फा. सं. 01 /94/180/0009 /एएम 05/पी सी-4.- विदेश व्यापार नीति, 2004-2009 के पैराग्राफ 2.4 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए महानिदेशक, विदेश व्यापार एतद्वारा प्रक्रिया पुस्तक ( खण्ड-1 ) में निम्नलिखित संशोधन करते हैं-
1. यथा संशोधित, प्रक्रिया पुस्तक खण्ड-1 , 2004-2009 के पैरा 4.7 को संशोधित कर निम्नानुसार पढ़ा जाएगा: -
" अग्रिम लाइसेंसिंग समिति द्वारा निर्धारित तदर्थ/ सिओन के अनुसार अंतिम समायोजन के लिए आवेदक द्वारा की गई स्वघोषणा तथा वचनबद्धता के आधार पर लाइसेंसिंग प्राधिकारी अग्रिम लाइसेंस भी जारी कर सकता है, जहां सिओन निर्धारित नहीं हैं । तथापि, लाइसेंसिंग प्राधिकारी द्वारा पैराग्राफ 4.7 के तहत, सींग, खुर और पशुओं के अन्य अंग , काली मिर्च अथवा अन्य कोई मद जिसके लिए विदेश व्यापार महानिदेशालय ने ऐसा अधिसूचित किया है, के आयात के लिए कोई अग्रिम लाइसेंस जारी नहीं किया जाएगा । ( i ) अध्याय 15 के अन्तर्गत वर्गीकृत सभी वनस्पति/खाद्य तेल और आई टी सी ( एच एस ) पुस्तक के अध्याय 12 के अन्तर्गत वर्गीकृत सभी प्रकार के तेलहन;
(ii ) आई टी सी ( एच एस ) पुस्तक के अध्याय 10 के अन्तर्गत वर्गीकृत सभी प्रकार के अनाज;
( iii ) आई टी सी ( एच एस ) पुस्तक के अध्यायं 9 और 12 के अन्तर्गत वर्गीकृत 30 प्रतिशत से अधिक शुल्क वाले सभी मसाले;
(iv) आई टी सी ( एच एस ) पुस्तक के अध्याय 7 और 8 के अन्तर्गत वर्गीकृत 30 प्रतिशत से अधिक शुल्क वाले सभी प्रकार के फल/सब्जियां ।
पर्फ्यूम, पर्फ्यूमरी योजकों तथा विटामिन युक्त विभिन्न खाद्य घटकों के निर्यात के लिए लाइसेंसिंग प्राधिकारी द्वारा पैराग्राफ 4.7 के तहत कोई लाइसेंस जारी नहीं किया जाएगा और आवेदकों को प्रक्रिया पुस्तक, खण्ड -1 के पैराग्राफ 4.4.2 के तहत आवेदन करना होगा। जहां जैव प्रौद्योगिकी मदों का निर्यात और/अथवा आयात निहित है, पैराग्राफ 4.7 के तहत जैत्र प्रौद्योगिकी विभाग से ' अनापत्ति प्रभाणपत्र ' प्रस्तुत करने पर ही लाइसेंसिंग प्राधिकारी द्वारा लाइसेंस जारी किया जाएगा । "

F. No. 01 /94/180 /0009 /AM05 /PC IV. In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2009-2009 . the Director General of Foreign Trade hereby makes the following amendment ( s ) in the Handbook of Procedures ( Volume 1 ) :
1. In the Handbook of Procedures , Volume 1 , 2004-2009 , as amended, Para 4.7 is amended to read as follows :-
"the licensing authority may also issue Advance Licences , whereas SION are not fixed , based on self declaration and an undertaking by the applicant for a final adjustment as per Adhoc / SION fixed by ALC . However, no Advance Licence for import of horn , hoof and other organ of animal , pepper or the categories of agricultural items fisted below or for any item for which DGFT may so notify , shall be issued under paragraph 4.7 by the licensing authority .
(i) All vegetable/ edible oils classified under Chapter- 15 and all types of oilseeds classified under Chapter - 12 of ITC ( HS ) book ;
( ii ) All types of cereals classified under Chapter - 10 of ITC ( HS ) book;
( ii) All spices having a duty of more than 30 % , classified under Chapters 9 and 12 of ITC ( HS ) book ; and ( iv) All types of fruits /vegetables having a duty of more than 30 %, classified under Chapters 7 and 8 of ITC (HS)book.
For export of perfumes , perfumery compounds and various feed ingredients containing vitamins , no licence shall be issued under Para 4.7 by the licensing authority and the applicants may apply under Para 4.4.2 of handbook ofProcedures. Vol. I. Whore export and/ or import of biotechnology items are involved, licence under Para 4.7 shallbe issued by the licensing authority only on submission of a ' No Objection Certificate front the Department ofBiotechnology ."
