अधिसूचना

सं. एफ- 37-3/विधिक/2004.- अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 (1987 का 52) की धारा 10 (ख) , (छ) , (झ) , (ट) , (त ) एवं (फ) और धारा 11 के साथ पठित धारा 23 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और दिनांक 06.01.2005 के विनियम 37-3/विधिक/2004 के अधिक्रमण में, परिषद् द्वारा एतद्वारा निम्नलिखित विनियम अधिसूचित किए जाते हैं :

संक्षिप्त नाम और प्रारंभ :

(1 ) इन विनियमों का संक्षिप्त नाम अखिल भारतीय तकनीकी शिक्षा परिषद् (अभातशिप ) , नई तकनीकी संस्थाएं शुरू करने , पाठ्यक्रम और कार्यक्रम प्रारंभ करने तथा पाठ्यक्रमों अथवा कार्यक्रमों के लिए सीटों की प्रवेश क्षमता में वृद्धि/ परिवर्तन करने के लिए अनुमोदन प्रदान करना तथा विद्यमान तकनीकी संस्थाओं के लिए अनुमोदन का विस्तार और मानित - विश्वविद्यालयों सहित विश्वविद्यालयों में सन्नियमों और मानकों का अनुरक्षण विनियम , 2005 है ।

(2) ये भारत के राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

(2) परिभाषाएं : -

इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :

(क) 'अधिनियम' से अभिप्रेत है अखिल भारतीय तकनीकी शिक्षा अधिनियम, 1987 (1987 का 52);

(ख) ' तकनीकी संस्था से अभिप्रेत है सरकारी, सरकार द्वारा सहायता प्राप्त तथा निजी (स्व- वित्तपोषित) संस्थाएं जो एमसीए, वास्तुकला , नगर आयोजना, प्रबंधन, भेषजी, होटल प्रबंधन एवं खानपान प्रौद्योगिकी अनुप्रयुक्त कला एवं शिल्प सहित इंजीनियरी /प्रौद्योगिकी तथा परिषद् द्वारा समय- समय पर अधिसूचित ऐसे अन्य कार्यक्रमों एवं विषयक्षेत्रों में तकनीकी शिक्षा, प्रशिक्षण एवं शोध के क्षेत्र में पाठ्यक्रम/ कार्यक्रम संचालित कर रही हैं ।

(ग) इसमें प्रयुक्त अन्य सभी शब्दों एवं अभिव्यक्तियों, जिन्हें यहां परिभाषित नहीं किया गया है परंतु अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 ( 1987 का 52) में

परिभाषित किया गया है, का वही तात्पर्य होगा जो उन्हें क्रमशः उक्त अधिनियम में निर्दिष्ट किया गया है ।

(3) प्रयोजन :-

ये विनियम निम्नलिखित उपबंध करेंगे :-

क) नई तकनीकी संस्थाओं की स्थापना के लिए अनुमोदन प्रदान करना ;

ख) तकनीकी संस्थाओं में नए पाठ्यक्रम अथवा कार्यक्रम शुरू करने और / अथवा विद्यमान पाठ्यक्रमों अथवा कार्यक्रमों में सीटों की प्रवेश क्षमता में वृद्धि और/ अथवा परिवर्तन के लिए अनुमोदन प्रदान करना ;

ग) विद्यमान तकनीकी संस्थाओं के लिए आगे अनुमोदन प्रदान करना ;

घ) तकनीकी शिक्षा प्रदान कर रहे विश्वविद्यालयों, जिनमें मानित विश्वविद्यालय भी शामिल हैं, में सन्नियमों और मानकों का अनुरक्षण सुनिश्चित करना ।

(4) प्रयोज्यता: -

ये विनियम मानित विश्वविद्यालयों सहित ऐसे विश्वविद्यालयों और सरकारी, सरकार द्वारा सहायता प्राप्त तथा निजी (स्व-वित्तपोषित) संस्थाओं पर लागू होंगे जो एमसीए , वास्तुकला , नगर आयोजना, प्रबंधन, भेषजी, होटल प्रबंधन एवं खानपान प्रौद्योगिकी ,अनुप्रयुक्त कला एवं शिल्प सहित इंजीनियरी/ प्रौद्योगिकी तथा परिषद् द्वारा समय- समय पर अधिसूचित ऐसे अन्य कार्यक्रमों एवं विषयक्षेत्रों में तकनीकी शिक्षा , प्रशिक्षण एवं शोध के क्षेत्र में पाठ्यक्रम/कार्यक्रम संचालित कर रही हैं ।

(5) अनुमोदन प्रदान करने की अपेक्षाएं :-

(1) परिषद् से पूर्व अनुमोदन प्राप्त किए बिना तकनीकी शिक्षा के क्षेत्र में सभी स्तरों पर सरकार, सरकार द्वारा सहायता प्राप्त अथवा निजी (स्ववित्त पोषित ) कोई भी नई संस्था, चाहे वह किसी विश्वविद्यालय से संबद्ध हो अथवा संबद्ध न हो , शुरू नहीं की जाएगी और कोई भी नया पाठ्यक्रम/कार्यक्रम प्रारंभ नहीं किया जाएगा तथा विद्यमान पाठ्यक्रमों/कार्यक्रमों में प्रवेश क्षमता में कोई वृद्धि और/अथवा परिवर्तन नहीं किया जाएगा । परिषद् अभातशिप से पूर्व-अनुमोदन प्राप्त किए बिना " तकनीकी शिक्षा " में पाठ्यक्रम/ कार्यक्रम संचालित करने के माध्यम से इस विनियम के उपबंधों के उल्लंघन के लिए यथास्थिति ऐसी व्यतिक्रमी संस्था/ सोसाइटी/ न्यास/कंपनी/ सहयोजित व्यक्तियों के विरुद्ध विधिक कार्रवाई कर सकेगी ।

(2) परिषद् के पूर्व अनुमोदन के बिना सरकारी , सरकार द्वारा सहायता प्राप्त अथवा निजी ( वित्त पोषित) कोई भी विद्यमान संस्था, चाहे वह किसी विश्वविद्यालय से संबद्ध हो अथवा संबद्ध न हो , कोई तकनीकी पाठ्यक्रम/ कार्यक्रम संचालित नहीं करेगी ।

(3) मानित विश्वविद्यालय सहित कोई विश्वविद्यालय अभातशिप द्वारा विहित सन्नियमों और मानकों का अनुरक्षण सुनिश्चित किए बिना कोई तकनीकी पाठ्यक्रम/कार्यक्रम संचालित नहीं करेगा ।

(4) कोई विश्वविद्यालय, बोर्ड अथवा अन्य कोई निकाय अभतशिप द्वारा अनुमोदित न किए गए तकनीकी पाठ्यक्रमों/कार्यक्रमों को संबद्ध नहीं करेगा ।

(5) कोई प्रवेश प्राधिकरण /निकाय/ संस्था अभातशिप द्वारा अनुमोदित न किए गए तकनीकी शिक्षा के पाठ्यक्रम/कार्यक्रम में छात्रों को प्रवेश नहीं देगा ।

6. तकनीकी पाठ्यक्रमों/ कार्यक्रमों के संचालन हेतु नई तकनीकी संस्थाओं की स्थापना के लिए अनुमोदन प्रदान करने हेतु प्रस्तावों के प्रक्रमण की पद्धति ।

6.1 प्रस्तावों/ आवेदन पत्रों को प्रस्तुत करना

प्रस्ताव प्रपत्र निम्नलिखित द्वारा प्रस्तुत किए जा सकते हैं

क) स्व-वित्त पोषित निजी संस्थाओं के मामले में रजिस्ट्रीकृत सोसाइटियां एवं न्यास

ख) केन्द्रीय /राज्य सरकार की संस्थाएं

(Le सरकार द्वारा सहायता प्राप्त संस्थाएं

प्रस्ताव प्रपत्र अभातशिप की वेबसाइट www.aicte.ernet.in द्वारा डाउनलोड किए जा सकते हैं । तथापि, ' सदस्य सचिव , अभातशिप के पक्ष में आहरित तथा नई दिल्ली में किसी राष्ट्रीयकृत बैंक के पक्ष में देय 5000/- रु. का एक डिमांड ड्राफ्ट आवेदन प्रपत्र के लिए प्रन्दाव प्रपत्र के साथ संलग्न किया जाना चाहिए जिसके न होने पर आवेदन पर विचार नहीं किया जाएगा ।

6.1 ( क) नई संस्थाओं की स्थापना के लिए अनुमोदन प्रक्रिया खुली होगी जिसमें आवेदक सोसाइटी/न्यास को पूरे वर्ष में किसी भी समय परिषद् के संबंधित क्षेत्रीय कार्यालय में प्रस्ताव प्रस्तुत करने की अनुमति दी जाएगी। नई संस्था के लिए परिषद् में प्राप्त आवेदन तीन वर्ष के लिए वैध होगा ।

(ख) विधिवत् रूप से भरे हुए तथा हस्ताक्षरित प्रस्ताव प्रपत्र चार प्रतियों में अपेक्षित प्रक्रमण शुल्क के साथ और दावे के समर्थन में अपेक्षित दस्तावेजों के साथ अभातशिप के संबंधित क्षेत्रीय कार्यालयों को प्रेषित किए जाने चाहिए ।

(ग) प्राप्त प्रस्ताब की संवीक्षा की जाएगी और परिषद् के क्षेत्रीय कार्यालय द्वारा उसकी कमियां यदि कोई हों, प्रस्ताव प्राप्त होने की तारीख से 15 दिन के भीतर आवेदक सोसाइटी/ न्यास को सूचित की जाएंगी ।

(घ) क्षेत्रीय कार्यालय प्रस्ताव प्राप्त होने की तारीख से 15 दिन के भीतर प्रस्ताव की एक प्रति नई दिल्ली में अभातशिप मुख्यालय को भी प्रेषित करेगा ।

6.2 (क) साथ ही साथ क्षेत्रीय कार्यालय भी प्रस्ताव प्राप्त करने की तारीख से 15 दिन के भीतर प्रस्तावों की एक- एक प्रति संबंधित राज्य सरकार/ संघ राज्य क्षेत्रों और संबद्ध विश्वविद्यालय को 30 दिन के भीतर उनकी राय प्राप्त करने के लिए अग्रेषित करेगा ।

(ख) राज्य सरकारें और संबद्ध विश्वविद्यालय अपनी राय क्षेत्रीय कार्यालय से प्रस्ताव प्राप्त होने की तारीख से 30 दिनों के भीतर अग्रेषित करेंगी । राज्य सरकारें और संबद्ध विश्वविद्यालय अपने दावे को प्रमाणित करने के लिए कारण और औचित्य प्रदान करेंगे तथा ऐसा वे परिषद् द्वारा समय - समय पर विनिर्धारित तारीख तक करेंगे ।

(ग) परिषद् के पास नई तकनीकी संस्थाओं की स्थापना के मामलों का निर्णय करते समय राज्य सरकार/विश्वविद्यालय की सिफारिशों को नामंजूर करने का अधिकार है ।

6.3 (क) इसके पश्चात् प्रस्तावों पर अभातशिप मुख्यालय में निम्नलिखित सुनवाई समिति द्वारा विचार किया जाएगा ।

प्रोफेसर के स्तर के तीन विशेषज्ञ सदस्य

क्षेत्रीय समिति के दो सदस्य ( संबंधित क्षेत्रीय अधिकारी सहित )

संयोजक के रूप में अभातशिप मुख्यालय के सलाहकार/निदेशक

(ख) सुनवाई समिति की अध्यक्षता किसी प्रतिष्ठित शिक्षाविद्/ वृत्तिक द्वारा की जाएंगी ।

(ग) प्रस्तावों के प्रक्रमण के लिए सुनवाई समिति की बैठक एक माह में कम से कम एक बार अवश्य होगी ।

6.4 (क) आवेदक सोसाइटी/न्यास परिषद् द्वारा विहित आवश्यक दस्तावेजों/ जानकारी के साथ सुनवाई समिति के समक्ष एक प्रस्तुतीकरण पेश करेंगे ।

(ख) आवेदक सोसाइटी/ न्यास द्वारा सुनवाई समिति के समक्ष रखे जाने वाले दस्तावेजों/ जानकारी की सूची परिषद् द्वारा समय- समय पर आवेदन प्रक्रिया पुस्तिका में अधिसूचित की जाएगी ।

6.5 सुनवाई समिति की सिफारिशों के आधार पर, अभातशिप आशय - पत्र जारी करेगी , जो आशय पत्र जारी करने की तारीख से तीन वर्ष तक वैध रहेगा, जिस अवधि के दौरान आवेदक सोसाइटी/न्यास सन्नियमों और मानकों तथा समय - समय पर विनिर्धारित अन्य शर्तों को पूरा करने के पश्चात् परिषद् से अनुमोदन पत्र प्राप्त करेगा । तीन वर्ष की अवधि की समाप्ति पर, आवेदक सोसाइटी/न्यास आशय पत्र जारी करने के लिए नया आवेदन करेगा ।

6.6 (क) ऐसे मामले में , जहां परिषद् द्वारा विनिर्धारित किए जाने वाले सन्नियमों और मानकों तथा शर्तों के पूरा न किए जाने पर आशय - पत्र दिए जाने से इंकार किया गया है, वहां आवेदक को इंकार करने के आधारों सहित सूचित किया जाएगा ।

(ख) इसके पश्चात् आवेदक सोसाइटी /न्यास पुनर्विचार के लिए विनिर्धारित शुल्क आदि के भुगतान पर किसी भी समय सुनवाई समिति ( उपर्युक्त पैरा 6.3 में उल्लिखित ) के समक्ष अभ्यावेदन देने के लिए स्वतंत्र होगा ।

6.7 उस आवेदक सोसाइटी/ न्यास द्वारा, जिसे आशय- पत्र जारी किया गया है, परिषद् द्वारा समय - समय पर निर्धारित सन्नियमों , मानकों और अपेक्षाओं को पूरा करने के पश्चात् परिषद् को आवेदन किया जाना अपेक्षित है, जिसमें निम्नलिखित दस्तावेजों के साथ- साथ विशेषज्ञ समिति की विजिटों के लिए उपयुक्त तारीखें प्राप्त की गई हों:

1) ' सदस्य सचिव , अभातशिप ' के पक्ष में आहरित तथा नई दिल्ली में देय 50,000/- रु. का अप्रतिदेय प्रक्रमण शुल्क (सरकारी संस्थाओं को प्रक्रमण शुल्क के भुगतान से छूट है ) ।

2) (क) नीचे दर्शाई गई संस्थाओं की श्रेणी के लिए यथालागू राशि के लिए ' सदस्य सचिव, अभातशिप ' के पक्ष में आहरित और नई दिल्ली में देय डिमांड ड्राफ्ट के रूप में प्रतिदेय निष्पादन गारंटी शुल्क (आरपीजीएफ) (सरकारी संस्थाओं और सरकारी विश्वविद्यालयों को आरपीजीएफ के भुगतान से छूट है) ।

इंजीनियरी एवं प्रौद्योगिकी

15.00 लाख रु .

भेषजी/एचएमसीटी/वास्तुकला/आयोजना/ अनुप्रयुक्त कला एवं शिल्प (डिग्री) एमसीए/ एमबीए/पीजीडीएम/ पीजीडीबीएम

ख) प्रतिदेय निष्पादन गारंटी शुल्क (आरपीडीएफ) 8 वर्ष की अवधि के पश्चात् संबंधित संस्था को वापस कर दिया जाएगा परंतु सन्नियमों, शर्तों और अपेक्षाओं के किसी उल्लंघन और/अथवा संस्था द्वारा गैर- निष्पादन और/ अथवा संस्था के विरुद्ध शिकायतों के क्रिसी मामले में इसे आगे ले जाया जा सकेगा । अभातशिप राशि को एफडीआर के रूप में रखेगी तथा केवल मेधावी और जरूरतमंद छात्रों को निःशुल्कता/छात्रवृत्ति आदि प्रदान करने के प्रयोजनार्थ और/ अथवा परिषद् द्वारा समय- समय पर निर्णित किए जाने वाले ऐसे अन्य प्रयोजनों के लिए इसके ब्याज को वार्षिक आधार पर संस्था को प्रेषित करेगी । अस्तित्व के 8 वर्ष सफलतापूर्वक पूरा करने पर, संस्था के विकास के प्रयोजन के लिए प्रतिदेय निष्पादन गारंटी शुल्क संस्था को जारी कर दिया जाएगा ।

6.8 (क) एक विशेषज्ञ समिति अपेक्षित प्रक्रमण शुल्क के भुगतान पर आवेदक सोसाइटी/ न्यास की संस्था के प्रस्तावित परिसर की विजिट करेगी तथा परिषद् द्वारा समय- समय पर विनिर्धारित सन्नियमों एवं मानकों तथा शर्तों के अनुसार गुणवत्तापूर्ण शिक्षा प्रदान करने के लिए संस्था की तैयारियों की जांच करेगी ।

(ख) विशेषज्ञ समिति निम्नलिखित सदस्यों से मिलकर बनेगी :

अध्यक्ष, अभातशिप द्वारा नामनिर्दिष्ट प्रोफेसर के स्तर के तीन विशेषज्ञ सदस्य

राज्य सरकार तथा संबंधित संबद्ध विश्वविद्यालय द्वारा नामनिर्दिष्ट विशेषज्ञ सदस्य

अध्यक्ष अभातशिप द्वारा नामनिर्दिष्ट संयोजक के रूप में संबंधित क्षेत्रीय अधिकारी अथवा परिषद् का कोई अधिकारी

ग) विशेषज्ञ समिति की अध्यक्षता किसी प्रतिष्ठित शिक्षाविद्/ वृत्तिक द्वारा की जाएगी ।

घ) दौरा करने वाली विशेषज्ञ समिति को उपलब्ध कराए जाने वाले दस्तावेज समय- समय पर अनुमोदन प्रक्रिया पुस्तिका में अधिसूचित किए जाएंगे ।

6.9 (क) निरीक्षण समिति की रिपोर्ट ईसी उप- समिति के समक्ष प्रस्तुत की जाएगी, जो निम्नलिखित से मिलकर बनेगी : -

ईसी उप- समिति के अध्यक्ष के रूप में परिषद् के उपाध्यक्ष

अध्यक्ष अभातशिप द्वारा नामनिर्दिष्ट कार्यकारी समिति के दो सदस्य और

संयोजक के रूप में अभातशिप के सलाहकार

(ख) ईसी उप- समिति की बैठक माह में कम से कम एक बार होगी ।

ग) ईसी उप- समिति की सिफारिशों तथा अन्य प्रासंगिक जानकारी के आधार पर नई तकनीकी संस्था की स्थापना के लिए "अनुमोदन ' प्रदान करने अथवा अन्यथा के बारे में परिषद् की ओर से अध्यक्ष अभातशिप द्वारा अंतिम निर्णय लिया जाएगा ।

घ) आवेदक सोसाइटी/न्यास को अनुमोदन पत्र निर्णय की तारीख से 30 दिन के भीतर जारी कर दिया जाएगा जो अनुमोदन पत्र को जारी करने की तारीख से दो वर्ष के लिए वैध रहेगा ।

ङ) ऐसे मामलों में , जहां परिषद् द्वारा यथा - विनिर्धारित सन्नियमों एवं मानकों और शर्तों के पूरा न किए जाने के आधार पर अनुमोदन से इंकार किया गया है , इंकार करने के आधारों के साथ इसे सूचित किया जाएगा 7

6.10 (क) आवेदक सोसाइटी/न्यास किसी भी समय अपील कर सकता है तथा अपील की सुनवाई एक अपीली समिति द्वारा की जाएगी जो अध्यक्ष, अभातशिप द्वारा समय- समय पर गठित की जाएगी तथा जो निम्नलिखित सदस्यों से मिलकर बनेगी :

अध्यक्ष के रूप में कोई प्रतिष्ठित शिक्षाविद/विद्वत्तजन

आईआईटी/एनआईटी/ आईआईएम का निदेशक *

. किसी विश्वविद्यालय के कुलपति

संयोजक के रूप सलाहकार (अभातशिप)

* (प्रबंधन प्रस्तावों के लिए)

(ख) अपीली समिति की बैठक तीन माह में एक बार होगी ।

6.11 (क) अपीलीय समिति की सिफारिशों तथा अन्य प्रासंगिक जानकारी के आधार पर नई तकनीकी संस्था की स्थापना के लिए "अनुमोदन ' प्रदान करने अथवा अन्यथा के बारे में परिषद् की ओर से अध्यक्ष अभातशिप द्वारा अंतिम निर्णय लिया जाएगा ।

(ख) अनुमोदन प्रदान करने अथवा अन्यथा का निर्णय संस्थाओं को पूरे वर्ष सूचित किया जाएगा । आवेदक संस्थाओं की यह जिम्मेवारी होगी कि वे विश्वविद्यालय /प्रवेश प्राधिकरण आदि के निर्धारित कार्यक्रम के अनुसार संबंधित संबद्ध विश्वविद्यालय / राज्य सरकार आदि से आवश्यक संबद्धता/अनुमति प्राप्त करें । इसके पश्चात् आवेदक सोसाइटी/न्यास डाटाबेस को अद्यतन बनाने के लिए 30 दिन के भीतर संस्था को प्रारंभ करने के बारे में अभातशिप को जानकारी प्रस्तुत करेगा ।

6.12(क) ऐसे मामलों में जहां परिषद् द्वारा यथानिर्धारित सन्नियमों एवं मानकों तथा शर्तों के पूरा न करने के कारण अपीली समिति की सिफारिशों के आधार पर अनुमोदन देने से इंकार किया गया है, इंकार किए जाने के आधार संबंधित आवेदक सोसाइटी/ न्यास को सूचित किए जाएंगे ।

(ख) तत्पश्चात् आवेदक सोसाइटी/ न्यास किसी भी समय विनिर्धारित शुल्क आदि के भुगतान पर सुनवाई समिति के समक्ष अभ्यावेदन करने के लिए स्वतंत्र होगा । जब भी कभी परिषद् आवेदक सोसाइटी /न्यास द्वारा किए गए दावों के सत्यापन के लिए एक निरीक्षण समिति नियुक्त करने का निर्णय लेती है, तो इस संबंध में किए जाने वाले सभी खर्चे आवेदक सोसाइटी/न्यास द्वारा वहन किए जाएंगे ।

7. विद्यमान तकनीकी संस्थाओं को अनुमोदन के विस्तार के लिए आवेदनों के प्रक्रमण हेतु आवेदन प्रक्रिया तथा मानित विश्वविद्यालय सहित किसी विश्वविद्यालय में शिक्षण , परीक्षाओं और शोध के मानकों का रखरखाव सुनिश्चित किया जानाः 8

[PART III-SEC. 4 ] 7.1 अभातशिप द्वारा अनुमोदित ऐसी तकनीकी संस्थाएं , चाहे वे किसी विश्वविद्यालय से संबद्ध हों अथवा नहीं, जो तकनीकी शिक्षा पाठ्यक्रम / कार्यक्रम संचालित कर रही हैं :

(क) अभातशिप अनुमोदित तकनीकी संस्थाएं पैरा 7.1 (7) में यथापरिभाषित अनिवार्य प्रकटन जानकारी के साथ विनिर्धारित प्रपत्र में अनुपालन रिपोर्ट की दो प्रतियां तथा प्रक्रमण शुल्क के तौर पर सदस्य सचिव, अभातशिप के पक्ष में आहरित व नई दिल्ली में देय 40,000 रुपये का डिमांड ड्राफ्ट प्रत्येक वर्ष 31 अगस्त तक परिषद् के संबंधित क्षेत्रीय अधिकारी को प्रस्तुत करेंगी ।

(ख) संस्थाएं विनिर्धारित प्रपत्र में एक वचन भी प्रस्तुत करेगीं जिसमें कहा गया होगा कि अनुपालन रिपोर्ट में प्रस्तुत जानकारी तथ्यात्मक और सही है और यह किं यदि यह पाया जाता है कि अनुपालन रिपोर्ट में प्रस्तुत कोई जानकारी असत्य है, तो परिषद् अनुमोदन वापस लेने और उपयुक्त विधिक कार्रवाई करने सहित उपयुक्त कार्रवाई कर सकती है ।

7.1 (1 ) (क) अनुपालन रिपोर्ट का प्रक्रमण एक मूल्यांकन समिति द्वारा किया जाएगा जो निम्नलिखित से मिलकर बनेगी :

विशेषज्ञता के संबंधित विषय/ विषयक्षेत्र/क्षेत्र में प्रोफेसर के स्तर अथवा शोध एवं विकास संगठनों अथवा उद्योग से समकक्ष शिक्षाविद् जो क्रमशः वैज्ञानिक ( एफ ) और महाप्रबंधक की पंक्ति से नीचे न हों , तीन विशेषज्ञ सदस्य ।

क्षेत्रीय अधिकारी सहित क्षेत्रीय समिति के दो सदस्य

संयोजक के रूप में परिषद् का एक अधिकारी

(ख) मूल्यांकन समिति की अध्यक्षता किसी प्रतिष्ठित शिक्षाविद / वृत्तिक द्वारा की जाएगी ।

7.1 (2) (क) मूल्यांकन समिति की सिफारिशों के आधार पर अध्यक्ष अभातशिप परिषद की ओर से अनुमोदन के विस्तार की अनुमति अथवा अन्यथा के बारे में निर्णय लेगे । ऐसे निर्णय को प्रत्येक वर्ष 31 जनवरी तक सूचित किया जाएगा ।

(ख) ऐसे मामलों में जहां परिषद द्वारा यथा विनिर्धारित सन्नियमों एवं मानकों और शर्तों को पूरा न करने के कारण अनुमोदन के विस्तार से इंकार कर दिया गया है, इंकार करने के आधारों के विषय में संबंधित संस्थाओं और प्राधिकरणों को सूचित किया जाएगा ।

7.1 (3) (क) कमियों में सुधार करने तथा परिषद् द्वारा समय - समय पर विनिर्धारित सन्नियमों, मानकों और शर्तों का अनुपालन करने के पश्चात् आवेदक संस्था अपील कर सकती है । अपील पर अपील समिति द्वारा विचार किया जाएगा जिसका गठन अध्यक्ष, अभातशिप द्वारा किया जाएगा तथा जिसमें निम्नलिखित सदस्य शामिल होंगेः-

अध्यक्ष के रूप में एक प्रतिष्ठित शिक्षाविद / विद्वतजन भारत का राजपत्र असाधारण

आईआईटी / एनआईटी/ आईआईएम का निदेशक *

किसी विश्वविद्यालय का कुलपति

(ख) अपीली समिति की बैठक तीन माह में एक बार होगी ।

7.1 . (4) अपीली समिति की सिफारिशों तथा अन्य प्रासंगिक जानकारी के आधार पर अध्यक्ष, अभातशिप द्वारा "अनुमोदन के विस्तार " की मंजूरी अथवा अन्यथा के बारे में परिषद् की ओर से अंतिम निर्णय लिया जाएगा ।

7.1 (5) सन्नियमों एवं मानकों के अनुरक्षण को सुनिश्चित करने के लिए अभातशिप पूरे वर्ष में किसी भी संस्था की स्थिति का सत्यापन करने के लिए किसी भी संस्था का कभी भी दौरा कर सकती है

7.1 (6) ऐसे मामलों में जहां दुर्विनियोजन, सन्नियमों एवं मानकों के उल्लंघन , कदाचार आदि की विशेष शिकायतें प्राप्त होती हैं, अभातशिप सत्यता का सत्यापन करने के लिए तारीखों को अधिसूचित करके अथवा इसके बिना ही निरीक्षण संचालित करवा सकती है । किसी भी उल्लंघन अथवा इसे प्रदान की गई असत्य जानकारी के लिए अभातशिप उपयुक्त दांडिक कार्रवाई करेगी ।

7.1 (7) (क) शैक्षणिक वर्ष के प्रारंभ होने से पूर्व तकनीकी संस्थाएं एक सूचना पत्र प्रकाशित करेंगी जिसमें अनिवार्य प्रकटन के रूप में संस्था तथा संचालित किए जाने वाले पाठ्यक्रमों / कार्यक्रमों और संकाय आदि को शामिल करते हुए अवसंरचनात्मक सुविधाओं के विवरणों के बारे में जानकारी दी गई हो । यह सूचना - पत्र मूल्य आधार पर तकनीकी शिक्षा के प्रत्येक पणधारी को उपलब्ध कराया जाना चाहिए । संस्था के समस्त पहलुओं के बारे में अद्यतन जानकारी द्वारा इस सूचना को प्रत्येक वर्ष संशोधित किया जाना चाहिए ।

(ख) तकनीकी संस्थाओं के लिए वेबसाइट रखना अनिवार्य होगा जिसमें विनिर्धारित जानकारी प्रदान की जाएगी । किसी भी परिवर्तन के होने की स्थिति में वेबसाइट की जानकारी को निरंतर अद्यतन बनाया जाना चाहिए ।

(ग) यदि तकनीकी संस्था जानकारी प्रकट करने में असफल रहती है अथवा जानकारी छिपाती है और / अथवा गलत जानकारी देती है, तो उपयुक्त कार्रवाई की जाएगी जिसमें अभातशिप का अनुमोदन वापस लिया जाना भी शामिल है ।

7.2 तकनीकी शिक्षा पाठ्यक्रम / कार्यक्रम संचालित कर रहे विश्वविद्यालय जिनमें मानित विश्वविद्यालय भी शामिल हैं :

7.2(1 ) तकनीकी शिक्षा पाठ्यक्रम / कार्यक्रम संचालित कर रहे विश्वविद्यालय, जिनमें मानित विश्वविद्यालय भी शामिल है, प्रत्येक वर्ष 31 अगस्त तक परिषद् के संबंधित क्षेत्रीय कार्यालय को विनिर्धारित प्रपत्र में अनिवार्य प्रकटनों के साथ अनुपालन रिपोर्ट प्रस्तुत करेंगे । हार्ड प्रति के अलावा मानित

विश्वविद्यालयों सहित सभी विश्वविद्यालयों के लिए विनिर्धारित प्रपत्र पर अनुपालन रिपोर्ट ऑनलाइन भी भेजना अनिवार्य है ।

7.2 (2) मानित विश्वविद्यालयों सहित विश्वविद्यालय विनिर्धारित प्रपत्र में एक बचन प्रस्तुत करेंगे जिसमें कहा गया होगा कि अनुपालन रिपोर्ट में प्रदान की गई जानकारी तथ्यात्मक और सही है और यह कि यदि यह पाया जाता है कि अनुपालन रिपोर्ट में प्रदान की गई कोई जानकारी असत्य है, तो परिषद् उपयुक्त कार्रवाई कर सकती है ।

7.2(3) मानित विश्वविद्यालयों सहित सभी विश्वविद्यालयों, जो तकनीकी शिक्षा पाठ्यक्रम / कार्यक्रम संचालित कर रहे हैं, से प्राप्त अनुपालन रिपोर्टों के आधार पर परिषद् वित्तीय आवश्यकताओं अथवा इसके शिक्षण , परीक्षा और शोध आदि के स्तर का पता लगाने के लिए मानित विश्वविद्यालयों सहित किसी भी विश्वविद्यालय का निरीक्षण करवा सकती है । परिषद् ऐसे मामलों में, जहां दुर्विनियोजन, सन्नियमों एवं मानकों के उल्लंघन, कदाचार आदि की विशेष शिकायतें प्राप्त हुई हैं, सत्यता का पता लगाने के लिए तारीखें अधिसूचित करके अथवा इसके बिना ही निरीक्षण भी करवा सकती है ।

7.2 (4) यदि कोई विश्वविद्यालय अथवा मानित विश्वविद्यालय शिक्षण , परीक्षा, शोध आदि के सन्नियमों एवं मानकों का उल्लंघन करता हुआ पाया जाता है, तो परिषद् इसके निष्कर्षों को सूचित करेगी तथा ऐसे निष्कर्षों के परिणामस्वरूप उपयुक्त कार्रवाई करने के लिए ऐसी कार्रवाई की जाएगी , जो निम्नलिखित उचित समझें : -

1. संबंधित विश्वविद्यालय / मानित विश्वविद्यालय

2. विश्वविद्यालय अनुदान आयोग

3. मा.सं.वि.मं. , भारत सरकार / संबंधित राज्य सरकारें

7.2(5) परिषद् आम जनता को सावधान करने के लिए अपने निष्कर्षों को समाचार पत्रों में प्रकाशित करेगी और अपनी वेबसाइट और / अथवा आम जनता को सूचित करने के किसी अन्य साधन के माध्यम से उसे प्रदर्शित करेगी ।

7.2(6) (क) मानित विश्वविद्यालयों सहित विश्वविद्यालय शैक्षणिक वर्ष के प्रारंभ होने से पूर्व एक सूचना- पत्र प्रकाशित करेंगे जिसमें अनिवार्य प्रकटन के रूप में संचालित किए जाने वाले पाठ्यक्रमों / कार्यक्रमों और संकाय आदि को शामिल करते हुए अवसंरचनात्मक सुविधाओं के विवरणों के बारे में जानकारी दी गई हो । यह सूचना-पत्र मूल्य आधार पर तकनीकी शिक्षा के प्रत्येक पणधारी को उपलब्ध कराया जाना चाहिए । संस्था के समस्त पहलुओं के बारे में अद्यतन जानकारी द्वारा इस सूचना को प्रत्येक वर्ष संशोधित किया जाना चाहिए ।

(ख) मानित विश्वविद्यालयों सहित विश्वविद्यालयों के लिए वेबसाइट रखना अनिवार्य है जिसमें विनिर्धारित जानकारी प्रदान की जाएगी । किसी भी परिवर्तन के होने की स्थिति में वेबसाइट की जानकारी को निरंतर अद्यतन बनाया जाना चाहिए ।

(ग) यदि तकनीकी शिक्षा पाठ्यक्रम / कार्यक्रम संचालित करने वाले विश्वविद्यालय , जिनमें मानित विश्वविद्यालय शामिल हैं, जानकारी प्रकट करने में असफल रहते हैं अथवा जानकारी छिपाते हैं, तो परिषद् द्वारा उपयुक्त कार्रवाई की जा सकेगी ।

8 . विद्यमान तकनीकी संस्थाओं में अतिरिक्त पाठ्यक्रम शुरू करने / प्रवेश क्षमता में वृद्धि / परिवर्तन करने के लिए प्रस्तावों के प्रक्रमण हेतु पद्धति

8.1 प्रस्ताव प्रस्तुत करना

(क) अभातशिप अनुमोदित तकनीकी संस्थाएं नए पाठ्यक्रम अथवा कार्यक्रम शुरू करने और / अथवा प्रवेश क्षमता में वृद्धि और / अथवा प्रवेश क्षमता में परिवर्तन के अनुमोदन के लिए वर्ष भर के दौरान ' किसी भी समय निम्नलिखित दस्तावेजों के साथ विनिर्धारित प्रपत्र (चार प्रतियां) पर एक प्रस्ताव परिषद् के संबंधित क्षेत्रीय कार्यालय में प्रस्तुत कर सकती हैं । प्रस्ताव प्रस्तुत करने के लिए परिषद् द्वारा कोई 'कट ऑर्फ तारीख निर्धारित नहीं की गई हैः

अनिवार्य प्रकटन के साथ परिषद् को प्रस्तुत की गई अनुपालन रिपोर्ट की एक प्रति ।

अनुमोदन प्रक्रिया पुस्तिका में अधिसूचित दस्तावेजों के साथ विस्तृत परियोजना रिपोर्ट ।

सदस्य सचिव, अभातशिप, नई दिल्ली के पक्ष में आहरित तथा नई दिल्ली में किसी राष्ट्रीयकृत बैंक में देय डिमांड ड्राफ्ट के माध्यम से 40,000 रुपये (चालीस हजार रुपये) का प्रक्रमण शुल्क ।

(ख) प्राप्त प्रस्तावों की संवीक्षा की जाएगी तथा कमियां, यदि कोई हों, परिषद् के क्षेत्रीय कार्यालय द्वारा प्रस्ताव प्राप्त होने की तारीख से 15 दिन के भीतर आवेदक सोसाइटी / न्थास को सूचित की जाएंगी ।

(ग) क्षेत्रीय कार्यालय प्रस्ताव प्राप्त होने की तारीख से 15 दिन के भीतर अभातशिप मुख्यालय को प्रस्तावों की एक प्रति भी अग्रेषित करेगा ।

8.2 (क) इस बीच क्षेत्रीय कार्यालय भी प्रस्ताव प्राप्त होने की तारीख से 15 दिन के भीतर सभी प्रकार से पूर्ण सभी प्रस्तावों की एक प्रति 30 दिन के भीतर सभी राज्य सरकारों / संघ राज्य क्षेत्रों को उनकी सिफारिशें प्राप्त करने के लिए अग्रेषित करेंगे ।

(ख) सिफारिशें अग्रेषित करते समय राज्य सरकारें और संबद्ध विश्वविद्यालय अपने पक्ष को प्रमाणित करने के लिए कारण और औचित्य उपलब्ध कराएंगे और ऐसा वे परिषद् द्वारा समय- समय पर विनिर्धारित तारीख तक करेंगे । नए पाठ्यक्रम अथवा कार्यक्रम प्रारंभ करने और / अथवा प्रवेश क्षमता में वृद्धि करने और / अथवा प्रवेश क्षमता में परिवर्तन करने के लिए प्रस्तावों पर विचार करने से पूर्वअन्य विभिन्न प्रासंगिक तथ्यों के साथ साथ राज्य सरकार और संबद्ध विश्वविद्यालयों की सिफारिशों को ध्यान में रखा जाएगा । आवेदक संस्था को संबंधित राज्य सरकार से अनापत्ति प्रमाण- पत्र प्राप्त करना अनिवार्य नहीं है । नए पाठ्यक्रम अथवा कार्यक्रम शुरू करने और / अथवा 12

प्रवेश क्षमता में वृद्धि करने और / अथवा प्रवेश क्षमता में परिवर्तन करने के मामलों का निर्णय करते समय परिषद् के पास राज्य सरकार की सिफारिशों को न मानने का अधिकार है ।

8.3 (क) इसके पश्चात् प्रस्तावों का मूल्यांकन अभातशिप मुख्यालय में निम्नलिखित सुनवाई समिति द्वारा किया जाएगाः

प्रोफेसर के स्तर के तीन विशेषज्ञ सदस्य ।

क्षेत्रीय अधिकारी सहित क्षेत्रीय समिति के तीन सदस्य।

संयोजक के रूप में अभातशिप मुख्यालय के सलाहकार / निदेशक

(ख) सुनवाई समिति की अध्यक्षता किसी प्रतिष्ठित शिक्षाविद / विद्वतजन द्वारा की जाएगी ।

(ग) वर्ष में प्राप्त प्रस्तावों का प्रक्रमण करने के लिए सुनवाई समिति की बैठक माह में कम से कम एक बार होगी ।

8.4( क) सुनवाई समिति के समक्ष प्रस्तुत किए जाने वाले दस्तावेजों की सूची अभातशिप द्वारा समय - समय पर अनुमोदन प्रक्रिया पुस्तिका में अधिसूचित की जाएगी ।

(ख) सुनवाई समिति संस्था द्वारा प्रदान की गई जानकारी के आधार पर निम्नलिखित का निर्णय करेगीः

(i) अनुमोदन के लिए अभातशिप को अनुशंसा करना, अथवा

(ii) विशेषज्ञ समिति की विजिट के लिए अभातशिप को अनुशंसा करना

(iii) अस्वीकार करने के लिए अभातशिप को अनुशंसा करना जिसमें ऐसे अस्वीकार के लिए प्रासंगिक आधार दर्शाए गए हों ।

(ग) अभातशिप अपने डाटाबेस को अद्यतन बनाने तथा सन्नियमों ओर मानकों का अनुरक्षण सुनिश्चित करने के लिए संस्था की स्थिति का सत्यापन करने हेतु वर्ष भर में किसी भी समय किसी भी संस्था की अकस्मात् विजिट कर सकती है ।

8.5 ऐसे मामलों में , जहां दुर्विनियोजन, सन्नियमों एवं मानकों के उल्लंघन, कदाचार आदि की विशेष शिकायतें प्राप्त होती हैं, अभातशिप सत्यता का सत्यापन करने के लिए तारीखों को अधिसूचित करके अथवा इसके बिना ही समय- समय पर निरीक्षण संचालित करवा सकती है । किसी भी उल्लंघन अथवा इसे प्रदान की गई असत्य जानकारी के लिए अभातशिप उपयुक्त दांडिक कार्रवाई करेगी ।

8.6(क) सुनवाई समिति की रिपोर्ट नए पाठ्यक्रम अथवा कार्यक्रम शुरू करने और / अथवा प्रवेश क्षमता में वृद्धि करने और / अथवा प्रवेश क्षमता में परिवर्तन करने के लिए ' अनुमोदन ' प्रदान करने के बारे में परिषद् की ओर से अंतिम निर्णय लेने के लिए अध्यक्ष, अभातशिप के समक्ष प्रस्तुत की जाएगी ।

(ख) अभातशिप द्वारा प्रदान किया गया अनुमोदन अनुमोदन- पत्र जारी करने की तारीख से दो वर्ष के लिए वैध होगा ।

(ग ) ऐसे मामलों में , जहां परिषद् द्वारा यथानिर्धारित सन्नियमों एवं मानकों तथा शर्तों को पूरा न करने पर अनुमोदन देने से इंकार किया गया है, इंकार करने के आधारों के बारे में संबंधित संस्थाओं को सूचित किया जाएगा ।

8.7 (क) कमियों को दूर करने तथा अभातशिप द्वारा समय - समय पर विनिर्धारित सन्नियमों, मानकों एवं शर्तों का अनुपालन करने के पश्चात् आवेदक अपील कर सकते हैं । अपील पर एक अपीली समिति द्वारा विचार किया जाएगा जिसका गठन अध्यक्ष अभातशिप द्वारा किया जाएगा तथा वह निम्नलिखित सदस्यों से मिलकर बनेगीः

अध्यक्ष के रूप में एक प्रतिष्ठित शिक्षाविद / विद्वतजन

आईआईटी/ एनआईटी/आईआईएम का निदेशक *

किसी विश्वविद्यालय का कुलपति

संयोजक के रूप में सलाहकार (अभातशिप)

* प्रबंध प्रस्तावों के लिए

(ख) अपीली समिति की बैठक तीन माह में एक बार होगी । अपीली समिति की सिफारिशों तथा अन्य प्रासंगिक जानकारी के आधार पर नए पाठ्यक्रम अथवा कार्यक्रम शुरू करने और / अथवा प्रवेश क्षमता में वृद्धि करने और / अथवा प्रवेश क्षमता में परिवर्तन करने के लिए 'अनुमोदन ' की मंजूरी अथवा अन्यथा के बारे में अध्यक्ष, अभातशिप द्वारा परिषद् की ओर से अंतिम निर्णय लिया जाएगा ।

8.8 (क) अनुमोदन प्रदान करने अथवा अन्यथा का निर्णय संस्थाओं को पूरे वर्ष सूचित किया जाएगा । आवेदक संस्थाओं की यह जिम्मेवारी होगी कि वे विश्वविद्यालय/प्रवेश प्राधिकरण आदि के निर्धारित कार्यक्रम के अनुसार संबंधित संबद्ध विश्वविद्यालय/ राज्य सरकार आदि से आवश्यक संबद्धता/अनुमति प्राप्त करें । इसके पश्चात् आवेदक सोसाइटी/ न्यास डाटाबेस को अद्यतन बनाने के लिए 30 दिन के भीतर संस्था को प्रारंभ करने के बारे में अभातशिप को जानकारी प्रस्तुत करेगा ।

(ख) ऐसे मामले में, जहां परिषद् द्वारा यथा विनिर्धारित सन्नियमों एवं मानकों और शर्तों के पूरा न किए जाने के कारण अपीली समिति की सिफारिशों पर अनुमोदन से इंकार किया गया है, इंकार करने के आधारों के बारे में संबंधित आवेदक संस्था को सूचित किया जाएगा ।

(9)निर्वचन

यदि इन विनियमों के निर्वचन के बारे में कोई प्रश्न उठता है, तो उसका निर्णय परिषद् द्वारा किया जाएगा ।

परिषद् के पास इन विनियमों के कार्यान्वयन के संबंध में उठने वाली किसी भी शंका को दूर करने के लिए स्पष्टीकरण जारी करने की शक्ति है ।

(10) छूट देने की शक्ति

परिषद्, अपवाद के मामलों में, किसी कठिनाई के निवारण के लिए अथवा ऐसे ही अन्य कारणों , जिन्हें लिखित रूप से अभिलेखित किया जाना है. के लिए संस्थाओं के किसी वर्ग अथवा श्रेणी के संबंध में इन विनियमों के उपबंधों में छूट दे सकती है ।

(11) अनुमोदन को वापस लेना

यदि कोई तकनीकी संस्था इन विनियमों के किसी भी उपबंध का उल्लंघन करती है, तो परिषद् ऐसी जांच, जो वह उपुयक्त समझे, करने तथा संबंधित तकनीकी संस्था को सुने जाने का अवसर प्रदान करने के पश्चात् इन विनियमों के अधीन प्रदान किया गया अनुमोदन वापस ले सकती है ।

11.1 नो एडमिशन / अनुमोदन वापस लेने के लिए पद्धति :

11.1 (1 ) किसी विश्वविद्यालय से संबद्ध तकनीकी संस्थाएं :

(क) परिषद् वित्तीय आवश्कताओं , अथवा सस्था के शिक्षण, परीक्षा और शोध के स्तर, सन्नियमों एवं मानकों के अनुरक्षण , विनियमों के उल्लघन और कदाचारों आदि के विषय में निर्धारण के प्रयोजनार्थ पूर्वसूचना देकर अथवा दिए बिना किसी भी तकनीकी संस्था का निरीक्षण करवा सकती है ।

(ख) परिषद् द्वारा यथा निर्धारित सन्नियमों एव मानकों और विनियमों आदि के उल्लंघन के मामले में, जिसे निरीक्षण समिति की सिफारिशों के आधार पर तकनीकी संस्थाओं को सूचित किया गया हो, परिषद् एक अथवा अधिक पाठ्यक्रमों अथवा कार्यक्रमों के लिए अनुमोदन को वापस ले सकती है । अथवा'नो एडमिशन अधिरोपित कर सकती है अथवा ऐसी कोई अन्य दांडिक कार्रवाई कर सकती है, जो वह आवश्यक समझे ।

(ग) परिषद् से सूचना प्राप्त होने के 15 दिन के भीतर तकनीकी संस्था एक अपीली समिति के समक्ष अपील कर सकती है जिसके लिए कमियों आदि के अनुपालन में सभी प्रासंगिक दस्तावेजों को संलग्न किया जाना चाहिए । यह अपीली समिति संबंधित संस्था से अपील प्राप्त होने से 15 दिन के भीतर अध्यक्ष अभातशिप द्वारा गठित की जाएगी तथा इसमें निम्नलिखित सदस्य होंगेः

(घ) अपीली समिति की सिफारिशें अंतिम निर्णय के लिए अध्यक्ष, अभातशिप के समक्ष रखी जाएंगी ।

(ड.) परिषद् का अंतिम निर्णय संबंधित संस्था तथा अन्य प्राधिकारियों को अपीली समिति की बैठक की तारीख से 15 दिन के भीतर संप्रेषित कर दिया जाएगा ।

(च) परिषद् के निर्णय के अनुसार संस्था के कार्यक्रमों को तत्काल प्रभाव से असंबद्ध करने के लिए परिषद संबंधित संबद्ध विश्वविद्यालय को सूचित करेगी ।

(छ) संबद्ध विश्वविद्यालय किसी व्यवधान को दूर रखने तथा विद्यमान छात्रों के शैक्षणिक क्रियाकलापों को जारी रखने के लिए संस्था के मौजूदा छात्रों को उस विश्वविद्यालय के अधिकार क्षेत्र के अधीन किसी अन्य संस्था में स्थानांतरित करने के लिए उत्तरदायी होगा । परिषद् तदनुसार कार्यक्रम की शेष अवधि के लिए इस प्रकार स्थानांतरित अतिरिक्त सीटों के रूप में छात्रों की संख्या अनुमोदित करेगी ।

(ज) यदि संबंधित संस्था ऐसी फीस और अन्य देय राशि को वापस करने से इंकार करती है, तो परिषद् अभातशिप द्वारा अनुमोदन वापस लिए जाने के परिणामस्वरुप अन्य सस्थाओं को स्थानांतरित किए गए छात्रों द्वारा पहले ही भुगतान की गई फीस एवं अन्य देय राशि की प्रतिपूर्ति के लिए संस्था / सोसाइटी/ न्यास की आरपीजीएफ / संयुक्त एफडीआर तथा अन्य परिसंपत्तियां जब्त करने के लिए उपयुक्त कार्रवाई करेगी ।

(झ) परिषद् आम जनता को सावधान करने के लिए अनुमोदन वापस लेने के बारे में समाचार पत्रों में समाचार प्रकाशित करेगी तथा इसे अपनी वेबसाइट और / अथवा किसी अन्य माध्यम से प्रदर्शित करेगी ।

11.1 (2) किसी विश्वविद्यालय से संबद्ध नहीं तकनीकी संस्थाएं ( जो गैर- डिग्री कार्यक्रम चला रही हैं)

(क) परिषद् वित्तीय आवश्कताओं, अथवा संस्था के शिक्षण, परीक्षा और शोध के स्तर, सन्नियमों एवं मानकों के अनुरक्षण , विनियमों के उल्लंघन और कदाचारों आदि के विषय में निर्धारण के प्रयोजनार्थ पूर्व सूचना देकर अथवा दिए बिना किसी भी तकनीकी संस्था का निरीक्षण करवा सकती है ।

(ख) परिषद् द्वारा यथा निर्धारित सन्नियमों एवं मानकों और विनियमों आदि के उल्लंघन के मामले में, जिसे निरीक्षण समिति की सिफारिशों के आधार पर तकनीकी संस्थाओं को सूचित किया गया हो, परिषद् एक अथवा अधिक पाठ्यक्रमों / अथवा कार्यक्रमों के लिए अनुमोदन को वापस ले सकती है। अथवा 'नो एडमिशन ' अधिरोपित कर सकती है अथवा ऐसी कोई अन्य दांडिक कार्रवाई कर सकती है, जो वह आवश्यक समझे ।

(च) परिषद् ऐसी संस्थाओं के विद्यमान छात्रों को अन्य समान अभातशिप अनुमोदित संस्थाओं में स्थानांतरित करने के लिए तत्काल प्रभाव से आवश्यक कदम उठाएगी । परिषद् कार्यक्रम की शेष अवधि के लिए उस संस्था, जिसके छात्रों को स्थानांतरित किया गया है, की अतिरिक्त सीटों की संख्या को तदनुसार अनुमोदित करेगी ।

(छ) यदि संबंधित संस्था ऐसी फीस और अन्य देय राशि को वापस करने से इंकार करती है, तो परिषद् अभातशिप द्वारा अनुमोदन वापस लिए जाने के परिणामस्वरुप अन्य सस्थाओं को स्थानांतरित किए गए छात्रों द्वारा पहले ही भुगतान की गई आनुपातिक फीस एवं अन्य देय राशि की प्रतिपूर्ति के लिए संस्था / सोसाईटी/ न्यास की आरपीजीएफ / संयुक्त एफडीआर तथा अन्य परिसंपत्तियां जब्त करने के लिए उपयुक्त कार्रवाई करेगी ।

(ज) परिषद् आम जनता को सावधान करने के लिए अनुमोदन वापस लेने के बारे में समाचार पत्रों में समाचार प्रकाशित करेगी तथा इसे अपनी वेबसाइट और / अथवा किसी अन्य माध्यम से प्रदर्शित करेगी ।

11.1 ( 3 ) अन्य तकनीकी संस्थाएं :

(क) ऐसी तकनीकी संस्थाएं, जो अभातशिप द्वारा अनुमोदित नहीं हैं तथा अभातशिप के पूर्व अनुमोदन के बिना तकनीकी शिक्षा, जैसी कि अभातशिप अधिनियम के अधीन परिभाषित की गई है, में पाठ्यक्रम / कार्यक्रम संचालित कर रही हैं, परिषद् ऐसी दोषी संस्था / सोसाइटी / न्यास / कंपनी/ व्यक्तियों के संगम , जैसा भी मामला हो, उपयुक्त कार्रवाई करेगी, जिसमें विधिक कार्रवाई भी शामिल है ।

No. F. 37-3 /Legal/2004.- In exercise of the powers conferred by sub- section ( 1 ) of section 23 read with section 10 (b) , ( g ) , ( i ) , (k ) , (p ) & ( v) and Section 11 of the All India Council for Technical Education Act , 1987 ( 52 of 1987) and, in super session of the Regulations No. F. 37- 3/Legal /2004 dated 06-01-2005 , the following regulations are hereby notified by the Council :

Short title and commencement : -

(1)

( 1 ) These Regulations may be called the All India Council for Technical Education ( AICTE ) Grant of approval for starting new technical institutions , introduction of courses or programmes and increase /variation of intake capacity of seats for the courses or programmes and Extension of approval for the existing technical institutions and maintenance of norms and standards in Universities including Deemed to be Universities Regulations, 2005.

(2) They shall come into force w.e.f. the date of publication in the Official Gazette of India .

Definitions : -

In these Regulations , unless the context otherwise requires , -

(a) "Act " means the All India Council for Technical Education Act, 1987 ( 52 of 1987) ;

(b) ' Technical institution " means the institution of Government , Government Aided and Private ( self financing) institutions conducting the courses / programmes in the field technical education, training and research in Engineering , Technology

Including MCA , Architecture , Town Planning, Management , Pharmacy, Hotel Management & Catering Technology , Applied Arts & Crafts and such other programmes and areas as notified by the Council from time to time ;

(c) All other words and expressions used herein and not defined but defined in the All India Council for Technical Education Act , 1987 (52 of 1987 ) , shall have the meanings respectively assigned to them in the said Act ;

(3) Purpose: -

These Regulations provides for : -

(a) Grant of approval for establishment of new technical institutions ;

(

b) Grant of approval for introduction of new courses or programs and/ or increase and / or variation in intake of seats in existing courses or programs in technical institutions ;

(

d) Ensuring maintenance of norms and standards in Universities including deemed to be Universities imparting technical education .

( 4) Applicability : -

These Regulations shall be applicable to Universities including deemed to be Universities and technical institutions of Government, Government Aided and Private ( self financing ) conducting the courses / programs in the fields of technical education, training and research in Engineering , Technology Including MCA , Architecture , Town Planning , Management , Pharmacy , Hotel Management & Catering Technology , Applied Arts & Crafts and such other programs and areas as notified by the Council from time to time .

5) Requirement of grant of approval : -

( 1) No new technical institution of Government , Government Aided or Private ( self financing ) institution, whether affiliated or not affiliated to 19

any University shall be started and no new courses or programs shall be introduced and no increase and/ or variation of intake in the existing Courses /Programmes shall be effected at all levels in the field of 'Technical Education' without obtaining prior approval of the Council . The Council may take Legal action against such defaulting Institution/ Society/ Trust/ Company/ Associated Individuals as the case may be for contravening provisions of this regulations by conducting courses /progarmmes in " technical Education " without obtaining prior approval from AICTE .

(2) No existing technical institution of Government, Government Aided or Private ( self financing ) institution whether affiliated or not affiliated to an University shall conduct any technical course/programme without prior approval of the Council .

(3 ) No University including Deemed University shall conduct technical courses /programmes without ensuring maintenance of the norms and standards prescribed by AICTE.

(4) No University , Board or any other body shall affiliate technical courses /programmes not approved by the AICTЕ .

(5) No admission authority /body /institution shall admit students to a course/programme of technical education not approved by AICTЕ .

6. PROCEDURE FOR PROCESSING OF PROPOSALS FOR GRANT OF APPROVAL FOR ESTABLISHMENT OF NEW TECHNICAL INSTITUTIONS FOR CONDUCT OF TECHNICAL COURSES / PROGRMMES

6.1 SUBMISSION OF APPLICATIONS / PROPOSALS

The Proposals Forms for establishment of New Technical Institutions for conducting technical programmes , can be submitted by the following :

Registered Societies and Trusts

Central/State Government Institutions

c) Government Aided Institutions 20

The Proposal Forms can be downloaded from the AICTE website : www.aicte.ernet.in . However , a DD for Rs . 5000/- towards application form drawn on a nationalized bank in favour of " The Member Secretary , AICTE " , payable at New Delhi , must be enclosed with the proposal form failing which the application shall not be considered .

6.1 ( a) The approval process for establishment of new Institutions shall be open ended , allowing the Applicant Society /Trust to submit proposals to the concerned Regional Office of the Council any time round the year . The proposal for the new Institution received by the Council shall be valid for three years .

(b)Duly filled in and signed Proposal Form in four copies along with requisite processing Fee and the requisite documents in support of the proposals shall be submitted to Concerned Regional Office of AICTE .

(c )The proposals received shall be scrutinized and deficiencies if any, be communicated by the Regional Office of the Council to the applicant Society/Trust within 15 days from the date of receipt of the proposal .

(d) The Regional Office shall also forward a copy of the proposals to AICTE HQs at New Delhi within 15 days from the date of receipt of the proposal .

6.2( a) The Regional Office shall in parallel , forward , within 15 days from the date of receipt of the proposal , one copy each of the proposals to the concerned State Govt./Union Territories and Affiliating University for obtaining their views within 30 days .

(b) The State Govts and the Affiliating Universities shall forward its views within 30 days from the date of receipt of the proposals from the Regional Office . The State Govt./ and the affiliating university , shall provide reasons and justification to substantiate their stand and do so by the date stipulated by the Council from time to time . The views of the concerned State Government/Universities shall be taken into consideration while processing the proposals for establishment of new technical institutions . No Objection Certificate ( NOC) by the Applicant Society/Trust from the concerned State Govt/University is not required .

(c)The Council shall have the right to overrule the recommendations of the State Govt/University while deciding the matters of establishment of new technical institutions .

6.3 (a) The proposals shall thereafter be considered by the following Hearing Committee at AICTE HQ.

Three Expert members at the level of Professor

Two members of the Regional Committee ( including Regional Officer concerned )

Advisor /Director of the AICTE HQ as convener.

(b)The Hearing Committee shall be headed by an academician/professional of repute .

as 6.4(a)The Applicant Society /Trust shall make a presentation before the Hearing Committee with necessary Documents /information prescribed by the Council.

(b) The list of documents/information to be placed before the Hearing Committee by the Applicant Society/Trust shall be notified by the Council in the Approval Process Hand Book from time to time.

6.5 Based on the recommendations of the Hearing Committee, the AICTE . may issue a Letter Of Intent (LOI ) , which shall be valid for three years from the date of issue of LOI during which time , the applicant Society/Trust shall obtain letter of approval from the Council after fulfilling the norms and Standards and other Conditions prescribed from time to time. On expiry of the 3 year duration, the Applicant Society/Trust shall make a fresh application for issuance of Letter of Intent.

6.6 ( a) In cases where Letter Of Intent is denied for non - fulfillment of norms & standards and conditions as may be stipulated by the Council , shall be informed along with grounds of denial .

(b ) The Applicant Society/ Trust shall be free to make representation anytime thereafter , before the Hearing Committee ( referred at para 6.3 above) on payment of prescribed fees etc. for reconsideration.

6.7 The applicant Society/Trust to whom a Letter of Intent has been issued shall be required to make an application to the Council , after fulfilling the norms , standards and requirements laid down by the Council from time to time , seeking suitable dates for visit of the Expert Committee along with the following documents :

1. A non - refundable processing fee of Rs . 50,000 /- drawn in favour of The Member Secretary , AICTE " payable at New Delhi (Government Institutions are exempted from payment of processing fee) .

2 ) ( a ) A Refundable Performance Guarantee Fee ( RPGF ) in the form of a Demand Draft in favour of " The Member Secretary , AICTE payable at New Delhi " for an amount as applicable to the category of the institutions indicated below ( Government Institutions and Govt . Universities are exempted from payment of RPGF).

b) The Refundable Performance Guarantee Fee ( RPGF ) shall be refunded to the concerned institution after a period of 8 years but could be carried forward in case of any violation of Norms , conditions , and requirements and/or non - performance by the institution and/ or complaints against the institution , AICTE would [ भाग III- खण्ड 4 ]

keep the amount in the form of FDR and remit the interest to the institution on yearly basis strictly for the purpose of providing Freeships / Scholarships etc to meritorious and needy students and/ or such other purposes as decided by the Council from time to time . On successful completion of 8 years of existence , the Refundable Performance Guarantee Fee shall be released to the Institution for the purpose of the development of the institution .

6.8( a) An Expert Committee shall visit the proposed premises of the institution on payment of requisite processing fee by the applicant Society /Trust and examine the preparedness of the institution to impart quality education as per the norms & standards and conditions prescribed by the Council from time to time .

(b) The Expert Committee shall comprise of the following members :

Three Expert members at the level of Professor nominated by the Chairman , AICTE

Expert members nominated by the State Govt and the respective Affiliating University

Concerned Regional Officer or an Officer of the Council as convener nominated by the Chairman AICTE .

(d) The documents to be made available to the visiting Expert Committee shall be notified in the Approval Process Handbook from time to time .

6.9 (a) The Report of the Inspection Committee shall be placed before EC Sub committee comprising:

The Vice Chairman of the Council as Chairman of the EC Sub- Committee

Two members of the Executive Committee nominated by the Chairman AICTE and

Advisor AICTE as convener .

(b) The EC Sub committee shall meet at least once in a month.

(c) Based on the Recommendations of the EC- Sub- Committee and other relevant information, final decision shall be taken by the Chairman AICTE on behalf of the Council on grant of " approval " or other wise for establishment of new technical institution .

(d) The Letter of Approval shall be issued to the Applicant Society /Trust within 30 days of the date of the decision which shall be valid for two years from the date of issue of letter of approval .

(e) In cases where approval is denied for non - fulfillment of norms & standards and conditions as may be stipulated by the Council , shall be informed along with grounds of denial .

6.10 ( a) The Applicant Society / Trust may prefer an appeal any time and the appeal shall be heard by an Appellate Committee constituted by the Chairman AICTE from time to time with the following members :

An educationist / academician of repute as Chairman Director of IIT/ NIT / IIM *

Vice Chancellor of an University

Advisor ( AICTE ) as convener

* ( For Management Proposals )

(b ) The Appellate Committee shall meet quarterly .

6.11 ( a)Based on the Recommendations of the Appellate Committee and other relevant information , a final decision shall be taken by the Chairman , AICTE on behalf of the Council for grant of " approval " or other wise on establishment of new technical institution .

(b) The decision on grant of approval or otherwise shall be communicated to the institutions throughout the year . It shall be the responsibility of the applicant institutions to obtain necessary affiliation/ permission from the concerned affiliating University/State Govt . etc. as per the prescribed schedule of the University/ Admission Authority etc. Thereafter the Applicant Society/Trusts shall furnish information about commencement of Institution within 30 days to AICTE for updating its database .

6.12(a)Cases where approval is denied on the recommendations of the Appellate committee due to non - fulfillment of norms , & standards and conditions as are stipulated by the Council , grounds of denial shall be communicated to the concerned Applicant Society/Trust .

(b)The Applicant Society/Trust shall be free to make representation anytime there after, before the Hearing Committee on payment of prescribed fees etc. As and when the Council decides to depute an inspection committee for verifying the claims made by the Applicant Society/Trust , all costs incurred on this account shall be borne by the Applicant Society /Trust .

7 APPROVAL PROCESS FOR PROCESSING APPLICATIONS FOR EXTENSION OF APPROVAL TO EXISTING TECHNICAL ΜΑΙΝΤΕΝANCE INSTITUTIONS AND OF STANDARDS OF ENSURING TEACHING , EXAMINATIONS AND RESEARCH IN AN UNIVERSITY INCLUDING DEEMED TO BE UNIVERSITY :

7.1 AICTE approved technical Institutions whether affiliated to an University notor courses /progarmmes : conducting technical education

(a) The AICTE approved technical Institutions shall submit two copies of Compliance Report in the prescribed format along with mandatory disclosure information as defined at para 7.1 ( 7) and a demand draft towards processing fee of Rs 40,000 drawn in favor of Member Secretary, AICTE payable at New Delhi to the concerned Regional Office of the Council by 31st August every year .

(b) The institution shall also submit an undertaking in the prescribed format stating that the information provided in the compliance report is factual and correct and that the Council can take appropriate action , including withdrawal of approval and appropriate legal action, if found that any information provided in the compliance report is false .

7.1 ( 1 )(a)The compliance reports shall be processed through an Appraisal Committee comprising :

Three Expert members at the level of Professor in the concerned subject/ fields/ area of specialization or equivalent from R& D organisations or from the Industry not below the rank of Scientist ( F) and General Manager respectively .

Two members of the Regional Committee including Regional Officer .

An Officer of the Council as convener

(b)The Appraisal Committee shall be headed by an academician/professional of repute .

7.1 ( 2) ( a) Based on the recommendations of the Appraisal Committee, the Chairman AICTE may take a decision on behalf of the Council to grant of Extension of approval or otherwise . Such decision shall be communicated by 31st January every year .

(b ) In those cases where extension of approval is denied for non - fulfillment of norms , & standards and conditions as may be stipulated by the Council , grounds of denial shall be communicated to the institutions and authorities concerned .

7.1 (3 ) ( a ) The Applicant Institution may prefer an appeal , after rectifying the deficiencies and complying with the norms , standards and conditions prescribed by the Council from time to time . The appeal shall be considered by an Appellate Committee constituted by the Chairman AICTE comprising the flowing members :

Vice Chancellor of an University

Advisor ( AICTE ) as convener

(b ) The Appellate Committee shall meet quarterly .

7.1 (4) Based on the Recommendations of the Appellate Committee and other relevant information , a final decision will be taken by the 27

Chairman , AICTE on behalf of the Council for grant of " Extension of approval " or other wise .

7.1 ( 5 ) AICTE may carry random visits round the year any time for verifying the status of the Institutions to ensure maintenance of norms and standards .

7.1 ( 6 ) The AICTE may cause to conduct inspections with or without notifying the dates in cases where specific complaints of mis- representation, violation of norms and standards , mal - practices etc. are reported to verify the facts . AICTE shall take appropriate punitive actions for any violations on false information furnished to it .

7.1 (7) (a )The technical institutions shall publish an information booklet before commencement of the academic year giving details regarding the institution and courses /programmes being conducted and details of infrastructural facilities including faculty etc. in the form of mandatory disclosure . The information booklet shall be made available to the stakeholders of the technical education on cost basis . The information shall be revised every year with updated information about all aspects of the institution.

(b) It shall be mandatory for the technical institutions to maintain a The website Web- site providing the prescribed information . information must be continuously updated as and when changes take place.

or (c) If a Technical Institution fails to disclose the information suppress and / or misrepresent the information , appropriate action could be initiated including withdrawal of AICTE approval .

7.2 Universities including Deemed to be Universities conducting technical education courses / programmes :

7.2 ( 1 )The Universities including Deemed to be Universities conducting technical education courses /programmes shall submit Compliance Report alongwith mandatory disclosures in the prescribed format to the concerned Regional Office of the Council by 31st August every year . Besides the hard copy, the Universities including Deemed to be 28

Universities shall also be required to send the Compliance Report online in the format prescribed.

7.2 ( 2 ) The Universities including Deemed to be Universities shall submit an undertaking in the prescribed format stating that the information provided in the compliance report is factual and correct and that the Council can take appropriate action if found that any information provided in the compliance report is false .

7.2(3 ) Based on the compliance reports received from the Universities , including Deemed to be Universities , conducting technical education courses /progarmmes the Council may cause an inspection to any University , including deemed to be university for the purposes of ascertaining the financial needs , or its standards of teaching, examination and research etc. The Council may also cause inspections with or without notifying the dates in cases where specific complaints of mis - representation , violation of norms and standards , mal - practices etc. reported to verify the facts .

7.2 (4 ) In case an University or Deemed to be University found to have been violating norms and standards of teaching , examination research etc. , the Council may communicate its findings and action to be taken as a result of such findings for appropriate action as deemed fit to :

1. The University/ Deemed University concerned.

2. The University Grants Commission

3. The MHRD Govt . Of India/State Govts concerned

7.2 ( 5 ) The Council may publish in newspapers and display in its website and/ or any other means to inform the general public about its findings cautioning the general public .

7.2( 6 ) ( a) The Universities including Deemed to be Universities shall publish a information booklet before commencement of the academic year giving the details regarding the courses /programmes being conducted and details of infrastructural facilities including faculty etc. in the form of mandatory disclosure . The information booklet shall be made available to the stakeholders of the technical education on cost basis . The information shall be revised every year with updated information about all aspects of the institution.

(b) It shall be mandatory for the Universities including Deemed to be Universities to maintain a Web - site providing the prescribed information . The website information must be continuously updated as and when changes take place.

(c) If an University including Deemed to be Universities conducting technical education courses /programmes fail to disclose the information or suppress and/ or misrepresent the information , appropriate action could be initiated by the Council

8. PROCEDURE FOR PROCESSING OF PROPOSALS FOR INTRODUCTION OF ADDITIONAL COURSES / INCREASE / VARIATION IN INTAKE IN THE EXISTING TECHNICAL INSTITUTIONS .

8.1 SUBMISSION OF PROPOSALS

(a)The AICTE approved technical Institutions may submit " any time " round the year, a proposal in the prescribed format (four copies ) along with the following documents to the concerned Regional Office of the Council for grant of approval for introduction of new courses or programmes and/or increase in intake and/or variation in the intake capacity. There shall be no ' cut off dates prescribed by the Council for submission of proposals:

A copy of the Compliance Report along with Mandatory Disclosures submitted to the Council .

Detailed Project Report along with the documents notified in Approval Process Handbook.

Processing Fee of Rs . 40,000/- ( Rupees Forty thousand only) by means of a Demand Draft drawn on a nationalized bank in favour of The Member Secretary, AICTE, New Delhi payable at New Delhi

(b)The proposals received shall be scrutinized and deficiencies if any , be communicated by the Regional Office of the Council to the applicant Society/ Trust within 15 days from the date of receipt of the proposal .

(c ) The Regional Office shall also forward a copy of the proposals to AICTE HQs at New Delhi within 15 days from the date of receipt of the proposal.

8.2( a) The Regional Office shall in parallel , forward , within 15 days from the date of receipt of the proposal , one copy each of the proposals complete in all respects to the concerned State Govt./Union Territories and Affiliating University for obtaining their recommendations within 30 days .

(b) The State Govts and the Affiliating Universities , while forwarding the recommendations , shall provide reasons and justification to substantiate their stand and do so by the date stipulated by the Council from time to time . The recommendations of the concerned State Government and the Affiliating Universities shall be taken into consideration , among various other relevant factors , before considering the proposals for introduction of new courses or programs and/ or increase in intake and/ or variation in the intake capacity .. Obtaining No Objection Certificate (NOC) by the Applicant Institutions from the concerned State Govt is not mandatory . The Council shall have the right to overrule the recommendations of the State Govt . while deciding the matters of introduction of new courses or programs and/or increase in intake and/ or variation in the intake capacity .

8.3 (a) The proposals shall thereafter be evaluated at AICTE HQs by the following Hearing Committee..

Three Expert members at the level of Professor

Two members of the Regional Committee including Regional Officer

Advisor/Director of the AICTE HQ as convener .

(b)The Hearing Committee shall be headed academician/professional of repute . by an

(c )The Hearing Committee shall meet atleast once in a month to process the proposals received round the year .

8.4(a) The list of documents /information to be submitted before the Hearing Committee shall be notified by the Council in the Approval Process Hand Bookfrom time to time .

(b) The Hearing Committee based on information furnished by the Institution may decide:

(i) To recommend to the AICTE for approval , or

( ii ) To recommend to the AICTE for the visit of the Expert Committee

(iii) To recommend to the AICTE for rejection showing relevant grounds for such rejection .

(c)AICTE may carry out , random visits round the year any time for verifying the status of the institutions to update its database and ensure maintenance of Norms and Standards .

8.5 AICTE may also conduct from time to time Inspections with or without notifying dates in such cases where specific complaints of misrepresentation , violation of norms and standards , mal- practices etc. are received to verify the facts , AICTE shall take appropriative punitive actions for any violations on false information furnished to it .

8.6(a)The Report of the Hearing Committee shall be placed before the Chairman AICTE for a final decision on behalf of the Council on grant of " approval " or other wise for introduction of new courses or programmes and/ or increase in intake and/or variation in the intake capacity.

(b) The approval accorded by the AICTE shall be valid for two years from the date of issue of letter of approval .

(c) In those cases where approval is denied for non - fulfillment of norms , & standards and conditions as may be stipulated by the Council , grounds ofdenial shall be communicated to the concerned institutions .

8.7(a) The Applicant Institution may prefer an appeal , after rectifying the deficiencies and complying the norms , standards and conditions prescribed by the Council from time to time . The appeal shall be [PART III-SEC . 4] THE GAZETTE OF INDIA : EXTRAORDINARY

considered by an Appellate Committee constituted by the Chairman AICTE comprising the flowing members :

(b ) The Appellate Committee shall meet quarterly . Based on the Recommendations of the Appellate Committee and other relevant information , a final decision will be taken by the Chairman, AICTE on behalf of the Council for grant of " approval " or otherwise for introduction of new courses or programmes and/or increase in intake and/ or variation in the intake capacity.

8.8 ( a) The decision on grant of approval or otherwise shall be communicated to the institutions throughout the year. It shall be the responsibility of the applicant institutions to obtain necessary affiliation/ permission from the concerned affiliating University/State Govt . etc. as per the prescribed schedule of the University/Admission Authority etc. Thereafter the Applicant Institution shall furnish information about commencement of programmes within 30 days to AICTE for updating its database .

(b) Cases where approval is denied on the recommendations of the Appellate committee due to non - fulfillment of norms , & standards and conditions as are stipulated by the Council , grounds of denial shall be communicated to the concerned Applicant Institution .

Interpretation

If any question arises as to the interpretation of these Regulations , the same shall be decided by the Council .

The Council shall have the power to issue clarification to remove any doubt which may arise in regard to implementation of these Regulations .

(10) Power to relax

The Council may in exceptional cases , for removal of any hardship or such other reasons to be recorded in writing, relax any of the provisions of these Regulations in respect of any class or category of institutions .

(11 ) Withdrawal of approval

If any technical institution contravenes any of the provisions of these Regulations , the Council may, after making such inquiry , as it may consider appropriate and after giving the technical institution concerned an opportunity of being heard , withdraw the approval granted under these Regulations .

11.1 Procedure for No Admission/ Withdrawal of approval ;

11.1 ( 1 ) Technical Institutions affiliated to an University :

(a) The Council may cause an inspection to any technical institution with or without prior intimation for the purposes of ascertaining the financial needs , or its standards of teaching , examination and research , maintenance of norms and standards , violation of regulations and malpractices etc.

(b) In case of violations of norms and standards and regulations etc as prescribed by the Council and as communicated to the technical institution/ s based on the recommendations of the Inspection Committee, the Council may decide to withdraw its approval/or impose "no admission " status for one or more courses/ or programmes or impose any other punitive action deemed necessary .

(c) The technical institution may prefer an appeal within 15 days of the receipt of the communication from the Council along with all relevant documents in compliance of the deficiencies etc. before an Appellate Committee , which shall be constituted by the Chairman AICTE within 15 days of the receipt of the appeal from the Institution concerned with the following Members :

(d) The recommendations of the Appellate Committee shall be placed before the Chairman , AICTE for final decision .

(e)The decision of the Council shall be communicated within 15 days of the date of meeting of the Appellate Committee, to the concerned institution and other authorities .

(f) The Council shall inform the concerned affiliating university to dis- affiliate the programmes of the institution concerned as per the decision of the Council with immediate effect .

(g) The Affiliating University shall be responsible to shift the current students of the institution to other AICTE approved institutions under the jurisdiction of that University to avoid any disruption and to continue the academic activities of the existing students . The Council shall accordingly approve the number of students , thus shifted as additional seats for the remaining duration of the programme.

(h) The Council shall take appropriate action to forfeit the RPGF/Joint FDR and other assets of the Institutions /Society /Trust to recover the proportionate fees and other dues already paid by the students who have been shifted to other Institutions consequent upon withdrawal of approval by AICTE , if the concerned Institute declines the refund of such fees and other dues .

(i) The Council shall publish in newspapers and display on its website and/ or by any other means about the withdrawal of approval etc. to caution the general public .

NOT 11.1 (2 ) Technical Institutions ( offering non- degree programmes )

affiliated to any University ;

needs , or its standards of teaching , examination and research, maintenance of norms and standards , violation of regulations and malpractices étc.

(b) In case of violations of norms and standards and regulations etc as prescribed by the Council and as communicated to the technical institution/s based on the recommendations of the Inspection Committee, the Council may decide to withdraw its approval/ or impose " no admission " status for one or more courses /or programmes or impose any other punitive action deemed necessary.

(f)The Council may take necessary steps to shift the existing students of such institutions to other similar AICTE approved institutions with immediate effect. The Council shall accordingly approve the number of additional seats in institutions to which the students are shifted for the remaining duration of the programme .

fees and other dues already paid by the students who have been shifted to other Institutions consequent upon withdrawal of approval by AICTE , if the concerned Institute declines the refund of such fees and other dues .

11.1 (3) Other Technical Institutions ;

(a)The Institutions which are not approved by AICTE conducting courses / programmes , without prior approval of AICTE in technical education as defined under AICTE Act, the Council may take appropriate action including Legal action against such defaulting Institution/ Society/ Trust/ Company/ Associated Individuals as the case may be.

(b) The Council shall also inform the general public about the status of approval of such institution from time to time .
