का.आ. 1650 (अ) .- केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48 ) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 क की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग) की अधिसूचना सं. का.आ. 78 (अ) तारीख 17 जनवरी, 2005 ( जिसे इसमें इसके पश्चात उक्त अधिसूचना कहा गया है) , जो भारत के राजपत्र, असाधारण, भाग 2 , खण्ड 3 , उपखंड ( ii ) , तारीख 24 जनवरी , 2005 को प्रकाशित की गई थी, द्वारा तमिलनाडु राज्य के वेल्लोर जिले में राष्ट्रीय राजमार्ग संख्या-46 के 98/ 058.5 कि.मी. से 127/450 कि.मी. ( कृष्णागिरि- रानीपेट सेक्शन ) तक के भूखण्ड और किलाचूर में टोल प्लाजा का निर्माण करने के लोक प्रयोजन के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी ;
और उक्त अधिसूचना का सार "दि हिन्दू" और "दिना थाँथी" दोनों में तारीख 17 अप्रैल, 2005 को प्रकाशित किया गया था ;
और उक्त भूमि में हितबद्ध किसी भी व्यक्ति से कोई भी आक्षेप प्राप्त नहीं हुआ है ;
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा उघ की उपधारा ( 1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः, अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट के प्राप्त हो जाने पर और उक्त अधिनियम की धारा उघ की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि संलग्न अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना है ;
और आगे , केन्द्रीय सरकार, उक्त अधिनियम की धारा उघ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि राजपत्र में इस अधिसूचना के प्रकाशन पर, इसके साथ संलग्न अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 24th November, 2005
S. O. 1650(E ). Whereasby notification of the Government of India in the Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways ) , number S.O. 78 ( E) dated the 17th January, 2005, published in the Gazette ofIndia , Extraordinary , Part II , Section 3 , Sub-section (ii ) dated the 24th January, 2005 (hereinafter referred to as the said notification ) and issued under sub -section (1 ) of section 3A of the National Highways Act , 1956 (48 of 1956) ( hereinafter referred to as the said Act) , the Central Government declared its intention to acquire the land specified in the Schedule appended to that notification for the public purpose of building (four- laning) of National Highway No.46 ( Krishnagiri Ranipet Section ) and Toll Plaza at Kilachur on the stretch from Km.98/058.5 to Km.127/450 in the District of Vellore in the State of Tamil Nadu;
And whereas , the substance of the said notification was published in "The Hindu " and "Dina Thanthi " , both dated 17th April , 2005;
And whereas , no objections have been received from any person interested in thesaid land;
And whereas , in pursuance of sub-section ( 1 ) of section 3D of the said Act , the competent authority has submitted its report to the Central Government ;
Now, therefore , upon receipt of the said report and in exercise of the powers conferred by sub-section ( 1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto should be acquired for the aforesaid purpose ;
And further , in pursuance of sub- section (2) of section 3D of the said Act , the Central Government hereby declares that , on the publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances .
