EQUITY LINKED SAVINGS SCHEME , 2005 नई दिल्ली, 13 दिसम्बर, 2005 साधारण शेयर बचत स्कीम, 2005
S.O. 1755 (E) . In exercise of the powers conferred by clause (xiii ) of Sub - section (2) of Section 80C of the Income-tax Act, 1961 (43 of 1961 ) , the Central Govern- ment herebymakes the following Scheme, further to amend the Equity Linked Savings Scheme , 2005 , namely:-
का.आ. 1755(अ) .- केन्द्रीय सरकार, आयकर अधिनियम, 1961 ( 1961 का 43 ) की धारा 80ग की उप धारा ( 2 ) के खंड (xiii ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए साधारण शेयर बचत स्कीम 2005 , का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. (1 ) This scheme maybe called the Equity Linked Savings (Amendment) Scheme, 2005 .
1. ( 1 ) इस स्कीम का संक्षिप्त नाम साधारण शेयर बचत. (संशोधन ) स्कीम, 2005 है ।
(2) It shall come into force on the date of its publi- cation inthe Official Gazette .
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगी ।
2. Inthe Equity Linked Savings Schemes , 2005,- 2. साधारण शेयर बचत स्कीम, 2005 में-
(i) पैरा 2 में खंड ( छ ) के स्थान पर निम्नलिखित खंड रखा
(i) In paragraph 2, for clause (g ) , the following clause shall be substituted, mamely:-
जाएगा, अर्थात्: -
(छ ) " वर्ष" से योजना में , यथास्थिति, आबंटन या यूनिट धारण कीतारीख से आरंभ होने वाला वर्ष अभिप्रेत है;
'(g) "year" means a year commencing from the dateof allotment or holding of units , as the case may be, intheplan;'
(ii ) पैरा 8 के पश्चात् निम्नलिखित पैरा अन्तःस्थापित किया
(ii) after paragraph 8, the following paragraph shall be inserted, namely :-
जाएगा; अर्थात्: -
" 9. अवाध प्रवेश साधारण शेयर बचत योजना- यूनिट ट्रस्ट या पारस्परिक निधि अपने विवेकानुसार भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 ( 1992 का 15 ) के अधीन स्थापित भारतीय प्रतिभूति और विनिमय बोर्ड के पूर्व अनुमोदन से एक अवाध प्रवेश साधारण शेयर बचत योजना का प्रचालन कर सकेंगे । "
" 9. Open Ended Equity Linked Saving Plan . -The Unit Trust or the Mutual Fund may at their discretion operate one Open Ended Equity Linked Saving Plan with the prior approval of the 'Securities and ExchangeBoard of India established under the Securities and Exchange Boardof IndiaAct, 1992 ( 15 of 1992) . " .
