का.आ. 1637( अ ).- अंतर्राज्यिक नदी जल विवाद अधिनियम , 1956 ( 1956 का 33 ) ( जिसे इसमें उक्त अधिनियम कहा गया है ) की धारा 9क की उप - धारा ( 1 ) में, यह उपबंध है कि केन्द्रीय सरकार प्रत्येक नदी द्रोणी के लिए राष्ट्रीय स्तर पर एक आंकड़ा कोष और सूचना प्रणाली बनाकर रखेगी जिसमें जल संसाधनों, भूमि, कृषि और उससे संबंधित विषयों के आंकड़े सम्मिलित होंगे जिन्हें केन्द्रीय सरकार समय - समय पर विहित करे ।
और, उक्त अधिनियम की धारा १ क की उप- धारा ( 1 ) में यह उपबंध है कि राज्य सरकार, केन्द्रीय सरकार को या उस प्रयोजन के लिए केन्द्रीय सरकार द्वारा नियुक्त किसी अभिकरण को, जब कभी अपेक्षित हो, आंकड़े प्रदाय करेगी;
और, तत्कालीन सिंचाई मंत्रालय ( वर्तमान में जल संसाधन मंत्रालय ) के अधीन गठित केन्द्रीय जल आयोग, जल संसाधनों, भूमि के संबंध में कृषि सांख्यिकीय , सिंचाई क्षमता, जल मूल्यांकन आदि पर केन्द्रीय जल आयोग के सूचना प्रणाली संगठन द्वारा संग्रहीत सूचना पर आधारित, द्रोणी- वार सूचना बनाए रख रहा है;
और, केन्द्रीय सरकार, केन्द्रीय जल आयोग द्वारा पालन किए जाने वाले कृत्यों को दृष्टि में रखते हुए, राज्य सरकारों द्वारा प्रदाय किए गए नदी द्रोणीयों से संबंधित सभी आंकड़े और सूचना संग्रहण करने के लिए केन्द्रीय जल आयोग को एक अभिकरण के रूप में नियुक्त करना आवश्यक समझती है;
और, अतः अब, केन्द्रीय सरकार , अंतर्राज्यिक नदी जल विवाद अधिनियम , 1956 की धारा 9 क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, प्रत्येक नदी द्रोणी के लिए आंकड़े कोष और सूचना प्रणाली बनाए रखने के लिए केन्द्रीय जल आयोग को एक अभिकरण के रूप में नियुक्तकरती है जिसमें संबंधित राज्य सरकारों द्वारा केन्द्रीय जल आयोग द्वारा समय- समय पर अपेक्षित ऐसे प्ररूप और रीति में उपलब्ध कराए जाने वाले जल संसाधनों, भूमि, कृषि और उससे संबंधित विषयों के बारे में अंकड़े सम्मिलित हैं;
और, उक्त अधिनियम की धारा १क की उप- धारा ( 2 ) के प्रयोजनों के लिए भी, केन्द्रीय सरकार, केन्द्रीय जल आयोग को नियुक्त करती है जो राज्य सरकार द्वारा प्रदाय किए गए आंकड़ों का सत्यापन करेगी और इस प्रयोजन के लिए केन्द्रीय जल आयोग , केन्द्रीय सरकार या केन्द्रीय जल आयोग के किसी अधिकारी को प्राधिकृत कर सकेगा जिसके अंतर्गत संबंधित राज्य सरकारों से ऐसे अभिलेखों और सूचना की जांच करने के लिए सेवानिवृत्त अधिकारी सम्मिलित हैं, जो उनके कृत्यों का निर्वहन करने के लिए आवश्यक समझे जाते हैं ।

S.O. 1637 (E ) .-Whereas Sub-section ( 1 ) of Section 9A of Inter - State River Water Disputes Act, 1956 (33 of 1956) (hereinreferredto as the said Act) provides that the Central Government shall maintain a data bank and information system atthe national level for each river basin which shall include data regarding water resources , land, agriculture and matters relating thereto, as the Central Government may prescribe from time to time.
Andwhereas Sub - section ( 1 ) of Section 9A of the said Act provides that the State Government shall supply the data tothe Central Government or to an agency appointed by the Central Government for the purpose , as and when required.
Andwhereas Central Water Commission ( CWC) constituted under the then Ministry of Irrigation (presently the Ministry of Water Resources ) is maintaining basin - wise information on water resources, agricultural statistics about land use (State-wise), irrigation potential, water pricing , etc. based on the information collected by the Information System Organisation of the CWC;
And, whereas the Central Government , keeping in view the functions performed by the CWC, considers it necessary to appoint the CWC as an agency to collect all data and information relating to river basin ( s) supplied by the State Government;
Andnow, therefore, in exercise ofthe powers conferred by Sub- section ( 1 ) of Section 9A of the Inter- State River WaterDisputes Act, 1956 , the Central Government hereby appoints CWC as an agency for maintaining the data bank and information system for each river basin which shall include data regarding water resources , land, agriculture and matters relating thereto in such form and manner as may required from time to time by the CWC to be made available by the respective State Governments;
And, also for the purposes of Sub - section (2 ) of Section 9A of the said Act , the Central Government hereby appoints the CWC which may verify the data supplied by the State Government and for this purpose the CWC may authorise any officerofthe Central Government or the CWC including retired officers to examine such records and information from the concerned State Governments as are considered necessary to discharge their function.
