विदेशी मुद्रा प्रबंध ( जमा )( दूसरा संशोधन ) विनियमावली, 2005
सा.का.नि. 663 ( अ ).-विदेशी मुद्रा प्रबंध अधिनियम, 1999 ( 1999 का 42 ) की धारा 6 की उप- धारा ( 3 ) के खंड ( च) , धारा 47 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय रिज़र्व बैंक इसके द्वारा विदेशी मुद्रा प्रबंध ( जमा ) विनियमावली, 2000 (मई 3, 2000 कीअधिसूचना सं . फेमा 5/2000- आरबी ) में निम्नलिखित संशोधन करता है , अर्थात्: -
संक्षिप्त नाम और प्रारंभ
1. ( i ) ये विनियम विदेशी मुद्रा प्रबंध ( जमा ) ( दूसरा संशोधन) विनियमावली , 2005 कहलाएंगे ।
(ii ) ये जुलाई 26, 2005 से लागू होंगे । @
विनियमावली में संशोधन:-
2. विदेशी मुद्रा प्रबंध (जमा ) विनियमावली, 2000 में , अनुसूची 2 में,
(i ) पैरा 2 निम्नलिखित से प्रतिस्थापित किया जाएगा:-
" 2. नामित मुद्राएं: खाते में निधि जमा ऐसी अनुमत मुद्राओं में स्वीकृत किया जाए जैसा रिज़र्व बैंक द्वारा समय - समय पर नामित किया जाए। "
(ii ) पैराग्राफ 3 निम्नलिखित से प्रतिस्थापित किया जाएगा: -
" 3. खाते का प्रकार : ये खाते केवल मीयादी जमा के रूप में ऐसी परिपक्वता अवधि के साथ खोले जाएं जैसा रिज़र्व बैंक द्वारा समय-समय पर विनिर्दिष्ट किया जाए । "

पाद टिप्पणी: ( i ) मूल विनियमावली सरकारी राजपत्र में दिनांक मई 5 , 2000 के सं. सा.का.नि. 388 ( अ ) में भाग II , खंड 3 , उप- खंड ( i ) में प्रकाशित किए गए हैं और तत्पश्चात् अप्रैल 9, 2002 के सं. सा.का.नि. 262 ( अ ) , अगस्त 19, 2002 के सं . सा.का.नि. 577 (अ ) , दिसम्बर 31 , 2002के सं. सा.का.नि. 855( अ ) , अगस्त 4, 2004 के सं. सा .का. नि. 494 ( अ ) तथा अप्रैल 7, 2005 के सं. सा.का. नि. 221 ( अ ) द्वारा संशोधित किए यए।
(ii ) @ यह स्पष्ट किया जाता है कि ऐसे नियमावली को पूर्वव्यापी प्रभाव देने से किसी पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा।

Foreign Exchange Management (Deposit ) (Second Amendment ) Regulations , 2005
G.S.R. 663 (E) .- In exercise of the powers conferred by clause ( f) of Sub- section (3 ) of Section 6 , Sub - section (2) ofSection47 of the Foreign Exchange Management Act , 1999 (42 of 1999 ) , the Reserve Bank of India makes the following amendments in the Foreign Exchange Management (Deposit ) Regulations , 2000 (Notification No. FEMA 5 /2000-RB dated 3rdMay2000), namely :-
Short Title and Commencement :-
1. These regulations may be called the Foreign Exchange Management (Deposit) (Second Amendment ) Regulations, 2005.
(i) They shall come into force from July 26 , 2005.@
Amendment ofthe Regulations :-
2. In the Foreign Exchange Management (Deposit ) Regulations, 2000 , in Schedule 2,
for paragraph 2, the following shall be substituted:---
" 2. Designated Currencies : Deposit of funds in the accounts may be accepted in such permissible currencies as may be designated by the Reserve Bank from time to time " .
(i) for paragraph 3 , the following shall be substituted :---
" 3. Type of account : These accounts may be opened only in the form of term deposit with maturity of such period as may be specified by the Reserve Bank from time to time " .

(ii) @ It is clarified that no person will be adversely affected as a result of retrospective effect being given to such regulations.
