सा.का.नि. 174(अ).-औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप, औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और 33 की अपेक्षानुसार, भारत के राजपत्र, असाधारण , भाग II , खण्ड 3 , उप- खण्ड ( i ) , तारीख 23 अगस्त, 2004 में भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना सं. सा.का.नि. 537( अ ) , तारीख 23 अगस्त , 2004 के अधीन प्रकाशित किया गया था, जिसमें उन सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना अंतर्विष्ट है, जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां तारीख 23-8-2004 को जनता को उपलब्ध करा दी गई थीं;
और उक्त प्रारूप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार ने विचार कर लिया है ;
अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( चौथा संशोधन ) नियम , 2005 है ।
(2 ) ये राजपत्र में उनके प्रकाशित की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम, 1945 की अनुसूची त में-
(क) " अन्य वैक्सीन " शीर्षक के अधीन क्रम सं. 2 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित शब्द, संख्या और अक्षर रखे जाएंगे, अर्थात्:-

NOTIFICATION

G.S.R. 174 ( E) . Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published , as required by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , in the Gazette of India, Extraordinary, Part II , Section 3 , Sub- section ( i ) dated the 23rd August, 2004 , under the notification of the Government of India in the Ministry ofHealth and Family Welfare ( Department of Health) , number G.S.R. 537 (E) , dated the 23rd August, 2004, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
Andwhereas copies of the said Gazette were made available to the public on 23-8-2004;
And whereas objections and suggestions received from the public on the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Sections 12 and 33 of the said Act, the Central Gvoernment , after consultation with the Drugs Technical Advisory Board , hereby makes the following rules further to amend the Drugs and Cosmetics , Rules , 1945 , namely :-
1.(1) These rules may be called the Drugs and Cosmetics (IV Amendment ) Rules , 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
1. In the Drugs and Cosmetics Rules, 1945 , in Schedule ' P'-
(a) under the heading 'Other Vaccines ' , for serial number 2 and the entries relating thereto , the following words , figures and letter shall be substituted, namely: ---
