted, namely: -

( a) " 104B . Fitment of reflectors for agricultural tractors.- ( 1 ) Every agricultural tractor shall be fitted with two non - triangular red reflectors of not less than 28.5 sq.cm. reflecting area one each on both sides at the rear .

(2) The reflectors referred in sub- rule ( 1) of this rule shall be of the reflex type conforming to Indian Standard IS: 8339-1993 , as amended from time to time . " ;

(b) 104C. Fitment of reflectors on power tillers.- on and from one month from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005 ,-

(i ) every power tiller shall be fitted with two white reflex reflectors of not less than 28.5 sq.cm. reflecting area in the front of the vehicle one on each side and visible to oncoming vehicles from the front at night;

(ii) in the case of trailers attached to power tiller , two red reflectors of not less than 28.5 sq.cm. reflecting area in the rear side , one each at right and left corners , at a height not exceeding 1500 mm above the ground shall also be fitted. " .

26. On and from 1st October , 2005 , in rule 105 of the said rules , for sub- rule (1) , the following sub - rule shall be substituted , namely: -

"(1) Save as hereinafter provided , every motor vehicle , while being driven in a public place, during the period half an hour after sunset and at any time when there is no sufficient light, shall be lit with the following THE GAZETTE OF INDIA: EXTRAORDINARY

lamps which shall render clearly discernible persons , vehicles and any other objects on the road at a distance of one hundred and fifty five metres ahead-

(a) in the case of motor vehicle other than three wheelers , three wheeled invalid carriages , motor cycles and construction equipment vehicles, two or four head lamps;

(b) in the case of motor cycles and three wheeled invalid carriages one or two head lamps ;

27. On and from 1st October , 2005, in rule 109 of the said rules , the words , figures and letters "of engine capacity not exceeding 500 cc " shall be omitted.

28. On and from 1st October , 2005 , in rule 110 of the said rules, -

(a ) for the heading , the following heading shall be substituted , namely : - " Lamps on three wheelers " ;

(b) for the words, figures and letters "auto- rickshaw and three wheeler of engine capacity not exceeding 500 cc " , the words "three wheeler " shall be substituted;

(c) after the proviso , the following proviso shall be inserted , namely: - "Provided further that fitment of one head lamp shall be applicable only in case of three wheelers with overall width not exceeding 1400 mm and in such cases the side lights shall be amber in colour ." .

29. On and from one year from the date of commencement of the Central Motor Vehicles ( ......Amendment) Rules , 2005, in rule 115A of the said rules, -

(a) for the heading , the following heading shall be substituted namely: - "Emission of smoke and vapour from agricultural tractors, power tillers and construction equipment vehicles driven by diesel engines " ;

(b) in sub - rule (4) , for the words "construction equipment vehicles " , the words, "construction equipment vehicles and power tillers " shall be substituted.

"(5) Every diesel driven agriculture tractor and power tiller shall be so manufactured and produced by the manufacturer that it complies with the following standards of gaseous pollutants emitted by them in addition to those of visible pollutants as provided in sub - rule (2) when tested as per the procedure described in ISO 8178-4 'C1 ' 8 mode cycle , namely: -

Theweighted average Mass of Carbon Monoxide ( CO ) , Hydrocarbon (HC) and oxides of nitrogen ( NOx) , and Particulate Matters ( PM) in gram per kilo watt hour emitted during the test shall not exceed the limits given below in the Table for Type Approval (TA) and Conformity of Production (COP) tests , namely: -

Notes:-

(1)The norms mentioned in column ( 2) of the Table shall be applicable for agricultural tractor with effect from 1st June , 2003 and for power tillers from 1st October , 2006 .

(2)The norms mentioned in column (3) of the Table shall be applicable for agricultural tractor with effect from 1st October, 2005 and for power tillers from 1st April , 2008. " .

30. Inrule 115B of the said rules, -

(a) On andfrom one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment ) Rules , 2005 , in part A, in item (I ) , in clause (a ) , -

(i ) for the words and figures " Bharat Stage- II " , the words and figures " Bharat Stage - III " shall be substituted;

(ii) for the words , figures and brackets " India - 2000 ( India Stage- I ) " , the words and figures " Bharat Stage - II " shall be substituted .

(b) in part A, in item ( II ) , for clause ( a ) , the following clause shall be substituted , namely: -

4 "(a) On and after expiry of one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, the in - use vehicles fitted with CNG kits shall meet the type approval emission norms specified in these rules for gasoline vehicles as applicable to the corresponding year of manufacture of such vehicle , subject to the condition that it shall meet minimum Bharat Stage II emission norms. However , the vehicle manufactured with Bharat Stage III emission norms shall meet the Bharat Stage III emission norms:

Provided that in respect of vehicle model/conversion kits/engine replacements type approved and certified under rule 115B prior to commencement of these rules (as per notification no . G.S.R. 853 (E) dated 19th November , 2001 ) , such certificates shall cease to be valid twelve months from the date of this notification , notwithstanding the period of validity specified in such certificates. Such certificates need to be revalidated by testing agencies in terms of the Central Motor Vehicles (...... Amendment ) Rules , 2005." .

(c) On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005 , in part B , in item ( I ) , in clause(a) , -

( i ) for the words and figures " Bharat Stage - II " , the words and figures "Bharat Stage- III " shall be substituted ;

(ii ) for the words, figures and brackets " India - 2000 ( India Stage - I ) " , the words and figures "Bharat Stage - II " shall be substituted .

(d) On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005 , in part F, for note 7, the following shall be substituted, namely: - भारत का राजपत्र असाधारण

"7. In case of conversion kits on in - use gasoline vehicles or converted diesel vehicles the validity of the certificate issued by the testing agencies shall apply to all such vehicles manufactured in the year of manufacture of the vehicle on which such kit had been tested and would extend till the validity of Bharat Stage- II or Bharat Stage- III norms, respectively as may be applicable . Testing agencies will be required to indicate specifically, the models and their variants on which the certificate will be valid . " .

31.

In rule 115C of the said rules, -

(a) In sub -rule (3 ) , for clause (a) , the following clause shall be substituted , namely: -

"(a ) On and after expiry of one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules, 2005, the in - use vehicles fitted with LPG kits shall meet the type approval emission norms specified in these rules for gasoline vehicles as applicable to the corresponding year of manufacture of such vehicle , subject to the condition that it shall meet minimum Bharat Stage - II emission norms:

Provided that in respect of vehicle model / conversion kits/engine replacements type approved and certified under rule 115C prior to commencement of these rules (as per notification no . G.S.R. 284(E) dated 24th April , 2001 ) , such certificates shall cease to be valid for one year from the date of this notification , notwithstanding the period of validity specified in such certificates . Such certificates need to be revalidated by testing agencies in terms of the Central Motor Vehicles (......Amendment) Rules, 2005. " .

(b) sub- rule (5) shall be omitted.

(c) On and from one year from the date of commencement of the Central Motor Vehicles ( ......Amendment) Rules, 2005, in sub - rule ( 6) , -

(i ) for the words and figures " Bharat Stage - II " , the words and figures " Bharat Stage- III " shall be substituted;

(ii ) for the words , figures and brackets " India- 2000 ( India Stage- I ) " , the words and figures "Bharat Stage - II " shall be substituted .

(d) On andfrom one year from the date of commencement of the Central Motor Vehicles ( ......Amendment) Rules, 2005, in sub- rute ( 7) , - THE GAZETTE OF INDIA : EXTRAORDINARY

(i ) for the words and figures "Bharat Stage - II " , the words and figures "Bharat Stage- III " shall be substituted;

(ii) for the words , figures and brackets " India - 2000 ( India Stage - I ) " , the words and figures "Bharat Stage - II " shall be substituted.

(e) On and from one year from the date of commencement of the Central Motor Vehicles (...... Amendment ) Rules , 2005 , in sub- rule (10 ) , after Note 5, thefollowing Note shall be inserted , namely: -

"(6) In case of conversion kits on in -use gasoline vehicles or converted diesel vehicles the validity of the certificate issued by the testing agencies shall apply to all such vehicles manufactured in the year of manufacture of the vehicle on which such kit had been tested and would extend till the validity of Bharat Stage- II or Bharat Stage- III norms , respectively as may be applicable . Testing agencies will be required to indicate specifically, the models and their variants on which the certificate will be valid .".

32. On and from one month from the date of commencement of the Central Motor Vehicles ( ...... Amendment) Rules , 2005, in rule 119 of the said rules,-

(a) in sub - rule ( 1 ) , for the words, "every motor vehicle including a construction equipment vehicle and agricultural tractor " the words "every motor vehicle , agricultural tractor , power tiller and construction equipment vehicle " shall be substituted.

(b) under sub - rule ( 1 ) , in the proviso , for the words , " horn installation requirements " , the words , " horn installation requirements for motor vehicle " shall be substituted.

33. In rule 120 of the said rules , -

(a) under sub- rule ( 2 ) , the following proviso shall be inserted , namely: - "Provided that on and from 1st October , 2005, where different noise levels are prescribed for petrol and diesel vehicles , the limits prescribed for petrol vehicles , shall apply to Battery Operated Vehicles. ";

(b) On and from one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment ) Rules , 2005 , after sub- rule (3 ) , following sub- rule shall be inserted, namely, - 33

"(4) In the case of Power tiller with a riding attachment or Power tiller coupled to trailer, the noise level when tested as per IS: 12180- 2000, as amended from time to time, shall not exceed 88 dB (A) at the bystander position and 98 dB (A) at the operator's ear level . " .

34. On and from 1st October , 2005, in rule 122 of the said rules , -

(a) for the heading , the following heading shall be substituted , namely: -

"Embossment of the Chassis number and Engine number or in the case of Battery Operated Vehicles , motor number and month of manufacture" ;

(b ) in sub - rule ( 1 ) , in the proviso , for the words, "engine number , chassis number and month of manufacture all together " , the words "engine number/motor number, chassis number and month of manufacture" shall be substituted .

35. On andfrom one month from the date of commencement of the Central Motor Vehicles ( ..... Amendment ) Rules , 2005, in rule 124 of the said rules , after sub - rule ( 1A) , the following proviso shall be inserted, namely: -

"Provided that the vehicle manufacturers shall ensure the fitment of the rear under run protective device in vehicles of categories N2 , N3 and their trailers except special purpose vehicles namely tractors and tippers at their end and lateral under run protective device either at their factory or at their dealer's end . Vehicle not fitted with such devices can not be registered under these rules . They shall also ensure to supply necessary kits if the fitment is not done by them:

Provided further that the rear under run protective device shall also be painted with yellow and white zebra stripes on the entire rear face of the device . A temporary red reflective triangle shall also be provided on the rear bumpers , till such time as truck body has been constructed . " ,

36. On and from one year from the date of commencement of the Central Motor Vehicles ( ..... Amendment) Rules , 2005 , after rule 124A of the said rules , the following rule shall be inserted , namely: -

"124B . Safety Standards of components for power tillers.- (1 ) The lamps/bulbs used on power tillers for the following:

(i ) Head Light main and dip .

(ii ) Parking light

(iii ) Direction indicator lamp

(v) Reversing lamp

(vi) Stop lamp

(vii ) Rear Registration mark illuminating lamp

shall be in accordance with AIS: 034, as amended from time to time till the corresponding BIS specifications are notified.

(2) The lighting and signaling devices shall be in accordance with AIS: 062 , as amended from time to time , till the corresponding BIS specifications are notified .

(3) The safety and comfort of the operator of a power tiller shall be in accordance with IS: 12239 ( Part 3 )-1996 , as amended from time to time.

(4) The grade ability of a power tiller coupled to a trailer under the declared combination weight by the manufacturer shall be in accordance with IS : 9980-1988 , as amended from time to time .

37. In rule 125 of the said rules , after sub - rule (5) , the following sub- rules shall be inserted, namely: -

"(6) On and from 1st October , 2006, the seats , their anchorages and their head restraints for M2 , M3 , N1 , N2 and N3 Category of vehicles, shall be in accordance with AIS : 023 , as amended from time to time till the corresponding BIS specifications are notified .

38. After rule 125A of the said rules, the following rules shall be inserted, namely: -

"125B . Special requirements for transport vehicles that are driven on hills . On andfrom 1st October , 2005, such transport vehicles as may be notified by State Governments in the official Gazette plying on such routes or areas in hilly terrains shall be fitted with fog lamp , power steering , defogging and demisting system:

Provided that the anti - lock braking system shall be introduced in all M -2category buses plying on All India Tourist Permit on and from 1st October, 2007 in such areas .

125C. Body building and approval.- ( 1) On and after 1st October , 2006, the testing and approval for body building of buses shall be in [ भाग II- खण्ड 3 (i ) ]

35 accordance with AIS: 052 for vehicles mentioned therein , till the corresponding BIS specifications are notified.

(2) The testing and approval for the body building of school buses shall be in accordance with AIS: 063 for vehicles mentioned therein , till the corresponding BIS specifications are notified . " .

39. On andfrom one year from the date of commencement of the Central Motor Vehicles ( ...... Amendment ) Rules , 2005, in rule 128 of the said rules , for sub- rule (4) , the following sub- rule shall be substituted, namely: -

"(4) Emergency Exit- The emergency exit provided on the tourist vehicle shall meet the following requirements: -

(i ) be clearly marked 'EMERGENCY EXIT' in bold letters on the inside and the outside of the tourist vehicle;

(ii ) be fitted with doors to open both from the inside and outside of the tourist vehicle;

(iii ) be so designed as to open from inside and the outside of the tourist vehicle;

(iv) be equipped with a fastening device which can be quickly released but so designed as to offer protection against accidental release;

(v) be easily accessible to persons of normal height standing on the ground outside the vehicle;

(vi ) be easily accessible to the passengers ;

(vii) be such that no seat or other object placed in the vehicle shall restrict the passage to the emergency door;

(viii) be located either at the back or on to the right hand side of the vehicle; and

(ix) have no step leading to it . " .

40. On and from two years from the date of commencement of the Central Motor Vehicles ( ......Amendment) Rules, 2005, after rule 128 of the said rules , the following rule shall be inserted , namely: -

"128A. Special provision for M3 category of vehicles . - [PART II-SEC. 3 ( i) ]

Theprovisions of sub - rule 4 of rule 128 shall apply to all M3 category of vehicles.

41. On and from six months from the date of commencement of the Central Motor Vehicles ( ...... Amendment ) Rules , 2005 , in rule 138 of the said rules , in sub- rule (4) , -

(a) After clause (c) , the following proviso shall be substituted , namely: - "Provided further that in addition M3 and N3 category of vehicles shall also be required to install red retro - reflective warning triangle as per AIS: 022 , permanently in front as well as at the rear of the vehicle. The location in front should be at least one meter above the ground level . At the rear it should be between the bumper and the rear under run protective device . " ;

(b) after clause (e) , the following clause shall be inserted , namely: -

1 "(f) at the time of purchase of two wheeler , the manufacturer of the two wheeler shall supply a protective headgear conforming to specifications prescribed by BIS:

Provided that this shall not apply to category of person exempted in terms of section 129 of the Motor Vehicles Act , 1988. " .

42. On and from 1st October , 2005, the words " Engine number " appearing in Forms 20 , 21 , 22, 22A, 23 , 23A, 24, 25, 27 , 28, 29, 31 , 32, 41, 42, 43, 46, 47, 51 and 54, the words "Engine number or motor number in the case of battery operated vehicles " shall be substituted .
