सा.का.नि. 674( अ ).-औषधि और प्रसाधन सामग्री नियमावली , 1945 कां और संशोधन करने के लिए कतिपय नियमों का प्रारुप सं. सा.का.नि. 334(अ ) दिनांक 25-5-2005 के तहत भारत के राजपत्र असाधारण भाग II , खंड 3 , उप- खंड ( i ) दिनांक 25 मई, 2005 में औषधि और प्रसाधान सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 33 - ढ की अपेक्षानुसार तथा इस अधिसूचना को मुद्रित करने वाले राजपत्र की प्रतियां जिस तारीख को जनता को उपलब्ध करा दी जाती हैं उससे 30 दिनों के गुजरने के भीतर इससे प्रभावित होने वाले व्यक्तियों के सुझावानुसार प्रकाशित किया जाता है;
और उक्त राजपत्रित अधिसूचना 25 मई, 2005 को जनता में उपलब्ध करा दी जाती है ।
उक्त प्रारूप पर जनता के आक्षेपों व सुझावों पर केन्द्र सरकार द्वारा विचार किया गया है । अतएव अब केन्द्र सरकार उक्त अधिनियम की धारा 33 - ढ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए औषधि और प्रसाधन सामग्री नियमावली, 1945 में एतद्वारा निम्नलिखित और संशोधन करती है, अर्थात्: -
उपयुक्त विनिर्दिष्ट अवधि के भीतर , उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से कोई सुझाव या आक्षेप प्राप्त होने पर केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
नियम
1. ( 1 ) ये नियम औषधि और प्रसाधन सामग्री ( संशोधन- VII ) नियम , 2005 कहे जा सकेंगे ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 में, -
नियम 160 ख के उपनियम ( 2 ) खंड ( ii ) में उपखंड ( ख ) के स्थान पर आयुर्वेद, सिद्ध , यूनानी औषधियों के परीक्षण-विश्लेषणार्थ निम्नलिखित को रखा जाएगा , अर्थात्: -
"(i ) आयुर्वेद या सिद्ध या यूनानी औषधि में ऐसे विशेषज्ञ जिसके पास भारतीय चिकित्सा केन्द्रीय परिषद् अधिनियम, 1970 की अनुसूची II के अधीन मान्यताप्राप्त डिग्री अर्हता है;
(ii ) रसायनज्ञ, जिसके पास किसी मान्यताप्राप्त विश्वविद्यालय द्वारा प्रदान की गई कम से कम विज्ञान या फार्मेसी या फार्मेसी (आयुर्वेद) में स्नातक डिग्री हो;

(iii) वनस्पतिज्ञ [ फार्मीकोगनोसिस्ट ] जिसके पास किसी मान्यताप्राप्त विश्वविद्यालय द्वारा प्रदान की गई कम से कम विज्ञान ( चिकित्सा ) या फार्मेसी या फार्मेसी ( आयुर्वेद ) में स्नातक डिग्री हो । "

NOTIFICATION
New Delhi , the 10th November, 2005
G.S.R. 674 ( E) .---Whereas a draft of certain rules further to amend the Drugs and Cosmetic Rules 1945 was published as required by Section 33 -N of the Drugs and Cosmetics Act , 1940 (23 of 1940) in the Gazette of India Extraordinary Part - II , Section 3 , Sub- section ( i) dated 25th May 2005 vide No. GSR 334 (E) dated 25-5-2005 and suggestions from persons likely to be affected hereby the expiry of 30 days from the date on which copies of the Official Gazette containing the notification where inade available to the public ;
Andwhereas the said Gazette Notification was made available to the public on 25th May 2005.
And whereas objections and suggestions from the public on the said draft have been considered by the Central Government. Now, therefore , in exercise of the powers conferred by Section 33 - N of the said Act, the Central Govemment, hereby makes the following further amendments in the Drugs and Cosmetics Rules 1945 , namely : ---
RULES
1. (1) These rules may be called the Drugs and Cosmetics (VII - amendment) Rule, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Drug and Cosmetics Rules , 1945;
In Rule 160B in Sub - rule (2) , in clause ( ii ) , for sub - clause ( b ) , the following shall be substituted for testing and analysis ofAyurveda , Siddha & Unani drugs namely ;
"(i) Expert in Ayurveda or Siddha or Unani medicine who possesses a degree qualification recognized under Schedule II of Indian Medicine Central Council Act, 1970;
(ii) Chemist, who shall possess at least Bachelor Degree in Science or Pharmacy or Pharmacy (Ayurveda ) awardedby a recognized University;
and
(iii) Botanist (Pharmacognosist ) , who shall possess at least Bachelor Degree in Science (Medical ) or Pharmacy or Pharmacy (Ayurveda) awarded by a recognized University. "
