सा.का.नि. 676( अ ).-केन्द्रीय सरकार, वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, वायुयान नियम, 1937 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम वायुयान ( चतुर्थ संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. वायुयान नियम , 1937 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 28 क के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्: -
" 28क. वृतिक पायलटों के लिए अधिकतम आयु सीमा.---( 1 ) ऐसा कोई व्यक्ति, जो इन नियमों के अधीन जारी विमान चालक अनुज्ञप्ति धारण करता है और पैंसठ वर्ष की आयु प्राप्त कर चुका है , वाणिज्यिक विमान परिवहन प्रचालनों में लगे वायुयान में पायलट- इन-कमांड या सह- पायलट के रूप में कार्य नहीं करेगा ।
( 2 ) ऐसा कोई व्यक्ति, जो इन नियमों के अधीन जारी विमान चालक अनुज्ञप्ति धारण करता है और साठ वर्ष की आयु प्राप्त कर चुका है, वाणिज्यिक विमान परिवहन प्रचालनों में लगे वायुयान में पायलट- इन- कमांड या सह - पायलट के रूप में तब तक कार्य नहीं करेगा जब तक कि वह बहु - कर्मी दल वातावरण में प्रचालित न किया जाए और दूसरा पायलट साठ वर्ष की आयु से कम का नहो।" ।
3. उक्त नियमों की अनुसूची 2 के अनुभाग- ण के पैरा 1 के खंड ( ख ) के उपखंड ( i ) में, " एक सौ पचास घंटों " , शब्दों के स्थान पर " एक सौ घंटों " , शब्द रखे जाएंगे ।

टिप्पण: - ( 1 ) मूल नियम राजपत्र में दिनांक 23 मार्च, 1937 की अधिसूचना संख्यांक वी -26 के द्वारा प्रकाशित किए गए थे और इनमें अंतिम संशोधन दिनांक 16 जून, 2005 की संख्या सा.का. नि. 401 (अ ) द्वारा किया गया था ।
(2 ) केन्द्रीय सरकार ने, वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 14 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, लोकहित में, नागर विमानन मंत्रालय में जारी दिनांक 17 नवम्बर, 2005 के आदेश सं. वी. 11012/ 10/ 2005 - ए द्वारा, इन नियमों के पूर्व प्रकाशन की शर्त से छूट दी है ।

NOTIFICATION
New Delhi , the 17th November , 2005
G.S.R. 676 (E ). In exercise of the powers conferred by Section 5 ofthe Aircraft Act, 1934 (22 of 1934) , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937 , namely :-
1. (1) These rules may be called the Aircraft (4th Amendment ) Rules , 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Aircraft Rules , 1937 ( hereinafter called the said rules ) , for rule 28A, the following rule shall be substituted, namely:--
"28A. Maximum age limit for professional pilots .-( 1 ) No person, holding a pilot's licence issued under these rules and having attained the age of sixty - five years , shall act as Pilot- in- Command or Co- pilot of an aircraft engaged in commercial air transport operations.
(2) No person holding a pilot's licence issued under these rules and having attained the age of sixty years , shall act as Pilot - in-Command or Co - pilot of an aircraft engaged in commercial air transport operations unless it is operated in a multi - crew environment and the other pilot is less has sixty years of age ." .
3. In the said rules , in Schedule II , in Section O , in paragraph I, in clause (b ) , in sub - clause ( i ) , for the words " one hundred fifty hours " , the words "one hundred hours " , shall be substituted .

Note: 1. The principal rules were published in the Official Gazette vide Notification number V - 26 , dated the 23rdMarch, 1937 and was last amended vide number G. S. R. 401 ( E) dated the 16th June, 2005 .
2. The Central Government in exercise of the powers conferred by proviso to section 14 of the Aircraft Act, 1934 (22 of 1934) has , in the public interest dispensed with the condition of previous publication of these rule vide its Order No. V. 11012/10/2005 -A dated the 17th November, 2005 , issued in the Ministry of Civil Aviation .
