सा.का.नि. 694(अ) .- खाद्य, अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार, खाद्य अपमिश्रण निवारण अधिनियम, 1954 (1954 का 37) की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय खाद्य मानक समिति से परामर्श के पश्चात् बनाना चाहती है, उक्त उपधारा (1 ) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है, और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से , जिसको उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है जनता को उपलब्ध करा दी जाती है साठ दिन की समाप्ति के पश्चात् विचार किया जाएगा ।
आक्षेप या सुझाव, यदि कोई हों, सचिव, भारत सरकार, स्वास्थ्य और परिवार कल्याण मंत्रालय , निर्माण भवन, नई दिल्ली 110011 को भेजे जा सकेंगे ।
ऐसे आक्षेपों या सुझावों पर, जो इस प्रकार विनिर्दिष्ट अवधि की समाप्ति के पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त हो सकेगें, केन्द्रीय सरकार द्वारा विचार किया जाएगा ।

प्रारूप नियम
1. ( 1) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण नियम ( संशोधन) नियम, 2005 है।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम 1955 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 2 में, खंड (च) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात् :-
(छ) "दावा " से ऐसा कोई अभ्यावेदन अभिप्रेत है जिसमें यह विवरण , सुझाव या अंतर्हित होता है कि किसी खाद्य में उसके उद्गम, पोषण गुण, प्रकृति, प्रसंस्करण , सम्मिश्रण या कोई अन्य क्वालिटी से संबंधित विशिष्ट क्वालिटी है ;
(ज) "उपभोक्ता" से उपभोग के लिए क्रय करने वाले और प्राप्त करने वाले व्यक्ति और कुटुंब अभिप्रेत है;
(झ) "संदूषक" से कोई ऐसा पदार्थ अभिप्रेत है जो खाद्य में साशय नहीं मिलाया गया है, जो ऐसे खाद्य में उत्पादन ( जिसके अंतर्गत फसल कृषि, पशु- पालन और पशु चिकित्सीय औषध में की गई संक्रियाएं भी है) विनिर्माण, प्रसंस्करण , निर्मिति, उपचार, पैंकिंग , पैकेजिंग , परिवहन या ऐसे खाद्य के धारण करने के परिणामस्वरूप या परिवेशी संदूषण के परिणामस्वरूप ऐसे खाद्य में विद्यमान हों । इस शब्द के अंतर्गत कीट खंड, कृन्तक रोम और अन्य बाह्य पदार्थ नहीं आते हैं;
(স) "विनिर्माण की तारीख " से ऐसी तारीख अभिप्रेत है जिसको यथा वर्णित उत्पाद खाद्य बन जाता है ;
(ट) " पैकेजिंग की तारीख " से वह तारीख अभिप्रेत है जिसको खाद्य सीधा उस आधान में रखा जाता है जिसमें उसे अंत में विक्रय किया जाएगा;
"के पूर्व सर्वोत्तम " से ऐसी तारीख अभिप्रेत है जो किन्हीं कथित भंडारण दशाओं के अधीन अवधि की समाप्ति को संज्ञापित करती है जिसके दौरान उत्पाद पूर्ण रूप [ भाग II- खण्ड 3 (i) ]

3 से विपण्य रहेगा और कोई विनिर्दिष्ट क्वालिटी प्रतिधारित करेगा जिसके लिए अव्यक्त या व्यक्त दावे किए गए हों । तथापि उस तारीख के बाल भी वह खाद्य पूर्णतः संतोषप्रद हो सकेगा ;
(ঙ) "समाप्ति की तारीख " से वह तारीख अभिप्रेत है जो किन्हीं भंडारण दशाओं के अधीन अनुमानित अवधि की समाप्ति को संज्ञापित करती है जिसके पश्चात् उत्पाद अधिसंभाव्यतः उपभोक्ताओं द्वारा उस क्वालिटी का नहीं माना जाएगा जिसकी सामान्यतः प्रत्याशा की जाती है । इस तारीख के पश्चात् खाद्य विपण्य नहीं माना जाएगा ;
( ढ) "खाद्य योज्य " से ऐसा कोई पदार्थ अभिप्रेत है जिसे सामान्यतः अपने आप में खाद्य के रूप में उपभोग नहीं किया जाता है और न ही समान्यतः खाद्य के विशिष्ट संघटक के रूप में प्रयुक्त किया जाता है , चाहे उसमें पोषक महत्व हो या नहीं , जिसके ऐसे खाद्य के विनिर्माण , प्रसंस्करण, निर्मिति, उपचार, पैंकिंग , पैकेजिंग परिवहन या धारण करने में किसी प्रौद्योगिक (जिसके अंतर्गत इंद्रियग्राही भी है) प्रयोजन के लिए उस खाद्य में जिसके मिलाए जाने का आशय ; या उसमें या उसके उपोत्पाद ऐसे खाद्य के अभिलक्षणों का संघटक होने या उसे अन्यथा प्रभावित करने के लिए उसके प्रभाव (प्रत्यक्षतः या अप्रत्यक्षतः) की युक्तियुक्त प्रत्याशा की जाए । इस शब्द के अंतर्गत ऐसे संदूषक या पदार्थ नहीं आते हैं जो खाद्य में पोषण संबंधी क्वालिटियों के बनाए रखने या उनके सुधार करने के लिए मिलाए जाते हैं ;
(ण) "विशेष आहार उपयोगों के लिए खाद्य" से ऐसे खाद्य अभिप्रेत है जो विशेषतः विशिष्ट आहार अपेक्षाओं को पूरा करने के लिए प्रसंस्कृत या बनाए जाते हैं जो किसी विशिष्ट शारीरिक या शरीर क्रियात्मक दशा और/या विनिर्दिष्ट रोगों और विकारों के कारण विद्यमान रहती हैं और जो उस रूप में प्रस्तुत किए जाते हैं इन खाद्य पदार्थों की संरचना तुल्य प्रकृति को उन सामान्य खाद्यों की संरचना से महत्वपूर्ण रूप से भिन्न होनी चाहिए , यदि ऐसा सामान्य खाद्य विद्यमान रहता है ।

स्पष्टीकरण: - विशेष आहार उपयोगों के लिए खाद्यों के कुछ उदाहरण शिशु दुग्ध अनुकल्प, शिशु आहार, ग्लूटन मुक्त खाद्य, निम्न सोडियम अंतर्वस्तु से युक्त खाद्य , विशेष चिकित्सीय प्रयोजनों के लिए खाद्य, भार नियंत्रण आहारों में उपयोग के लिए सूत्र , हैं ;
(क) "संघटक" से कोई पदार्थ अभिप्रेत है जिसके अंतर्गत किसी खाद्य के विनिर्माण या निर्मिति में प्रयुक्त कोई खाद्य योज्य भी है और संभवतः किसी उपांतरित रूप में अंतिम उत्पाद में विद्यमान हो;
(थ) "लेबल " से किसी खाद्य पैकेज के आधान या उससे संलग्न आच्छादन, ढक्कन या किरीट पर कोई लिखित , आलेखी, छिद्रिल , स्टांपित , टैग , ब्रांड, चिन्ह, पिक्टोरियल या अन्य वर्णनात्मक बात, मुद्रित , स्टेंसिल , चिन्हित, उच्चित्रित या छापित कोई संप्रदर्शन अभिप्रेत है ;
(द) "लेबल लगाना " जिसके अंतर्गत कोई लिखित , मुद्रित या अलेखी बात भी है जो खाद्य के साथ लगे लेबल पर विद्यमान है, या खाद्य के निकट संप्रदर्शित की जाती है जिसके अंतर्गत वह जो उसके विक्रय के बढ़ाने या व्ययन के प्रयोजन के लिए है ;
(ध) "लॉट संख्यांक " या " कोड संख्यांक या " बैच संख्यांक " से वह संख्यांक जो या तो अंकों या वर्णमाला में या दर्शित संयोजन के पूर्व "लॉट संख्यांक " या लॉट" या "कोड संख्यांक " या " बैच संख्यांक" या " बैच " शब्द या कोई सुभेदक उपसर्ग होगा जो खाद्य के विनिर्माण में अनुरेखित और वितरण में पहचाना जा सकता हो, अभिप्रेत है;
(न) "पहले से पैक की गई" से किसी आधान में पहले से ही पैक की गई या तैयार की गई उपभोक्ता को पेश करने या खान- पान प्रयोजनों के लिए तैयार, अभिप्रेत है ;

(प) "प्रधान संप्रदर्शन पैनल" से लेबल का वह भाग अभिप्रेत है जो संपदर्शित किए जाने के लिए आशयित या संभाव्य है, और पैकेज में अंतर्विष्ट वस्तु के संप्रदर्शन, विक्रय या क्रय की सामान्य और रूढ़िगत शर्तों के अधीन प्रदर्शित या दर्शित या ग्राहक द्वारा परीक्षित हो ;
(फ) " प्रसंस्करण सहाय्य " से ऐसा पदार्थ या सामग्री अभिप्रेत है जिसके अंतर्गत साधित्र या बर्तन नहीं हैं और न ही अपने आप में खाद्य संघटक के रूप में उपभोग किया जाता है जो आशयित रूप से उपचार या प्रसंस्करण के दौरान कतिपय प्रौद्योगिक प्रयोजन को पूरा करने के लिए कच्ची सामाग्री , खाद्य या उसके संघटकों के प्रसंस्करण में प्रयुक्त किए जाते हैं और जिसके गैर आशयित प्रभाव हो सकेगा किन्तु अंतिम उत्पाद में अवशिष्ट या व्युत्पन्न की अपरिहार्य उपस्थिति हो सकेगी।
3. उक्त नियमों के नियम 32 में, -
(अ) " 32. खाद्य पैकेज पर एक लेबल का होना - प्रत्येक खाद्य पैकेज पर एक लेबल होगा और ऐसे प्रत्येक लेबल पर और जब तक इन नियमों में अन्यथा उपबंधित न किया जाए, निम्नलिखित विनिर्दिष्ट किया जाएगा : -
(क) वर्णन , पैकेज में रखे गए खाद्य पदार्थ का नाम, व्यापार नाम, या
(ख) उत्पाद में प्रयुक्त संघटकों के नाम, यथास्थिति, उनकी संरचना में भार या प्रबलता के अनुसार अवरोही क्रम में ; " शब्दों और अंकों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: - 6

[PART II-SEC. 3(i)] " 32. खाद्य के पैकेज पर एक लेबल का होना, -
(1) साधारण
( i) पहले से पैक किए गए खाद्य को किसी लेबल पर या किसी लेबल लगाने की रीति में वर्णित या दर्शित नहीं किया जाएगा जो मिथ्या, भ्रामक या प्रवंचक हो या उसके संबंध में किसी प्रकार से उसके स्वरूप के बारे में गलत धारणा पैदा होने की संभावना हो ।
(ii) पहले से पैक किए गए खाद्यों में लेबल ऐसी रीति में लगाया जाएगा कि वे आधान से पृथक नहीं हो जाएं ।
( iii) लेबल पर अन्र्त्तवस्तु स्पष्ट, प्रमुख , अमिट और क्रय और उपयोग की सामान्य शर्त के अधीन उपभोक्ता द्वारा आसानी से सुपाठ्य होगी ।
( iv) जहां आधान लपेटन द्वारा आवरित किया जाता है वहां लपेटन पर आवश्यक सूचना लगी होगी या आधान पर लेबल बाहरी लपेटन के माध्यम से आसानी से सुपाठ्य होगा या उसके द्वारा मलिन नहीं होगा ।
(2) पहले से पैक किए गए खाद्यों पर लेबल होना
खाद्य के प्रत्येक पैकेज के लेबल पर निम्नलिखित सूचना होगीः-
खाद्य का नाम
(क)
पैकेज में अंतर्विष्ट खाद्य का नाम, व्यापार नाम या वर्णन ।
(ख) संघटकों की सूची
संघटकों की सूची लेबल पर घोषित की जाएगी और निम्नलिखित रीति से होगी: -
(i) संघटकों की सूची शीर्ष पर होगी या उसके पहले एक समुचित शीर्षक होगा जिसमें "संघटक" शब्द समाविष्ट या सम्मिलित होगा ।
( ii) उत्पादों में प्रयुक्त संघटकों के नाम, यथास्थित, भार या प्रबलता के अनुसार उनकी संरचना अवरोही क्रम में लेबल पर घोषित होगी ।
(iii) किसी मिश्रण या संयोजन के रूप में बेचे गए खाद्य के प्रत्येक पैकेज पर खाद्य (जिसके अंतर्गत सम्मिश्रित संघटकों के संघटक या संघटकों के प्रवर्ग है) के [ भाग II- खण्ड 3 (i) ]

विनिर्माण के समय किसी संघटक की भीतर जाने वाली प्रतिशतता भार या प्रबलता के अनुसार याथोचित रूप में प्रकट की जाएगी और -
(क) उस पर शब्दों या चित्रों या आलेखों के माध्यम से लेबल पर यथा विद्यमान रूप में जोर दिया जाता है ; या
(ख) वह खाद्य के अभिलक्षण के लिए आवश्यक है और उसका ऐसे अन्य खाद्यों से सुभिन्न करना आवश्यक है जो भ्रमित कर सकते हों; या
(ग) उस पर खाद्य के नाम में जोर दिया जाता है ; या
(घ) वह फलों, सब्जियों, साबुत अनाजों या मिलाई गई शर्कराओं की उपस्थिति के बारे में किसी व्यक्त या विविक्षित दावे की विषयवस्तु है ; और
(ङ) जिसका प्रकटीकरण उपभोक्ताओं के स्वास्थ्य में वृद्धि या उपभोक्ता प्रवंचना का निवारण करने के लिए आवश्यक समझा जाता है :
परंतु जहां संघटक उत्पाद के कुल भार के दो प्रतिशत से कम है और वासक के प्रयोजनों के लिए प्रयुक्त किया गया है वहां उपरोक्त प्रकटीकरण अपेक्षित नहीं है ;
( iv) उत्पाद की 100 प्रतिग्राम संपूर्ण पोषण संबंधी सूचना लेबल पर दी जाएगी जिसमें निम्नलिखित अंतर्विष्ट होगा :-
(क) ऊर्जा मूल्य संबंधी सूचना आईसीएमआर की आरडीए के पोषक की प्रतिशतता के साथ प्रति 100 ग्राम या प्रति 100 मिलीलीटर केजे और केसीएएल में अभिव्यक्त की जानी चाहिए ।
(ख) खाद्य में प्रोटीन, कार्बोहाइड्रेट और वसा की मात्रा संबंधी सूचना आईसीएमआर की आरडीए के पोषक की प्रत्तिशतता के साथ प्रति 100 ग्राम या प्रति 100 मिली लीटर में अभिव्यक्त की जानी चाहिए ।
(ग) वसीय अम्लों की मात्रा और / या प्रकार (जिसके अंतर्गत संतृप्त वसीय अम्लों, बहुअसंतृप्त वसीय अम्लों और पार वसीय अम्लों की मात्रा भी है) ।
(घ) विटामिनों और खनिज संबंधी अंकीय सूचना मीट्रिक यूनिटों में और/या आईसीएमआर के आरडीए के पोषक की प्रतिशतता के साथ प्रति 100 ग्राम [PART II-SEC. 3 (i) ]

या प्रति 100 मिलीलीटर आईसीएमआर के पोषक निर्देश मूल्य की प्रतिशतता "के रूप में अभिव्यक्त की जानी चाहिए ।"
(v) जहां संघटक अपने आप में दो या अधिक संघटकों का उत्पाद है, ऐसे सम्मिश्रित संघटकों की सूची में उसी रूप में घोषित किया जा सकेगा परंतु यह है कि यह किसी सूची के ठीक साथ भार अवरोही क्रम में उसके संघटकों के कोष्टकों में लगा होगा :
परंतु यह कि जहां किसी सम्मिश्रित संघटक जिसके लिए इन नियमों में कोई नाम नियत किया गया है, खाद्य योज्यों से भिन्न संघटक खाद्य के 2 प्रतिशत से कम होता है जो तैयार उत्पाद में प्रौद्योगिक कार्य की पूर्ति करता है के घोषित किए जाने की आवश्यकता नहीं होगी ;
(vi) मिलाया गया जल संघटकों की सूची में घोषित किया जाएगा सिवाए जब ब्राइन, सीरप या सम्मिश्रित खाद्य में प्रयुक्त ब्रोथ जैसे संघटक का भाग रूप जल हो और संघटकों की सूची में उस रूप में घोषित किया जाता है । विनिर्माण के दौरान उद्वाष्पित जल या अन्य वाष्पशील संघटकों के घोषित करने की आवश्यकता नहीं है :
परंतु यह कि इस नियम के साधारण उपबंध के अनुकल्पित रूप में निर्जलित या संघनित खाद्य जो केवल जल के मिलाए जाने से पुर्नगठित किए जाने के लिए आशयित हैं, संघटक पुर्नगठित उत्पाद में भार के क्रम में सूचीबद्ध किए जा सकेंगे , परंतु यह तब जब कि " उत्पाद के संघटक जब लेबल पर निदेशों के अनुसार तैयार किए जाते हैं" जैसा कथन सम्मिलित किया जाता है । " ।
(आ) खंड (ख) में, -
(i ) पहले और दूसरे परंतुक जिसके अंतर्गत दूसरे परंतुक के पश्चात् निम्नलिखित पैरा भी है, का लोप किया जाएगा ;
"20 ग्राम या उससे कम भार वाले कन्फेक्शनरी के पैकेजों की दशा में जिन्हें भी संघटकों के घोषणा से छूट प्राप्त हैं " पशु उद्गम " चाहे इसमें जिलेटिन अंतर्विष्ट है को घोषणा से छूट प्राप्त होगी , परंतु यह कि ऐसी घोषणा मल्टीपीस पैकेज पर ऐसी रीति में दी जाएगी कि वह पैकेज के खोले बिना भी सुपाठ्य हो ।"
(ii) अंत में, खंड (ग) के पूर्व निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् : - 9

66 परंतु यह भी कि जब रंगों और सुवासकों की सम्मिलित घोषणा दी जाती है तब प्रयुक्त रंगों के अंतर्राष्ट्रीय संख्यात्मक पहचान संख्यांक भी या तो संघटकों की सूची के नीचे या घोषणा के साथ उपदर्शित की जाएगी :
परंतु यह भी कि सूकर मांस वसा, सूकर वसा और गो मांस वसा या उसका निष्कर्षण उनके विनिर्दिष्ट नामों द्वारा घोषित किए जाएंगे ।"
( इ) खंड ( घ), खंड (ङ) , खंड (च) , खंड (छ) , खंड (ज) और खंड (ख) , खंड ( घ) , खंड (ङ) और खंड (च) से संबंधित खंड (च) के अधीन सभी परंतुकों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
66 " (घ) शुद्ध अंतर्वस्तुएं और जलोत्सारित भार
अंतर्वस्तुएं शुद्ध भार या संख्या या माप या मात्रा जैसा परिस्थितयों के अनुसार अपेक्षित हो, लेबल पर घोषित किया जाएगा । शुद्ध अंतर्वस्तुएं (क) मात्रा के अनुसार द्रव खाद्यों के लिए ; (ख) भार के अनुसार ठोस खाद्यों के लिए ; (ग) अर्द्ध ठोस और श्यान खाद्यों के लिए या तो भार या मात्रा के अनुसार घोषित की जाएंगी । शुद्ध अंतर्वस्तुओं की घोषणा के अतिरिक्त द्रव माध्यम में पैक किए गए किसी खाद्य पर खाद्य के जलोत्सारित भार की मैट्रिक प्रणाली में घोषणा होगी ।
इस अपेक्षा के प्रयोजनों के लिए द्रव माध्यम से जल, चीनी और नमक के जलीय घोल, केवल डिब्बा बंद फलों और सब्जियों में फल और सब्जी के रस या सिरका को या तो अकेले या अभिमिश्रण अभिप्रेत है ।
(ङ) लॉट/कोड/ बैच पहचान
बैच संख्यांक या कोड संख्यांक या लाट संख्यांक जो पहचान का कोई चिन्ह है जिसके द्वारा खाद्य विनिर्माण में अनुरेखित किया जा सकता हो या वितरण में पहचाना जा सकता हो, लेबल पर दिया जाएगा ।
(च) विनिर्माण या पैक करने की तारीख
तारीख , मास और वर्ष जिसमें वस्तु विनिर्मित , पैक या पहले से पैक की जाती है लेबल पर दी जाएगी , परंतु यदि उत्पादों की "तारीख के पूर्व सर्वोतम" 3 मास से अधिक है तो विनिर्माण, पैक करने या पहले से पैक करने का मास और वर्ष दिया जाएगा :
परंतु यह भी कि ऐसी कोई पैकेज वस्तु जिसकी 3 मास से कम की अल्प निधानी आयु है की दशा में वह तारीख, मास और वर्ष जिसमें वस्तु विनिर्मित या तैयार या पहले से पैक की जाती है लेबल पर उल्लिखित की जाएगी ।

(छ) समाप्ति की तारीख
निम्नलिखित की दशा में समाप्ति की तारीख दी जाएगी, -
(i) एसपर्टम के पैकेज की दशा में जो पैक करने की तारीख से तीन वर्ष से अधिक नहीं होगी ;
(ii ) शिशु आहार अनुकल्प और शिशु आहार की दशा में ।
किरणित खाद्य
(ज)
(i ) किसी खाद्य, जो आयन किरणन से उपचारित किया गया है के लेबल पर खाद्य के नाम के निकट सामिप्य में उपचार उपदर्शित करने वाला लिखित कथन होगा । यथा नीचे दर्शित अंतर्राष्ट्रीय खाद्य किरणन प्रतीक प्रयुक्त खाद्य के नाम या ब्रांड नाम के निकट सामिप्य में किया जाएगा ।
(ii) जब कोई किरणित उत्पाद किसी अन्य खाद्य में संघटक के रूप में प्रयुक्त किया जाता है तब यह संघटकों की सूची में इस प्रकार घोषित किया जाएगा।
(iii) जब कोई एकल संघटक उत्पाद कच्ची सामाग्री से तैयार किया जाता है जो किरणित की गई हो तब उत्पाद के लेबल पर उपचार उपदर्शित करने वाला कथन अंतर्विष्ट होगा ।
( iv) किरणित यूनिटों की अनुज्ञप्ति संख्यांक लेबल पर घोषित की जाएगी ।" ।

(ई) खंड (झ) में, तीसरे परंतुक का लोप किया जाएगा ।
(उ) खंड ( झ) के पश्चात् और स्पष्टीकरणों के पूर्व, निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्: -
" (ञ) उद्गम का देश
(i) खाद्य के उद्गम का देश घोषित किया जाएगा ।
(ii ) जब खाद्य का प्रसंस्करण किसी दूसरे देश में किया जाता है जिससे उसकी प्रकृति बदल जाती है तब वह देश, जिसमें प्रसंस्करण किया जाता है, लेबल लगाने के प्रयोजनों के लिए उद्गम का देश समझा जाएगा ।
(ट) उपयोग के लिए अनुदेश
उपयोग जिसके अंतर्गत पुनर्गठन भी है, के लिए अनुदेश , जहां भी लागू हो, खाद्य का सही उपयोग सुनिश्चित करने के लिए, यथा आवश्यक, लेबल पर सम्मिलित किए जाएंगे ।
(ठ) लेबल होने की अपेक्षाओं से छूट
जहां लेबल के महत्तम पृष्ठीय क्षेत्रफल 10 सीएम से कम है, वहां ऐसा लेब संघटकों की सूची, लॉट संख्यांक/ बैच संख्यांक, समाप्ति तारीख तारीख के पूर्व सर्वोत्तम और उपयोग के अनुदेश की अपेक्षाओं से छूट प्राप्त हो सकेगा किन्तु ये अपेक्षाएं यथास्थितिः थोक पैकेजों या मल्टी-पीस पैकेजों पर दी जाएंगी ।
(ड) अन्य लेबल होने की अपेक्षाएं
लिखित, मुद्रित कोई सूचना या पिक्टोरियल युक्ति, या आलेखी बात लेबल में संप्रदर्शित की जा सकेगी परंतु यह तब जब कि यह इन नियमों की अपेक्षाओं के उल्लंधन में नहीं है ।" (ऊ) खंड (झ) के पश्चात् आने वाले स्पष्टीकरण 1,3 और 4 का लोप किया जाएगा ।
4. नियम 37क के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात् :-

[PART II-SEC. 3( i) ] " 37क सांपत्तिक खाद्य का विनिर्माण : -
सांपत्तिक खाद्य से ऐसा खाद्य अभिप्रेत है जो खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन मानकीकृत नहीं किया गया है ।
अन्यत्र इन नियमों के अधीन यथा विहित लेबल उपबंधों के अतिरिक्त सांपत्तिक खाद्य निम्मलिखित अपेक्षाओं के अनुरूप भी होगा : -
(क) सांपत्तिक उत्पादों का विनिर्माता प्रत्येक सांपत्तिक खाद्य के विनिर्माण के लिए पृथक् अनुज्ञप्ति अभिप्राप्त करेगा । विनिर्माता अनुज्ञप्ति प्राधिकारी के अवलोकन या समीक्षा के लिए प्रोटोटाइप लेबल या अंतिम लेबल जो भी उपलब्ध है आवेदन के साथ प्रस्तुत करेगा ।
(ख) खाद्य का नाम और/ या प्रवर्ग जिसके अधीन इन नियमों के अंतर्गत वह आता है लेबल पर उल्लिखित किया जाएगा ।
(ग) किसी मिश्रण या संयोजन के रूप में बेचे गए खाद्य के प्रत्येक पैकेज पर खाद्य (जिसके अंतर्गत सम्मिश्रित संघटकों के संघटक या संघटकों के प्रवर्ग है) के विनिर्माण के समय किसी संघटक की भीतर जाने वाली प्रतिशतता भार या प्रबलता के अनुसार याथोचित रूप में प्रकट की जाएगी और
(i) उस पर शब्दों या चित्रों या आलेखों के माध्यम से लेबल पर यथा विद्यमान रूप में जोर दिया जाता है ; या
(ii) वह खाद्य के अभिलक्षण के लिए आवश्यक है और उसका ऐसे अन्य खाद्यों से सुभिन्न करना आवश्यक है जो भ्रमित कर सकते हों ; या
(iii) उस पर खाद्य के नाम में जोर दिया जाता है ; या
(iv) वह फलों , सब्जियों, साबुत अनाजों या मिलाई गई शर्कराओं की उपस्थिति के बारे में किसी व्यक्त या विविक्षित दावे की विषयवस्तु है ; और 13

(v) जिसका प्रकटीकरण उपभोक्ताओं के स्वास्थ्य की वृद्धि या उपभोक्ता प्रवंचना का निवारण करने के लिए आवश्यक समझा जाता है :
परंतु जहां संघटक उत्पाद के कुल भार के दो प्रतिशत से कम है और वासक के प्रयोजनों के लिए प्रयुक्त किया गया है वहां उपरोक्त प्रकटीकरण अपेक्षित नहीं है ;
(घ) उत्पाद की प्रति 100 ग्राम संपूर्ण पोषण संबंधी सूचना लेबल पर दी जाएगी जिसमें निम्नलिखित अंतर्विष्ट होगा : -
(i) ऊर्जा मूल्य संबंधी सूचना आईसीएमआर की आरडीए के पोषक की प्रतिशतता के साथ प्रति 100 ग्राम या प्रति 100 मिलीलीटर केजे और केसीएएल में अभिव्यक्त की जानी चाहिए ।
(ii ) खाद्य में प्रोटीन, कार्बोहाइड्रेट और वसा की मात्रा संबंधी सूचना आईसीएमआर की आरडीए के पोषक की प्रतिशतता के साथ प्रति 100 ग्राम या प्रति 100 मिली लीटर में अभिव्यक्त की जानी चाहिए ।
( iii) वसीय अम्लों की मात्रा और/ या प्रकार ( जिसके अंतर्गत संतृप्त वसीय अम्लों, बहुअसंतृप्त वसीय अम्लों और पार वसीय अम्लों की मात्रा भी है) ।
(iv) विटामिनों और खनिज संबंधी अंकीय सूचना मीट्रिक यूनिटों में और/या आईसीएमआर के आरडीए के पोषक की प्रतिशतता के साथ प्रति 100 ग्राम या प्रति 100 मिलीलीटर आईसीएमआर के पोषक निर्देश मूल्य की प्रतिशतता के रूप में अभिव्यक्त की जानी चाहिए ।"
(ङ) तंबाकू अल्कोहलिक पेय और निकोटिन सांपत्तिक उत्पादों के विनिर्माण में संघटकों के रूप में प्रयुक्त नहीं की जाएगी ।
(च) उत्पाद में ऐसे कोई पदार्थ अंतर्विष्ट नहीं होंगे जो स्वास्थ्य के लिए हानिकारक हो सकते हैं ।
(छ) जहां नियमों के अधीन पहचान किए गए रूप में कोई तीव्रग्राही और/ या अतिसंवेदी संघटकों, या किसी तीव्रग्राही और/ या अतिसंवेदी संघटकों से उद्भूत होने वाले किसी संघटक से युक्त खाद्य में खाद्यों के नाम में तीव्रग्राही संघटक/ अतिसंवेदी संघटकों को विनिर्दिष्ट नहीं किया 14

[PART II SEC. 3 (i ) ] जाता है वहां उस खाद्य को संबंधित तीवग्राही/ संवेदी संघटक के नाम के स्पष्ट प्रतिनिर्देश से चिन्हित किया जाएगा या लेबल लगाया जाएगा ।
(ज) उत्पाद में उस खाद्य और/ या खाद्य के प्रवर्ग के लिए इन नियमों में यथा उपबंधित के सिवाय खाद्य योज्य नहीं होंगे ।"
5. नियम 37ख में, उपनियम (1 ) के पूर्व निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात् : -
" किसी शिशु खाद्य पदार्थ का जिसका मानक परिशिष्ट ' ख ' में विहित नहीं है विक्रय के लिए विनिर्माण, विक्रय के लिए प्रदर्शन या विक्रय के लिए भंडारकरण , भारत सरकार से ऐसे खाद्य पदार्थ और उसके लेबल का अनुमोदन अभिप्राप्त करने के पश्चात् ही किया जाएगा । शिशु दुग्ध अनुकल्प/शिशु आहार की लेबल अपेक्षाओं में अन्यत्र इन नियमों के अधीन यथा विहित लेबल उपबंधों के अतिरिक्त निम्नलिखित सूचना भी लगी होगी । "
6. नियम 40 कें उपनियम (2) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अथात् : -
(2) ( i) ऐसे किसी फल- सीरप , फल रस , फल स्क्वैश, फल पेय, कार्डियल, क्रंश या इन नियमों के परिशिष्ट ख के अधीन मानकीकृत किसी अन्य फल उत्पाद का जिसमें फल- रस/फल गूदा/फल अंतर्वस्तु विहित मात्रा में नहीं है, यथास्थिति , फल- सीरप , फल- रस , फल स्क्वैश , फल-पेय , कार्डियल, क्रश या किसी अन्य फल उत्पाद के रूप में वर्णन नहीं किया जाएगा और ऐसे उत्पादों का फल रहित उत्पादों के रूप में वर्णन किया जाएगा ।
प्रत्येक फल रहित उत्पाद स्पष्ट रूप से , सहज दृश्य रूप से और आसानी से पठनीय रीति में फल रहित उत्पाद' के रूप में लेबल पर चिन्हित किया जाएगा और ऐसे उत्पाद से युक्त आधान पर फलों के चित्र या फल शब्द चाहे उससे संलग्न हों या ऐसे आधान के लपेटन पर या अन्यथा नही लगे होंगे जिसमें उपभोक्ता को यह विश्वास हो जाए कि वह फल उत्पाद है ।
(ii) कोई खाद्य उत्पाद जिसमें केवल फल वासक अंतर्विष्ट हों चाहे प्राकृतिक वासक और प्राकृतिक वासक पदार्थ हों या वासक पदार्थों से मिलती- जुलती प्रकृति या एकल रूप में 15

या संयोजन में कृत्रिम पदार्थ हों किसी फल उत्पाद के रूप में वर्णित नहीं किया जाएगा और ' फल ' शब्द ऐसे किसी उत्पाद के वर्णन करने में प्रयुक्त नहीं किया जाएगा और ऐसा उत्पाद का ऐसे किसी लेबल के साथ विक्रय नहीं किया जाएगा जिसपर कोई फल का चित्र या शब्द लगा हो ।
( iii) कोई खाद्य उत्पाद जिसमें फल संघटक के रूप में प्रयुक्त नहीं किया गया है ऐसे उत्पाद के वर्णन करने में ' फल ' शब्द का प्रयोग नहीं किया जाएगा और ऐसा उत्पाद का ऐसे किसी लेबल के साथ विक्रय नहीं किया जाएगा जिसपर कोई फल का चित्र या शब्द लगा हो ।
( iv) कार्बानेटीकृत जल पर जिसमें कोई फल रस या फल गूदा अंतर्विष्ट नहीं है ऐसा कोई लेबल नहीं होगा जिसमें उपभोक्ता को यह विश्वास हो जाए कि वह फल उत्पाद है ।" ।
7. नियम 42 के उपनियम ( ययय) में खंड (21 ) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्, -
66 (22) किसी तीव्रग्राही और/ या अतिसंवेदी संघटकों से युक्त खाद्य के प्रत्येक पैकेज पर निम्नलिखित लेबल लगा होगा :-
(खाद्य का नाम) में........................तीव्र ग्राही और/या अतिसंवेदी संघटक अंतर्विष्ट हैं ।
8. नियम 44- ज के पश्चात् निम्नलिखित नियम अंतःस्थापित किए जाएंगे , अर्थात् :-

" नियम 44 झ . उत्पादों में ऐसे पदार्थ अंतर्विष्ट नहीं होंगे जो स्वास्थ्य के लिए हानिकार हो सकते हैं, -
उत्पाद में ऐसे कोई पदार्थ अंतर्विष्ट नहीं होंगे जो स्वास्थ्य के लिए हानिकार हो सकते हैं
जहां किसी खाद्य में नियमों के अधीन पहचान किए गए रूप् में कोई तीव्रहग्राही और/ या अतिसंवेदी संघटक, या किसी तीव्रग्राही और/ या अतिसंवेदी संघटकों से उद्भुत होने वाला कोई संघटक अंतर्विष्ट है खाद्य के नाम में तीव्रग्राही संघटकों/ अतिसंवेदी संघटकों को विनिर्दिष्ट नहीं करता है वहां नियम 42 के उपनियम ( ययय) (22) में यथा उपबंधित लेबल घोषणा लगी होगी ।"

NOTIFICATION
New Delhi , the 25th November , 2005
G.S.R. 694(E). The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government , after consultation with the Central Committee for Food Standards , proposes to make in exercise of the powers conferred by sub - section ( 1 ) of section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954 ) , is hereby published , as required by the said sub - section, for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Official Gazette in which this notification is published , are made available to the public .
Objections or suggestions , if any, may be addressed to the Secretary , Ministry of Health and Family Welfare , Government of India , Nirman Bhawan, New Delhi - 110011 .
The objections and suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Government .
DRAFT RULES
(1) These rules may be called the Prevention of Food Adulteration ( Amendment) Rules , 2005.
(2) They shall come into force on the date of their final publication in the Official Gazette .

2. In the Prevention of Food Adulteration Rules , 1955 ( hereinafter referred to as said rules , in rule 2, after clause ( f) , the following shall be inserted, namely , -
(g) " Claim " means any representation which states , suggest or implies that a food has particular qualities relating to its origin , nutritional properties , nature , processing , composition or any other quality;
(h ) " Consumer " means persons and families purchasing and receiving food for consumption;
( i ) " Contaminant " means any substance not intentionally added to food, which is present in such food as a result of the production (including operations carried out in crop husbandry , animal husbandry and veterinary medicine), manufacture , processing , preparation, treatment, packing , packaging , transport or holding of such food or as a result of environmental contamination. The term does not include insect fragments , rodent hairs and other extraneous matter ;
(j) "Date of Manufacture " means the date on which the food becomes the product as described;
(k) "Date of Packaging " means the date on which the food is placed in the immediate container in which it will be ultimately sold ;
(1 ) " Best Before " means the date which signifies the end of the period under any stated storage conditions during which the product will remain fully marketable and will retain any specific qualities for which tacit or express claims have been made. However , beyond the date the food may still be perfectly satisfactory;
(m) " Expiry Date " means the date which signifies the end of the estimated period under any stated storage conditions , after which product probably will not have the quality attributes normally expected by the consumers and the food shall not be marketable;
(n) " Food Additive " means any substance not normally consumed as a food by itself and not normally used as a typical ingredient of the food, whether or not it has nutritive value , the intentional addition of which to food for a technological (including organoleptic) purpose in the manufacture , processing, preparation , treatment , packing , packaging, transport or holding of such food results ; or may be reasonably expected to result, (directly or indirectly) in it or its by- products becoming a component of or otherwise affecting the characteristics of such foods . The term does not include contaminants or substances added to food for maintaining or improving nutritional qualities ;
(o) " Food for Special dietary uses " means foods which are specially processed or formulated to satisfy particular dietary requirements because of a particular physical or physiological condition and / or specific diseases and disorders and which when are presented as such, the composition of these food stuffs shall be significantly different from the composition of foods of comparable nature , that exists .

Explanation: Some examples of foods for special dietary uses are infant milk substitute , infant food, gluten free food, food with low- sodium content, foods for special medical purposes , formula for use in weight control diets ;
(p) " Ingredient" means any substance , including a food additive , used in the manufacture or preparation of a food and present in the final product although possibly in a modified form;
(q) "Label " means a display of written, graphic , perforated, stamped , tag, brand , mark, pictorial or other descriptive matter , printed , stenciled, marked, embossed or impressed on , or attached to , a container ,cover, lid or crown of any food package;
(r) " Labelling" includes any written, printed or graphic matter that is present on the label, accompanies the food, or is displayed near the food, including that for the purpose ofpromoting its sale or disposal;
(s) "Lot number " or " Code number " or " batch number " means the number either in numericals or alphabets or in combination, representing the Lot number or code number or batch number being preceded by the words " Lot No " or " Lot" or " code number " or "Batch No " or " Batch " or any distinguishing prefix by which the food can be traced in manufacture and identified in distribution;
(t) "Prepackaged" means packaged or made up in advance in a container, ready for offer to the consumer , or for catering purposes ;
(u) "Principal display panel " means that part of a label which is intended or is likely to be displayed, and presented or shown or examined by the customer under normal and customary conditions of display , sale or purchase of the commodity contained in the package;
(v) " Processing Aid" means substance or material, not including apparatus or utensils , and not consumed as a food ingredient by itself, intentionally used in the processing of raw materials, foods or its ingredients , to fulfill a certain technological purpose during treatment or processing and which may result in the non- intentional but unavoidable presence of residues or derivatives in the final product .
3. In rule 32 of the said rules , -
(A) for the words and figures "32. Package of food to carry a label : Every package of food shall carry a label and unless otherwise provided in these rules , there shall be specified on every label : -
(a)the name, trade name or description of food contained in the package;
(b) the names of ingredients used in the product in ' descending order of their composition by weight or volume as the case may be ; " the following shall be substituted, namely: - 30

"32, Package of food to carry a label, -
(1) General
(i) Prepackaged food shall not be described or presented on any label or in any labelling manner that is false , misleading or deceptive or is likely to create an erroneous impression regarding its character in any respect .
(ii) Label in prepackaged foods shall be applied in such a manner that they will not become separated from the container .
( iii) Contents on the label shall be clear, prominent , indelible and readily legible by the consumer under normal condition of purchase and use .
( iv) Where the container is covered by a wrapper , the wrapper shall carry the necessary information or the label on the container shall be readily legible through the outer wrapper or not obscured by it .
(2) Labelling of Prepackaged Foods
Every package of food shall carry the following information on the label .
(a) The Name of the Food
The name , trade name or description of food contained in the package .
(b) List ofIngredients
A list of ingredients shall be declared on the label and shall be in the following manner .
(i) The list of ingredients shall be headed or preceded by an appropriate title , (ii) which consists of or includes the term " ingredient" . The names of ingredients used in the product in descending order of their composition by weight or volume as the case may be .
(iii) Every package of food sold as a mixture or combination shall disclose the ingoing percentage , by weight or volume as may be appropriate , of any ingredient at the time of the manufacture of the food ( including ingredients of compound ingredients or categories or ingredients) and it --
( a) is emphasized as present on the label through words or pictures or graphics; or
(b) . is essential to characterize the food and is essential to distinguish the food from others with which it may be confused; or
(c) is emphasized in the name of the food; or
(d) is the subject of an express or implied claim about the presence of any fruits , vegetables , whole grains or added sugars and
(e) the disclosure of which is deemed to be necessary to enhance the health of consumers or prevent consumer deception :

Provided that the above disclosure is not required where ingredient comprises less than two percent of the total weight of the product and has been used for the purposes of flavouring;
(iv) The complete nutritional information per 100 gm of the product shall be given on the label containing the following: -
(a) Information on energy value should be expressed in kJ and Kcal per 100 gm or per 100 ml alongwith percentage of nutrient of RDA of ICMR .
(b) Information on the amounts of protein, carbohydrate and fat in the food should be expressed in gm per 100 gm or per 100 ml alongwith percentage of nutrient ofRDA of ICMR
(c) The amount and/or type of fatty acids (including amount of saturated fatty acids , polyunsaturated fatty acids and trans fatty acids) .
(d) Numerical information on vitamins and minerals should be expressed in metric units and/or as a percentage of the Nutrient Reference Value of ICMR per 100 gm or per 100 ml alongwith percentage of nutrient of RDA of ICMR. "
(v) Where an ingredient is itself the product of two or more ingredients , such a compound ingredient may be declared, as such, in the list of ingredients , provided that it is immediately accompanied by a list, in brackets , of its ingredients in descending order of weight:
Provided that where a compound ingredient for which a name has been established in these rules constitutes less than 2 percent of the food, the ingredients other than food additives which serve a technological function in the finished product need not to be declared;
(vi) Added water shall be declared in the list of ingredients except when the water forms part of an ingredient such as brine , syrup or broth used in a compound food and declared as such in the list of ingredients . Water or other volatile ingredients evaporated in the course of manufacture need not to be declared;
Provided that dehydrated or condensed food, which are intended to be reconstituted by the addition of water only, the ingredients may be listed in order of weight in the reconstituted product provided that a statement such as " ingredients of the product when prepared in accordance with the directions on the label " is included." .
(B) In clause (b) , -
(i ) the first and second proviso including the paragraph after second proviso beginning with the words, " In case of packages of confectionery " and ending with the words , "without opening package" , shall be omitted;
(ii) at the end, before clause (c) , the following proviso shall be inserted, namely: -
"Provided also that when combined declaration of colours and flavours are given, the intemational numerical identification number of colours used shall also be indicated either under the list of ingredients or along with the declaration:

Provided also that pork fat , lard and beef fat or extract thereof shall be declared by their specific names . "
(C) For clauses (d) , (e ), (f) , (g ) , (h) and all the provisos under clause (f) relating to clauses (b) , ( d) , ( e) and (f) , the following shall be substituted, namely : -
(d) Net contents and drained weight
The net weights or number or measure of volume of contents as the circumstances may require shall be declared on the label . The net contents shall be declared ( a) for liquid foods , by volume ; (b) for solid foods , by weight ; ( c) for semi - solid and viscous foods , either by weight or volume . In addition to the declaration of net contents , a food packed in a liquid medium shall carry a declaration in the metric system of the drained weight of the food . For the purposes of this requirement , liquid medium means water, aqueous solutions of sugar and salt, fruit and vegetable juices in canned fruits and vegetables only, or vinegar , either singly or in combination.
(e) Lot / Code / Batch identification
A batch number or code number or lot number which is a mark of identification by which the food can be traced in manufacture and identified in distribution , shall be given on the label.
(f) Date of manufacture or packing
The date , month and year in which the commodity is manufactured, packed or pre-packed , shall be given on the label . Provided that the month and the year of manufacture , packing or pre -packing shall be given if the "Best Before Date" of the products is more than 3 months:
Provided also that in case of any package commodity which has a short shelf life of less than 3 months , the date , month and year in which the commodity is manufactured or prepared or prepacked shall be mentioned, on the label .
(g) Date of Expiry
The date of expiry shall be given, -
(i) in case of package of Aspertaine which shall be not more than three years from the date of packing;
(ii) in case of infant milk substitute and infant foods .
Irradiated foods
(h)
(i) The label of a food, which has been treated with ionizing radiation , shall carry a written statement indicating the treatment in close proximity to the name of the food . The use of the international food irradiation symbol , as shown below shall be in close proximity to the name or brand name of the food .

(ii) When an irradiated product is used as an ingredient in another food, this shall be so declared in the list of ingredients .
( iii) When a single ingredient product is prepared from a raw material which has been irradiated, the label of the product shall contain a statement indicating the treatment .
(iv) The licence number of irradiated units shall be declared on the label ." .
(D) In clause (i ), the third proviso shall be omitted.
(E) After clause ( i ) and before Explanations , the following shall be inserted, namely: -
"(j ) Country of Origin
(i ) The country of origin of the food shall be declared.
(ii) When a food undergoes processing in a second country which changes its nature , the country in which the processing is performed shall be considered to be the country of origin for the purposes of labelling .
(k) Instructions for use
Instructions for use , including reconstitution, where applicable , shall be included on the label , as necessary , to ensure correct utilization of the food .
(1 )Exemptions from labelling requirements
Where the largest surface area of the label is less than 10 cm² , such label may be exempted from the requirements of list of Ingredients , Lot Number / Batch Number, Expiry Date / Best Before Date and Instruction for use , but these requirements shall be given on wholesale packages or multi - piece packages as the case may be .
(m) Other labelling requirements
Any information or pictorial device written , printed, or graphic matter may be displayed in labelling provided that it is not in conflict with the requirements of these rules . " .
(F) Explanation - I, III and IV occurring after clause (i ) shall be omitted
4. For rule 37- A, the following rule shall be substituted , namely , -
"37- A, Manufacture of Proprietary food: -

Proprietary food means a food which has not been standardized under the Prevention ofFood Adulteration Rules , 1955 .
In addition to the labelling provisions as prescribed under these rules elsewhere the proprietary food shall also conform to the following requirements : -
(a) The manufacturer of proprietary products shall obtain separate licence for manufacture of each proprietary product . The manufacturer shall submit alongwith the application prototype label or final label whichever is available for perusal or examination of the Licencing Authority.
(b) The name of the food and/or category under which it falls in these rules shall be mentioned on the label .
(c) Every food sold as a mixture or combination shall disclose the ingoing percentage , by weight or volume as may be appropriate , of any ingredient at the time of the manufacture of the food including ingredients of compound ingredients or categories of ingredients that
(i) is emphasized as present on the label through words or pictures or graphics ; or
(ii) is essential to characterize the food and is essential to distinguish the food from others with which it may be confused ; or
(iii) is emphasized in the name of the food ; or
(iv) is the subject of an express or implied claim about the presence of any fruits , vegetables , whole grains or added sugars and
(v) the disclosure of which is deemed to be necessary to enhance the health of consumers or prevent consumer deception:
Provided that the above disclosure is not required where ingredient comprises less than two percent of the total weight of the product and has been used for the purposes of flavouring;
(d) The complete nutritional information per 100 gm of the product shall be given on the label containing the following: -
(i) Information on energy value should be expressed in kJ and Kcal per 100 gm or per 100 ml alongwith percentage of nutrient of RDA of ICMR.
(ii) Information on the amounts of protein , carbohydrate and fat in the food should be expressed in gm per 100 gm or per 100 ml alongwith percentage of nutrient ofRDA of ICMR.
(iii) The amount and/or type of fatty acids (including amount of saturated fatty acids , polyunsaturated fatty acids and trans fatty acids) . Numerical information on vitamins and minerals should be expressed in metric units and/ or as a percentage of the Nutrient Reference Value of ICMR per 100 gm or per 100 ml alongwith percentage of nutrient of RDA of ICMR .

(e) Tobacco , alcoholic beverages and nicotine shall not be used as ingredients in manufacture ofproprietary products .
(f) The product shall not contain any substances which may be injurious to health .
(g) Where food containing any allergenic and / or hypersensitive ingredients as identified under the rules , or any ingredient originating from an allergenic and / or hypersensitive ingredients , does not specify the allergenic ingredients / hypersensitive ingredients in the name of the foods , that food shall be marked or labeled with a clear reference to the name of the allergenic / hypersensitive ingredient concerned.
(h) The product shall not contain food additives except as provided in the rules for that food and/ or category of food. "
5. In rule 37-B , before sub- rule ( 1 ) , the following shall be inserted, namely, -
"An article of infant milk substitutes / infant foods whose standards are not prescribed in Appendix B shall be manufactured for sale , exhibited for sale or stored for sale only after obtaining the approval of such articles of food and its label from Government of India. The labelling requirements of infant milk substitutes / infant food shall also carry the following information in addition to the labelling provisions as prescribed under these rules elsewhere ."
6. For sub -rule (2) of rule 40, the following sub - rule shall be substituted, namely , -
"(2)( i ) Any fruit syrup , fruit juice , fruit squash, fruit beverages , cordial , crush or any other fruit products standardized under Appendix B of these Rules , which does not contain the prescribed amount of fruit juice / fruit pulp / fruit content shall not be described as fruitsyrup , fruit juice , fruit squash , fruit beverages , cordial , crus. or any other fruit product as the case may be and such products shall be described as a non- fruit products.
Every non- fruit product shall be clearly , conspicuously and easily readable manner marked on the label as ' NON - FRUIT PRODUCT ' and the container containing such product shall not have pictures of fruits or word fruit whether attached thereto or printed on the wrapper of such container or otherwise , which may lead the consumer into believing that it is a fruit product.
(ii) Any food product which contains only fruit flavours whether natural flavours and natural flavouring substances or nature identical flavours substances or artificial flavouring substances as single or in combination shall not be described as a fruit product and the word 'FRUIT ' shall not be used in describing such a product and such product shall not be sold with a label which carries the picture or word of any fruit.
(iii)Any food product in which fruit has not been used as ingredient, the word ' FRUIT ' shall not be used in describing such a product and such product shall not be sold with a label which carries the picture or word of any fruit.
(iv) Carbonated water containing no fruit juice or fruit pulp shall not have a label which lead the consumer into believing that it is a fruit product. " .

7. In rule 42, in sub - rule ( zzz ) , after clause ( 21 ) , the following shall be inserted, namely, -
(22) Every package of food containing any allergenic and/ or hypersensitive ingredients shall bear the following label :
.(name of food)
This contains . .. (name of) allergenic and /orhypersensitive ingredients .
8. After rule 44 -H , the following rules shall be inserted , namely, -
" Rule 44-1 . Product not to contain any substances which may be injurious to health. -
The product shall not contain any substances which may be injurious to health .
Where any food contains any allergenic and / or hypersensitive ingredients as identified under the rules , or any ingredient originating from an allergenic and / or hypersensitive ingredients , does hot specify the allergenic ingredients / hypersensitive ingredients in the name of the foods , shall bear the label declaration as provided in sub- rule ( zzz) (22) of rule 42. "
9. Rule 48 -B shall be omitted.
