आ.अ. 10( अ ).- परिसीमन अधिनियम, 2002 ( 2002 का 33 ) की धारा 10 की उप- धारा ( 1 ) के अनुसरण में, पांडिचेरी संघ राज्य क्षेत्र ( यहां पर संघ राज्य क्षेत्र के रूप में संदर्भित किया गया है ) में संसदीय और विधान सभा निर्वाचन क्षेत्रों के परिसीमन के संबंध में अधिनियम की धारा 4 की उप- धारा ( 2 ) के साथ पठित धारा 9 की उप - धारा ( 2 ) के अधीन परिसीमन आयोग द्वारा बनाए गए निम्नलिखित आदेश इसके द्वारा प्रकाशित किए जाते है:-

यतः, परिसीमन ( संशोधन ) अधिनियम, 2003 (2004 का 3) द्वारा यथा संशोधित परिसीमन अधिनियम, 2002 (2002 का 33) की धारा 8 , 4 और 2 (च ) के अनुसरण में भारत के राजपत्र और पांडिचेरी के राजपत्र के 8 अक्तूबर, 2004 के असाधारण अंक में प्रकाशित अपने 8 अक्तूबर, 2004 के आदेश सं० 1 द्वारा परिसीमन आयोग ने निर्धारित किया है कि (i ) पांडिचेरी संघ राज्य क्षेत्र में लोक सभा के लिए आंबटित किए जाने वाले कुल स्थानों की संख्या एक ( 1 ) होगी जिसमें से कोई भी स्थान अनुसूचित जाति के लिए आरक्षित नहीं किया जाएगा और अनुसूचित जनजाति के लिए भी कोई स्थान आरक्षित नहीं किया जाएगा तथा (ii ) राज्य की विधान सभा के लिए नियत किए जाने वाले कुल स्थानों की संख्या तीस (30) होगी जिसमें से अनुसूचित जाति के लिए पॉच (5) 1074 GI/2005

[PART II-SEC.3 (iii)] स्थान आरक्षित किए जाएंगे और अनुसूचित जनजाति के लिए कोई भी स्थान आरक्षित नहीं किया जाएगा ।
यतः, उक्त अधिनियम की धारा 9 की उपधारा ( 1 ) के साथ पठित, धारा 5 की उपधारा ( 1 ) के अनुसरण में, परिसीमन आयोग ने संघ राज्य क्षेत्र में संसदीय और विधान सभा निर्वाचन क्षेत्रों के परिसीमन के लिए कार्यवाही के साथ संघ राज्य क्षेत्र के सह- सदस्यों के साथ अपने आप को सम्बद्ध किया; और
यतः, उक्त अधिनियम की धारा 9 की उपधारा (2 ) के अनुसरण में, परिसीमन आयोग ने सह सदस्यों के असम्मत प्रस्तावों के साथ अपने प्रस्तावों को प्रकाशित किया जिन्होंने संघ राज्य क्षेत्र में संसदीय और विधान सभा निर्वाचन क्षेत्रों के परिसीमन के लिए उक्त प्रस्तावों से संबंधित आपत्तियों और सुझावों को कमशः 25 अक्तूबर, 2004 और 20 दिसम्बर, 2004 तक आमंत्रित करने के लिए भारत सरकार के राजपत्र और पांडिचेरी के राजपत्र के असाधारण अंक में 8 अक्तूबर , 2004 और 8 दिसम्बर , 2004 को प्रकाशित करने की इच्छा प्रकट की; और
यतः, उक्त अधिनियम की धारा 9 की उपधारा (2) के अनुसरण में, आयोग के उपवर्णित आदेश सं० 1 और आयोग के संदर्भित प्रारूप प्रस्ताव 9 अक्तूबर , 2004 और 8 दिसम्बर, 2004 को स्थानीय समाचार- पत्रों में भी प्रकाशित किए गए थे और रेडियो , टेलिविजन और जन संचार के अन्य माध्यमों द्वारा और ज्यादा प्रचार किया; और
यतः, उक्त अधिनियम की धारा 9 की उपधारा (2) के अनुसरण में आयोग ने 8 अक्तूबर , 2004 को एक सार्वजनिक सूचना भी जारी की जिसे बाद में 1-11-2004, 8-12-2004 , 4-1-2005 तथा 25-1-2005 को परिशोधित नोटिसों द्वारा संशोधित किया गया था । इस सार्वजनिक सूचना में सभी आपत्तियों और सुझावों पर, जो 25 अक्तूबर, 2004 तथा 20 दिसम्बर, 2004 को या उससे पहले प्राप्त किये जा सकते है , विचार करने के लिए, सार्वजनिक बैठकों की तारीख , समय व स्थान विनिर्दिष्ट किया; और
यतः, उक्त अधिनियम की धारा 9 की उपधारा (2) के अनुसरण में आयोग ने 19 मार्च, 2005 को कराइकल में और 20 मार्च, 2005 को पांडिचेरी में सार्वजनिक बैठकें कराई और जनता के सदस्यों को सुना और आयोग को 3

पहले ही भेजे गए लिखित अभ्यावेदनों के साथ - साथ मौखिक प्रस्तुतीकरण, यदि कोई हो, करने का पूर्ण अवसर उन्हें प्रदान किया गया; और
यतः, संविधान के सुसंगत प्रावधानों तथा उक्त अधिनियम के प्रकाश में, उक्त प्रस्तावों के सम्बन्ध में आयोग ने उपर लिखित आम बैठकों में दिये गये अथवा अन्य प्रकार से प्राप्त सभी आपत्तियों तथा सुझावों पर विचार किया है । अतः, अब , यथा संशोधित उक्त अधिनियम की धारा 2 (च) और 4 (2) के साथ पठित धारा 9 की उपधारा (2 ) खण्ड (घ ) के अनुसरण में परिसीमन आयोग एतद्वारा निम्न रूप से निर्धारित करता है :-
1. संघ राज्य क्षेत्र की विधान सभा के लिए निर्वाचनों के उद्देश्य से प्रादेशिक विधान सभा निर्वाचन क्षेत्रों, जिनमें पांडिचेरी संघ राज्य क्षेत्र को बांटा जाएगा तथा ऐसे प्रत्येक निर्वाचन क्षेत्र का विस्तार सारणी ' क' में दर्शाए अनुसार होगा ।
2. लोक सभा के निर्वाचनों के उद्देश्य से प्रादेशिक संसदीय निर्वाचन क्षेत्र जिनमें पांडिचेरी संघ राज्य क्षेत्र को बांटा जाएगा तथा ऐसे प्रत्येक निर्वाचन क्षेत्र का विस्तार , सारणी ' ख ' में दर्शाये अनुसार होगा ।
3. सारणी ' क' में दर्शाये गए किसी निर्वाचन क्षेत्र का नाम जिसमें उस निर्वाचन क्षेत्र का अनुसूचित जातियों के लिए स्थान आरक्षित है कोष्ठक तथा अक्षरों " (अ०जा०) " द्वारा चिन्हित किया गया है ।

NOTIFICATION

O.N. 10(E). In pursuance of sub -section ( 1) of Section 10 of the Delimitation Act, 2002 (33 of2002), the following Order made by the Delimitation Commission under sub - section (2) of Section9 readwith sub - section (2) ofSection 4 ofthe Act, in respect ofthe delimitation ofParliamentary and Assembly Constituencies in the Union Territory ofPondicherry ( hereinafter referred to as UT) is herebypublished.

Whereas , in pursuance of sections 8, 4 and 2(f) of the Delimitation Act, 2002 ( 33 of 2002) , as amended by the Delimitation (Amendment) Act, 2003(3 of 2004) , the Delimitation Commission has , by its Order No. 1 , dated 8th October , 2004, published in the extraordinary issue of the Gazette of India and the Gazette of Pondicherry on 8th October , 2004 , determined - (i ) the total number of seats in the House of the People to be allocated to the Union Territory of Pondicherry as one (1 ) , of which no seat shaii be reserved for the Scheduled Castes and also no seat shall be reserved for the Scheduled Tribes, and ( ii ) the total number of seats to be assigned to the Legislative Assembly of the Union Territory as thirty ( 30), of which five( 5) seats shall be reserved for the Scheduled Castes and no seat for the Scheduled Tribes ; and
Whereas , in pursuance of sub-section ( 1 ) of section 5 , read with sub- section ( 1 ) of section 9 of the said Act , the Delimitation Commission associated with itself the Associate Members from the UT with the proceedings for the delimitation of Parliamentary and Assembly Constituencies in the UT; and Whereas , in pursuance of sub - section (2) of section 9 of the said Act , the Delimitation Commission published its proposals , along with the dissenting proposals of the Associate Members of the Commission who desired publication thereof, for the delimitation of Parliamentary and Assembly Constituencies in the Union Territory , in the extraordinary issues of the Gazette of India and the Gazette of Pondicherry on 8th October , 2004 and 8th December , 2004 , for भारत का राजपत्र असाधारण

inviting objections and suggestions in relation to the aforesaid proposals by 25th October, 2004 and 20th December , 2004 respectively; and
Whereas, in pursuance of the said sub -section (2) of section , 9 of that Act , the Commission's Order No.1 mentioned above and the above referred draft proposals of the Commission along with the dissenting proposals of the Associate Members were also published in the local newspapers on 9th October, 2004 and 8th December, 2004 and given further publicity through radio and television and other media of mass communication ; and
Whereas, in pursuance of the said sub - section ( 2) of section (9 ) of that Act, the Commission also issued a public notice on 8th October , 2004 , which was subsequently amended by its revised notices on 1-11-2004, 8-12-2004,4-1-2005 and 25-1-2005 , specifying the venue , date and time of public sittings to consider all objections and suggestions which may be received by it on or before the 25th October, 2004 and 20th December , 2004; and
Whereas, in pursuance of the said sub -section (2 ) of section 9 of that Act , the Commission held public sittings at Karaikal on 19th March , 2005 and at Pondicherry on the 20th March , 2005 and heard the members of the public and afforded them full opportunity of making oral and written submissions , in addition to the written representations already sent , if any, to the Commission ; and Whereas , the Commission has considered all objections and suggestions made at the aforesaid public sittings and/ or received by it otherwise , in relationto its said proposals , in the light of the relevant provisions of the Constitution and the saidAct;
Now, therefore, in pursuance of clause ( d) of sub-section 2 of section 9 read with sections 2(f) and 4( 2) of the said Act , as amended , the Delimitation Commission hereby determines as follows: -
1. The territorial assembly constituencies into which the Union Territory of Pondicherry shall be divided for the purpose of elections to the Legislative Assembly of the Union . Territory and the extent of each such constituency shall be as shown in Table A.

[PART II-SEC. 3 ( iii) } 2. The extent of territorial parliamentary constituency in respect of the Union Territory of Pondicherry for the purpose of elections to the House of the People shall be as shown in Table B.
3. Where the name of a constituency as shown in Table A is distinguished by the brackets and letters " ( SC) " the seat in that constituency is reserved for the Scheduled Castes .
