का.आ. 1760 (अ).- केन्द्रीय सरकार , राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 और धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह अधिसूचित करती है कि महाराष्ट्र राज्य में पूना जिले में पूना नासिक रोड, राष्ट्रीय राजमार्ग संख्या 50पर 12/190 कि. मी. से 42/000 कि. मी. को चार लेन बनाने और उसे सुदृढ करने " के ( जिसे इसमे इसके पश्चात परियोजना कहा गया है ) उपयोग के जिए यांत्रिक यानो पर और उसके द्वारा उपलब्ध कराई गई सेवा के लिए इसमे नीचे दी गई अनुसूची मे दी गई दरों पर और मैसर्स ए. टी. आर. इन्फ्रास्ट्रचर प्राइवेट लिमिटेड जिसका रजिस्ट्रीकृत कार्यालय 501 दताश्रम , हिन्दू कालोनी लेन न01 , दादर मुंबई में है, के साथ तारीख 25 अगस्त , 2003 को " पूना नासिक रोड (राष्ट्रीय राजमार्ग संख्या 50) के 12/190 कि.मी. से 42/000 कि.मी. तक को चार लेन का बनाने और सुदृढ करने " के लिए निर्माण , संचालन और अन्तरण करने के लिए किए गए रियायत करार को ध्यान में रखते हुए , फीसें उद्वगृहीत और संदत्त की जाएंगी तथा उक्त मैसर्स ए. टी. आर . इन्फ्रास्ट्रचर प्राइवेट लिमिटेड या उसके प्राधिकृत विधिक प्रतिनिधि को राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से और 14 सितम्बर , 2021 तक उक्त अनुसूची मे विनिर्दिष्ट दरो पर यांत्रिक यानों पर फीस का संग्रहण करने और उन्हें उसके पास रखने के लिए प्राधिकृत करती है ।

उपवर्णित फीस " पूना नासिक रोड , राष्ट्रीय राजमार्ग संख्या 50 के 12/190 कि. मी . से 42/000 कि. मी . को चार लेन बनाने और सुदृढ करने के लिए " उपयोक्ताओं से एक मार्गी चक्कर के लिए प्रभारित की जाएगी ।
2. जब किसी यान को "पूना नासिक रोड , राष्ट्रीय राजमार्ग संख्या 50 के 12/190 कि. मी . से 42/000 कि. मी. तक के चार लेन बनाने और सुदृढ करने " के मार्ग को एक दिन में एक से अधिक बार पार करना हो तो उपयोक्ताके पास यह विकल्प होगा कि वह एकलमार्ग में एकलमार्गी या पहले चक्कर के लिए अनुसूची में दी गई दरों पर डेढ गुना फीस का संदाय करें । यान स्वामी एकलमार्ग के लिए 30 गुना फीस के समतुल्य फीस का भारत का राजपत्र असाधारण

संदाय करके मासिक पास प्राप्त कर सकता हैं , चक्कर से परियोजना लम्बाई की 12/190 कि. मी . से 42/000 कि. मी . के बीच से एक या दोनों टोल स्टेशनों को पार करने पर पूर्णतः या भागतः लम्बाई के लिए अनिर्दिशित यात्रा अभिप्रेत है ।
3. अनुसूची में उपर्युक्त विनिर्दिष्ट फीस से निम्न प्रकार के यानों को छूट प्राप्त हैं , अर्थातः-
(i) रक्षायान ;
(ii) अति महत्वपूर्ण प्रतीकों वाले यान ;
(iii) पुलिसयान ;
(iv) अग्नि शमन यान ;
(V) एंबुलेस;
(vi ) अन्त्येष्टि यान ;
(vii) डाक व तार विभाग के डाक और तार विभाग के यान;
(viii ) डूयटी पर केन्द्रीय सरकार और राज्य सरकार के यान ।
4. शासकीय रुप से निम्नलिखित के यान अति महत्वपूर्ण व्यक्ति प्रतीक वाले यान समझे जाएंगे , अर्थात:-
(i) भारत के राष्ट्रपति ;
(ii) भारत के उपराष्ट्रपति ;
(iii ) केन्द्रीय और राज्यमंत्री;
( iv) लोक सभा/ राज्य सभा/ राज्य विधान मंडलों के विपक्ष के नेता जिनकी प्रस्थिति केबिनेट मंत्री की हो ;
(V) राज्यों के राज्यपाल ;
(vi ) संघ राज्य क्षेत्रों के उप राज्यपाल ;
(vii ) केन्द्रीय और राज्य विधान मंडलों के अध्यक्ष या सभापति ;
( viii ) भारत के राजकीय दौरे पर विदेशी उच्च पदस्थ व्यक्ति ;
( ix) सी डी(राजनयिक कारों ) प्रतिक वाली कारों का उपयोग कर रहे भारत में रह रहे विदेशी राजनयिक;
(X) सम्पूर्ण देश के संसद सदस्य , संसद द्वारा जारी किए गए पहचान पत्र प्रस्तुत किए जाने पर;
(xi ) राज्य के भीतर विधान सभाओं/ विधान परिषदों के सदस्य , राज्य विधान मंडल और विधान परिषदो द्वारा जारी किए गए पहचान पत्र प्रस्तुत किए जाने पर ;
(xii ) शौर्य पुरस्कारों अर्थात परमवीर चक्र , अशोक चक्र , महावीर चक्र , कीर्ति चक्र , वीर चक्र , और शौर्य चक्र के विजेता , सक्षम प्राधिकारी द्वारा पुरस्कार अधिप्रमाणित करने वाले पहचान पत्र प्रस्तुत किए जाने पर ।
5. उपरोक्त उल्लिखित दरें टोल प्लाजा पर 12/190 कि. मी. से 42/000 कि. मी . तक के पूना नासिक रोड (राष्ट्रीय राजमार्ग संख्या 50) के चार लेन बनाने और सुदृढ करने के दोनों तरफ टोल प्लाजा के 200 मीटर आगे की दूरी पर संप्रदर्शित की जाएगी । संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों को संप्रदर्शन बोर्ड पढना आसान हो और वे अंग्रेजी , हिन्दी और उस क्षेत्र जिसमें परियोजना स्थित है, की क्षेत्रीय भाषा में स्पष्ट रूप में लिखा या मुद्रित किए जाएगे । मैसर्स ए. टी . आर . इन्फ्रास्ट्रचर प्राइवेट लिमिटेड या उसके प्राधिकृत विधिक प्रतिनिधि संदायकर्ता को , उससे संग्रहीत फीस के लिए फीस की प्राप्ति रसीद देगे ।

NOTIFICATION
New Delhi , the 15th December, 2005
S.O. 1760 (E ) . In exercise of the powers conferred by sections 7 and 8A of the National Highways Act, 1956(48 of 1956) , the Central Government hereby notifies that there shall be levied, and paid fees on mechanical vehicles , for the use of the "Four laning and strengthening of Pune-Nashik Road, National Highway No. 50, in the District Pune, in the State of Maharashtra from Km . 12/190 to Km . 42/000 " ( hereinafter referred as project) at the rates specified in the Schedule hereunder and having regard to the Concession Agreement dated the 25th August, 2003 entered into with M /s ATR INFRASTRUCTURE PRIVATE LIMITED having its registered office at 501, Dattashram , Hindu Colony, Lane No. 1 Dadar , Mumbai to build, operate and transfer the" Four laning and strengthening of Pune- Nashik Road ( N.H. 50) from Km . 12/190 to Km. 42/000 , and for service providedby it and hereby authorizes the said " M /s ATR INFRASTRUCTURE PRIVATE LIMITED " or its auhorized legal representative to collect and retain the fees on mechanical vehicles at the rates specified in the said Schedule from the date of publication of this notification in the Official Gazette and until the 14th September, 2021.

NOTES:-
1. The fee set forth shall be charged to the users of the " Four laning and strengthening of Pune-Nashik Road , National Highway No. 50from Km . 12/190 to Km. 42/000 " for a one way trip.
2. When a vehicle has to use the " Four laning and strengthening of Pune- Nashik Road , National Highway No. 50 from Km. 12/190 to Km . 42/000 " more than once in a day, the user shall at his option be entitled to do so on payment of one and half times the fee at the rates as given in the Schedule for one way trip in the first trip itself. A vehicle owner shall also be entitled to a monthly pass on payment of fee equal to thirty times the fee for one-way trip . The trip shall mean unidirectional joumeybetween Km . 12/190 and 42/00 of Project length either for full or part length crossing either one or both toll stations.
3. Thefollowing types of vehicles are exempted from the fee specified above in the Schedule , namely: -
(i ) Defence vehicles ;
(ii) Vehicles with VIP symbols;
(iii) Police vehicles;
(iv) Fire-fighting vehicles;
(V) Ambulances;
Funeral vans ;
(vi )
(vii ) Posts and Telegraph Department vehicles of the Department of Postand Telegraph;
(viii) Central Government and State Government vehicles on duty;
4. The vehicles officially belonging to the following shall be deemed to be vehicles having VIP symbols , namely: -
Presidentof India;
Vice-President of India;
Central and State Ministers;
Leaders of Opposition in Lok Sabha / Rajya Sabha/State Legislature having the status of Cabinet Ministers;
(v) Governors of States;
(vi) Lieutenant Governors of Union Territories;
(vii) Speakers or Chairman of Central and State Legislatures ;
(viii) Foreign dignitaries on State visit to India;
(ix) Foreign Diplomats stationed in India using cars with CD( Car Diplomatic) symbols;
(x) Members of Parliament of the entire country on production of ID Card issued by the Parliament ;
(xi) Members of Legislative Assemblies/ Legislative Councils within the State on production of ID Card issued by the State Legislature Assembly and Legislative Council ;
(xii ) Winners of the Gallantry Awards namely , Param Vir Chakra , Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra on production of ID Card authenticating the Award by the Competent Authority.

5. The above mentioned rates shall be conspicuously displayed at the toll plazas and also at a distance of about 200 metres ahead of the toll plazas on either side of " Four laning and strengthening of Pune- Nashik Road (N.H. 50) from Km . 12/190 to Km . 42/000" . The height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English , Hindi and other regional language of the area in which the project is situated .
6. The said " M/ s ATR INFRASTRUCTURE PRIVATE LIMITED " or its authorized legal representatives shall give a receipt to the payer for the fee collected from him .
