का.आ. 1645 (अ).-केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना सं . का. आ. 1038(अ) तारीख 11 जुलाई, 2005, जो भारत के राजपत्र, असाधारण, भाग 2, खण्ड 3 , उपखंड ( ii) , तारीख 21 जुलाई, 2005 में प्रकाशित की गई थी, द्वारा उत्तर प्रदेश राज्य के फैजाबाद जिले में राष्ट्रीय राजमार्ग संख्या-28 के 9.000 कि.मी. से 251.700 कि.मी. और 279.800 कि.मी. से 360.570 कि.मी. ( लखनऊ उत्तर प्रदेश/ बिहार सीमा) तक के भूखण्ड का निर्माण करने (चौड़ा करने) के लोक प्रयोजन के लिए उक्त अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी;
और, उक्त अधिसूचना का सार तारीख 09 सितम्बर, 2005 के "दैनिक जागरण " और " सहारा " दोनों में प्रकाशित किया गया था ;
और, सक्षम प्राधिकारी द्वारा उक्त भूमि में हितबद्ध व्यक्तियों से प्राप्त आक्षेपों पर विचार कर लिया गया है और उनका निपटान कर दिया गया है ;
और, सक्षम प्राधिकारी ने, उक्त अधिनियम की धारा उघ की उपधारा (1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त हो जाने पर और उक्त अधिनियम की धारा उघ की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना है ;
और केन्द्रीय सरकार, उक्त अधिनियम की धारा उघ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इससे उपाबद्व अनुसूची में विनिर्दिष्ट भूमि इस अधिसूचना के राजपत्र में प्रकाशन पर, सभी विल्लंगमों से मुक्त आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 24th November, 2005
S.O. 1645(E ) .- Whereas by the notification of the Government of India in the Ministry ofShipping , Road Transport and Highways ( Department of Road Transport and Highways) , number S.O. 1038 (E) , dated the 11th July, 2005 , published in the Gazette of India, Extraordinary, Part- II , Section 3 , Sub - section (ii ) , dated the 21st July, 2005 issued under sub - section ( 1 ) of section 3A of the National Highways Act , 1956 ( 48 of 1956) (hereinafter referred to as the said Act) , the Central Government declared its intention to acquire the land specified in the Schedule appended to that notification for the public purpose of building (widening) of National Highway No.28 in the stretch of land from Km.9.000 to Km.251.700 and from Km.279.800 to 360.570 ( Lucknow Uttar Pradesh/Bihar Border) in District Faizabad, in the State of Uttar Pradesh ;
And whereas , the substance of the said notification was published in "Dainik Jagran " and in " Sahara", both dated 09th September , 2005 ;
And whereas the objections received from the persons interested in the said land have beenconsidered and disposed of by the competent authority;
And whereas in pursuance of sub- section ( 1 ) of section 3D of the said Act , the competent authority has submitted its report to the Central Government;
Now, therefore , upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub - section ( 1 ) of section 3D of the said Act , the Central Government hereby declares that the land specified in the Schedule annexed hereto is to be acquired for the aforesaid purpose ;
And further , in pursuance of sub- section ( 2) of section 3D of the said Act, the Central Government hereby declares that on the publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances .
