सा.का.नि. 191 (अ). जबकि , मैसर्स सिंगरेनी कोलिरिएज कंपनी लिमिटेड , ईस्टर्न कोलफील्ड्स लिमिटेड और केन्द्रीय खनन अनुसंधान संस्थान ने केन्द्र सरकार से यह अभिवेदन किया है कि पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल-आर) का प्रयोग भूमिगत खानों में ब्लास्टिक गैलरी पद्धति में किया जाता है और बाजार में पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों का कोई प्रतिस्थानी उपलब्ध नहीं था ।
और जबकि यह भी अभिवेदन किया गया है कि नाइट्रो-ग्लाइसीरीन आधारित विस्फोटकों पर प्रतिबंध के कारण देश के दक्षिणी क्षेत्र में विद्युत जनित्रण के लिए कोयले के उत्पादन पर गंभीर प्रभाव पड़ा है:
और जबकि केन्द्र सरकार की यह राय है कि केवल मैसर्स सिंगरेनी कोलिरिएज कंपनी लिमिटेड, ईस्टर्न कोलफील्ड्स लिमिटेड और केन्द्रीय खनन अनुसंधान संस्थान को ही भूमिगत खनन में ब्लास्टिंग गैलरी पद्धति में पी-3 किस्म के नाइट्रो-ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल-आर ) का प्रयोग करने की अनुमति देना जनहित में उचित है;
अतः अब विस्फोटक अधिनियम , 1884 ( 1884 का 4) की धारा 14 की उप- धारा ( 2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा निम्नलिखित को , इस अधिसूचना के प्रकाशन से एक वर्ष की अवधि के लिए भूमिगत खनन में ब्लास्टिंग पद्धति में , पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल -आर) का प्रयोग करने , रखने एवं परिवहन करने की छूट प्रदान करती हैः (i) मैसर्स सिंगरेनी कोलिरिएज कंपनी लिमिटेड , ईस्टर्न कोलफील्ड्स लिमिटेड और केन्द्रीय 1011 GI/2005

खनन अनुसंधान संस्थान ( सीएमआरआई) को पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल -आर ) को रखने , परिवहन करने एवं प्रयोग करने के लिए ; और (ii) पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल-आर) के विनिर्माण हेतु लाइसेंस वाली इकाईयों को , पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल-आर) , को रखने , बेचने और परिवहन करने के लिए ।
2. उपर्युक्त छूट पर निम्नलिखित शर्तें लागू होंगी , नामतः-
(i) पी-3 किस्म के नाइट्रो- ग्लाइसीरीन आधारित विस्फोटकों ( बैलजेक्स कोल -आर) का कुल उत्पादन 500 मीट्रिक टन से अधिक न हो;
(ii) इस प्रकार के विस्फोटकों का उत्पादन , वाणिज्य और उद्योग मंत्रालय के तहत विस्फोटक विभाग के प्रतिनिधियों की निगरानी में किया जाएगा;
ऐसे विस्फोटकों को विनिर्माताओं के परिसर से इन्हें प्रयोग करने के स्थान तक सशस्त्र (iii)
सुरक्षा गार्डों की सुरक्षा में ले जाया जाएगा ; (iv) विनिर्माताओं और उपयोगकर्ताओं द्वारा उत्पादन , परिवहन एवं उपयोग का रिकार्ड रखा जाएगा , जी विस्फोटक विभाग द्वारा जांच के लिए खुले रहेंगे ;
(v) उपयोगकर्ताओं द्वारा ऐसे विस्फोटकों को भंडारित किए जाने की जगह पर पर्याप्त एवं सख्त सुरक्षा का भी प्रबंध किया जाएगा तथा ऐसे विस्फोटकों के भंडारण व उपयोग के बारे में विस्फोटक विभाग को मासिक सूचना उपलब्ध करायी जाएगी; और
(vi) उपयोगकर्ता और विनिर्माता इस अधिसूचना में विनिर्दिष्ट की गई अवधि के भीतर , शेष स्टॉक का, यदि कोई हो , निपटान कर देंगे ।

NOTIFICATION

G.S.R. 191 (E) .- Whereas , it has been represented by M/ s Singareni Collieries Company Limited , Eastern Coalfields Limited and Central Mining Research Institute to the Central Government that P-3 type Nitro-glycerine based explosives ( Belgex Coal - R ) are used in the Blasting Gallery method in underground mines and there was no substitute available for P -3 type Nitro- glycerine based explosives in the market;

And whereas , It has also been represented that production of coal for power generation has been seriously affected in the southern region of the country, due to ban of Nitro-glycerine based explosives;
Andwhereas , the Central Government is of the opinion that it is expedient in the public interest to allow only M/s. Singareni Collieries Company Limited, Eastern Coalfields Limited and Central Mining Research Institute to use P -3 type Nitro-glycerine based explosives (Belgex Coal - R) in the Blasting Gallery method in underground mining ;
Now , therefore , in exercise of the powers conferred by Sub - section (2) of Section 14 of the Explosives Act , 1884 (4 of 1884) , the Central Government hereby exempts :
(i) M/sSingareni Collieries Company Limited , Eastern Coalfields Limited and Central Mining Research Institute ( CMRI ) for possession , transport and use of P- 3 type Nitro-glycerine based explosives (Belgex Coal-R); and
(ii) Units having licence to manufacture P- 3 type Nitro-glycerine based explosives (Belgex Coal - R ) for possession , sale and transport of P -3 type Nitro-glycerine based explosives ( Belgex- Coal - R),
To use , possess and transport P - 3 type nitro -glycerine based explosives (Belgex- Coal R) in Blasting Gallery method in underground mining , for a period of one year from the date of publication of this notification .
2. The above exemption shall be subject to the following conditions , namely:-
(i ) Total production of P -3 type NG explosives (Belgex - coal R ) does not exceed 500 Metric Tonnes;
(ii) Such explosives shall be produced under the supervision of representatives of Department of Explosives under the Ministry of Commerce & Industry;
( iii ) Such explosives shall be transported from the manufacturers' premises to the site where it isto be used under armed security guards;

[PART II -SEC. 3(i)] (iv) The manufacturers as well users shall maintain records of production , transport and usage , which would be open for scrutiny by the Department of Explosives;
(v) The users shall also arrange adequate and strict security at the place of strorage of such explosives and furnish monthly information about storage and usage of such explosives to Department of Explosives; and
(vi ) The user and manufacturer shall dispose of the remaining stocks, if any, within the period specified under this notification .
