सा.का.नि. 173( अ ) .-केन्द्रीय सरकार, रेल दावा अधिकरण अधिनियम , 1987 ( 1987 का 54 ) की धारा 30 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रेल दावा अधिकरण ( प्रक्रिया ) नियम, 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम रेल दावा अधिकरण ( प्रक्रिया ) संशोधन नियम , 2005 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. ( क) रेल दावा अधिकरण ( प्रक्रिया ) नियम, 1989 के, नियम 31 के उप- नियम ( 1 ) के स्थान पर, निम्नलिखित रखा जाएगा, अर्थात्:-
" ( 1 ) अधिकरण , आवेदक और प्रत्यर्थी की सुनवाई करने के पश्चात् या तो तुरंत या उसके पश्चात् जहां तक हो सकें, यथासाध्य शीघ्र लेकिन बहस समाप्त हो जाने की तारीख से इक्कीस दिन के भीतर आदेश पारित करेगा; और जहां वह ऐसा करने में असमर्थ है , अपनी असमर्थता के कारण अभिलिखित करेगा । "
(ख) नियम 32 के उप- नियम ( 2 ) के स्थान पर, निम्नलिखित रखा जाएगा, अर्थात्:-
" ( 2 ) जहां अधिकरण को यह प्रतीत होता है कि पुनर्विलोकन के लिए पर्याप्त आधार नहीं है, वहां वह आवेदन को नामंजूर कर देगा और ऐसा करने के लिए अपने कारण अभिलिखित करेगा । "

NOTIFICATION
New Delhi , the 16th March , 2005
G.S.R. 173 (E). In exercise of the powers confcrted by Sub - section (2 ) of Section 30 of the Railway Claims Tribunal Act , 1987 (54 of 1987 ) , the Central Government hereby makes the following rules further to amend the Railway Claims Tribunal (Procedure ) Rules, 1989, namely:-
1. ( 1 ) These rules may be called the Railway Claims Tribunal (Procedure ) Amendment Rules, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Railway Claims Tribunal (Procedure ) Rules , 1989,-
(a) for sub -rule ( 1) ofrule 31 , the following shall be substituted, namely :-
"( 1 ) The Tribunal , after hearing the applicant and respondent, shall pass an order cither at once , or as soon as thereafter, as may be practicable, but not later than twenty -one days from the date of conclusion ofthe arguments ; and where it is unable so to do , it shall record its reasons for such inability. " (b) for sub - rule (2 ) of rule 32 , the following shall be substituted, namely:-
"(2) Where it appears to the Tribunal that there is no sufficient ground for a review, it shall reject the application and record its reasons for so doing. "
