सा.का.नि. 176 (अ) .-खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार, खाद्य अपमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात् बनाना चाहती है, उक्त उपधारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है, और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती हैं, साठ दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
सकेंगे; आक्षेप या सुझाव, यदि कोई हों, सचिव , स्वास्थ्य और परिवार कल्याण मंत्रालय , भारत सरकार, निर्माण भवन , नई दिल्ली-110011 को भेजे जा ऐसे आक्षेपों और सुझावों पर, जो उक्त प्रारूप नियमों की बावत्किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति के पूर्व प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( संशोधन ) नियम , 2005 है।
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम , 1955 में ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) , के नियम 22 में सारणी के पश्चात् विद्यमान " टिप्पण " के स्थान पर निम्नलिखित टिप्पण रखा जाएगा, अर्थात्-

[PART II-SEC . 3 ( i) ] " टिप्पण- पैकेजबंद दशा में ( मुहरबंद आधान/पैकेज ) बिक्रीत आहार जहां तक व्यवहार्य हो, पैकेज को खोले बिना अनुमानित मात्रा गठित करने के लिए मूल लेबल सहित उसकी मूल दशा में विश्लेषण के लिए भेजा जाएगा । थोक पैकेजों की दशा में, जहां भी इन नियमों के अधीन अपेक्षानुसार परिरक्षी मिलाने हों, नमूना मुहरबंद आधानों/ पैकेज को खोलने के पश्चात् लिया जाएगा । मूल लेबल की अंतर्वस्तु नमूने के साथ विश्लेषण के लिए भेजी जाएगी । तथापि , ऐसे नमूने सूक्ष्मजीवीय विश्लेषण के लिए उपयुक्त नहीं होंगे । "

रीता तेवतिया, संयुक्त सचिव टिप्पण: खाद्य अपमिश्रण निवारण नियम, 1955 भारत के राजपत्र, भाग II खण्ड 3 में का.नि.आ. 2106 तारीख 12 सितम्बर, 1955 के तहत प्रकाशित किए गए थे और अंतिम संशोधन सा. का. नि. 821 (अ ) तारीख 21-12-2004 द्वारा किया गया ।

NOTIFICATION
New Delhi, the 16th March, 2005
G.S.R. 176 (E ) .-The following draft of certain rules further to amend the Prevention of Food Adulteration Rules, 1955 , which the Central Government , after consultation with the Central Committee for Food Standards , proposes to make, in exercise of the powers conferred by sub - section ( 1 ) of Section 23 of the Prevention of Food Adulteration Act , 1954 (37 of 1954) , is hereby published, as required by the said Sub- section , for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Official Gazette in which this notification is published , are made available to the public;
Objections or suggestions , if any , maybe addressed to the Secretary, Ministry of Health and Family Welfare, Government of India, Nirman Bhavan, New Delhi -110011.
The objections and suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Government;
DRAFT RULES
Amendment) Rules, 2005 . 1.(1) These rules may be called the Prevention of Food Adulteration ( ..
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Prevention of Food Adultcration Rules , 1955 ( hereinafter referred to as a said rule) , in rule 22 , after the table for the existing " Note " , the following note shall be substituted , namely :-
"Note:---Food sold in packaged condition ( scaled container /package ) shall be sent for analysis in its original condition, without opening the package as far as practicable , to constitute approximate quantity alongwith original label . In case of bulk packages wherever preservatives are to be added, as per the requirement under these rulcs, the sample shall be taken after opening sealed container/package . The contents of the original label shall also be sent alongwith the sample for analysis . However, such samples shall not be fit for microbiological analysis ".

Note : The Prevention of Food Adulteration Rules , 1955 were published in Part 11 , Section 3 ofGazette of India vide S.R.O. 2106, dated the 12th September, 1955 and were last amended vide No. G.S.R. 821 (E) , dated 21-12-2004.
