का.आ. 1747 ( अ ) . कीटनाशी अधिनियम , 1968 ( 1968 का 46) के प्रवृत्त होने पर कीटनाशी अनुदत्त किए गए " रजिस्ट्रीकृत स्थिति वाला समझा जाएगा" के सम्बन्ध में 18 नवम्बर , 1998 और 24 सितंबर , 1999 को प्रमुख समाचार पत्रों में विनिर्माताओं से आँकड़े उत्पन्न करने और प्रस्तुत करने की माँग की लोक सूचना जारी की गई थी और परिणामस्वरूप कतिपय कीटनाशियों के सम्बन्ध में आँकड़ा केंद्रीय कीटनाशी बोर्ड एवं रजिस्ट्रीकरण समिति के सचिवालय को नाशकजीवमार उद्योग द्वारा उत्पन्न और प्रस्तुत किया गया था ;
और रजिस्ट्रीकरण समिति ने नाशकजीवमार उद्योग के प्रतिनिधियों के परामर्श से रजिस्ट्रीकृत नाशकजीवमार वाला समझा गया के सम्बन्ध में केन्द्रीय कीटनाशक बोर्ड और रजिस्ट्रीकरण समिति के सचिवालय तथा नाशकजीवमार उद्योग के पास उपलब्ध कुल आँकड़ों का परीक्षण के लिए विशेषज्ञों का एक कोर समूह गठित किया गया ;
अतः अब केन्द्रीय सरकार , कीटनाशी अधिनियम , 1968 (1968 का 46) की धारा 27 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , रजिस्ट्रीकरण समिति के परामर्श के पश्चात् और विशेषज्ञों के उक्त कोर समूह की सिफारिशों पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि नीचे प्रगणित रजिस्ट्रीकृत किए गए नाशकजीवमार का और उपयोग किया जाना मनुष्यों और पशुओं को ऐसी जोखिम कारित किए जाने की संभावना है जो उनकी सुरक्षा , नाशकजीवमार उद्योग से चाहे गए आँकड़ों से पूर्णतः स्थापित नहीं हो सका है , निम्नलिखित प्रारूप आदेश करने का प्रस्ताव करती है , अर्थात्: -

(क) आदेश के प्रकाशन की तारीख से , प्रत्येक कीटनाशी के विरूद्ध वर्णित की गई फसलों के लिए निम्नलिखित कीटनाशियों के दावा करने के लेबल को हटा दिया जाएगा: -

)عل( सभी रजिस्ट्रीकृत व्यक्तियों को, ऊपरवर्णित की गई नाशकजीवमार के संबंध में लेबल/लिफलेट्स के साथ रजिस्ट्रीकरण के प्रमाणपत्रों , जो अनुदत्त किए गए हैं , सचिव , केंद्रीय कीटनाशक बोर्ड और रजिस्ट्रीकरण समिति , एन०एच ० IV , फरीदाबाद , को इस अधिसूचना के प्रकाशन की तारीख से छह मास के भीतर उनको रजिस्ट्रीकरण के प्रमाणपत्र लौटाना चाहिए , जिसके न हो सकने पर कीटनाशी अधिनियम , 1968 की धारा 14 के अधीन अनुज्ञप्ति का प्रतिसंह्रण करने की कार्रवाई आरंभ की जाएगी ।
(घ) रजिस्ट्रीकरण प्रमाणपत्र के पृष्ठांकन या संशोधन इस आदेश के उपबंध के उल्लंघन में रजिस्ट्रीकरण प्रमाणपत्र पर प्रवर्तित होने के रूप में अनुज्ञा या अनुमोदन नहीं लिया जाएगा ।
(ड़) सम्यक् तारीख तक प्रमाणपत्रों को प्रस्तुत नहीं किए जाने पर रद्द समझे जाएंगे ।
(च) राज्य सरकारें , अपने अधिकारिता वाले क्षेत्र में , ऐसे उपाय कर सकेगी जिन्हें वे , इस आदेश को लागू करने के लिए ठीक समझे ।
(छ) इस आदेश के अनुसरण में केंद्रीय सरकार द्वारा किए गए , यथास्थिति , हटाए जाने और/या प्रत्याहरण करना , जैसे ही मार्गदर्शी सिद्धांतों के अनुसार कीटनाशी(यो) के लिए अपेक्षित सम्पूर्ण, आँकड़े उपलब्ध किए जाते हैं, अप्रवर्तनीय हो जाएंगे और सरकार को कीटनाशी उद्योग द्वारा प्रस्तुत किए जाएंगे और रजिस्ट्रीकरण समिति द्वारा स्वीकार किए जाएंगे ।
प्रारूप आदेश को, जिसका केंद्रीय सरकार प्रस्ताव करती है , ऐसे सभी व्यक्तियों की जानकारी के लिए , जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप आदेश पर उस तारीख से , जिसको इस आदेश की भारत के राजपत्र की प्रतियाँ जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि समाप्ति के पश्चात् विचार किया जाएगा ;
उक्त प्रारूप आदेश के सम्बन्ध में , कोई व्यक्ति , किसी सुझाव या आक्षेप कि वांछा करता है तो उनको इसके लिए विनिर्दिष्ट अवधि के भीतर केंद्रीय सरकार द्वारा विचार करने के लिए संयुक्त सचिव (पौध संरक्षण) , कृषि मंत्रालय , कृषि और सहकारिता विभाग , कृषि भवन , नई दिल्ली-110001 को भेजा जा सकेगा ।

NOTIFICATION
New Delhi , the 12th December, 2005
S.O. 1747 ( E) .- Whereas a public notice was issued in leading newspapers on 18th November , 1998 and 24th September , 1999 asking manufacturers to generate and submit data in respect of insecticides granted 'deemed to be registered status' on the coming into force of the Insecticides Act, 1968 (46 of 1968) , and , consequently , data in respect of certain insecticides was generated and submitted by the pesticide industry to the Secretariat of Central Insecticides Board and Registration Committee ;
And whereas, Registration Committee , in consultation with representatives of pesticide industry , constituted a Core Group of Expertsto examine the total data available with the Secretariat of Central Insecticides Board and Registration Committee and the pesticide industry in respect of Deemed to be Registered Pesticides ;
Now, therefore , in exercise of the powers conferred by sub-section (2) of section 27 of the Insecticides Act, 1968 (46 of 1968) , the Central Government after considering the recommendation of the said Core Group of Experts and after consultation with the Registration Committee and on being satisfied that further use of Deemed to be Registered Pesticides enumerated below is likely to cause risk to human beings and animals as their safety cannot be fully established for want of complete data asked for from the pesticide industry, hereby propose to make the following draft Order , namely: -

(C) All registrants who have been granted certificates of Registration alongwith label / leaflets in respect of the above mentioned pesticides should return their Certificates of Registration to the Secretary, Central Insecticides Board and Registration Committee, NH - IV, Faridabad within six months from the date of publication of this notification , failing which action to revoke the licence under section 14 of the Insecticides Act , 1968 shall be initiated.
Non endorsement or correction of the Certificates of Registration (D)
will not be taken as permission or approval to operate upon Certificates of Registration in contravention of the provision of this Order.
(E) Certificates not submitted by the due date shall be deemed to have been cancelled .
(F) The State Governments may take such steps in their respective jurisdiction as they may deem fit for carrying out this Order .
(G) The deletion and /or withdrawal , as the case may be, made by the Government pursuant to this Order shall become inoperative as soon as the required complete data for the insecticide ( s) as per the guidelines is generated and submitted by the Pesticide Industryto the Government and accepted by the Registration Committee.
Thedraft Order , which the Central Government proposes to make , is hereby published for information of all persons who are likely to be affected thereby; and notice is hereby given that the said draft order shall be taken into consideration after the expiry of a period of forty- five days from the date on which the copies of the Gazette containing this Order are madeavailable to the public;
Any person desirous of making any suggestion or objection in respect of said Order may forward the same for consideration of the Central Government within the period so specified to the Joint Secretary (Plant Protection ) , Ministry of Agriculture , Department of Agriculture and Cooperation , Krishi Bhavan , New Delhi - 110001.
