का.आ. 1588(अ).- केन्द्रीय सरकार, पौधा किस्म और कृषक अधिकार संरक्षण अधिनियम, 2001 ( 2001 का 53 ) की धारा 1 की उप- धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तारीख 11 नवम्बर, 2005 को उस तारीख के रूप में नियत करती है जिसको उक्त अधिनियम कीनिम्नलिखित धाराएं प्रवृत्त होंगी , अर्थात्:-
( 1 ) धारा 2 से धारा 13 ( इसमें दोनों सम्मिलित हैं ) ; और
(2 ) धारा 95 से धारा 97 ( इसमें दोनों सम्मिलित हैं ) ।

New Delhi , the 11th November, 2005
S.O. 1588 (E) . In exercise of the powers conferred by sub- section (3 ) of Section 1 of the Protection of Plant Varieties and Farmers ' Rights Act, 2001 (53 of 2001 ) , the Central Government hereby appoints the 11th day of November, 2005 , as the date on which the following sections of the said Act shall come into force , namely:---
(1) Sections 2 to 13 (both inclusive) ; and
(2) Sections 95 to 97 (both inclusive) .

का.आ. 1589(अ) .-केन्द्रीय सरकार, पौधा किस्म और कृषक अधिकार संरक्षण अधिनियम, 2001 ( 2001 का 53 ) की धारा 1 की उप- धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम के प्रयोजनों के लिए पौधा किस्म और कृषक अधिकार संरक्षण प्राधिकरण स्थापित करती है जो निम्नलिखित अध्यक्ष और सदस्यों से मिलाकर गठित होगा, अर्थात्: -
धारा 3 की उप - धारा ( 5 ) के खण्ड ( क ) के अधीन नियुक्त अध्यक्ष:

2. प्राधिकरण के अध्यक्ष की पदावधि इस अधिसूचना के जारी होने की तारीख से पांच वर्ष के लिए या 65 वर्ष की आयु प्राप्त करने तक, इनमें से जो भी पूर्वतर हो, होगी और उसके सदस्यों की पदावधि ( पदेन सदस्यों के अतिरिक्त) उनकी नियुक्ति की तारीख से तीन वर्ष कीअवधिके लिए होगी।

2. The term of the Chairperson of the Authority shall be for a period of five years or up to the age of 65 years , whichever is earlier from the date of issue of this notification and the term of office of its Members (other than the members , ex officio ) shall be for a period of three years from the date oftheir appointment .
