विषयः- यूरोपीय संघ और चीनी ताइपेई से सोडियम नाइट्रेट के आयातों से संबंधित पाटनरोधी जांच । सं. 54/ 1 / 2001-डीजीएडीः- 1995 में यथासंशोधित सीमाशुल्क टैरिफ अधिनियम, 1975 तथा सीमाशुल्क टैरिफ (पाटित वस्तुओं का अभिज्ञान, उन पर शुल्क अथवा अतिरिक्त शुल्क का आकलन एवं वसूली तथा क्षति निर्धारण) नियमावली, 1995 के अंतर्गत दिनांक 28 अक्तूबर, 2002 की अंतिम जांच अधिसूचना संख्या 54/1 / 2001-डीजीएडी के द्वारा निर्दिष्ट प्राधिकारी ईयू और चीनी ताइपेई से सोडियम नाइट्रेट के आयातों के संबंध में पाटनरोधी शुल्क लगाने की सिफारिश करते हैं । पाटनरोधी शुल्क केन्द्र सरकार द्वारा दिनांक 29 नवम्बर, 2002 की अधिसूचना द्वारा अधिसूचित किया गया था । यतः विनिर्दिष्ट प्राधिकारी के ध्यान में यह लाया गया है कि चीनी ताइपेई में सोडियम नाइट्राइट का उत्पादन नहीं होता है और जांच अवधि के दौरान ( 1 अप्रैल , 2000 से 31 मार्च, 2001 तक) चीनी ताइपेई से सम्बद्ध वस्तु का कोई निर्यात नहीं हुआ है । सभी हितबद्ध पक्षकारों को सरकारी आंकड़ों में पाई गई आंकड़े संबंधी ऐसी त्रुटियों के बारे में सूचना दी गई थी जिसके आधार पर चीनी ताईपेई से सोडियम नाइट्रेट के आयातों पर पाटनरोधी शुल्क लगाया गया था । भारत के सीमाशुल्क प्राधिकारियों द्वारा बाद में की गई जांच से यह पुष्टि हुई है कि चीनी ताइपेई से उक्त आयात वास्तव में चीन जन ० गण० से हुए थे । उपर्युक्त को ध्यान में रखते हुए दिनांक 28 अक्तूबर, 2002 की अधिसूचना सं. 54/1 / 2001- डीजीएडी के तहत अधिसूचित जांच परिणामों के पैरा 25 और 26 के स्थान पर निम्नलिखित पैरा प्रतिस्थापित किया जाता है ।
ण. निष्कर्ष
25. उपरोक्त पर विचार करने के पश्चात प्राधिकारी का निष्कर्ष यह हैकिः-
(क) ईयू मूल के अथवा वहाँ से निर्यातित सोडियम नाइट्राइट का भारत को निर्यात सामान्य मूल्य से कम मूल्य पर किया गया है जिसके परिणाम स्वरूप पाटन हुआ है ।

(ख) घरेलू उद्योग को वास्तविक क्षति हुई है ।
(ग) ईयू से सम्बद्ध वस्तु के पाटित आयातों द्वारा क्षति हुई है ।
26. पूर्वोक्त पर विचार करने के पश्चात प्राधिकारी का यह निष्कर्ष है किः
क. प्राधिकारी यूरोपीय यूनियन के मूल के अथवा वहाँ से निर्यातित सोडियम नाइट्रेट जो सीमाशुल्क टैरिफ अधिनियम के अध्याय 28 के अंतर्गत आता है, के सभी आयातों पर निश्चयात्मक पाटनरोधी शुल्क लगाने की सिफारिश करते हैं ।
ख. प्राधिकारी ने पाटन मार्जिन के बराबर अथवा उससे कम पाटनरोधी शुल्क की राशि की सिफारिश करने पर विचार किया जिसे यदि लगाया जाता है तो उससे घरेलू उद्योग को भी क्षति समाप्त हो जाएगी । इस प्रयोजनार्थ आयातों के औसत पहुँच मूल्य की तुलना जांच अवधि के लिए निर्धारित याचिकाकर्ता कम्पनी की गैर क्षति कारक कीमत के साथ की गई थी । जहाँ उक्त अन्तर पाटन मार्जिन से कम पाया गया था वहाँ पाटन मार्जिन से कम शुल्क लगाने की सिफारिश की जाती है ।
ग. तदनुसार, प्राधिकारी पाटनरोधी शुल्क लगाने के बारे में प्रारंभिक जांच परिणामों की पुष्टि करते हैं और यूरोपीय यूनियन से आयातित सोडियम नाइट्रेट पर निश्चयात्मक शुल्क लगाने की सिफारिश करते हैं । पाटनरोधी शुल्क की राशि सीमाशुल्क टैरिफ के अध्याय 28 के अंतर्गत आने वाले यूरोपीय यूनियन के मूल के अथवा वहां से निर्यातित सोडियम नाइट्रेट के सभी आयातों पर निम्नलिखित तालिका के कालम (3 ) में उल्लिखित राशि होगी ।

Collection of Anti - Dumping Duty on Dumped Articles and for Determination of Injury) Rules , 1995 the Designated Authority recommended Anti Dumping Duty in respect of imports of Sodium Nitrite from EU and Chinese Taipei vide its Final Finding Notification No. 54/1 / 2001 - DGAD dated the 28th October, 2002. Anti Dumping Duty was notified by the Central Government vide notification dated 29th November 2002. Whereas it has been brought to the notice of the Designated Authority that Sodium Nitrite is not produced in Chinese Taipei and no import has taken place of the subject goods from Chinese Taipei during the period of investigation ( 1st April 2000 to 31st March 2001 ) . All the interested parties were informed about the data error found in the official statistics based on which Anti Dumping Duty on imports of Sodium Nitrite from Chinese Taipei were imposed . Comments on the same were received from the Domestic Industry. Subsequent verification by the Customs Authorities in India has confirmed that the said imports from Chinese Taipei were in fact originated and exported from China PR . In view of the foregoing , para 25 and 26 of the Final Finding notified vide Notification No. 54/ 1 /2001 -DGAD dated the 28th October , 2002 stands replaced as under:
O. CONCLUSIONS:
25. The Authority , after considering the foregoing , concludes that:
(a) Sodium Nitrite originating in or exported from EU has been exported to India below normal value resulting in dumping ;
(b) The domestic industry has suffered material injury;
(c) The injury has been caused by the dumped import of the subject goods from EU .
26. The Authority after considering the foregoing , concludes that :
a. TheAuthority recommends imposition of definitive anti dumping duty on all imports of Sodium Nitrite, falling under Chapter 28 of the Custom Tariff Act, originating in or exported from European Union .
b. TheAuthority considered recommending the amount of anti dumping duty equal to the margin of dumping or less , which if levied , would remove the injury to domestic industry. The average landed price of the imports , for the purpose , was compared with the non - injurious price of the petitioner Wherever the company, determined for the period of investigation . difference was less that the dumping margin, a duty lower than the dumping margin is recommended.
C. Accordingly , the Authority confirms the preliminary findings with regardto imposition of anti dumping duty and recommends imposition of definitive Anti Dumping Duty on imports of Sodium Nitrite from European Union .
