का.आ. 1663 (अ) .- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्यांक का.आ. 78 (अ) तारीख 4 फरवरी, 1999 द्वारा पश्चिम बंगाल राज्य में राष्ट्रीय राजमार्ग संख्या 2 के 516.00 कि.मी. से 670.00 कि.मी. तक के सेक्शन को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् " प्राधिकरण " कहा गया है) को सौंपा था और का.आ. 1356 (अ) तारीख 25 नवम्बर, 2003 द्वारा 670.00 कि.मी. से 672.197 कि.मी. के सेक्शन को भी सौंप दिया था )
और राष्ट्रीय राजमार्ग सं. 2 पर हावडा और कोलकाता दोनों तरफ पहुँच मार्गों सहित हुगली नदी पर द्वितीय विवेकानन्द पुल का विकास करने के लिए प्राधिकरण ने मैसर्ज सेकण्ड विवेकानन्द ब्रिज टोलवे कम्पनी प्राइवेट लिमिटेड जिसका रजिस्ट्रीकृत कार्यालय मार्फत कंसलटिंग इंजीनियरिंग सर्विसेज (इंडिया ) प्राइवेट लिमिटेड, 41 -ए, मेकर टावर ई, चौथी मंजिल, कफ परेड, मुम्बई 400005 में है ( जिसे इसमें इसके पश्चात " रियायतग्राही " कहा गया है) के साथ करार किया है ;
अतः , अब , केन्द्रीय सरकार, राष्ट्रीय राजमार्ग (राष्ट्रीय राजमार्गों पर स्थायी पुल/अस्थायी पुल के उपयोग के लिए फीस की वसूली) नियम, 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजमार्ग संख्या 2 के उक्त पुल का निर्माण करने , अनुरक्षण, प्रबंध और प्रचालन में व्यय, विनिहित पूँजी पर ब्याज, युक्तियुक्त प्रत्यागम, यातायात परिमाण तथा प्राधिकरण और उक्त रियायतग्राही के बीच हुए ऐसे करार की अवधि को ध्यान में रखते हुए अधिसूचित करती है कि नीचे दी गई सूची में विनिर्दिष्ट दरों पर पश्चिमी बंगाल राज्य में राष्ट्रीय राजमार्ग , सं . 2 पर 666.165 कि.मी. से आरंभ होकर 672.197 कि.मी. तक पुल के उपयोग के लिए यांत्रिक यानों पर फीस उद्ग्रहीत और संदत्त की जाएगी और उक्त रियायतग्राही को वाणिज्य प्रचालन की तारीख से इसकी समाप्ति की तारीख तक विनिदिष्ट दर पर फीस संग्रहीत तथा प्रतिधारित करने के लिए प्राधिकृत करती है ।

इस अधिसूचना के प्रयोजन के लिए परिभाषाएँ :-
(क) "वास्तविक फीस " से प्राधिकरण द्वारा यथा अनुमोदित पुल के उपयोक्ताओं से प्रभारित वास्तविक फीस और इस अधिसूचना की अनुसूची में यथा रूप से दी गई प्रति यान फीस अभिप्रेत है ।
(ख) "वाणिज्य प्रचालन की तारीख " से वह तारीख जिसको राष्ट्रीय राजमार्ग के उक्त पुल के पूरा हो जाने पर स्वतंत्र परामर्शदाता द्वारा जारी किए गए यथास्थिति पूर्णता प्रमाणपत्र की तारीख अथवा अनंतिम प्रमाणपत्र की तारीख अभिप्रेत है,
(ग) " समाप्ति की तारीख " से वह तारीख अभिप्रेत है, जिसको प्राधिकरण और रियायतग्राही के मध्य किया गया उक्त करार समाप्त होता है अथवा समापन नोटिस द्वारा समाप्त किया जाता है, और
(घ) इस अधिसूचना में प्रयुक्त किये गये शब्दों और पदों के, जिन्हें परिभाषित नहीं किया गया है किंतु जिन्हें पश्चिमी बंगाल राज्य में राष्ट्रीय राजमार्ग संख्या 2 के 666.165 कि.मी. से 672.197 कि.मी. तक पुल के संबंध में प्राधिकरण और रियायतग्राही के मध्य हुए करार में परिभाषित किया गया है, के वही अर्थ होंगे जो उक्त करार में इनके लिए समनुदेशित हैं ।

टिप्पण -
1. ऊपर उपयोक्ता फीस की अनुसूची में दी गई उपयोक्ता फीस की दरों को परियोजना के पूरा होने की नियत तारीख ( ऐसी प्रत्येक तारीख , "फीस पुनरीक्षण की तारीख ") से प्रत्येक अब्दिकी पर संशोधित किया जायेगा (अर्थात यदि रियायत करार पर 02 सितंबर, 2002 को हस्ताक्षर किए गए हैं और नियत तारीख 01 मई , 2003 है तो परियोजना पूरा होने की नियत तारीख 01 मई , 2006 होगी तथा प्रथम फीस संशोधन की तारीख 01 मई, 2007 होगी ) । ऊपर अवधारित पुनरीक्षित फीस (" परिकलित फीस" ) की गणना निम्नानुसार दो दशमलव तक की जायेगी :
परिकलित फीस = गत वर्ष की परिकलित फीस x [ 1 +0.75 x (थोक मूल्य सूचकांक/थोक मूल्य सूचकांक-1 -1) + 0.25 x ( एफईएन/एफईएन -1) + ए ]
अर्थात्:
थोक मूल्य सूचकांक = फीस पुनरीक्षण की तारीख से तुरंत पहले 31 जनवरी, को थोक मूल्य सूचकांक (अर्थात् 01 मई, 2007 को देय फीस पुनरीक्षण के लिए , 31 जनवरी , 2007 का थोक मूल्य सूचकांक)
थोक मूल्य सूचकांक-1 = फीस पुनरीक्षण की तारीख से तुरंत पहले गतवर्ष की 31 जनवरी का थोक मूल्य सूचकांक (अर्थात् 01 मई, 2007 को देय फीस संशोधन के लिए , 31 जनवरी , 2007 का थोक मूल्य सूचकांक)
एफईएन = फीस पुनरीक्षण की तारीख से तुरंत पहले 31 जनवरी को भारतीय रुपए/ अमेरिकी डॉलर की दर ( भारतीय रिजर्व बैंक की संदर्भ दर) (अर्थात् 01 मई, 2007 को देय फीस पुनरीक्षण के लिए, 31 जनवरी , 2007 का थोक मूल्य सूचकांक)
एफईएन-1 = फीस पुनरीक्षण की तारीख से तुरंत पहले गत वर्ष 31 जनवरी को भारतीय रुपए/ अमेरिकी डॉलर की दर ( भारतीय रिजर्व बैंक की संदर्भ दर) ( अर्थात् 01 मई, 2007 को देय फीस पुनरीक्षण के लिए 31 जनवरी, 2006 को भारतीय रिजर्व बैंक की संदर्भ दर) ए = एक स्थिर कारक = 1.15/ 100 ( शून्य दशमलव शून्य एक एक पाँच)
" थोक मूल्य सूचकांक" से अभिप्रेत है, भारत सरकार के उद्योग मंत्रालय द्वारा प्रकाशित थोक मूल्य सूचकांक और थोक मूल्य सूचकांक को प्रतिस्थापित करने वाला कोई सूचकांक भी इसमें सम्मिलित होगा ।
प्रभारित वास्तविक फीस रूपए के निकटतम पूर्णांक में होगी ("वास्तविक फीस ") 4

2. निम्नलिखित यानों के संबंध में किसी फीस का संदाय या संग्रहण नहीं किया जाएगा
अर्थात् :
(क) रक्षा यान ;
(ख) पुलिस यान ;
(ग) अग्निशमन यान ;
( घ) एम्बुलेंस ;
( ङ) अंत्येष्टि यान ;
( च) डाक और तार विभाग के वाहन ;
( छ) केन्द्रीय और राज्य सरकार की ड्यूटी वाले यान ;
(ज) " अति महत्वपूर्ण व्यक्ति" प्रतीक वाले यान और ;
(झ) निम्नलिखित से संबंधित यान ;
(i) भारत के राष्ट्रपति,
(ii) भारत के उपराष्ट्रपति,
(iii) केन्द्रीय और राज्य मंत्री,
(iv ) लोकसभा /राज्यसभा/ राज्य विधान परिषदों में विपक्ष के नेता जिनका दर्जा कैबिनेट मंत्री का हो,
(v) राज्यपाल/उपराज्यपाल/ केन्द्रीय और राज्य विधान परिषदों के कार्यपालक पार्षद/अध्यक्ष/सभापति
(vi ) अपने चुनाव क्षेत्रों में संसद सदस्य और राज्य विधानसभाओं/विधान परिषदों के सदस्य
(vii ) भारत में राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति
(viii ) " सी डी" प्रतीक प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक ।
3. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और रियायतग्राही का नाम, पता, टेलीफोन न. , जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए , पथकर चौकी से 500 मी. आगे , पथकर चौकी से 100 मी. आगे और पथकर चौकी पर भी स्पष्ट और प्रमुख रूप से संप्रदर्शित किया जाएगा । संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड को पढ़ना सहज हो ।
4. राष्ट्रीय राजमार्ग के किसी सेक्शन स्थाई पुल/अस्थाई पुल पर वसूल की जाने वाली अधिकृत फीस की सारणी अंग्रेजी , हिन्दी और उस क्षेत्र जिसमें वह राष्ट्रीय राजमार्ग स्थित है, की प्रादेशिक भाषा में स्पष्ट रूप से लिखकर अथवा छपवाकर फीस संग्रह करने वाली चौकियों के निकट सहजदृश्य स्थान पर संबंधित व्यक्ति द्वारा प्रदर्शित की जाएगी ।

5. रियायतग्राही अपने एक कर्मचारी को फीस संग्रहण प्रभारी के रूप में नामनिर्दिष्ट करेगा और वह नामनिर्दिष्ट व्यक्ति यह सुनिश्चित करने के लिए कि सड़क उपयोक्ताओं से नियत दर से अधिक फीस न वसूल की जाए और यह फीस सहजता से तथा सड़क उपयोक्ताओं को बगैर कोई परेशानी के संग्रहीत की जाए तथा राष्ट्रीय राजमार्गों के पुल के लिए संग्रहीत की जाने वाली फीस से संबंधित अन्य सभी मामलों के लिए उत्तरदायी होगा ।
6. उपयोक्ताओं से संग्रहीत की जाने वाली वास्तविक फीस की गणना रियायतग्राही द्वारा की जाएगी और इसे प्रतिवर्ष 31 जनवरी के बाद शीघ्रातिशीघ्र किंतु वृद्धि दर लागू होने से कम से कम 45 दिन पूर्व अनुमोदन के लिए प्राधिकरण को भेजा जाएगा । प्राधिकरण , फीस संशोधन प्रस्ताव प्राप्त होने के बाद शीघ्रातिशीघ्र किंतु फीस संशोधन प्रस्ताव प्राप्त होने के 15 दिन के भीतर टिप्पणी भेजेगा अथवा स्पष्टीकरण के लिए अनुरोध करेगा । यदि प्राधिकरण इस अवधि में कोई टिप्पणी नहीं देता है अथवा स्पष्टीकरण नहीं मांगता है तो रियायतग्राही द्वारा यथाप्रस्तावित संशोधित फीस, प्राधिकरण द्वारा अनुमोदित की हुई मानी जाएगी ।
7. रियायतग्राही, वाणिज्यिक प्रचालन की तारीख से न्यूनतम 10 दिन पहले इस अधिसूचना का सार कम से कम दो स्थानीय समाचार पत्रों में (इनमें से एक जन भाषा में होगा ) प्रकाशित करेगा, जिसमें इस अधिसूचना के उपबंध के अनुसार वाणिज्यिक प्रचालन की तारीख का भी उल्लेख होगा । ऐसा सार, इस अधिसूचना के अनुसार संशोधित दर के प्रभावी होने से 10 दिन पहले प्रति वर्ष प्रकाशित किया जाएगा ।

NOTIFICATION
New Delhi , the 25th November, 2005
S.O. 1663 (E)-WHEREAS , by the notification of the Government of India in the then Ministry of Road Transport and Highways , No. S.O. 78 ( E ) , dated the February 4th, 1999 issued under section 11 of the National Highways Authority of India Act , 1988 , the Central Government has entrusted the section from Km . 516.00 to Km. 670.00 of National Highways No. 2 in the State of West Bengal to the National Highways Authority of India (hereinafter referred to as the "Authority " ) and vide SO 1356 (E) , dated the 25th November , 2003 had further entrusted from Km 670.00 to Km 672.197 to the said Authority ;
AND whereas , the Authority has entered into an Agreement with M/ s Second Vivekananda Bridge Tollway Company Private Limited, having its registered office atC/o Consulting Engineering Services (India ) Private Limited , 41 - A, Maker Tower E, 4th Floor , Cuffe Parade , Mumbai 400 005 , ( hereinafter referred to as the "Concessionaire ") for the development of Second Vivekananda Bridge across the river Hooghly along with its approaches from both Howrah and Kolkata side on National Highway No. 2;
NOW , therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , read with rule 3 of National Highways ( Collection of Fees by any Person for the Use of Section of the National Highways /Permanent Bridge/Temporary Bridge on National Highways ) , Rules 1997 , the Central Government, having regard to the expenditure involved in building, maintenance , management and operation of the said bridge of the National Highway No. 2, interest on the capital invested, reasonable return, the volume of traffic and the period of agreement entered into between the Authority and the Concessionaire , hereby notifies that there shall be levied and paid fees on mechanical vehicles for the use of the bridge starting from Km 666.165 to Km 672.197 of National Highways No. 2 in the State of West Bengal at the rate specified in the schedule below, and authorizes the said Concessionaire to collect and retain the fees at the rate specified in the said Schedule for a period commencing from the commercial operation date to the termination date .
Definitions for the purpose of this notification : -
(a) " actual fees " means the fees actually charged from the users of the bridge as may be approved by the Authority and the fee per vehicle as given in the Schedule to this notification;

(b) "commercial operations date" means the date on which the completion certificate or the Provisional Certificate upon completion of the said bridge of National Highway, as the case may be , issued by the Independent Consultant;
(c) "termination date " means the date on which agreement entered into between the Authority and the Concessionaire expires or is terminated by termination notice; and
(d) Words and expressions used in this notification but not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of bridge from Km 666.165 to Km 672.197 of the National Highway No. 2 in the State of West Bengal shall have the same meaning as assigned to them respectively in the said agreement .

NOTES ; -
1. These rates of fees specified in the above Schedule of User fee shall be revised on every anniversary of the Scheduled Project completion date (each such date , a " Fee revision date" ) . (Forexample If the Concession Agreement is signed on September 2nd, 2002 , and appointed date is May 1st, 2003 , the Scheduled Project completion date will be May 1st, 2006 and the First Fee revision date shall be May 1st, 2007) . The revised fee as determined above shall be computed (" computed fee " ) to two decimal places as follows:

Where
WPIn WPI on January 31 immediately preceding the fee revision date ( e.g. for fee revision due on May 1st, 2007, WPI on January 31st , 2007).
WPIn- 1 WPI on January 31 of the year immediately preceding the year of the Fee Revision Date ( e.g. for fee revision due on May 1 , 2007 , WPI on January 31 , 2006) Fen = INR/ USD rate ( RB1 reference rate ) on January 31st immediately preceding the fee revision date (e.g. for fee revision due on May 1 , 2007 , WPI on January 31st , 2007)
Fen- 1 = INR/ USD rate (RBI reference rate ) on January 31 of the year immediately preceding the year of the fee revision date ( e.g. for Fee revision due on May 1 , 2007 , RBI reference rate on January 31 , 2006 )
A = a constant factor = 1.15 / 100 ( zero point zero one one five )
"WPI " means the Wholesale Price Index published by the Ministry of Industry , Gol and shall include any index , which substitutes the WPI .
The actual fees to be charged shall be the computed fees rounded off to the nearest one Rupee (" actual fees" ) .
2. No fee shall be payable or collected in respect of the following vehicles , namely :
(a) Defence Vehicles ;
(b ) Police Vehicles ;
(c) Fire Fighting Vehicles ;
(d) Ambulances
(e) Funeral vans
(f) Vehicles of the Departments of post and Telegraph ;
(g) Central and State Government vehicles on duty;
(h) Vehicles with " VIP " symbols and
(i ) Vehicles belonging to the;
(i) President of India,
(ii) Vice President of India,
(iii) Central and State Ministers ,
(iv) Leaders of Opposition of Lok Sabha/Rajya Sabha/State Legislatures , having the status of Cabinet Ministers ,
(v) Governors /Lt Governors /Executive Councilors / Speakers / Chairmen of Central and State Legislatures ,
(vi) Members of Parliament and Members of State Legislative Assemblies/ Councils, within their respective Constituencies ,
(vii) Foreign dignitaries on State visit to India , and
(viii) Foreign Diplomats stationed in India using cars with " CD " symbols .
3. The Rates of Fees , the Categories of Vehicles exempted from payment of fee and the name , address and telephone number of the Concessionaire to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 भारत का राजपत्र असाधारण

meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also . The height of the display boards and size of letters being such that it is easy for drivers to read the display boards .
4. A table of fees authorized to be collected on any section of national highways / permanent bridge /temporary bridge on national highway shall be put up by such person in a conspicuous place near a fee collection booth legibly written or printed in English, Hindi and the regional language of the area in which the national highway is situated.
5. The Concessionaire , shall nominate an official as in charge of fee collection and official so nominated shall be responsible to ensure that fees are collected at not more than the agreed rates and the fee collection is smooth without causing undue hardship to the road users , and for all other matters connected with the fee collection of the bridge of national highway.
6. The actual fees to be charged to users will be computed by the Concessionaire and sent to Authority for approval as soon as possible after January 31st every year, but at least 45 days before the rate increase is to be effective . Authority shall provide comments or ask for clarifications as soon as possible upon receipt of the fee revision proposal but not later than 15 days of receipt of the fee revision proposal . If Authority does not offer comments / seek clarifications during this period , the revised fee, as proposed by the Concessionaire , will be deemed to be approved by Authority .
7. Concessionaire shall publish substance of this notification in two local newspapers (one of which shall be in vernacular language ) , which shall also state the commercial operation date as per the provision of this notification, at least 10 days prior to the commercial operation date . Such substance shall also be repeated every year, 10 days prior to giving effect to revised fees as per this notification.
