सा.का.नि. 654(अ).- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय स्वास्थ्य सेवा नियम, 1996 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -
1. (1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय स्वास्थ्य सेवा ( संशोधन) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. केन्द्रीय स्वास्थ्य सेवा नियम, 1996 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) , के नियम 7 के उपनियम (5) के खंड ( ii) के उपखंड (ख) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
" (ख) अनुसूची 6 में विनिर्दिष्ट सुपर विशेषज्ञताओं के पदों, जिनके लिए न्यूनतम आवश्यक अर्हता आयुर्विज्ञान में डाक्टर (डी एम) या मैजिस्टर चिरुंगई ( एम सीएच) या समतुल्य है,
(i ) अध्यापन विशेषज्ञ उपकाडर में 10,000-15200 रुपए, और
(ii ) अध्यापनेत्तर विशेषज्ञ उपकाडर में 10,000-15200 रुपए और 12000-16500 रुपए
के वेतनमान में सीधी भर्ती की जाएगी । "

अनुसूची 3 में, " II . अध्यापन विशेषज्ञ उपकाडर पद " शीर्षक के अधीन, उपशीर्षक " (2) विशेषज्ञ श्रेणी 2 " के नीचे मद (i) और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -

(i) (क) सह- आचार्य (सुपर विशेषज्ञता)

रिक्तियों से संबंध रखे बिना ज्येष्ठता एवं योग्यता के आधार पर प्रोन्नति द्वारा , जिसके न हो सकने पर सीधी भर्ती द्वारा
सीधी भर्ती द्वारा
(ख) सहायक आचार्य (सुपर विशेषज्ञता)
10000-15200 रुपए के वेतनमान में सुपर विशेषज्ञता सहित ऐसा सह- आचार्य जिसने उस श्रेणी में दो वर्ष की नियमित सेवा की हो ।
अर्हताओं, अनुभव और आयु सीमा आदि के लिए अनुसूची 5 देखें " ।
(iii ) अनुसूची 5 में , " II . अध्यापन विशेषज्ञ उपकाडर पद" शीर्षक के अधीन, " (ख) विशेषज्ञ श्रेणी ' के नीचे क्रम सं0 2 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -

45 वर्ष से अधिक नहीं ( सरकारी सेवकों के लिए केन्द्रीय सरकार द्वारा जारी अनुदेशों के अनुसार 5 वर्ष तक शिथिल की जा सकती है)
अधिनियम, (i) भारतीय आयुर्विज्ञान परिषद् 1956 की प्रथम या द्वितीय अनुसूची के भाग 2 में सम्मिलित मान्यताप्राप्त (एम.बी.बी.एस.) अर्हता (जो अनुज्ञप्ति प्राप्त अर्हताओं से भिन्न है ) । तृतीय अनुसूची के भाग 2 में सम्मिलित शैक्षिक अर्हता के धारकों को भारतीय आयुर्विज्ञान परिषद् अधिनियम, 1956 की धारा 13 की उपधारा (3 ) में अनुबद्ध शर्तें भी पूरी करनी चाहिएं ।

2क. सहायक आचार्य (सुपर विशेषज्ञता) (10000-325- 15200 रुपए ) (ii) अनुसूची 6 के खंड क में उल्लिखित सम्बद्ध सुपर विशेषज्ञता में स्नातकोत्तर उपाधि या समतुल्य ।
(iii ) प्रथम स्नातकोत्तर उपाधि प्राप्त करने के पश्चात् किसी मान्यताप्राप्त अध्यापन संस्था से संबद्ध सुपर विशेषज्ञता में न्यूनतम पांच वर्ष का अनुभव जिसमें से कम से कम दो वर्ष उस विशेषज्ञता में सहायक आचार्य के रूप में होना चाहिए ।
वांछनीय :
इंडेक्स मैडिकस/ राष्ट्रीय पत्रिका में अनुक्रमणित न्यूनतम चार अनुसंधान प्रकाशन ।
आवश्यक :
45 वर्ष से अधिक नहीं (सरकारी सेवकों के लिए केन्द्रीय सरकार द्वारा जारी अनुदेशों के अनुसार 5 वर्ष तक शिथिल की जा सकती है) (ⅰ) भारतीय आयुर्विज्ञान परिषद् अधिनियम, 1956 की प्रथम या द्वितीय अनुसूची के भाग 2 में सम्मिलित मान्यताप्राप्त (एम.बी.बी.एस.) अर्हता (जो अनुज्ञप्ति प्राप्त अर्हताओं से भिन्न है ) । तृतीय अनुसूची के भाग 2 में सम्मिलित शैक्षिक अर्हता के धारकों को भारतीय आयुर्विज्ञान परिषद् अधिनियम, 1956 की धारा 13 की उपधारा (3) में अनुबद्ध शर्तें भी पूरी करनी चाहिएं ।

(iii) प्रथम स्नातकोत्तर उपाधि प्राप्त करने के पश्चात् किसी मान्यताप्राप्त अध्यापन संस्था से संबद्ध सुपर विशेषज्ञता में ज्येष्ठ रेजीडेंट/ट्यूटर/डेमोन्सट्रेटर/ रजिस्ट्रार के रूप में तीन वर्ष का अध्यापन अनुभव ।
टिप्पण- पांच वर्ष की अवधि की डी.एम. / एम.सी.एच. अर्हता के धारक की दशा में , उक्त डी.एम./ एम.सी.एच. के अन्तिम भाग में की गई ज्येष्ठ स्नातकोत्तर रेजिडेंसी की अवधि को पांच वर्ष के अनुभव की अपेक्षा के लिए संगणित किया जाएगा ।

G.S.R. 654(E )-In exercise of powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Health Service Rules , 1996, namely:-
These rules may be called the Central Health Service ( Amendment ) Rules , 2005.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Health Service Rules, 1996 (hereinafter referred to as the said rules), in sub- rule (5) of rule 7, in clause (ii ) , for sub- clause (b) , the following shall be substituted, namely: -
"(b) The direct recruitment to posts belonging to Super Specialities specified in Schedule- VI for which minimum essential qualification is Doctorate of Medicine (D.M. ) or Magister Chirurguie(M.Ch . ) or equivalent shall be made in the scale of,
(i) Rs. 10000-15200, in the Teaching Specialists sub - cadre, and
(ii ) Rs . 10000-15200 and Rs. 12000-16500 , in the Non- Teaching Specialists Sub- cadre."
(ii) In Schedule- III , under heading " Il. Teaching Specialist sub -cadre Posts " , under sub- heading " (2) Specialist Grade - II " , for item (i) and the entries relating thereto, the following shall be substituted namely: -

(i) (a) Associate Professor (SuperSpecialities )

By promotion on the basis of without seniority-cum- fitness linkage to vacancies failing which by direct recruitment .
Assistant Professor in the scale of Rs . in 10000-15200 SuperSpeciality with two years ' regular service in the grade.

Essential:
Not exceeding 45 years ( Relaxable for Government servants by five years in accordance with the instructions issued by the Central Government)
( i ) An MBBS qualification recognizedby Medical Council of India included in the First or Second Schedule or Part II of the Third Schedule ( other than licentiate qualifications) to the Indian Medical Council Act, 1956. Holders of Educational Qualifications included in Part II of the Third Schedule should also fulfill the conditions stipulated in sub- section (3 ) of section ( 13 ) of the Indian Medical Council Act , 1956.
( ii ) Post- graduate degree in the concerned super-speciality mentioned in Section -A of Schedule-VI or equivalent .
(iii) At least five years ' teaching experience in the concerned super speciality after obtaining the first post graduate degree in a recognized teaching institution, out of which at least two years ' should be as Assistant Professor in that speciality.
Desirable:
Minimum of four Research Publications indexed in index Medicus/National journals .

2A Assistant Professor (Super Specialities) (Rs . 10000-325- 15200)
Essential:
Not exceeding 45 years (Relaxable for Government servants by five years in accordance with the instructions issued by the Central Government )
( i) An MBBS qualification recognized by Medical Council of India included in the First or Second Schedule or Part II of the Third Schedule ( other than licentiate qualifications) to the Indian Medical Council Act, 1956. Holders of Educational Qualifications included in Part II of the Third Schedule should also fulfill the conditions stipulated in sub - section (3 ) of section ( 13 ) of the Indian Medical Council Act , 1956 .
(ii) Post-graduate degree in the concerned super- speciality mentioned in Section-A of Schedule- VI or equivalent .
(iii) Three years ' teaching experience as Sr. Resident/ Tutor/Demonstrator / Registrar in the concerned super- speciality in a recognized teaching institution after obtaining the first Post graduate degree.
Note : In the case of holders of D.M./M.Ch. qualification of five years ' duration , the period of senior PG residency rendered in the last part of the said D.M./M.Ch . shall be counted towards requirement of five years ' experience" .
