S.O. 1738 (E). The Securities and ExchangeBoard ofIndia, having considered the application for renewal of recognition made under Section 3 of the Securities Contracts (Regulation) Act , 1956by Magadh Stock Exchange Association, having its registered office at 9thFloor, Ashiana Plaza , Budh Marg , Patna -800001 and being satisfied that it would be in the interest ofthe trade andalso in the public interest so to do , hereby grants , in exercise of the powers conferredby Section 4 of the Securities Contracts (Regulation ) Act, 1956 renewal of recognition to the said Exchange under Section 4 of the saidAct for a period of one year commencing on the 11thday ofDecember 2005 and ending on the 10thday of December 2006, in respect ofcontracts in securities subject to the conditions stated herein below or as may be prescribed or imposed hereinafter:
का.आ. 1738(अ).- भारतीय प्रतिभूति और विनिमय बोर्ड, मगध स्टॉक एक्सचेंज एसोसिएशन, जिसका अपना रजिस्ट्रीकृत कार्यालय 9वीं मंजिल, आशियाना प्लाजा, बुधमार्ग , पटना-800001 में स्थित है द्वारा प्रतिभूति संविदा (विनियमन ) अधिनियम, 1956 की धारा 3 केअधीन किए गए मान्यता के नवीकरण के लिए आवेदन पर विचार करते हुए और यह समाधान हो जाने पर कि यह व्यापार के हित में होगा और ऐसा करना लोक हित में भी होगा , एतद्वारा , प्रतिभूति संविदा ( विनियमन ) अधिनियम, 1956 की धारा 4 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त एक्सचेंज को मान्यता का नवीकरण उक्त अधिनियम की धारा 4 के अधीन 11 दिसम्बर, 2005 को प्रारम्भ होने वाली और 10 दिसम्बर, 2006 को समाप्त होने वाली एक वर्ष की कालावधि के लिए, प्रतिभूतियों में संविदाओं कीबाबत इसमें नीचे कथित शर्तों अथवा जो इसमें इसके पश्चात् विहित या अधिरोपित की जायें के अध्यधीन प्रदान करता है :
(1) The Exchange shall not regulate or control the dealings in securities in any manner whatsoever until further directions as stated inthe order no . WTM/GA/35/ MIRSD/ 12/05 dated December 06, 2005 .
(i ) एक्सचेंज तारीख 06 दिसम्बर, 2005 केआदेश सं. डब्ल्यू टीएम/जीए/35/एमआईआरएसडी/ 12/05 में यथा कथित अगले निदेशों तक किसी भी रीति से चाहे जो भी हो प्रति- भूतियों में व्यौहारों को विनियमित या नियंत्रित नहीं करेगा।
(ii) The Exchange shall commence trading only after obtaining final approval from SEBI for establishment of the Settlement Guarantee Fund:
(ii ) एक्सचेंज निपटान गारंटी निधि की स्थापना के लिए भाप्रवियो (सेबी) से अंतिम अनुमोदन अभिप्राप्त करने के पश्चात् ही व्यापार प्रारम्भ करेगा ।
